MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF'BAYTOWN '
February 9, 1967
The City Council of the City of Baytown, Texas met in regular session on Thursday.
February 9, 1%7 at 6:30 p.m., in the Council Room of the Baytown City Hall with the
following members in attendance:

The meeting was called to order by Mayor Cravey, the Invocation was offereed, after -
which he called for the minutes of the regular meeting of January 26, 1967. The following
corrections were made: Hearina - Delinquent Grass Cutting Bills: The Council stressed
the need of having these errors filed immediately . . Equipment - Bowie School: An investi-
gation will be conducted on the possibility of getting matching federal or state funds
Drainage - Street Intersections: South Pruett at Dailey Street . . Committee Reports
Councilman Fanestiel gave a report . . . . . red blinkers will be installed at the inter-
section of Pruett and Pearce, Pruett at Sterling going west will stripe lane for traffic
turning right on Sterling. A traffic count will be made on East Texas . With these
corrections, Councilman Braswell moved to approve the minutes as amended. Councilman
Fanestiel seconded the motion. The vote follows:

After discussing several points relating to the overall construction, Councilman
Donnelly moved to accept the low bid and award the contract to Brown & Root, Inc.,
at a bid prive of $39,983.40. Councilman Braswell seconded the motion. The vote follows:

} A. J. Busch, consulting engineer, informed the Council that the bids on both the
storm sewer and street paving were disappointing, both exceeded the engineer's estimate.
In talking with the storm sewer contractors, they had expressed concern about the require-
ment to maintain traffic on North Main Street during the course of construction of the
storm sewer - they think this will cause the project to be both slow and tedious as
well.as expensive as they are required to furnish flagman to maintain traffic - plus,
the critical labor shortage. In talking with the low bidder on the storm sewer
construction, Stephens Construction Company, there is some indication that changes may
be made in the plans to reduce the cost of such installation by the contractor. Mr. Busch
pointed out that this is ethical procedure to negotiate with the low bidder and his re-
commendation was to allow the two, the City Manager Lanham and Mr. Busch, to negotiate with
Mr: S ephens for the reduction of the costs on the installation of the storm sewer.
they, in turn, will make a report on their findings at a later date. Mr. Fanestiel
suggested a possible delay agreement, Mr. Busch mentioned prior discussion with V. V.
Ramsey on the use of county labor and equipment, with the city furnishing pipe, on a
section of the proposed construction from Schilling Street to Bob Smith Road.which is
an old county ditch. Mr. Ramsey did not commit himself at the first approach but has
promised an answer the week of the 12th. (° Councilman Pat Ball arrives.) Other changes
were.suggested in relation to the storm sewer construction and it was the consensus of
opinion that new bids should be sought, if there is major modification in the present
plans. In view of all the discussion, Councilman Fanestiel moved to go out for new
bids on the storm sewer portion, stipulating modifications suggested - but Councilman
Braswell suggested that this type action be held up pending a report from the County.
Commission on the suggestion for county participation, with man -power and equipmment.,
in the laying of storm sewer in the old county ditch between Schilling and Bob Smith Road.
Should the County refuse to request, other changes would not warrant the delay of readver-
tising. Councilman Donnelly moved to defer awarding the contract on the storm sews in-
stallation until after the City Manager and Engineer have explored the possibility of
the County doing a portion of the work - following this another meeting will be held to
determine if the City should'readvertise or award a contract on the basis of the present
bids. Councilman Massey seconded the motion. Other discussion followed before Mayor

Consider Resolution - Sale of Municipal Bonds
Mr. Eddleman of Underwood, Neuhaus & Company, Houston brokers, introduced a resolution
authorizing notice of sale of bonds for the date of February 23. 1%7 in accordance with
the amounts approved by the City Council at its regular meeting of January 26th. In
the discussion following the reading of the resolution, Councilman Ball reaffirmed his
feelings on a closer 50 -50 division of bond sale as the City will not need all of the
funds derived from the sale within the next six months and the interest rate may be
stabilized by that time. Mayor Cravey agreed that he, too, would have favored a more
equally divided sale. Follwin_g the discussion, Councilman Fanestiel moved to adopt
the resolution setting forth the sale of $1,400,000 General Obligation Bonds, Series 1%7,
and $425,000 Waterworks. and Sanitary Sewer Revenue Bonds, Series 1%7. Councilman Massey
seconded the motion. The vote follows:

