1971 06 29 CC Minutes, Specialr II r 5033 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTO'iN June 29, 1971 The City Council of the City of Baytown, Texas met in special session on Tuesday, June 29, 1971 at 4:30 p.m., in the Conference Room of the Baytown City Hall with the following members in attendance: C. 0. Walker Councilman Jody Lander Councilman Leonard Stasney Councilman Jim McWilliams Councilman C. Glen Walker Mayor D. R. Voelkel City Manager Howard Northcutt Administrative Assn't Edna Oliver City Clerk Absent: Ted Kloesel Councilman Allen Cannon Councilman Mayor Walker called the meeting to order, and stated the purposes of the meeting was to consider filing an application, prior to the deadline of June 30th, for federal funds out of this fiscal year's budget through the EPA program. Each year funds are made available to States to reimburse local governments for sanitary sewer improvements and in this fiscal year Texas has $41 M. The Federal government will contribute 558 if the State will contribute 259 and Texas has voted an amendment to the Constitution to allow the State to sell $100 M in bonds to loan the cities for this purpose. It is not known whether the $100 M will be sufficient to provide funds for all applications so, in order to have a backup, the alternate is proposed which permits the City to contract a Memorandum Agreement with some authority such as San Jacinto River Authority.,. the Gulf Coast Waste Disposal whereby the Authority agrees to loan the City the State allocation of 258. When the project is completed, the City would get the money. In order to meet the deadline, some compact agreement must be filed with the Water Quality Board in Austin prior to June 30th, in order to quality. The Administration is now asking the Council to enter into one of the Memorandum Compact Agreements with the San Jacinto River Authority, place it on file with the Texas Water Quality Board prior to the deadline. If the City is unable to get funds from the bonds which will be sold in Texas at a later date, the City could then use this avenue of acquiring the 559 federal funds to build the sanitary sewer project. This Will be a grant of $1,235 M - our total project cost being $2,246 M. The Council discussed the proposal at length. Councilman McWilliams expressed some concern over entering into a contract agreement without the opinion of the City Attorney who was out of town. Following some further discussion, Councilman Walker moved to adopt ordinance approving the memorandum agreement between The City of Baytown and the San Jacinto River Authority. Councilman Stasney seconded the motion. The vote follows: Ayes: Councilmen Walker, Lander and Stasney Mayor Walker Nays: None Abstained: Councilman McWilliams The caption of the ordinance follows: ORDINANCE NO. 1104 AN ORDINANCE APPROVING MEMORANDUM AGREEMENT BETWEEN THE CITY OF BAYTOWN AND SAN JACINTO RIVER AUTHORITY AND AUTHORIZING AND DIRECTING THE EXECUTION THEREOF AND SETTING AN EFFECTIVE DATE.
