1969 05 28 CC Minutes, Special4661 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS May 28, 1969 The City Council of the City of Baytown, Texas met in special session on Wednesday, May 28, 1969 at 5:00 p.m., in the Council Room of the Baytown City Hall with the following members in attendance: Ted L. Stasney Councilman Councilman Councilman Councilman Mayor Acting City Manager City Attorney City Clerk Councilman Councilman The Mayor called the meeting to order, the Invocation was offered, afterwhich the following business was transacted. Resolution - Canvassing Election Returns - Zoning Ordinance Election The City Council canvassed the returns of the special election on whether or not the City Council shall adopt a Zoning Ordinance for the City of Baytown. The election was held on May 20th. The Council verified the election totals of the eleven precincts and the absentee machine at City Hall as submitted by the election officials. The City Attorney then introduced and read a resolution declaring the results of the.election, finding that notice was duly given and the returns made by the proper officers, and that said election resulted in the defeat of the proposed comprehensive Zoning Ordinance. Councilman Kelley moved to,adopt the resolution j as read. Councilman Evans seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Cannon, and Kelley Mayor Walker Nays: None The caption of the Resolution follows: RESOLUTION NO. 258 RESOLUTION AND ORDER CANVASSING RETURNS AND DECLARING RESULTS OF SPECIAL ELECTION HELD IN THE CITY OF BAYTOWN, TEXAS ON MAY 20, 1969, ON THE QUESTION OF ADOPTION OF A COMPREHENSIVE ZONING ORDINANCE Westheimer Properties, Inc. - Public Hearing Notice - Texas Water Quality Board The Council discussed the Public Hearing Notice on the application of West - heimer Properties, Inc. for a regular permit to discharge 1,000,000 gallons per day of treated domestic sewage with the effluent to be discharged to Spring Gully. The Hearing will be conducted by the Texas Water Quality Board in Houston on June 17, 1969. This discharge will be from a Water Control and Improvement District in the northwest portion of the Baytown area and will be known as Water Control & Improvement District No. 127. The Council offered objections to the effluent being discharged in Spring Gully because of the proposed development of a Fresh Water Lake on Burnett Bay. After some discussion, Councilman Kelley moved to instruct the Administration to get in touch with representatives of Westheimer Properties, Inc.., and request them to meet with the Council at their earliest convenience. Councilman Evans seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Cannon, and Kelley Mayor Walker Nays: None TRANSFER RESOLUTION Councilman Kloesel moved to adopt a Resolution transferring $11,575.00 from Budget Accounts 201 -10 -4 and 200- 10 -11, to various accounts within the Police Department Budget. Councilman Cannon seconded the motion. The vote f of lows r _ 4662 Minutes, May 28, 1969 Ayes: Councilmen Kloesel, Evans, Cannon, and Kelley Mayor Walker Nays: None The caption of the Resolution follows: RESOLUTION NO. 260 A RESOIUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CITY MANAGER TO TRANSFER ONE THOUSAND SIX HUNDRED NINETY -NINE & 54/100 ($1,699.54) DOLLARS FROM BUDGET ACCOUNT 201 -10 -4, MOTOR VEHICLES, AND NINE THOUSAND EIGHT HUNDRED SEVENTY -FIVE & 46/100 ($9,875.46) DOLLARS FROM BUDGET ACCOUNT 200- 10 -11, SIGNAL SYSTEMS, TO ACCOUNTS WITHIN THE GENERAL FUND BUDGET Approved Hiring Filing and Clerical Employee - Police Department Lieutenant Charles Cowan appeared before the Council to ask for permission to hire an additional filing and clerical employee so that he can develop and maintain a more detailed Records Division within the Police Department. He pointed out the need for this type records but due to the heavy work load now imposed upon the Police Clerical Department, detailed records were not available. Following some further discussion, Councilman Kelley moved to approve the hiring of an additional filing and clerical employee who will be assigned to the Records Division of the Police Department. Councilman Evans seconded the motion. The vote follows: Ayes: Councilmen Evans, Cannon, and Kelley Mayor Walker Nays: Councilman Kloesel Request Removal Parking Meters - Texas Avenue Mr. LeFevre was requested to prepare an income and disbursement summation on the parking meters on Texas Avenue. A request has been made by the Retail Merchants on West Texas to remove the existing parking meters, and the Council wanted this infor- mation before making a decision upon the request for removal. Discussion - Purchase of Tract of Land Adjacent to Communitv Center The Council adjourned to the Conference Room to discuss the feasibility of pur- chasing a tract of land adjacent to the Community Center property. City Officials had ordered an independent realtor to appraise the property at an earlier date. Following discussion, Councilman Kelley moved to authorize the Administration to negotiate with the property owner to purchase the property at a price not to exceed the per acre value placed on the property by the realtor. Councilman Kloesel seconded the motion. The vote follows: Ayes: Councilmen Kloesel, Evans, Cannon, and Kelley Mayor Walker Nays: None Request - Retail Merchants Association - Hang Christmas Decoration East Texas Avenue Mayor Walker reported that he had received a request from the Retail Merchants Association for the City to furnish equipment and personnel to hang Christmas decora- tions at one intersection on Texas Avenue east of North Main Street as a display. It was hoped that this Would encourage more merchants to participate in the cost of additional decorations for Texas Avenue. Councilman Evans moved to approve the request.
