MINUTES OF THE REGULAR MEETING OF
THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS
January 23, 1969
The City Council of the City of Baytown, Texas, met in regular session on
Thursday, January 23, 1969 at 6:30 p.m., in the Council Room of the Baytown City
Hall with the following members in attendance:

The meeting was called to order by Mayor Pro Tem Braswell, the Invocation was
offered, afterwhich Mayor Pro Tem Braswell called for the minutes of the regular
meeting of January 9, 1969. Councilman Kloesel moved to approve the minutes as
submitted in written form. Councilman Walker seconded the motion. The vote follows:

Committee - Review Complaint Against Police Making Arrest
Councilman Kelley was asked to act as Chairman of a Committee appointed by
Mayor Pro Tem Braswell to make an investigation of a complaint filed by Messrs. Ray
Dailey and Jerry Boehm regarding methods used by policemen when making an arrest.
Councilman Kloesel and Walker were appointed to serve with Councilman Kelley. A
report will be made on their findings at a later date. 7
Frank Thielen - F.H.A. Supplement Rent Program
Mr. Frank Thielan, local builder, asked the council to give assurance that
they will accept a rent supplement program for Baytown and grant him authority to
go further with it. The program consists of a rental project that anyone can rent.
It is not restricted as Public housing, but if a person cannot afford the full rent
he is given assistance by the supplement program. Mr. Thielen stated that he is
now building F.H.A. rent supplement housing in Navasota, Silsbee and Crockett, Texas.
This is a sponsor -owned project and the sponsor will pay taxes to the City, State
and School district as any local homeowner does. In order for the project to be
finally approved, the City must have a workable program which is being studied by
the Council at the present time. However, Mr. Thielen pointed out that it will take
some 6- months or more for the project to begin construction as a vast amount of
paper work must be done to comply with the rent supplement program. He needs only
the approval of the council at this time. Mr. Osterhaus, of the Interfaith group,
stated that he had talked with Mr. Thielen earlier in the week and he heartily en-
dorsed the program in addition to public housing. - both of which are needed. In
addition, would be the consideration of what's going to happen to the people after
housing is provided. The Council felt that a separate meeting should be held in-
cluding Mr. Thielen and the Interfaith Housing group, to explore the proposal in depth.
A meeting was scheduled for February 6, 7:00 p.m. in the City Hall.
Request - Formation Fifteen - Member Committee- Coordinate Programs Within Poverty Prop
Burne tte W. Dowler, representing a citizens committee, appeared before the
Council to discuss the proposal for a Poverty Commission for the City of Baytown,
He stated that a group began meeting out of a concern for the ratification of dupli-
cation of effort in working in the poverty area because most of the work officially
being done in Baytown officially was being done out of Houston, which leaves must
to be desired. Of the money being allotted by the government for poverty work
in Harris County, about ninety -five per cent is being spent in Houston and the Baytown
area was having difficulty in obtaining funds for its needs. Some of the projects

die when a Houston worker is moved, primarily because of lack of citizens support
and involvement. For this reason, he proposed that the City Council oversee the
election of a Poverty Commission consisting of fifteen (15) members, five of whom
shall be Negro; with one of the fifteen named chairman. When questioned about the
number, Mr. Dowler stated that he felt the area itself,will be broad enough to require
the fifteen members in the coorination structure. Mr. Dowler also told of the work
that had been done prior to the presentation of this recommendation in meeting and
discussing the proposal of a Poverty Commission for Baytown with the many groups which
are presently engaged in activities of a poverty program nature in Baytown, including
the HCCAA. Richard Timmons, Senior Community Organizer with HCCAA, gave a little back -
gound on the work of the HCCAA in the Baytown area, its efforts to formulate an area
council which will be comprised of residents of the various poverty areas in Baytown,
LaPorte, Linus, etc. The people enrolled in the area council were voted upon by the
resident council and selected to represent them in the poverty program in formulating
policy. He agreed that the proposed Poverty Commission could be one assistance to
the HCCAA in training, ascertaining the needs of the people and things of this nature,
as he has received literature from headquarters stressing cooperation between local
agencies such as the Health League, Housing Authority, etc., Councilman Walker stated
that he had been making a study of the program and coordination was a prime factor
if at all possible as it would be helpful to the HCCAA. He had a suggesticnhe wanted
to discuss with this group which, in his opinion, would strengthen the recommendation
greatly. He was not in a position to do it at this meeting and proposed a delay on
the question until the next regular meeting. After some further discussion councilman
Kelley moved to postpone further action upon the recommendation until the next regular
meeting of the Council. Councilman Walker seconded the motion. The vote follows:

Employ Consultant - Review Performance Standards Proposed Zoning Ordinance
Councilman Walker moved to employ Jerome K. Brasch, Enviromental Engineer,
to review the planned Performance Standards in the proposed Zoning Ordinance. Council-
man Fanestiel seconded the motion. Councilman Kloesel suggested that the Physics
teacher at either Lee College, or one of tha two high schools, be contacted to make
the review rather than an expert. Other members of the Council felt that the advise
of an expert in the field of environmental science was needed. Following the discussion,
the vote was called.

