MINUTES OF THE REGULAR
MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
July 23, 1970
The City Council of the City of Baytown, Texas met in regular session on
Thursday, July 23, 1970 at 6:30 p.m., in the Council Room of the Baytown City Hall
with the following in attendance:

The Mayor called the meeting to order and the Invocation was offered by
the Reverend Henry Korver, First Presbyterian Church. Mayor Walker then called
for the minutes of the regular meeting on July 9. Councilman Kelley moved to ap-
prove the minutes as submitted in written form. Councilman Hullum seconded the
motion. The vote follows:

Adopt Ordinance - Standards for Nuclear Fallout Shelters
Councilmen Kloesel moved the adoption of Ordinance No. 1036 which pro-
vides standards for Nuclear Fallout Shelters which will be considered when public
buildings are constructed if it is determined that the cost is feasible. Councilman
Stasney seconded the motion. The vote follows:

ORDINANCE NO. 1036
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN REQUIRING THAT
NUCLEAR FALLOUT SHELTERS BE PROVIDED IN BUILDINGS CONSTRUCTED OR RE-
MODELED WITH PUBLIC FUNDS; ESTABLISHING STANDARDS FOR SUCH SHELTERS,
AND PERMITTING CERTAIN EXCEPTIONS; PROVIDING FOR THE ADMINISTRATION
OF THIS ORDINANCE AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
Miscelleanous
Grover Edge brought forward three filters which he had used on his water
line from city main to his home since last October. He urged the Council to con-
tinue its efforts to clear the lines as the filters bore evidence of solids yet being
discharged through the water service mains.
John Humphrey, a Baytown fireman and member of the International Fire
Fighter's Association, presented the Council with tickets for each member and his wife
to attend the fund raising base ball game which will be played in Baytown on August
15.
Rufus Honeycutt, local businessman, asked the City administration to follow
through on the enforcement of an ordinance which will eliminate the propane and bu-
tane truck traffic on Texas Avenue except for delivery only.
Councilman Kelley urged the Council to attend an all day session relating
to butane and propane truck traffic on August 3 in Houston. This program is being
presented by the Houston Fire Department and will be of special benefit to all.

Start Proceeding Sale Bond - First Phase Improvements
Councilman Kelley made a motion pending concurrence of the City's fiscal
agent, to sell the first phase of the capital improvements bonds. Councilman Hullum
seconded the motion. The vote follows:

Activities - Environmental Advisory Board
Councilman Stasney reported that the Environmental Advisory Board had held
two meetings. The first was an organizational meeting with Jack Walker elected
Chairman, Charles Cody, Vice Chairman and Larry Hale elected as Secretary. The
second meeting was a business meeting at which time the Board discussed the
Helmerich -Paine hearing scheduled to be held before the Water Quality Board in Austin
on a waste water discharge permit. The permit application is for some 7,000 gallons
per day of industrial and domestic waste water to be discharged into an open ditch
running past the Country Club apartments. The Board felt that this was not a de-
sirable long range prospect and recommended a protest be submitted by the City of
Baytown to the Water Quality Board to limit the discharge permit of the sanitary
sewer portion to such time as the City of Baytown constructs a lateral nearby. Then
Helmerich -Paine will be required to tie the sewage into the lateral line at their
expense. Councilman Stasney moved to accept the report and the recommendation of the
Board for the City of Baytown to register the protest with the Water Quality Board.

Jack Morton - Letter - Water Quality Board - Consolidation of Highlands & Baytown STP
Jack Morton, City Engineer, reported that he had received a personal call
from a consulting engineer for Water District No. 1, Highlands relative to a meeting
held before the Water Quality Board in Austin on July 22. The Water District had
made an application for an amendment to their permit which would allow them to build
a new addition to their sewage treatment plant. At the hearing the examiner had
asked whether the sanitary sewer loan of the plant could be diverted and taken into
the City of Baytown's system rather than building an additional small treatment
unit at Highlands. Apparently the feeling of the Board is to consolidate smaller
plants rather than continuation of enlargement. The engineer had asked Mr. Morton
if this could be done and his answer had to be "no" because of the present over-
load at both Lakewood and Craigmont plants. The engineer then asked that he write
a letter to the Water Quality Board certifying that the City of Baytown does not
have sufficient capacity at this time to permit the extension and tie -in. However,
the proposal could be given consideration in the future when the new sewage treat-
ment plant for Baytown is constructed near Interstate 10. This plant could then be
expanded at the time of construction to include Highlands if deemed feasible but this
would mean a deferment of two years or more. Following some further discussion,
Councilman Kelley moved to approve the writing of the letter as outlined by Mr. Morton.

