1971 04 08 CC Minutes, Executive SessionMINUTES OF THE EXECUTIVE SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN April 8, 1971 The City Council of the City of Baytown, Texas, met in executive session on Thursday, April 8, 1971, in the Conference Room of City Hall with the following members in attendance: Ted L. Kloesel David Evans Don M. Hullum Leonard Stasney Lamar Kelley Allen Cannon D. R. Voelkel Bill Laughlin Howard Northcutt Jim Woods Wanda Orton Absent: C. Glen Walker Councilman Councilman Mayor Pro Tem Councilman Councilman Councilman City Manager City Attorney Administrative Assistant Reporter- Houston Post Reporter- Baytown Sun Mayor The subject of the executive session was discussion on the purchase of land for a future landfill site. City Attorney, Bill Laughlin, stated that the property owners would be agreeable to payments of five (5) equal installments. This could be ac- complished by the issuing of time warrants. He further explained that the Council must pass a resolution stating their intent to issue time warrants. The resolution must then be published and a period of thirty (30) days must elapse to give time for any petitions to be filed opposing Council action. At the end of the thirty (30) day period the Council must adopt an ordinance for the issuing of the warrants. Councilman Hullum stated that he thought that a law suit might be filed if the City used the proposed land for burying trash and garbage. Councilman Kelley moved that the administration proceed with the time warrant procedure. Councilman Hullum amended the motion to state that the administration proceed provided that the core samples taken of the pro- perty were of a good quality. City Attorney Laughlin stated that the contract had provisions for the core sampling of the property to establish our working depth. The motion was then seconded by Councilman Stasney. Some discussion followed. It was the opinion of the majority of the Council that the City needed to go to a depth of forty -five (45) to sixty (60') feet. Councilman Evans called for the question. The vote follows: Ayes: Councilmen Evans, Kelley, Cannon, Hullum, and Stasney Nays: Councilman Kloesel There being no further business the executive session adjourned. Don M.