RESOLUTION NO. 159
RESOLUTION AUTHORIZING NOTICE OF SALE OF BONDS BOTH
.GENERAL OBLIGATION AND WATERWORKS AND SANITARY SEWER
.SYSTEM REVENUE BONDS.. SERIES, 1967.
Allen Cannon - Sanitary Sewer Service - Drainaae
Mr. Allen Cannon, a property ownertbo owns a lot on Donovan Street just north of 1
Knowlton appeared before the Council to request the installation of a sanitary sewer
service line along Donovan. He reported that there are twenty (20) lots involved
with eleven property owners. He has contacted eight (8) of the owners and-all have
expressed a willingness to cooperate with the city in the cost of the installation.
Only two property owners on the street have sewer service and prior negotiations for
such extension have been fruitless - it seems that it will be necessary to•install a
lift station for the existing line. The property owners would like to tie -into the
existing line but this is not feasible. The City Engineer submitted a drawing and estimates
of cost on the installation of an 8 -inch sewer main with two manholes from Cedar Bayou
Road.to the property line of the Cannon lot - $3.835.00 - and a 10 -inch storm sewer -
line from Cedar. Bayou Road to the east side of the dead -end of Donovan Street - $3.820.00.
This will provide proper drainage for Donovan Street. The Council talked of a more
comprehensive plan for drainage with the.possibility of including Beaumont Street into
the system. Since talking with the City Manager, Mr. Cannon reported that he had talked
with the property owner of the large lot and he would grant the City permission to cut a sur-
face ditch to drain the water from Donovan to a.drainage ditch on Nolan Road, if the City
Engineer would survey the area to see if the water would drain to Cedar Bayou Road.
This would ss.isfy the property owners in relation to drainage; the main problem is
sanitary sewer facilities. After taling with the property owners and receiving a•
favorable reply to cooperate with the city in the cost of the sanitary sewer line,
Mr. Cannon stated that the estimated cost would be $5,160.00 to lay line to Knowlton
Road. Mr. Cannon stated that he had prepared an estimate of cost for his own information
and if the City will make the sewage facilities available to the property owners at the
end of Donovan, the property owners could bear the costs the entire length of Donovan
thus making the costs approximately 50 -50 basis. Councilman Ball mentioned that -if the
problem is worked out on a participation basis, the City will need a petition with
the property owner signatures for the records and moved that the request for sanitary
sewer service on Donovan Street be tabled pending the receipv,of a petition from the
group; the City Manager give more study to .the participation propsal in order to determine
the percentage of cost to be borne by the city and the property owners and upon comple-
tion of his findings, the request be referred back to the Council. Councilman Braswell
seconded the motion. The vote follows:

Councilman Ball moved to .table further discussion on the drainage until the City
Engineer has time to look at the alternates that have been discussed on the ditch -
also, running the storm sewer over to Nolan Road if there is a storm sewer on Nolan
Road and the City Manager with Mr. Cannon check on the willingness of Mr. Brewer to
grant the necessary easement for drainage in the event we put a ditch. Councilman
Braswell seconded the motion. The vote follows:

Ordinance - Annexinc Strip FM Road 1942
Councilman Donnelly moved to adopt an ordinance extending the city limits of
Baytown to annex a ten -foot strip along State F. M. Highway 1942. Councilman Massey
seconded the motion. The vote follows:

