1971 12 09 CC Minutes, Special5131 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF BAYTOWN December 9, 1971 The City Council of the City of Baytown, Texas, met in special session on Thursday, December 9, 1971, at 5:00 p.m., in the Conference Room of the Baytown City Hall with the following members in attendance: Ted Kloesel Councilman C. O. Walker Councilman Jody Lander Councilman Leonard Stasney Councilman Jim McWilliams Councilman C. Glen Walker Mayor D. R. Voelkel City Manager Howard Northcutt Assn't Administrator Neel Richardson City Attorney Edna Oliver City Clerk Absent: Allen Cannon Councilman The Mayor called the meeting to order. A. J. Busch, Consulting Engineer, was asked to explain the reason for the special called meeting. Approve - Water Main Installation for Completion of Contract No 2 - Bond Program In 1969, the City Council approved a contract with Whitelak, Inc. for the installation of arterial water maing but a section of the construction had to be deferred because the required right -of -way had not been negotiated. Mr. Whitehead, President of Whitelak, Inc., had given the City a letter extending the contract, at the prices shown in the bid, and the company will be available to complete the remaining portion of theproject when the right -of -way is acquired and the City issues a work order. The letter was dated February 23, 1971. The right - of-way has now been negotiated and the project can proceed toward completion. Mr. Whitehead is willing to do the work or terminate the contract depending upon the decision of the Council. It was pointed out that the unit prices received on the two lowest bids received on the Phase II arterial water mains were much lower than the unit prices quoted in the Whitelak, bid. Should the Council decide to add this project to the present contract of Bayshore Constructors it would realize a savings of approximately $6,000. Councilmen Kloesel and Lander preferred advertising for bids for the completion of the project - this would delay the project approximately six weeks. When asked, City Attorney Richardson stated that the Council could legally add this additional work to the current contract of Bayshore Constructors if it so elected. Mr. Busch proposed to include additional proposed construction to the project should bids be sought as the project was too small for receiving favorable bids. Following further discussion, Councilman Walker moved to add this work to the lowest contract now in process. Councilman Stasney seconded the motion. The vote follows: Ayes: Councilman Walker, Stasney and McWilliams Mayor Walker Nays: Councilman Kloesel and Lander Adjourn There being no further business to come before the Council, the motion was made by Councilman Stasney, seconded by Councilman Walker that the meeting adjourn.
