1966 09 08 CC Minutes4201 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYOWN September 8, 1966 The City Council of the City of Baytown, Texas met in regular session on Thurs- day, September 8, 1966 at 6:30 p.m., in the Council Room of the Baytown City Hall with the following members in attendance: *• Patrick Ball Councilman C. Donnelly Councilman * Seaborn Cravey Mayor Fritz Lanham City Manager George Chandler City Attorney Jaunice Rawlinson Acting City Clerk Absent: Edna Oliver City Clerk The Mayor called the meeting to order, the Invocation was offered, afterwhich he called for the minutes of the special meetings of August 8th and August 25th and the regular meeting of August 25th. The following corrections weremade: August 8th - B. T. Sines - Vice President SPRR - U. S. Steel representatives said they would have to have a $30 rate to move the steel from Cedar Point to Houston. The Council vote d to hire Roy Williams, consulting engineer (not employed by Humble) as a consultant to the Council. August 25th - Consider Ordinance requiring fencing of swimming pools. -.Councilman Braswell voted Nay. Resurfacing of Airhart Drive - Re- moval of culverts from ditches on the West side of Airhart Drive. One or two other minor corrections were made, afterwhich Councilman Donnelly moved to approve the minutes as corrected. Councilman Fanestiel seconded the motion. The vote follows: Ayes: Councilmen Ball, Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None Bids - Mud Jack Two bids were received on the advertisement for purchase of a mud jack. The tabulation follows: Brown -Fogle Equipment Company Koehring $1,345.00 - 30 days R. B. Everett and Company Hydra -Jak $1,627.00 - 30 days Mr. Lanham pointed out that both bids met the specifications but that the more ex- pensive machine had some features that would be advantageous to the City. Each machine was discussed as to its individual features and capabilities, afterwhich Councilman Fanestiel moved to accept the bid of R. H. Everett and Company. Council- man Braswell seconded the motion. The vote follows: Ayes: Councilmen Ball, Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None Equalization Board Annual Report The Council heard a report from R. H. Pruett, Chairman of the 1965 Equalization Board, relating to its meetings and hearings conducted for the tax year of 1966. The contents of the report included the general hearings of the citizens. The board made a request and four recommendations. The request of the Board of Equalization was that of Mrs. Kathryn Bayne, part owner and representative for the Busch Estate properties located at Park Street and Decker Drive. She requested that the penalty and interest be waived on property Minutes Baytown City Council 4202 September 8, 1966 tax identified as Tract D-18, Harvey Whiting Survey, for the two years of 1963 and 1964. During these two years the property was billed in the name of T. C M. Corpor- ation. Later it was discovered, by the Tax Office, to belong to the Busch Estate and It was promptly billed. Councilman Braswell moved to forgive the penalty and interest for the years 1%3 and 1964 with the understanding that the taxes be paid.during the month of September,- -1966. Councilman Ball seconded the motion. The vote follows: Ayes: Councilmen Ball, Massey. Hullum and Braswell Mayan Cravey Nays: Councilmen Donnelly and Fanestiel The four recommendation in the report are: . (1) All property roll having less than $100 assessed value and cannot be com- bined with like properties on the same roll, be exempt from taxation. The reason being the cost of handling exceeds the revenue gained. (2) The Council allow the Tax Assessor and the Director of Finance -to review the delinquent Personal Property rolls for uncollectable taxes. Having determined these itees, proceed to delete them from the tax roll and controls thereof, destroy and report to the Council the total tax dollars of such action. ' (3) Let this Council clarify some of the generalities of the Resolution passed November 29, 1%2, with reference to policies for taxation of industrial properties. 1. Who is to determine what is heavy manufacturing industry. 2. Who determines the time of annexation according to the resolution. 3. How and where the Tax Assessor gets authority to assess properties out- side the city limit lines. 4. That the Council or City Manager discuss with the Tax Assessor the problems confronted by this policy. (4) That there be one man added to the personnel of the Tax Office. preferably one full time basis, if not,•at least part time of not less than six months. Reason being the rapid increase in new improvements and our request that the Personal Property be handled on a personal contact basis in order to maintain its present level. Councilman Ball moved to accept reommendations one and two with number two amended to read: "Having determined these items, proceed, with the approval of the Council, to delete them from the roll and controls thereof, cancel and report to the Council the total tax dollars of such action." Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Ball. Hullum and Braswell Mayor Cravey Nays: Councilmen Massey and Donnelly. Councilman Donnelly stated that he thought the Council acted hastily without full knowledge of the affect that some of the recommendations will have. He felt that there was not any need of urgency. Estimates - East Nazro to Sunset. Miriam to Sunset Drive & Briarwood to South Main At the August 25th meeting Mr. M. P. Fuller submitted petitions from residents in Wynnewood and Lawndale Additions requesting the City Council and Missouri Pacific Railroad Comapny to consider the opening of a city street to connect the existing streets of Nazro and Sunset Drive. should Parkway Drive be closed. Mr. Lanham presented to the Council estimates of the three extensions. They are as follows: Miriam to Sunset Drive - $20,890.00; East Nazro Street to Sunset Drive - $7,000.00; Briarwood to South Main Street - $19,754.00. These estimates do not include any right -of -way property that may have to be purchased. The three extensions were discussed at length, afterwhich Councilman Donnelly moved to make this proposal to MOP: That Parkway Drive be closed; the extension from Parkway Drive to Alexander Drive not be built as they had proposed, and in lieu of this that MOP pay for construction of a 29' street extension from East Nazro Street from Layton to Sunset Drive; furnish the right -of -way to build the street and dedicate it to the City. Councilman Ball seconded the motion. The vote follows: Ayes: Councilmen Ball, Massey, Hullum, Braswell. Fanestiel and Donnelly. Mayor Crevey Nays: None • Councilman Ball excused from meeting. 4203 Minutes Baytown City Council September 8, 1966 Plans - Paving of Daniel Street and Wye Drive Johnny Busch, Consulting Engineer, presented to the Council plans and estimates on the paving of Daniel Street and Wye Drive. The cost estimated on Daniel Street is $25.110.09. $12.544.90 is this is City right -of -way and $12,565.19 is Missouri Pacific right -of -way. Mr. Busch stated that part of Daniel Street is a dedicated street and part of it is not a dedicated street, but is Missouri Pacific right -of- way, which has been used by the residents of the area as an access. Mr. Busch pointed out that the people living along the railroad right -of -way cannot be assessed for the street improvement. Missouri Pacific has indicated that they will pay 100% of the cost of improvements on the part that abutts their property and a reasonable amount of the paving of the dedicated part of the street. Mr. Busch requested authorization from the Council for Mr. Lanham and himself to meet with MOP Officials and discuss further the problem of assessment. Councilman Donnelly moved to,authorize Mr. Lanham, Mr. Busch and Air. Morton, City Engineer, and any of the oth9r Councilmen who are interested to meet with ATOP Officials and report back at the next regular council meeting. Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey. Nays: None The cost estimate on Wye Drive is $34,221.61. The plans were discussed by the Council. Mr. Busch suggested that since the Daniel Street and Wye Drive were both small projects that they be included in one contract when let out for bids. Report - Construction of City Hall and Community Center Mr. A. H. Howard, Inspector for the City Hall and Community Center, presented to the Council Construction Report 82 on the two buildings. The Contractor has been at work on the job 55 days since signing the contract. Rain has occurred on ten of these days. The lower level floor slabs and foundations have been completed and the waterproof membrane installed. The walls of the basement have been poured on.the south, east and partially on the west wall, comprising a total of about 60% of the basement and the lower level walls. The remainder of the forms on the lower level are being erected and the steel tied. Basement wall pour complete, September 8, 1966. Foundations for Community building have been drilled and poured except for about 12 small fottings for canopy, etc. On the Community building, the structural grade.beams have been approximately 30% excavated in preparation for setting of forms and tying steel. CATV Franchise Ordinance - Second Readina Councilman Donnelly moved to approve the second reading of the CATV Franchise Ordinance No. 812. Councilman Fanestiel seconded the motion. The vote follows: Ayes: Councilmen Hullum, Braswell, Fanestiel and Donnelly. Mayo Cravey Nays: None Ordinance - Amending Impounded Vehicle Ordinance Councilman Braswell moved to adopt an ordinance amending the Impounded Vehicle Ordinance. Councilman Fanestiel seconded the motion. Mayor Pro Tem Braswell presides. Ordinances - Condemnation - North Main Right -Of -Way Property Mr. Lanham gave a status report on the North Main right -of -way. Thirty -two deeds have been signed, Six are still in -the process of talking. On fifteen parcels it is necessary to institute condemnation proceedings. Mr. D. G. Riley -,who owns property abutting upon North Main Council with a request to be paid 55t per square foot instead of being, he will be losing more property than anyone else for the Riley's request was discussed, afterwhich•the Council denied the explanationthat if they granted this to Mr. Riley, there would a would want their price adjusted. WALKER CONSTRUCTION COMPANY, INC. FOR THE•ACQUISITION OF CERTAIN INTERESTS IN CERTAIN LANDS. YOUNG AND WIFE, DOROTHY YOUNG FOR THE ACQUISITION OF CERTAIN INTERESTS IN CERTAIN LANDS DESCRIBED IN SAID ORDINANCE REQUIRED FOR PUBLIC USE FOR STREET, ROAD AND HIGHWAY PURPOSES, IN FEE SIMPLE, REQUIRING THAT SUCH OFFER BE ACCEPTED WITHIN FIVE DAYS; DIRECTING THE CITY ATTORNEY TO BRING CONDEMNATION PROCEEDINGS IN THE EVENT SUCH OFFER IS REFUSED; PROVIDING FOR THE EFFECTIVE•DATE HEREOF. 