Ordinance - Amendina Buildina Code
-,The Council discussed the proposed amendments to the Building Code in accordance
with the recommendation from the Building Code Committee and presented at the last
regular meeting. Mr. Frost, Chief Building Inspector. stated that in the present
ordinance a permit could be taken out and wait three years before building but in the
new conditions if the permit, such permits will become invalid at the expiration of.
6- months; require mechanical ventilation or windows in restrains to meet the requirements
of the State law - portions of the recommended changes are taken from the new Southern
Building Code. Councilman Donnelly mentioned that some of the same wording is used in
the proposed Zoning Ordinance - he especially mentioned (1) of Subsection (g) which re-
quired a permit for the alteration, repair, improvement, to convert or demolish any
building or structure. The strict interpretation of the word repair would work a hard-
ship on persons who may have an emergency arise and had notime to get a permit for the
repairs. Councilman Braswell was of the opinion that if the word "repair" was removed
from the stipulated conditions nothing would be deleted from the purpose of the ordinance.
Other sections were mentioned but it was generally agreed that should the amendments work
a hardship, changes could be made as the need arises. Following a lengthy discussion,
Councilman-Braswell moved to adopt the ordinance amending the City's building code
as proposed by the Building Code Committee. Councilman Massey moved to amend the first
motion to.,delete the word "repair" from Section I- Paragraph (g) -(i) of the amended ordi-
nance. Councilman Ball seconded the motion. The vote follows:

Letter - Corns of Engineers Development of Goose Creek Stream
The §ouncil discussed the contents of a letter addressed to City Manager Lanham
relative to the proposed development of Goose Creek for navigation purposes.
Members of the Corps of Engineers met with the Council in 1966 and outlined the project.
Following this meeting, contacts were made with nearby property owners regarding spoil
areas but.no solutkn was found -on the source of funds for the development of dike and
levee and encasement of pipe lines in the area. Since there seems to be not enough
interest to warrant the dredging, it was proposed that the project be abandoned,. .
Following a short discussion, Councilman Braswell moved to table definite action upon
the contents of the letter at the next regular meeting. In the meantime contacts will
be made by the Administration and Council relative to the navigation project. Council-
man Ball seconded the motion. The vote follows:

Reguest - Oren Boise Street - Wooster Heights
The Council discussed the request of a property owner in Wooster Heights whose parents
had purchased a lot in the area in 1930 but no street had been provided for ingress or
egress evdn though a 50 -foot street dedication was made at the time the Wooster Heights
subdivision was filed for record. He was,now requesting that Boise Street be; opened,
so that he could get to the property. Councilman Ball moved to authorize the Administra-
tion to cut Boise Street and to use any available scrap material from other streets as
a base for the street. Councilman Massey seconded themotion. The vote follows: {

Resolution - Spur No. 201 Construction
Councilman Fanestiel moved to adopt a resolutim urging the Texas Highway Department
to take steps to hasten the completion of Loop 201 around and through the City of Bay-

IN ORDER TO HASTEN THE COMPLETION OF LOOP NO. 201 AROUND AND THROUGH THE
CITY OF BAYTOWN; AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO
EXECUTE THIS RESOLUTION AND FOR THE CITY MANAGER TO FORWARD A COPY OF
SAME TO THE GOVERNOR OF TEXAS, THE CHAIRMAN OF THE TEXAS HIGHWAY DEPART -

Resolution - Bridge over Ship Channel
Councilman Donnelly moved to adopt a resolutim requesting the Texas Highway Department
to undertake a study of building a bridge over the Houston Ship Channel near the Baytown
La Porte Tunnel and to proceed with the necessary steps to effectuate same. Councilman
Ball seconded the motion. The vote follows:

AN UNANIMOUS RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS
TAKING COGNIZANCE OF THE FACT THAT THE BAYTOWN -LA PORTE TUNNEL IS BECOMING
OVER - LOADED; THAT A BRIDGE OVER THE HOUSTON SHIP CHANNEL NEAR SAID TUNNEL
IS THE ONLY REAL SOLUTION TO LOCAL AND THROUGH TRAFFIC PROBLEMS AT THIS
POINT; REQUESTING THE TEXAS HIGHWAY DEPARTMENT TO UNDERTAKE A STUDY OF SUCH
PROJECT AND TO PROCEED WITH THE NECESSARY STEPS TO EFFECTUATE SAME; AUTHORIZ
ING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE THIS RESOLUTION AND
FOR THE CITY MANAGER TO FORWARD A COPY OF SAME TO THE GOVERNOR OF TEXAS,
THE CHAIRMAN OF THE TEXAS HIGHWAY DEPARTMENT, TO MR. RILEY CARMICHAEL AND

