1970 04 15 CC Minutes, Specialr r A 4792 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYOWN, TEXAS April 15, 1970 The City Council of the City of Baytown, Texas, convened in a special meeting on the 15th day of April, 1970. The Mayor stated that this meeting, provided by the City Charter, was called for 5 :00 p.m.; however, three council- men being out of the City made it impossible to have more than a minimum quorum to transact business and for this reason the items concerning the proposed im- provements to Thomas Circle and the hearing on Flood Insurance would be postponed until a majority of the Council could be in attendance. The delayed arrival of one member of the Council caused the start of the meeting to be delayed until 6:00 p.m. Present: C. Glen Walker Mayor Don M. Hullum Councilman Leonard W. Kloesel Councilman David Evans Councilman Allen Cannon Councilman Canvass of Election - Three Council Members The Mayor called the Greeting to order and the canvass of the election returns for three council members was brought on for consideration and the fol- lowing resolution was submitted in written form: RESOLUTION No. 283 A RESOLUTION CANVASSING THE RETURNS OF THE REGULAR MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 2ND DAY OF APRIL, 1970, FOR THE PURPOSE OF ELECTING THREE (3) COUNCILMEN FROM THE RESPECTIVE DISTRICTS NOS. ONE (1), FOUR (4) AND FIVE (5) TO SERVE REGULAR TWO YEAR TERMS; FINDING THAT NOTICE OF SAID ELECTION WAS DULY AND PROPERLY GIVEN AND THAT SAID ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. WHEREAS, pursuant to Article IX, Section 96 of the Charter of the City of Baytown, the City Council of said City, at a special meeting held on this 15th day of April, 1970, proceeded, as required by law, to canvass the returns of the Regular Municipal Election held in the City of Baytown on the 2nd day of April, 1970, for the purpose of electing three (3) councilmen from the respective Districts Nos. One (1), Four (4) and Five (5); said election having been held under and pursuant to the provisions of the Charter of said City and an ordinance duly passed on the 22nd day of January, 1970, calling said Election; and WHEREAS, said Election having been duly and regularly had and held as called in said Ordinance and according to law, and the returns thereof having been duly made and the Election Judges having certified the results of said Election, as hereinafter set out, and the City Council having duly and regularly 4792 -A Minutes, April 15, 1970 canvassed the returns of said Election and finding that the total votes cast at said Election were as follows, to -wit: FOR COUNCILMAN FROM DISTRICT NO. 1 Ted L. Kloesel 309 Votes FOR COUNCILMAN FROM DISTRICT NO. 4 Leonard W. Stasney 297 Votes FOR COUNCILMAN FROM DISTRICT NO. 5 James Allen Cannon 301 Votes WHEREAS, the City Council of the City of Baytown finds the Election returns as set out above to be accurate and correct and no Election protest or contest having been filed with said Council or instituted in connection with Election; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That TED L. KLOESEL received a majority of the votes cast at said Election for the office of Councilman from District No. One (1) and, accordingly, District No. One (1) of the City of Baytown. Section 2. That LEONARD W. STASNEY received a majority of the votes cast at said Election for the office of Councilman from District No. Four (4), accordingly, District No. Four (4) of the City of Baytown. Section 3: That JAMES ALLEN CANNON received a majority of the votes cast at said Election for the office of Councilman from District No. Five (5) and, accordingly, District No. Five (5) of the City of Baytown. Section 4: That the City Council of the City of Baytown further finds that the notice of said Election was duly and properly given as re- quired by law and as provided in the ordinance calling said Election and that said Election was duly and regularly held and the returns thereof duly and regularly made by the proper officials of said Election, and in all things according to law. Appointment - Commissioner - Baytown Housing Authority Mayor Walker explained that the Reverend W. J. Comer, appointed to serve as commissioner on the Baytown Housing Authority Board, had declined acceptance at this time, with an expression of apprectiation for the consider- ation given him, and stated that perhaps in the future he could accept such an appointment. Mayor Walker then announced the reappointment of incumbent E. C. Winegartner. Councilman Stasney made a motion, seconded by Councilman Kelley, that the reappointment of E. C. Winegartner to serve as Commissioner on the Baytown Housing Authority Board for the two ensuing years, effective April 18, 1970, be ratified.