Appointment - Charter Committee
Councilman Stasney reported that the City Charter Selection Committee has
met and selected fifteen (15) Baytonians whom the Committee would like to recommend
for appointment to the Charter Committee. Fourteen (14) of the selectees have been
contacted and agreed to serve and he recommended their appointment. However, he
proposed to delay the appointment of the fifteenth (15th) until contact is made.
The selectees were:

Councilman Stasney moved the appointment of the fourteen to the Charter Committee;

the fifteenth to be named at a later date. Councilman Kelley seconded the motion.
Councilman Kloesel questioned the removal of Ron Roberts from the original selection
committee since he had expressed an interest in the committee at the time of its ap-
pointment. Mayor Walker explained his reasons for dismissing the original committee
which was nothing personal, but a matter of timing and need of study. Following
some further discussion, Councilman Kelley moved to end debate. Councilman Stasney
seconded the motion. The vote follows:

Councilman Kloesel - Traffic Committee Report
Councilman Kloesel referred to the Traffic Committee report which was in-
cluded in the material sent to the Council the earlier part of the week. He pointed
out the need for Council decision on the business district parking and truck muting
before the Traffic Committee can recommend solutions to other problems. Also, Counci-
man Kloesel moved to instruct the City Attorney to prepare an ordinance, for presen-
tation at the next regular meeting, changing the speed limit on Baker Road to 40 miles
per hour except during the hours when Sterling is taking up or dismissing. Councilman
Kelley seconded the motion. The vote follows:

Requests - Preparation of Resolution - Appointing Committee - Detailed Analysis
The City Attorney was instructed to prepare a resolution, for presentation
at the next regular meeting, commending John Henderson for his contribution to the
citizens of Baytown during his past year of service as assistant to Mayor Walker.
Councilman Kloesel requested that the Mayor and City Council consider
appointing a Committee to make and study and submit a recommendation for a raise for
the city employees which will be considered by the Council during its budget study.
Councilman Hullum requested the City Administration to prepare a detailed
analysis of what eventually happens on the tax assessment; a breakdown on how many
residential property values were raised or lowered, increase on vacant property by
what percent, plus including any area where an increase was made in the assessment.
Traffic Committee - Traffic Signalization Bowie Drive and Lacy Drive
Mr. Voelkel informed the Council of the action of the Traffic Committee to
install traffic signals across State Highway 146 at both Bowie and Lacy Drives. The
State Highway Department has asked that the signals be interconnected. The estimated
cost for such an installation is $11,000.00 and the budget currently has a free balance
Of $8,956.00 for traffic signalization. The Committee will proceed with its plans for
the installation. Should the cost exceed the $8,956.00, funds are available in the
Council Contingency Fund to cover the remaining costs.
Study Revision Garbage Pickup Including Trash
At the suggestion of Councilman Stasney to study the revision of the garbage
pickup schedule, City Manager Voelkel proposed to deviate from the use of the six
trash trucks and convert three to garbage trucks and have ten garbage trucks working
four days a week with three less men than we have now. Then on Wednesday of each
week, put the three remaining trash trucks plus the seven garbage trucks out picking
up trash. Councilman Stasney moved to request the Administration to pursue this line
of study. Councilman Kelley seconded the motion. The vote follows:

Councilman Kloesel requested the Administration to prepare a report on the
equipment for Council consideration during budget study.

There being no further business to come before the Council, Councilman Kelley
moved for the meeting to adjourn. Councilman Stasney seconded the motion. The ayes
were unanimous and the Mayor declared the greeting adjourned.