Propose Contest - Desionina New City Decal (Seal)
Councilman Fanestiel mentioned the interest than has been created in the project
to design a new city seal which will be more symbolic of the area and the activities
that occur. Since the interest is widespread, he proposed a contest similar to the
one now in progress on the landscaping of the City Hall and Community Center site -
the new city seal contest be placed on the same basis as the landscaping contest. He
further stated that should the Council favor this approach, he had a list of names he
would like to submit to start the project in full swing.1 This committee could then
set up the rules as well as the prizes which would be offered to the contestants.
In conjunction with this project, Councilman Braswell proposed that the same Committee
to instructed to enlarge the constest to include a new design which will replace the
one on the tunnel road which the Council authorized to be dismantled* at the last meeting.
He proposed that an appropriate design be placed on all roads coming into Baytown.
Councilman Ball reported that he had been talking with an artist in Dallas who is
connected with a firm which does Commercial Art packaging - this firm is interested in
designing a seal for the City of Baytown at no cost - the design is ready but the artist
copy in color and black and white are not ready, will be a possible delay of 2 -3 weeks.

If the Council is interested in a commercial firm doing this work on a professional basis,
he proposed that a decision be postponed until he could contact the artist representing
the firm. He was not sure if the commercial firm would want to compete yet he is embar-
rassed to press them for the artist copy since it is being done at no cost to the City.
However, he will be in Dallas the Tuesday following the meeting and will be prepared to
make a report at the next regular meeting. Councilman Donnelly then moved to defer fur-
ther discussion on the design contest until the next regular.meeting. Councilman Ball
seconded the motion. The vote follows:

Committee Reports
The City Manager was instructed to check and determine if there is a need for a
street light on West Defee near the drive -in mail box and at the east entrance to the
Lee High School Band Hall.
Councilman Donnelly reported upon the meeting of the Ambulance Committee and Mr.
Camp of Belfort Ambulance Service which resulted in a feature story in,the Baytown Sun
to educate the citizenry of Baytown on the ambulance availability and costs under the
new contract.
Councilman Donnelly reported that the City - School Joint Election Committee met and
found that there can be a joint run -df election - the time periods will permit the
school to set their time to coincide with the city as the 29th of April falls as a
favorable day. for'both school and city. The fringe precincts can be controlbd as
the Precinct Judge can operate the voting machine to block off .that section listing
the City candidates. The suggestion was to share the costs of the election equally and
a contract with the School District for the purpose of holding a joint run -off election
on April 29th. The School Board will take this into consideration at its February 27th
meeting. Councilman Ball expressed some objections to the holding a joint election
because of the cost items and the possibility of an uninformed vote turnout. Councilman
Fanestiel moved to accept the recommendation-of the Committee to hold the joint run -off
election and to work toward the complete consolidation in the following years. Council-
man Braswell seconded the motion. The mote follows:

Endorse Braun Bill - Conservation Board - Air Pollution Control
Mayor Cravey introduced and read a letter which he had received from the Air &
Water Conservation Board which,read in part:
"At a meeting of the Air & Water Conservation Board on February 1,
1%7, a discussion was held concerning water and air pollution control
bills pending in the State Legislature. The following motion was un-
animously passed by the Board:
"As a start toward better air and water pollution control, the
Air and Water Conservation Board recommends to the Baytown City
Council that it endorse the Braun Bill."
At the last meeting the Council had requested Councilman Braswell to meet with the
Board and determine which one of the bills they would recommend the City Council
endorse. The Braun Bill covers the entire State of Texas and gives the Health Officer
the right of entry. and the City right to bring suit against corporations rather than
individuals. In line with the recommendation of the Board. Councilman Braswell moved
that the City Council to endorse the Braun Bill and to send a copy of the endorsement

