MINUTES OF THE SPECIAL
MEETING OF THE CITY COUNCIL OF BAYTOWN
September 4, 1969
The City Council of the City of Baytown, met in special session on Thursday, September 4,
1969 at 6:30 p.m., in the Council Room of Baytown City Hall with the following members in
attendance:

The Council heard a request from Joe Aylot, developer of Kings Bend Subdivision, asking for
extension of utilities to said subdivision. Councilman Kloesel moved to refer the request
to the Engineering Department for study and a recommendation. The motion died for lack of
a second.
In conjunction with this request, Councilman Kelley stated that he too, had one from
the developer of Westwood Village Apartments for the extension of utilities, After discussion,
Councilman Hullum moved that the City go the first 100 feet in both cases, including all
appurtenances involved. Councilman Kelley seconded the motion. The vote follows:
Ayes: Councilmen Kloesel, Evans, Hullum, Stasney, Cannon, and Kelley

Brownwood Land -Base Levee Committee
Thad S. £enema, Chairman, and members of the Brownwood Land -Base Levee Committee met
with the Council to discuss any questions the Council might have relating to their report.
After discussion, the Committee was assured that the Council would give their recommendations
immediate consideration.
Formulate Policy.- Police Enforcement on Private Property
The Council was asked to formulate a policy on police enforcement procedures for certain
offenses on private property. At the present time the Police Department does appear at
scene on most complaints, but does not make a thorough investigation unless there seems to
a need for it. After a lenghty discussion, Councilman Kelley moved to establish a policy
that the Police Department will not appear or investigate any accidents on private property.
Councilman Kloesel seconded the motion. After further discussion, Councilman Hullum moved
to amend the motion to state: The Police Department will not investigate any accidents on
private property unless bodily injury occurs. Councilman Kelley seconded the motion. The
vote on the amendment follows:

The Mayor called
the meeting to order, the Invocation
was offered by Hubert A. Moss,
Pruett & Lobit Church
of Christ. Mayor Walker then called
for the minutes of the
regular
meeting of August 14 and special meetings of August 21
and 22. Councilman Kelley
moved to
approve the minutes as
submitted in written form. Councilman
Hullum seconded the
motion.

Proclamation - Constitution Week
Mayor Walker read a proclamation proclaiming the week of September 17 -23, 1969, as
"Constitution Week" in Baytown.
Baytown Community Assistance Board - Ordinance No. 992
Copies of Ordinance No. 992, creating a fifteen member Advisory Board to assist the
City Council, were passed out, but due to lack of time for the Council to study the
ordinance action was deferred to the next council meeting.
Water Problem - Linus Community
Mrs. Martin Hernandez, a representative from the Linus Community, appeared before the
Council to request the City to annex the community. She stated the reason for wanting an-
nexation was because of the extreme water shortage they have experienced this summer. The
Community is presently serviced by the Harris County Fresh Water District IA of McNair.
After discussion of possible problems in annexing part of a water district, the Council
instructed the administration to gather information and set up a meeting as soon as possible
with representatives of the water district to see if something could be worked out.
Senior Citizens - Tax Exemption on Homesteads
The Council discussed adoption of a resolution recommending that the legislature permit
a $3,000.00 homestead exemption for persons 65 years of age or over. It was decided to defer
action until the administration could oome up with some figures as to how it will affect the
tax revenue of the City.
City Sales Tax Election
Councilman Stasney moved that the Council endorse the City Sales Tax, election to be
held September 23, 1969. Councilman Cannon seconded the motion. The following comments
in regards to the sales tax were made: Councilman Stasney: "I favor city sales tax because
fifteen percent of the retail trade comes from outside the city limits and all of these
people use the city services." Councilman Hullum: "We are not premature in favoring the
city sales tax. It is a choice of a sales tax or an ad valorem increase." Councilman Kloesel:.
"We may not have control over whether it will be one, two, or three . percent; do not have
control over coverage of sales tax; may tax food next year." Councilman Kelley: "If we
continue to add tax only on home owners, we will destroy the great American home." Councilman
Cannon: "Let people from out of town bear their share of the load." Councilman Evans: We
can't continue to put the burden on the home owner." Mayor Walker: " I was previously
opposed to the sales tax, but had calls from people outside city limits asking the city not
to pass the sales tax and decided it most be a good thing." The vote follows:

Transfer Resolution - Parks Department
Councilman Kloesel moved to adopt a resolution authorizing the transfer of $250.00
within the General Budget Classification 600. Councilman Hullum seconded the motion.

Oppose Permit to Discharge Waste Into Cedar and Cary Bayous o_
Councilman Kelley moved to instruct the Administration to register a protest with the
Texas Water Quality Board on the discharging of industrial waste water into Cedar Bayou and
Cary Bayou. Councilman Kloesel seconded the motion. The vote follows:

Name Park - Gene Muller Field
Upon recommendation of the Parks 6 Recreation Board,Councilman Kelley moved to name
the Lakewood Little League Park, "Gene Muller Field ", provided it is acceptable to the
little league. Councilman Cannon seconded the motion. The vote follows:
Ayes: Councilmen Kloesel, Evans, Hullum, Stasney, Cannon, and Kelley

Nays: None
Adjournment
There being no further business to come before the Council the motion was made and
Seconded that the meeting adjourn. The ayes were unanimous and the Mayor declared the
meeting adjourned.
