1971 01 07 CC Minutes4902 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN January 7, 1971 The City Council of the City of Baytown, Texas, met in regular session on Thursday, January 7, 1971 at 6:30 p.m., in the Council Room of the Baytown City Hall with the following members in attendance: Ted Kloesel Councilman David Evans Councilman Leonard W. Stasney Councilman Allen Cannon Councilman C. Glen Walker Mayor D. R. Voelkel City Manager W. R. Laughlin City Attorney Edna Oliver City Clerk Absent: Don M. Hullum Councilman Lamar Kelley Councilman The Mayor called the meeting to order and the Invocation was offered by The Reverend A. E. Weatherly, Garth Road Baptist Church. The Mayor then called for the minutes of the December 17 meeting. Councilman Kloesel asked that the minutes be amended to include his minority report regarding salary increases by referring to tape to make this addition to minutes. Councilman Cannon asked that motion regarding requirements for construction of sidewalks be completed to include the name of Councilman Stasney as making the motion. Councilman Kloesel then moved to approve the minutes as corrected. Councilman Stasney seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney and Cannon Mayor Walker Nays: None Refer Proposed Ordinance - Granting Franchise United Gas, Inc. - Utility Committee Mayor Walker referred to a proposed ordinance which would grant United Gas, Inc. a franchise to distribute natural gas within the corporate limits of Baytown and asked for discussion. Councilman Kloesel, a member of the Utility Committee, stated that the Committee has not met recently to discuss the proposal of United Gas, Inc. for a franchise; this proposal had been received in 1970. It was pointed out, however, that this ordi- nance was different from the first presentation in that it is a limited franchise to eliminate any possibility of duplication of facilities. Following some discussion, Councilman Kloesel moved to refer the ordinance back to the Utility Committee for study with the understanding that the Committee will return to the Council with a recommendation following the conclusion of its study. Councilman Stasney seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney and Cannon Mayor Walker Nays: None Retain Service Frank Dorr - Study Corrosion Problem Councilman Stasney moved to retain the services of Mr. Frank Dorr to conduct a survey of the City's corrosive water. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney and Cannon Mayor Walker Nays: None Minutes, January 7, 1971 4903 Ordinance - Prohibiting the Overnight Parking of Commercial Vehicles Upon Residential Streets City Attorney Laughlin reviewed the contents of a proposed ordi- nance which would prohibit the overnight parking of any commercial vehicle, truck tractor, trailer or semitrailer, upon any residential street of the City, however, an exception was made for delivery by commercial vehicles in the usual course of business and the right to park for the length of time necessary to make such deliveries. Councilman Kloesel moved to adopt the ordinance as presented. Councilman Cannon seconded the motion. Public Hearing - Annexation 10 -foot Strip Covering Highways F.M. 1405 565 6 S -146 Mayor Walker opened the public hearing upon the porposed annex- ation, by the City of Baytown, of a ten (101) strip of land along public right- of-way covering portions of Highways F.M. 1405, 565 and S -146, so as to extend the City's ten (10') foot strip of land northward from the United States Steel plant entrance // to Highway I -10. He asked if any in the audience wished to be hearq regarding the proposed annexation. No one in the audience arose to be recognized and heard, nor did the Council offer any comment. The Mayor then declared the public hearing closed. Ordinance - Amending Code of Ordinances Add New Chapter Truck Routes Councilman Cannon moved to adopt an ordinance amending the code of ordinances of the City by the addition of a new chapter designated truck routes so as to regulate the weight of commercial motor vehicles being operated over, on and upon certain designated streets in the City. Council- man Evans seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney, and Cannon Mayor Walker Nays: None 'D:e caption of the ordinance follows: ORDINANCE NO. 1064 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, BY THE ADDITION OF A NEW CHAPTER, TO -WIT: CHAPTER 30, "TRUCK ROUTES ", SO AS TO REGULATE THE WEIGHT OF COMMERCIAL MOTOR VEHICLES WITH A TRAILER, SEMI- TRAILER OR OTHER VEHICLES ATTACHED THERETO, BEING OPERATED OVER, ON OR UPON CERTAIN STREETS IN THE CITY OF BAYTOWN; PROVIDING FOR ISSUANCE OF A PERMIT UNDER CERTAIN CIR- CUMSTANCES; PROVIDING A PENALTY CLAUSE; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. 