Mayor Cravey introduced and read a letter which he had received from W. H. Rouse,
President of Region 14, calling a meeting to discuss the Bylaws of the Houston - Galveston
Area Council and to receive suggested changes which will give samller cities more represen-
tation in the organization. The meeting will be held on Tuesday. February 14th at 7 :30
p.m., in the Bellaire City Hall. Councilman Braswell will attend the meeting to represent
the City of Baytown.
Swanson - Municipal Sales Tax
The City Manager was instructed to forward Bill T. Swanson a copy of a resolution
adoped by the Council in December, 1%6, in support of legislation to authorize a
city toAmpose a municipal sales tax on a permissive basis after approval by a majority
of the qualified voters of the city.
Citv•s Manaaers Report
The City Manager has received a request from interested parties who are planning
to purchase property on both sides of Beaumont Street for the City to improve-Beaumont
Street under the bond program. The total length of the street is 3,900 feet and these
interested parties are willing to pay for improvement on both sides of Beaumont Street
for a distance of 2,100 feet leaving a balance of 1.100 feet which would have to be
assessed from other property owners. The Mayor pointed out that the City has a policy
for this type improvement. If the parties are interested in the development, they must
present a petition with 51% of the property owner signatures requesting this improvement
and agreeing to bear their pro -rata share of the cost. The Council will accept the
petition and if funds are available. proceed with passing an initiation ordinance
for the improvement. Mr. Lanham will relate this decision to the parties.
Proposal - Mr. Ellifrit - Development Bowie School Park Site
As per instruction of the City Council, Mr. Lanham presented a proposal from
Mr. Ellifrit, Planning Consultant, on his fee for preparation of specifications for
bids on the development of Bowie Elementary School Park Site. He agreed to prepare all
drawings and specifications necessary to the taking-of bids -work involves planting, walks
paving, structures, play facilities and other features shown to the south of the
shcool building, including five (5) advisory trips to Baytown, ten copies of plans and
specifications, estimated time 45 days at a fee of $3,200.00. This is computed on
the basis of 9% of an estimated construction cost of $45,000.00 less the preliminary
planning fee of $850. Councilman Fanestiel suggested getting a group from the TSPE to
do the work on a volunteer basis. Councilman Donnelly moved to name Councilman Fanestiel
and Braswell as a Commiteee to approach the TSPE with the proposal to see if they will
volunteer their services in this civic project. Councilman Massey seconded the motion.

Councilman Ball gave a brief report onthe two meetings of the Parks & Recreation
Board. The group reviewed the drawing of the proposed Bowie Elementary City - School
site, Parks and Recreation Director applications were opened and considered. The qualify
of applicants was very good so interviews are being set up. Mr. Lanham will assit in
the selection. The Teen Council is being selected, two representatives from each High
School and Lee College plus Justin Killmeyer who is on the Board. A regular meeting
schedule was agreed upon, the 1st and 3rd Tuesdays of each month. - 7 :30 p.m. City Hall.

City Manager Lanham submitted an updated estimate of $34,414.00 to properly drain
Morrell Street and remove the dips which impede traffic because of their depth. The
estimate is based on construction of 840 -feet of storm sewer, installation of.four
catch basins, removal of the dips and resurfacing of the portion of the street presently
covered by the three dips. Mr. Lanham felt that this work should be done and suggested
that it be included, along with other streets, in the summer program. Councilman Ball
moved to, accept the recommendation of the City Manager to include this proposed con-
struction in the summer program of street improvement and maintenance. Councilman
Braswell seconded the motion. The vote follows:

Mayor Cravey read a letter which he had received from A. N. Johnson. Chairman of
the Chamber of Commerce Beautification & Cleanup Committee requesting that the City
Council consider the Watermelon Red Crepe Myrtle as the city flower or shrub. The
Garden Clubs are unanimous in their desire that this shrub be chosen as it is particu-
larly suited for our area. The Council agreed that.this shrub was the better selection.
Councilman Fanestiel moved to pass a resolution adopting the Watermelon Red Crepe
Myrtle as the official flower of Baytown. Councilman Braswell seconded the motion.

Upon recommendation of the City Manager, Councilman Ball moved to authorize Leo
Frost and Lindsey Lawless to install the electrical traffic signalization at Garth
and Baker Road intersection, work to be done on Saturday of the week and the City
Manager be instructed to pay them.for this work on an overtime basis. Councilman
Donnelly seconded the motion. Ire vote follows:
