1971 12 20 CC Minutes, Special5132 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF BAYTOWN December 20, 1971 The City Council of the City of Baytown, Texas, met in special session on Monday, December 20, 1971, at 5:00 o'clock p.m., in the Council Room of the Baytown City Hall with the following members in attendance" Ted Kloesel Councilman C. 0. Assistant Neel Richardson City Attorney Absent: Jody Lander Councilman Edna Oliver City Clerk The Mayor called the meeting to order and the following business was transacted: Ordinance - Providing Increased Municipal Contributions - Employees Retirement Plan Councilman Kloesel moved to adopt an ordinance providing for increased contributions to the current service annuity reserve of each member to a sum that is two hundred per cent (200`$) of such member's accumulated deposits for such month of employment. Councilman Stasney seconded the motion. Ordinance - U Special P to Provide For, and Granting Antecedent Service Credit - Service Credit Councilman Kloesel moved to adopt an ordinance providing for and granting "antecedent service credit" calculated on the basis of one - hundred per cent of each current service deposit by employee who is member of TMRS on the 31st day of December, 1971; and granting "Special Prior Service Credit" who is a member of TMRS and who holds in said System an effective prior service certificate. Councilman Walker seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Walker, Stasney, Cannon and McWilliams Mayor Walker Nays: None The caption of the ordinance follows: ORDINANCE NO. 1144 AN ORDINANCE UNDERTAKING TO PROVIDE FOR, AND GRANTING "ANTECEDENT SERVICE CREDIT" AND "SPECIAL PRIOR SERVICE CREDIT" AT THE RATES HEREIN SPECIFIED, TO QUALIFYING EMPLOYEES OF THE CITY OF BAYTOWN, TEXAS; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. 1 5133 * The City Administration will investigate the possibility of extending this coverage to employees who have retired within the calendar year. Ordinance - Allowing Vesting - Retirement Under TMRS Councilman Walker moved to adopt an ordinance providing for and allowing any city employee who has attained the age of fifty (50) years, and who has completed twenty -five or more years of creditable service shall be eligible for service retirement, and after having completed twenty (20) years or more of creditable service an an employee of Baytown shall continue as a member of TMRS despite subsequent absence of service provided he does not withdraw his deposits during such absence, and shall be eligible to retirement upon and after attainment of the minimum age prescribed by the Act. Councilman Kloesel seconded the motion. The vote follows: Ayes: Councilman Kloesel, Walker, Stasney, Cannon and McWilliams Mayor Walker Nays: None The caption of the ordinance follows: ORDINANCE NO. 1145 AN ORDINANCE PROVIDING FOR AND ALLOWING VESTING OF CERTAIN RIGHTS, AND FOR RETIREMENT UNDER TEXAS MUNICIPAL RETIREMENT SYSTEM OF EMPLOYEES OF THE CITY OF BAYTOWN WHO HAVE ATTAINED FIFTY YEARS OF AGE, AND HAVE COMPLETED TWENTY -FIVE YEARS OF CREDITABLE SERVICE WITH SAID CITY; REPEAL- ING ORDINACES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Ordinance - Electing Single Composite Participation Date All Departments under TMRS Councilman Kloesel moved to adopt an ordinance electing a single date to have all departments participating in TMHS for the purpose of determining normal and prior service contribution rates to TMRS system. Councilman Cannon seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Walker, Stasney, Cannon and McWilliams Mayor Walker Nays: None The caption of the ordinance follows: ORDINANCE NO. 1146 AN ORDINANCE ELECTING A SINGLE COMPOSITE PARTICIPATION DATE FOR ALL DEPARTMENTS OF THE CITY OF BAYTOWN PARTICIPATING IN TEXAS MUNICIPAL RETIREMENT SYSTEM TO BE USED FOR CALCULATION OF NORMAL AND PRIOR SERVICE CONTRIBUTION RATES AND FOR DETERMINATION OF FUNDING PERIODS OF CERTAIN OBLIGATIONS TO THE TEXAS MUNICIPAL RETIREMENT SYSTEM; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Resolution - Designating Sterling Library as Area Library within State Library System Councilman Kloesel moved to adopt a resolution designating Sterling Municipal Library as an Area Library within the State