MINUTES OF THE SPECIAL MEETING OF THE
CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS
July 1, 1966
The City Council of the City of Baytown, Texas met in special session on Friday,
July 1, 1966 at 4:45 p.m. in the Council Room of the Baytown City Hall with the
following members in attendance:

The Mayor called the meeting to order, the Invocation was offered afterwhich,
the following business was transacted:
Assignment Civic Center Contract - Bayport Construction Company
The Council reviewed the request of the W. R. Grimshaw Construction Company,
successful bidder for construction of Civic Center, to assign the Construction Contract
to the Bayport Construction Company of Baytown at no change in the contract price or
terms of contract. The Council was concerned because of claims that may be made against
the city by subcontractors who have purchased materials and surplus stock,on the
basis of the Grimshaw Construction Contract. Mr. Rivers, a representative of the
Grimshaw Constructim Company, assured the Council that no contracts had been signed 17
with sub - contractors, however, he was will ing to execute an indemnity - agreement for
the protection of the city should any disagreement arise relative to the change. Aside
from this agreement, the Bayport Construction Company will assume, in toto,' all rights,
privileges, and obligations that the Grimshaw Construction Company holds and in
addition furnish the City with the Payment and Performance Bond as ,set forth in-the
original contract requirements. After some further questioning, Councilman- Donnelly
moved to permit the assignment of the Grimshaw Construction Company's construction
contract for the Civic Center to the Bayport Construction Company of Baytown, conditioned
upon the execution of the indemnity agreement by Grimshaw Construction Company for
the protection of the City of Baytown and the filing of the required Payment and Per-
formance Bond direct to the City by the Bayport Construction Company of Baytown. Council-
man Fanestiel seconded the motion. The vote follows:
Ayes: Councilmen Massey, Fanestiel, Ball and Donnelly.

Approve - Repair Driveways - Alabama Street
City ,Manager Lanham reviewed the problem presently existing on Alabama Street
relative to the driveways and the guide lines adopted by the Council to justify the
City bearing the cost of such repair. To date forty -nine driveways have been repaired
under the guide line; twenty -four remain unrepaired. Money spent to (late on the additional
driveways, moving dirt, ets., is approximately $4,400 and Mr. Morton estimated an
additional $900 would repair all of the remaining driveways. After some discussion,
Councilman Ball moved to approve the $900 additional expenditure for the repair of
the remaining driveways on Alabama Street. Councilman Massey seconded the motion. The
vote follows:
Ayes: Councilmen Ball, Massey, Fanestiel and Donnelly.

City Purchase Pipe - Garth Road Extension - Deduct from Contract Price
Mr. Lanham reported that, under the City's present pipe contract with Black -
Broiller Company, the City can buy pipe cheaper than the contractor, Brawn C Root, Inc.
for the Garth Road Extension project; Black - Broiller Company has agreed to furnish
the pipe to the City and this can be deducted from the original contract. However,
the Contracts, Brown G Root, Inc., is not willing to give the City the full savings.
Even though the City will not benefit from the full savings, it will amount to about
$1,750.00. After some discussion, Councilman Donnelly moved to approve the City
furnishing the pipe for the project and $1,750.00 be deducted from the price of the
original contract; pipe footage quantity the same as set forth-in the original contract.
Councilman Alassey seconded the motion. The vote follows:
Ayes: Councilmen Ball, Massey, Fanestiel and Donnelly.

Miscelleanous
Officials of the Missouri - Pacific Railroad will be hosts to members of the City
Council on Wednesday, duly 6th, for lunch at the Goose Creek Country Club.
The Council received an invitation from officials of the General Telephone Company
to have dinner and attend the ball game at the Astrodome on Wednesday evening, July 6th.
Adiournment
Councilman Ball moved for the meeting to adjourn. Councilman Fanestiel seconded
the motion. The ayes were unanimous and the Mayor declared the meeting adjourned.
