1969 09 11 CC Minutes4701 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN September 11, 1969 The City Council of the City of Baytown, Texas, met in regular session on Thurs- day, September 11, 1969 at 6:00 p.m., in the Council Roan of the Bayown City Hall with the following members in attendance: David Evans Ted Kloesel Leonard Stasney Allen Cannon * Lamar Kelley C. Glen Walker D. R. Voelkel W. R. Laughlin Edna Oliver Absent: Don M. Hullum Councilman Councilman Councilman Councilman Councilman - Mayor Pro Tem Mayor City Manager City Attorney City Clerk Councilman The Mayor called the meeting to order, the Invocation was offered by Dr. W. Edward Thiele, Pastor Memorial Baptist Church, afterwhich he called for the minutes of September 4. The following correction was made: Water Problem - Linus Community "Mrs. Martin Hernandez . . . appeared before the Council to request some assistance from the City in solving the water problem in the Linus Community. The area is being services by the Harris County Fresh Water District lA of McNair, but has experienced an extreme water short- age this summer. After some discussion, the Council instructed the Administration to gather information and set up a meeting as soon as possible with representatives of the water district to see if something could be worked out." With this correction, Councilman Stasney moved to approve the minutes as corrected. Councilman Kelley seconded the motion. The vote follows: Ayes: Councilmen Evans, Mayor Walker Nays: None Discussion Wrecker Ordinance Kloesel, Stasney, Cannon, and Kelley Councilman Cannon, Chairman of the Council's Wrecker Study Committee, reviewed the draft of a revised wrecker ordinance and concluded his remarks with a recommendation that the ordinance be adopted, copies of which had been mailed to the Council two weeks prior to this meeting. Councilman Kloesel stated that he would like to hear from the wrecker opera- tors before adoption of the ordinance and suggested a joint meeting with the Wrecker Study Committee and the wrecker operators. Andrew Lannie, a local attorney representing the wrecker operators, informed the Council that the wrecker operators have agreed to set up an association, which will be voluntary, and attempt to coordinate and concert their efforts, with some internal policing, toward the external regulations which are required for ob- taining a permit to operate within the city limits. He has a copy of the proposed ordinance ' in final form, but has not had time to study it- neither have the wrecker operators. Since they plan to hold one or two meetings of the Association in order to review the proposed ordinance, Mr. Lannie requested that the Council defer action upon the ordinance until the next regular meeting. Councilman Cannon encouraged the setting up of an Association, but saw no advantage in delaying action upon the ordinance because this was suggested at the beginning of the study when a joint meeting was held with the Committee and several wrecker operators, approximately three months ago. James Stipe, owner and operator of two wreckers within the City, stated that he was offended because no wrecker operator was named as a member of the Wrecker Stuffy Committee. He also enumerated several objection- able specifics of the ordinance. (Discussion ceased on subject matter to permit two annexation hearings called for 6:30 p.m. *Following close of public hearings Mayor Walker excused from meeting; Councilman Kelley serves as Mayor Pro Tem), Mayor Pro Tem Kelley resumed discussion on the proposed wrecker ordinance. In view of what has been presented by interested persons who possibly did not have an opportunity to participate in a dis- cussion in meetings prior to the submission of the ordinance in final form, Councilman Evans moved to table the matter for two weeks to give the Study Committee an opportunity to meet with members of the Wrecker Association if it is formed. Councilman Kloesel seconded the motion. Councilman Stasney asked if it was a non - debatable motion - Mayor Pro Tem Kelley stated it was a privileged motion. The call was made. Minutes, September 11, 1969 4702 Ayes: Councilmen Evans and Kloesel Nays: Councilmen Cannon and Stasney Abstained: Mayor Pro Tam Kelley Due to the tie -vote the motion was debatable. Councilman Cannon then com- mented that he thought the people have had an opportunity to get with the Wrecker Study Committee to discuss the ordinance but they have not. They must share in the respon- sibility. Councilman Stasney asked how many wrecker operators did participate in the discussions, and how many agreed that this was a proper ordinance and they could work under it. Other points of clarification were made by the City Attorney, following which the Mayor Pro Tom called for another motion. Councilman Cannon moved to post- , pone further action upon the revised ordinance until the next regular meeting. Council- man Evans seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney, and Cannon Nays: None Abstained: Mayor Pro Tem Kelley Hearing - Annexation Two Sections Chapparel Village The public hearing upon the proposed annexation of two sections of Chapparel Village was opened by City Attorney Laughlin. He stated the notice had been properly published giving interested parties the right to appear and he heard on the proposed annexation. Following the hearing, an ordinance will be presented at the next regular meeting, on first reading, to properly effect the annexation. However, since calling the hearing the Engineering Department and City Planner determined that it may be ad- visable to annex more than these two sections of Chapparel Village. Several hones which presently receive City services are not included within the two sections of Chapparel Village but are adjacent to the area and the Council may want to include them within the annexed area. Mr. Laughlin suggested that the Council allow anyone here tonight who is interested in the proposed annexation to be heard and adjourn the meet- ing until the next meeting date, readvertise as to the new area to be annexed, and the next time take final action upon both annexations. Mayor Walker then asked if anyone was present from Chapparel Village who would like to be heard relative to the proposed annexation. No one came forward to be heard. Councilman Kloesel then moved to adjourn the hearing on the annexation until the next regular meeting, for the purpose of adding the other residential area adjacent to Section One and Two of Chapparel Village in the metes and bounds of the area to be annexed. Councilman Evans seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney, Cannon, and Kelley Mayor Walker Mays: None Hearing - Annexation King's Ben Subdivision, Section 1 The public hearing upon the proposed annexation of Section 1 of King's Bend Subdivision was opened by City Attorney Laughlin who stated that the notice had been properly published giving interested parties the right to appear and be heard on the proposed annexation. Mayor Walker asked if anyone in the audience Would like to be heard regarding the proposed annexation. No one stood to be recognized and heard. Councilman Evans moved to adjourn the hearing. Councilman Stasney seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney, Cannon, and Kelley Mayor Walker Nays: None Appoint Committee - Formulate Guidelines Selection City Depository I Councilman Kelley moved to approve the appointment of a Committee composed of ' the Presidents of the five (5) banks in Baytown, plus two Councilmen to recommend guidelines and establish policies for future Councils in the selection of a City depo- sitory. Councilman Evans seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Stasney, Cannon, and Kelley Mayor Walker Nays: None Mayor Walker asked Councilman Evans to serve as chairman of the Committee, Councilman Kloesel to serve with him with the five (5) bank Presidents. Request - Increase Salary - Sanitation Employees Sam Savage, representing the City sanitation employees, appeared before the 9703 Minutes, September 11, 1969 Council and asked for a salary increase for all sanitation employees equal to the increase granted the Police and Fire Department employees. His appearance was at the request of Councilman Kloesel. Mayor Pro Tom Kelley gave him an opportunity to present his request but stated that it was premature as no salaries have been set for any department in the City as yet. Councilman Stasney pointed cut that he and Councilman Hull= were on a Com- mittee which is presently studying City employee wages. The Committee has not reached any conclusion as to what wages shall be, but they will complete the study soon. He asked that the Council defer any kind of action regarding wages, for any City employee other than what has already been approved for the Police and Fire Departments, until this com- mittee completes its work and submits its findings. Councilman Kloesel stated that he had no intention to make any recommendation at this : meting, but the employees in this depart - went were concerned as to whether they will get an increase in salary in the 1969 -70 budget. In his presentation, Mr. Savage also stated that an additional truck was needed with man- power to operate it; his concern was not only a wage increase but working conditions also. He requested a reply from the Council within a week, if possible. Councilman Stasney in- formed Mr. Savage that the remainder of the data that the Committee has been waiting for is ready, and he was confident that the Committee could give employees of the sanitation Department some indication of the rate scale which will be proposed to the council. Adjourn There being no further business to come before the Council, the motion was made and seconded that the meeting adjourn.
