1969 04 03 CC Minutes, Specialr r r 4635 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN April 3, 1969 The City Council of the City of Baytown, Texas met in special ses- sion on Thursday, April 31 1969 at 6:30 p.m., in the Council Room of the Baytown City Hall with the following members in attendance: Absent: Ted Kloesel Glen Walker Lamar Kelley Don M. Hullum J. B. LeFevre William Laughlin Edna Oliver Seaborn Cravey Councilman Councilman Councilman Mayor Pro Tem Acting City Manager City Attorney City Clerk Mayor The meeting was called to order, the Invocation was offered, afterwhich, due to the absence of Mayor Cravey the first order of business was to elect a Mayor Pro Tem to preside over the meeting. Elect - Mayor Pro Tem Councilman Walker moved to nominate the Senior Councilman, Don M. Hu11um, as Mayor Pro Tem to preside over this meeting in the absence of Mayor Seaborn Cravey. Councilman Kelley seconded the motion. The vote follows: AYES: Councilmen Walker, Kelley and Hullum NAYS: None ABSTAINED: Councilman Kloesel Opened Hearing - Purchase Acreage for Sanitary Landfill Site Mayor Pro Tem Hullum opened the meeting on the discussion relating to the purchase of a tract of land near the easterly terminus of Redell Road as a sanitary landfill site. He asked for an orderly presentation from those who came prepared to speak pro or con. Following the presen- tation of the interested parties, a film will be shown by a representative of Browning- Ferris Equipment Corporation on the orderly maintenance of a sanitary landfill. Richard King, local realtor and one of the principals in the sale transaction of acreage to the City of Baytown, who addressed his remarks to the Council and people present at the meeting. He gave a brief but concise resume of the procedures which were followed in presentation of the proper- ty to the City Administration as a sanitary landfill site. This proposal was submitted the latter part of 1968, the property was cored to determine that it was not water bearing sands, and it was found to be feasible for sanitary landfill. In January 1969, the principals in the sale furnished the City of Baytown a title report giving the ownership andproving that this was valid and an agreement was entered into between the principals and the City on February 17th for the option of the property for a period of ninety (90) days. During the ninety (90) days the City Administration would fol- low the necessary legal steps to acquire the property, including the ad- vertisement of issuing warrants in the Baytown Sun for the purchase of the land in question, the passage of an ordinance and other relating factors. All of this has been done, including a delay of the purchase at the February 27th meeting. He concluded his remarks by urging the Council to make some decision upon the matter at this meeting. Charles Orsborne, Attorney representing residents of the Coady Com- munity, submitted the views of the residents concerning the sanitary land- fill, their concern over the effect this will have upon the entire community. Complaints have been made heretofore to the proper County authorities re- garding the practice of illegal dumping by parties unknown on this particular site and have been assured that this practice will be stopped. He presented statements which were made by persons living near the City's sanitary land- fill off Ferry Road and concluded the presentation by asking the Council to give more study to the locating of a sanitary landfill in a residential area. The residents of Coady asked to assist the City in locating a place where devaluations of land will not occur; to find reclaimable land which will be suitable for location of a sanitary landfill. Minutes, Special Meeting, April 3, 196 Bill Hodges, Chairman of the Coady Community, presented petitions from residents of the County Club and Craigmont Additions of Baytown, the Coady Community, McNair and Linus Communities opposing the purchase of the tract of land in the particular area as a sanitary landfill site. Councilman Walker moved to accept the petitions. Councilman Kloesel seconded the mo- tion. The vote follows: AYES: Councilmen Kloesel, Walker and Kelley Mayor Pro Tem Hullum NAYS: None Gene Muller, local realtor, also expressed concern over the site which has been selected by the City of Baytown as a landfill site. He proposed that the Council delay action until some men in real estate business can study the situation and suggest sites which will not be undesirable tocitizens. Gladys Griffin, a resident of Coady now living in Port Prthur, asked the Council to reconsider its plans for purchasing property in the Coady area for a landfill site. Immediately following Mrs. Griffin, the group was shown a film which demonstrated the difference between a garbage dump and a sanitary landfill. Jack Morton, Director of Public Works, gave a brief report on the work now being done by the City in its effort to maintain a sanitary landfill as per the instructions of the State Health Department. Councilman Kloesel mentioned that the Council had two choices to follow: (1) postpone action, or (2) adopt an ordinance approving claims and autho- rizing delivery of time warrants to purchase the tract of land, as agreed. Should the Council adopt the ordinance, in good faith, it has the authority to appoint a committee to investigage land available, sell the present land some- time within the next two year period, and purchase a more suitable site. He expressed his appreciation of the comments made by the Attorney and other citi- zens of the Coady area. Since the City Council has committed itself to pur- chase the tract of land and a $4,000.00 expenditure involved in the prelimi- nary investigation will be lost if the purchase is not consummated, he con- cluded his remarks with a motion that the Council adopt the ordinance autho- rizing delivery of the time warrants to purchase the tract of land, and in goo( faith, to appoint a Committee, including a person selected by the Coady citi- zens to represent them, to assist the City in locating a more desirable lo- cation for a sanitary landfill. Councilman Walker seconded the motion, Fol- lowing the motion some discussion was made for clarification and the vote was called: AYES: Councilman Walker, and Kloesel Mayor Pro Tem Hullum NAYS: Councilman Kelley Councilman Kloesel and Kelley were appointed to the Committee to represent the Council. Councilman Kloesel was asked to serve as Chairman. The caption of the ordinance follows: ORDINANCE NO. 970 AN ORDINANCE APPROVING CLAIMS AND AUTHORIZING DELIVERY OF TIME WARRANTS; CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT; AND PROVIDING THAT SAID ORDINANCE SHALL BE EFFECTIVE IMMEDIATELY UPON ITS ADOPTION. Adjourn There being no further business to come before the Council, the motion was made and seconded that the meeting adjourn. The ayes were unanimous and the Mayor Pro Tem declared the meeting adjourned. Edna Oliver, City Clerk