0 Councilmen Fanestiel and Hullum excused from meeting. 4207 Sidewalks - New Subdivisions Johnny Busch, local engineer, urged the Council to make a decision relative to sidewalks in new subdivisions. He-stated that he,was in the process of finishing up a new subdivsion off Kilgore Road and.needed a decision as soon as possible. He said he would like to see the present subdivision ordinance amended and include sidewalks in the Building Code. The Council agreed to consider the recommendation of the Building Code Study Committee at the new regular meeting.,. This would give the Council members that were not present at this meeting time to study the report. Committee Reports Councilman Ball reported on the negotiations with Mr. 0. 0. Shields and the Baytown Gun Club relative to the ingress and egress to a piece of property which the Gun Club uses as a rifle range. Councilman Ball and Donnelly.met with both parties Involved and discussed the problem, afterwhich they recommended Mr. Shields find a way to get onto the back of his property without going past the firing line of the Gun Club, which he said he could do. The Committee indicated to.him that this would be a temporary situation until the peak firing season is over. The Gun Club stated that they would make a study and come up with a plan to rearrage or redesigf their ranges to try to afford,-!protection, not only to Mr. Shields, but also to free the road going down the South side of the back portion so that trucks would not inter- fere with their firing. Councilman Ball stated that he thought that while the Council had cooperative parties it would be advantageous for the City to try to obtain an easement across the corner of Mr. Shields property. Mr. Shields expressed an agreement to work some- thing out along this line. City Manager's Report Mr. Lanham presented to the Council a periodical report on the status of the paving liens of the City. The total unpaid liens remaining the Street and Drain- age Improvement Fund, Series 1958 is $10,648.52 and the total unpaid liens in the General Fund is $11,093.60. Councilman Ball moved to authorize the City Attorney to write letters to the property owners that are delinquent, pointing out the in- debtedness and the accruing :interest, the fact that it is a lien against the pro- perty which will eventually have to be paid, to encourage those who have not made any payments, to do so if possible. Councilman Massey seconded the motion. The vote follows: Ayes: Councilmen Ball, Massey and Donnelly. Mayor Pro Tem Braswell Nays: None Bids on the.East District Sewage Treatment Plant are scheduled to be opened Thurgday, September 15, 1966 at 5:00 p.m. Mr. Lanham reported that the City's application for a permit was considered by the Water Pollution Control Board and was approved. Mr. Lanham stated that after the Council had reviewed plans for the plant, Mr. Turner noticed that a building had not been provided for the pumps and blowers. Mr. Turner would like to change the plans to permit construction of a metallic type wilding 56' long and 18' wide. This would increase cost.of con- struction of the plant about $4,000.00. The total amount would be $309,000.00 Mr. Lanham presented a request to the Council from a property owner on North Main who has 604'of fence on the proposed right -of -way. The fence was appraised at 10� per.foot. The owner has a bid proposal to move the fence back and it is 35� per foot. The property owner wants the City to agree to pay for moving of the fence. Councilman Donnelly moved for the City to get a bid on the moving of the fence and pay the difference of the appraisal and the bid. Councilman Massey seconded the motion. The vote follows: Ayes: Councilmen Ball, Massey and Donnelly. Mayor Pro Tem Braswell Nays: None , The City Manager reported the appraisals on South Main have been turned in to the County. The appraisers have promised to give the City some of the appraisals on Davis Road on the 9th and the rest of them by the end of the ne)t week. 9208 Councilman Donnelly temporary Chairman for the Committee for Decent Literature, reported that the Committee will have a meeting Tuesday, September 13, 1%6 at 7 :30 p.m. at the K of C Hall, 2600 West Main. Mr. Lanham announced the annual picnic for the employees of the City. It is to be held September 29. 1966 at Roseland Park. He invited all the Councilmen, Mayor, their wives and children to attend. He mentioned that service awards are givenrd this time for employees who have been with the City for 10 and 20 years and watches are given for employees who have beenayt th the City for.25 years. He stated that the City has no provisions for those /retiring. He asked and received permission from the Council to award watches to those employees who are.retiri:ng. Adiournment Councilman Ball moved for the meeting to adjourn. Councilman Massey seconded the motion.