4904 Minutes, January 7, 1971 Ordinance - Amending Code of Ordinances - Subdivision - To Add Townhouse Subdivisions The City Attorney reviewed the ordinance amending the Code of Ordinances Chapter 27, Subdivisions, by the addition of a new Article V, "Townhouse Subdivisions ", which defined the type structure, subdivision, interior streets, access streets, open space, building setback lines, lots, density standard and screening walls. City Planner, Ross Wilhite, con- firmed that the Ordinance has been reviewed in detail by the Planning and Zoning Commission in an open public meeting and recommend its adoption. The City Attorney also discussed possible exceptions to the density standard as set forth in the ordinance relative to the townhouse subdivisions pre- viously considered by the Planning Commission, particularly Mr. Beal's townhouse development in Lakewood as he would like to develop under the sketch plan as presented. Councilman Stasney moved the adoption of the ordinance, and further moved that no exceptions be granted to this ordinance. Councilman Kloesel seconded the motion. Adopt Resolution - Support Adequate Funds for Library Systems Act After hearing the City Liararian, Flora Wilhite, in support of the adoption of a resolution supporting the request of the Texas Library and His- torical Commission that the 62nd Legislature appropriate the sum of $1,700,00(,, for each year of the next biennium to fully implement the provisions of the Library Systems Act. Councilman Kloesel moved to adopt the resolution as submitted. Councilman Cannon seconded the motion. Ordinance - Agreement With Highway Department Signa"zation Intersection_ Spur 330 & SJ Ave. Councilman Kloesel moved to adopt the ordinance providing for the approval of the agreement between the State of Texas and the City of Baytown for the installation of highway traffic signals'at the intersection of Spur 330 and San Jacinto Avenue. Councilman Stasney seconded the motion. Awarding Bids on City Vehicles 4905 Before the Council began its review of the bids received on city vehicles, City Manager, Voelkel pointed out the receipt of a bid, prior to the opening of bids, but four (4) minutes late on the time schedule for receipt of bids. The bid was for compact trucks which was not included in the bid specifications by oversight. When contacted the dealer was asked to submit a bid, and since it was submitted later than the time schedule, he asked the Council's direction on whether or not to open the bid for consideration with other bids received and summarized. Councilman Stasney . moved to allow the opening and consideration of the bid that was four (4) minutes late. Councilman Kloesel seconded the motion. Following matters of clarification relating to the specifications and departments to use the trucks, Councilman Kloesel moved to purchase one Ford pick -up with auto- matic transmission and five pick -up trucks from Kemp & Tony Equipment Company. The motion was declared dead for want of a second. Councilman Cannon then made a motion to purchase tow Ford trucks, with automatic transmission, and five Datsun trucks without automatic transmission. Councilman Stasney seconded the motion. Councilman Cannon seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney and Cannon Mayor Walker Nays: None The Council held a short recess and upon returning to the table, Councilman Cannon moved to void the bid awarded on the five (5) Data= pickups since other comparable dealers were not given an opportunity to submit a bid on a similar truck. Councilman Cannon seconded the motion. The vote follows: Ayes: Councilmen Evans and Cannon Nays: Councilmen Kloesel and Stasney Mayor Walker Councilman Kloesel then moved to purchase two trucks, with auto- matic transmission, from Courtesy Ford and five pickup trucks from Kemp & Tony leaving the trade -ins at the best monetary bid by the purchasing department. This motion died for want of a second. Councilman Cannon then made a motion to award a contract to Courtesy Ford for two (2) pick -up trucks with automatic transmission and readvertise for bids on five (5) pick -up trucks. Councilman Evans seconded the motion. The vote follows: Ayes: Councilmen Cannon and Evans Mayor Walker Nays: Councilmen Stasney and Kloesel MWA Councilman Kloesel's motion to purchase one pickup truck, with auto- matic transmission from Kemp & Tony for use in the police department was de declared out of order as the Council had previously voted to readvertise for the five (5) remaining pickup contained in the original bid. Resolution - Adopting Land Acquisition Policy Statement as Required by HUD Councilman Kloesel moved to adopt a resolution formally adopting an acceptable land Acquisition Policy Statement as a condition of eligibility for assistance under the open Space land Program and administered by Department of Housing & Urban Development. Councilman Cannon seconded the motion. M 4908 Minutes, January 7, 197 Mr. Gourner - Complaint Traffic Control East Texas Ave and Highway 146 After hearing a complaint from Harris Gourner relative to traffic control on East Texas Avenue at Highway 146 abutting the Woolco Shopping Center, Councilman Kloesel moved to refer the complaint with the proposed changes to the Traffic Committee for study. Councilman Stasney seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney and Cannon Mayor Walker Nays: None Receive Request - Jack Kimmons - Houston Lighting & Power Company - Rate Increase Minimum Jack Kimmons, Division Manager of Houston Lighting & Power Company, presented a request for an increase in the minimum residential and commercial rates of his company. At the present time the base rate is $1.20 for the first 20 kilowatt hours and Houston Lighting & Power Co. is asking that this base minimum be increased to $1.90 for the first 20 kilowatt hours. This will be only change from the present rate schedule. this increase in rates will enable the company to recover a portion of the increased costs of serving each individual customer. Since this increase will directly affect the customer, Councilman Kloesel moved to set a public hearing for January 14 at 7:00 p.m., on the rate increase requested by Houston Lighting & Power Company. Councilman Stasney seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney and Cannon Mayor Walker Nays: None Committee Reports Councilman Kloesel referred back to the Wage and Salary Committee report and requested that the City Administration contact the Texas Employment Commission and arrange for an analysis of a staff study. They will come in, d. at no cost to the City, and assist the City in training people. This will be done on a part -time basis, and in his opinion is needed in the clerical and secretarial division. Appoint Committee - Chamber County Liaison The Council approved the appointment of a Council Liaison Committee to meet with officials of Chambers County on a quarterly basis. The committee is composed of Councilman Allen Cannon, Chairman, Councilman Leonard Stasney and Councilman Ted Kloesel. Ordinance - Off - Street Parking Councilman Kloesel moved to adopt an ordinance amending Ordinance No. 1055 to provide administrative procedure, granting of exceptions and ex- cluding off - street parking on parts of Harbor, Market and West Main Streets. Councilman Stasney seconded the motion. Minutes, January 7, 1971 4909 Approve - Recommendation Texas Highway Department Dispose of Surplus ROW along Loop 201 Councilman Kloesel moved that the recommendation of the Texas Highway Department, Post Office 1386, Houston, Texas, 77001, requesting the City's concurrence in the disposition of certain State -owned surplus pro- perty on Loop 201 as described in Exhibits A, B, C, D, E, and F attached hereto and made a part hereof, be adopted, and that the City Council of the City of Baytown concent and concur in the State's sale of said tracts 1 through 6, inasmuch as this property is no longer needed by the citizens for use as a road, and that the State be requested to put in a billboard restriction clause; the metes and bounds description of said surplus tracts being described in Exhibits A through F attached to this motion. Councilman Cannon seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney and Cannon Mayor Walker Nays: None Petition - Requesting Traffic Light - West Avenue and Bayway Drive Councilman Kloesel moved to accept a petition requesting th Qin stallation of a traffic light at the intersection of West Avenue and SawjmpawFt Drive, and to refer the request to the Traffic Committee for study. Council- man Cannon seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney and Cannon Mayor Walker Nays: None Carl Connerton- Complaints Carl Connerton referred to charter provision on public records and asked for clarification on what records are open to the public. He was ex- pecially interested in police records. Also, he asked for consideration of n 7% returnable interest to customers having a $10.00 water deposit with the City. City Attorney stated that he was of the opinion that charter provi- sions in reference to records does not include police files as public records since the information is confidential. He also referred to real estate and condemnation records which may be public records but are con- fidential matters and the records will not be disclosed to the public in general.' Mr. Laughlin also stated that municipalities do not pay interest on its fund since it is not in the profit motive business but a security measure. Objection Offered Councilman Kloesel - Administrative Assistant As Acting City Manager Kloesel offered some objection to the practice of appointing the Administrative Assistant as acting City Manager during the City Manager's absence. His question was not directed at the abilities of the Adminis- trative Assistant but as a matter of policy. He preferred the appointment of a department head. Mr. Voelkel stated that the department heads have a full load and the Administrative Assistant is kept abreast of the matters of the city and knows the full program. Miscellaneous The City Council will meet with Mr. Bray, the new County Commissioner, at 6:00 o'clock p.m., Thursday, January 14th to acquaint him with the needs of the city. Councilman Stasney asked that the ordinance prohibiting erection of signs on the city's rights of way be placed on the January 21st agenda.
