1967 11 09 CC Minutes4437 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN November 9, 1967 The City Council of the City of Baytown, Texas, met in regular session on Thurs- day, November 9, 1967 at 5:00 o'clock p.m., in the Council Room of the Baytown City Hall with the following members in attendance: Patrick Ball Glen Walker Don Al. Hullum W. M. Braswell Albert Fanestiel Lamar Kelley Councilman Councilman Councilman Councilman Councilman Councilman Seaborn Cravey Mayor Fritz Lanham City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order. the Invocation was offered.afterwhich, the Mayor called for the minutes of the October 12th and 19th meetings. Councilman Fanestiel moved to approve the minutes as submitted in written form. Councilman Braswell seconded theimotion. The vote follows: Ayes: Councilman Walker, Hullum, Braswell. Fanestiel and Kelley Mayor Cravey Nays: None Approve Payment - Brown G Root - Commerce Street Improvement The City Manager introduced and read an ordinance accepting the work of Brown & Root. Inc. on the construction of the permanent paving of Commerce Street from_the South line of Forrest Street to the north line of Gulf Street within the City of Baytown. Councilman Walker moved to adopt the ordinance as read. Councilman Fanestiel seconded the motion. The vote follows: Ayes: Councilmen Ball, Walker, Hullum, Braswell. Fanestiel and Kelley Mayor Cravey Nays: None The caption of the ordinance follows: ORDINANCE NO. 900 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, RECEIVING AND ACCEPTING THE WORK OF CONSTRUCTION OF PERMANENT PAVING AND OTHER IMPROVEMENTS WITHIN THE FOLLOWING DEFINED PORTIONS OF COMMERCE STREET IN THE CITY OF BAYTOWN; AUTHORIZING AND DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL ASSESSMENT CERTIFICATES TO BROWN & ROOT, INC., THE CONTRACTOR PERFORMING SAID WORK; APPROVING THE FORM OF SUCH SPEQAL ASSESSMENT CERTI- FICATES; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Approve Purchase Used Winch Truck Councilman Braswell ,moved to approve the purchase of a used winch truck - purchase price. $990.00. Councilman Hullum seconded the motion. The vote follows: Ayes: Councilmen Ball, Walker, Hullum, Braswell. Fanestiel and Kelley Mayor Cravey Nays: None Approve - Final Payment Brown G Root, Inc.. Beaumont Street Improvement After receiving a report and recommendation from A. J. Busch. Jr., for acceptance of Beaumont Street improvement, Councilman Braswell moved to accept the recommendation for acceptance and final payment to the contractor for the improvement of Beaumont Street. Councilman Walker seconded the motion. The vote follows: Ayes: Councilmen Ball. Walker, Hullum, Braswell, Fanestiel and Kelley Mayor Cravey Nays: None 4438 % (, ct' .7 Discussion - Construction Eight -Inch Water Line -- Sterling and Price Streets The Council discussed the proposed installation of an eight (8') inch water main along Sterling and Price Streets to provide looping of the line with an existing eight (8') inch main on West Texas to provide additional pressure to the San Jacinto Hospital and Sterling Library area, as well as permit the installation of fire hydrants which are needed. The San Jacinto Hospital is presently served from a six (6') inch main on Decker Drive and the Hospital Administrator has complained of low pressure and sediment in the water. Too, the Hospital will take bids for additional construction in January, 1968. The Council talked of other proposed building within the area and a need for a more detailed study of the area in order to determine if an eight -inch line will be of sufficient size for future growth. Mr. Brown, the Administrator of San Jacinto Hos- pital, was assured that remedial steps will be taken by fie City, but further study needs to be made in realtion to the entire area. Councilman Fanestiel moved to table the request, until the next regular meeting. Councilman Ball seconded the motion. The vote follows: Ayes: Councilmen Ball, Walker, Hullum, Braswell, Fanestiel and Kelley. . . Mayor Cravey Nays: None The City Administration will give additional study to the project and submit a recommendation at the next meeting. Councilman Braswell will assist them in the study. Retain Used Garbage Truck - Haul Sludge City Manager Lanham asked permission to retain one of the used garbage trucks which is scheduled to be used as a trade -in on a new truck, in order for-it to be con- verted into a truck for hauling sludge from the West Main and East District Sewage Treatment plants. Councilman Fanestiel moved to approve the retainage of one used garbage truck and assign smse to the Sewer Department for hauling sludge. Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Ball, Walker, Braswell, Hullum, Fanestiel and Kelley Mayor Cravey Nays: done Request - Housing Authority - Cooperation Agreement for 250 Low Rent Apartments Mr. Lanham reported that the Housing Authority had asked that the Council consider their request for additional low-rent apartments. The Housing Authority Board would like for the Council to authorize the cooperation agreement for the 250 apartments; the Board could then make plans for construction. However, in order for final approval to be given by the federal government for this type construction, the City must have a workable program. The City is now studying a phase of this program in its review of a draft of an ordinance establishing minimum standards governing the use, occupancy and maintenance of dwellings. units and accessory structures under the Southern Standard Housing Code. The Council is not in agreement with the Code, and there is some question on whether or not zoning is required for a workable program. Should the Council authorize the cooperation agreement, it would tend to convey the idea that the ordinance would be adopted as written and there.is.some doubt of its passage at present. Councilman Ball moved to table the request, and bring it up after the Council is able to identify a workable program. Councilman Walker seconded the motion. Fanestiel and Kelley Mayor Cravey Nays: None 4439 Committee Reports Councilman Braswell, reporting for the Ambulance Committee, stated that he had been contacted by Mr. Navarre, with whom the City has a contract for furnishing ambulance services to the citizens of Baytown, asking to Council's permission to incorporate. He is now in business as an individual and his liability is somewhat higher than it would be as a Corporation, Mr. Braswell had no objections, but he we in doubt as to the legal steps to be taken in such a change -over. Mr. Lanham stated that he had been contacted by Mr. Navarre, and he would be placed on the agenda for the November 21st meeting, The Council cnuld then ask questions and make a decision upon the proposal, Councilman Walker reported that the efforts to raise the funds for the pre- liminary study of the proposed Lake Burnet Project has gone over the $6,000.00 figure; the amount required.as fee for the engineering services in the preliminary study, Councilman Ball reported that the Utilities Committee will be meeting with management of General Telephone in Baytown on Monday. November 13th, at 5:30 p.m. in the Conference Room to discuss and plan for the change and improvement of telephone service in Baytown on December 17th. Members of the Council were invited to sit in on the meeting if they so desired. City Manager's Report Bids on Janitorial service for the City Hall and Community Center will be received on November 13th. These will be submitted to the Council prior to the next regular meeting. Councilman Walker moved to set a special meeting of the Council for Tuesday, November 20th, to review the bid proposals on the Improvement of Ward Road and Daniel Street; the time of the meeting to be 5:00 p.m. Councilman.Braswell seconded the motion. The vote follows: Ayes: Councilmen Ball, Walker, Hullum, Braswell, Fanestiel and Kelley Mayor Cravey 1 Nays: None 1 Air. Lanham reported that Mr. E. C. Woods, an active member of the Senior Citizens Club, has approached him with a proposal that the Senior Citizens and Garden Clubs in the community be permitted to take the responsibility of planting trees and shrubs on the grounds according to the plans that have been previously approved by the Council. No objections.were offered by the Council, but the groups will be asked to work with the Parks G Recreation Committee on the project. The Council will postpone its meeting with the Port Authorities for two weeks or longer, Mr. Lanham reported that the Tax Assessor Collector has appraised the 400 square feet of land owned by the City and formerly used as a lift station site and the appraised price if $100.00. However, the City Attorney has stated that before the City makes any sale or contract for the sale of any property belonging to the City, opportunity shall be given for open competition. .Councilman Braswell moved to authorize the Administration to advertise for bids on the sale of the property. Councilman Hullum seconded the motion. The vote follows: Ayes: Councilmen Ball, Walker, Hullum, Braswell, Fanestiel and Kelley Mayor Cravey Nays: None Mr. Lanham reported that the sewer line on Bayway Drive has been installed, and connections will be made as the residents pay the required tapping fee. The City Attorney will file suit against Ready -Mix Concrete the first of next week to force them to clean up the premises.abutting upon Riggs Street,. Adjournment There being no further business to come before the Council, the motion was made and seconded that the meeting adjourn.