Ordinance - Municipal Election
Councilman Walker moved to adopt an ordinance ordering the regular Municipal
Election of the City of Baytown to be held between the hours of seven o'clock a.m.
and seven o'clock p.m. on April lst., 1969. Councilman Fanestiel seconded the motion.
The vote follows:

Permission - Shelter School Children - Craigmont- Ponderosa Area
The City Administration has received a request from citizens of the Craigmont=
Ponderosa area for permission to place a shelter, on public property, for school
children waiting for the school bus. Mr. Lanham stated that it could be placed on
City property where it would not become a traffic hazard, but the City should be able
to review the plans before its installation. Councilman Kelley moved to permit the
construction of such a shelter provided they coordinate it with the City. Councilman
Hullum seconded the motion. The vote follows:

Authorize Appraisal - Property Intersection Massey - Tompkins Road and Raccoon Dr.
Mr. Lanham asked Council authorization to have an appraisal made of property
located at the Northwest turner of the intersection of Massey - Tompkins Road and Raccoon
Dr. and as Baker Road extension was included in the Master Thoroughfare Plan by action
of the Planning & Zoning Commission and the City Council and will tie -in to Massey -
Tompkins Road at this point. The property has recently been sold and the new owner
indicates the he will construct an apartment complex at this location. Councilman
Walker koved to authorize the Administration to get one appraisal. Councilman Kloesel
seconded the motion. The vote follows:

Presentation Copies of Annual Audit - Gerace
James Gerace, CPA of the firm of Hullum & Gerace, submitted copies of the
annual audit of the City of Baytown to members of the Council. He stated that the
accounting of the was found to be in excellent condition and the City was also, in
excellent financial condition. Should the Council have questions: regarding the
report at the conclusion of their study, Mr. Gerace will be asked to meet with them.
Rugus Bergeron Park
Councilman Walker moved to approve the recommendation of the Parks and Recreation
Committee and adopt a resolution to change the name of the Kentucky Street Park to the
Rugus Bergeron Park, with appropriate sign to be erected upon the premises. Council-
man Hullum seconded the motion. The vote follows:

A UNANIMOUS RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
RECOGNIZING THE MANY FINE CONTRIBUTIONS THAT THE LATE RUFUS BER-
GERON MADE TO THE GREATER BAYTOWN AREA; FORMALLY NAMING A PUBLIC
PARK IN HIS HONOR; AUTHORIZING AND DIRECTING THAT THIS RESOLUTDN
BE EXECUTED BY THE MAYOR AND CITY CLERK AND THAT A CERTIFIED COPY
THEREOF BE PRESENTED TO MRS. BE RGERON; DIRECTING THE CITY PARKS AND
RECREATION DEPARTMENT TO HOLD AN APPROPRIATE DEDICATION CEREMONY.
Baytown Health League Budget
Copies of the Baytowh Health League's budget were passed out to the Councilmen
for study. This will be placed on the agenda for discussion at the next regular
meeting.

Emergency - Replace Motor Water Well Baker Road
Due to an emergency which has arisen at the Baker Road wellsite, Councilman
Hull= moved to declare an emergency and authorized the City Administration to purchase
a new motor without taking bids. Councilman Fanestiel seconded the motion. The vote
follows:

Bridge Tri -City Beach Road - Houston Lighting and Power Company
Councilman Kelley moved to approve the plans of Houston, Lighting and Power
Company for the construction of a bridge crossing Tri City Beach Road for the intake
canal. Councilman Hullum seconded the motion. The vote follows:

U. S. Steel Application - Discharge Waste Water Cedar Bayou
Mr. Lanham reviewed the notice from the Texas Water Qualify Board relating to
hearing on application of U. S. Steel to discharge waste into Cedar Bayou. In addition,
he had information from Mr. Spitz on their plans who stated that only 2,000,000 to
3,000,000 gallons of water will be discharged from Phase I and Phase II of their plant.
The application is based on what their ultimate needs may be. Councilman Kelley moved
to authorize the Mayor's expenses to Austin when the Hearing is held, Councilman Kloesel
seconded the motion. the vote follows:

The air & Water Conservation Board of Baytown will hold a meeting with Mr.
Spitz in the Conference Room Of the City Hall on Tuesday, January 28th at & 7:00 p.m.
Following this meeting, the Council will hold a special meeting to hear the recommend-
ation of the Chairman of the Board. This will be held Thursday, January 30th at noon.
Resolution - Recognizing Anniversary - Goose Creek
Councilman Kelley moved to adopt a Resolution recognizing the 50th anniversary
of Goose Creek with the announcement that a formal celebration will beheld on January
28, 1969 as a fitting tribute to this great occasions Councilman Hullum seconded
the motion. The vote follows:

TION OF THE CITY OF GOOSE CREEK, TEXAS, TO BE HELD ON SUNDAY,
JANUARY 26, 1969, AT THE COMMUNITY CENTER OF THE CITY OF BAYTOWN
TEXAS; AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO
EXECUTE THIS RESOLUTION.
Adiourn
There being no further business to come before the Council, the motion was made
and seconded bat the meeting adjourn. The ayes were unanimous and the Mayor Pro Tem
declared the meeting adjourned.