Library System as authorized by House Bill 260 and it will adhere to all requirements and execute responsibilities within the framework of the Houston Major Resource Center System. Councilman Walker seconded the motion. The vote follows: Ayes; Councilmen Kloesel, Walker, Stasney, Cannon and McWilliams Mayor Walker Nays: None The caption of the resolution follows: 5134 Minutes, December 20, 1971 RESOLUTION 363 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN ACCEPTING THE DESIGNATION OF STERLING MUNICIPAL LIBRARY AS AN AREA LIBRARY WITHIN THE STATE LIBRARY SYSTEM AS AUTHORIZED BY HOUSE BILL 260 PASSED BY THE 61st LEGISLATURE OF THE STATE OF TEXAS. Counclman Kloesel moved to adopt an ordinance authorizing the Mayor and City Clerk to execute and attest to a contract with Bernard Johnson, Inc., for the sum of Forty -Five Thousand and N01100 ($45,000) dollars as the City's portion of a proposed joint drainage study for Harris County Flood Control District and the City of Baytown, with a total fee of Ninety Thousand and N01100 ($90,000) Dollars. Councilman Stasney seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Walker, Stasney, Cannon and McWilliams Mayor Walker Nays: None The caption of the ordinance follows: ORDINANCE NO. 1147 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE AND ATTEST TO A CONTRACT WITH BERNARD JOHNSON, INC., FOR THE SUM OF FORTY -FIVE THOUSAND AND NO 1100 ($45,000) DOLLARS AS THE CITY OF BAYTOWN'S PORTION OF A PROPOSED JOINT DRAINAGE STUDY FOR HARRIS COUNTY FLOOD CONTROL DISTRICT AND THE CITY OF BAYTOWN, OR FOR THE SUM OF NINETY THOUSAND AND N01100 ($90,000) DOLLARS REPRESENTING THE TOTAL FEE FOR SAID JOINT DRAINAGE STUDY IN THE EVENT THE CITY OF BAYTOWN IS TO RECEIVE AND DISBURSE HARRIS COUNTY FLOOD CONTROL DISTRICT'S SHARE OF THE COST OF SAID STUDY. Ordinance - Accepting the Improvement of Post Oak Street - Assessment Notices Councilman Kloesel moved to adopt an ordinance accepting the work of improving Post Oak Street from North Burnett Drive to the west boundary line of Lakewood Subdivision, Section "0 ", within the City. Councilman Walker seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Walker, Stasney, Cannon and McWilliams Mayor Walker Nays: None The caption of the ordinance follows: ORDINANCE NO. 1148 AN ORDINANCE ACCEPTING THE WORK OF IMPROVING POST OAK STREET IN THE CITY OF BAYTOWN, TEXAS, WITHIN THE LIMITS HEREINBELOW DEFINED, UNDER A CERTAIN CONTRACT THEREFOR ENTERED INTO; FINDING AND DETERMINING THAT SUCH WORK AND IMPROVEMENTS HAVE BEEN COMPLETED IN ACCORDANCE WITH SUCH CONTRACT AND THAT THE CITY'S ENGINEER HAS SO FOUND AND HAS SO CERTIFIED TO THE CITY COUNCIL, AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. Unfinished Business - Mayor to Appoint Committee - Study Method Handling Insurance Programs Councilman Kloesel moved that the Mayor be authorized to reappoint a committee composed of three (3) councilmen and two (2) city employees to determine and recommend a method that the City will use in handling the City's health and life insurance programs. Councilman Cannon seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Walker, Stasney, and Cannon Mayor Walker Nays: None Abstained: Councilman McWilliams Minutes, December 20, 1971 5135 New Business - Briefing Session Scheduled - Council Districts Councilman Kloesel reported that he had asked the City Attorney to arrange an informal meeting with County Precinct Chairmen, members of the City Council and member of the Planning Department relating to redistricting the City according to the requirements of the City Charter. The meeting is to be a briefing session in order to give the City's Assistant Planner an opportunity to present the information he has accumulated. Following some discussion, Councilman McWilliams moved that the City Council ast as a Committee of the whole to consider the redistricting of City Councilmen districts based on information from the Planning Department and the Precinct Election Judges. Councilman Kloesel seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Walker, Cannon and McWilliams Mayor Walker Nays: Councilman Stasney Adjourn Councilman McWilliams then moved for the meeting to adjourn to an executive session to consider purchase of real estate.
