1966 06 23 CC Minutes4150 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOM, TEXAS June 23, 1966 The City Council of the City of Baytown, Texas, met in regular session on Thursday, June 23, 1966 at 6:30 p.m. in the Council Room of the Baytown City Hall with the following members in attendance: C. Donnelly Seaborn Cravey Fritz Lanham George Chandler Edna Oliver Absent: Patrick Ball Councilman Councilman Councilman Councilman Councilman Mayor City Manager City Attorney City Clerk Councilman The Mayor called the meeting to order, the Invocation was offered, afterwhich he called for the minutes of the June 9th regular meeting and the June 15th special meeting. Councilman Hullum moved to approve the minutes with the following corrections, Reaular: Alabama Street: "Some concessions were made . . . May 12th meeting without sufficient information relating to the problem and met in regular session on Thursday, June 9th." Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None Bids - Garth Road Extension - Park to Decker The bids on the Garth Road extension, from Park to Decker, were submitted for Council approval. Busch, engineer, reviewed the items tabulated, the base bid requirement for 7" concrete pavement, the alternate of 10" cement stabilized shell base with 1,�" hot mix asphalt, the sodding of esplanade and the alternate using 4" cement stabilized base with 1" hot mix asphalt. It was his recommendation that the Council select the paved esplanade and concluded his resume with the recommendation that the contract be awarded to Brown & Root, Inc. on the alternate method of paving using shell base with hot mix asphalt topping plus the paved esplanade at a total project bid of $170,538.60. After some further discussion, Councilman Braswell moved to award the con tract for paving Garth Road extension, from Park to Decker, to Brown & Root, Inc. on the basis of the alternate paving and the 4" stabilized shell base on esplanade, total amount of $170,536.60. Councilman Fanestiel seconded the motion. The vote follows: Ayes: Councilmen Hullum, Braswell and Fanestiel Mayor Cravey Nays: Councilmen Massey and Donnelly 4151 Bid - Mapleton Road For Sanitary Sewer Construction Only one bid was received on the Advertisement for construction of a 6' cast iron force main on Mapleton Road between Lift Station No. 3 and Crow Road. This bid was submitted by Bayshore Construction Company at a total project bid of $4,062.80. The construction project had been properly advertised but no interest was shown by contractors because of its size. Councilman Hullum moved to award the contract to Bayshore Construction Company on the basis of the bid, total project cost, $4,062.80. Councilman Massey seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None Bids - Tractor with Mower Attachment The bids on the tractor with mower attachment are tabulated as follows: Kemp G Tony's Equipment Company International $1,675.00 Lansdowne -Moody Co., Inc. Ford $2,014.59 Councilman Donnelly moved to accept the low bid of Kemp B Tony's Equipment Company on the International Lo -Boy net bid of $1,675.00. Councilman Hullum seconded the mo- tion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey - Nays: None Bids - Vibrating Roller Only one bid was received on the advertisement for purchase of a vibrating roller but others had called and expressed an interest in bidding but received the notice too late to submit written bids. It was the recommendation of the administration that the bids be readvertised. Councilman Braswell moved to accept the recommendation of the Administration, the one bid be returned unopened and the bid specifications be readvertised. Councilman Donnelly seconded the motion. The vote follows: Ayes: Councilmen Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None Abstained: Councilman Massey Hearing - Proposed Sion Ordinance The Mayor opened the public hearing upon the use of advertising signs throughtout the city. He gave a brief explanation on the reasons for drafting such an ordinance, the work of the committee and gave opportunity to those attending the meeting to be heard should they have questions relating to the conditions and terms of the proposed ordinance. No one in the audience expressed an interest in being heard and after some discussion among the Council, Mayor Cravey appointed Councilmen Hullum and Massey and Leo Frost to meet with the original Sign Committee and review together the original and revised drafts and come to some agreement upon the terms of an ordinance which will not go beyond policy and reasonable terminology. Ordinance - Extending City Limits - FM Road 2354 Councilman Donnelly moved to adopt an ordinance extending the city limits along -FM Road 2354 from FM Road No. 565 to State Highway 73 under Tract No. 1 and under Tract No. 2 along Tri -City Beach Road as strip annexation. Councilman Hullum seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None 4152 The caption of the ordinance follows: ORDINANCE NO. 800 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, .TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 2.4 ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN,,TEXAS Discussion - Proposed Extension of AIP Railroad to US Steel Site A group of interested citizens, whose properties would be affected by or be in- cluded in the proposed routing of the Missouri Pacific Railroad's extension to the U. S. Steel site, met with the Council for an open discussion on the proposed routing which is not clear to the Council nor to the citizens at this time. Prior to this meeting, the Council had gone on record as opposing any route through the heart of the city and protests were submitted by Lamar Kelly, representing the Saint John Methodist Church and citizens in close proximity to the Church, Airs. Jones, Robert W. Rogers and others in Wynnewood and Lawndale Additions. Each person heard protested the proposed routing and sought an answer to the questions of their rights as property owners. At the conclusion of the discussions, Councilman Hullum moved to adopt a resolution requesting the railroad to select alternate routes as it believes the present planned expansion would result in major traffic hazards, be unsightly and contrary to the general health and welfare of all concerned and asks for a meeting and consultation withthe city officials to the end that a route may be selected that will benefit the company and the citizens of Baytown. Councilman Massey seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None The caption of the resolution follows: RESOLUTION NO. 110 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, ADVISING THE PROPER OFFICIALS OF THE MISSOURI PACIFIC RAIL- ROAD COMPANY THAT IT WANTS TO CO- OPERATE WITH MISSOURI PACIFIC AND ANY AND ALL OTHER PRIVATE AND CORPORATE CITIZENS WHERE SUCH CO- OPERATING IS ADVANTAGEOUS TO A MAJORITY OF THOSE CONCERNED; INFORMING MISSOURI PACIFIC THAT THE CITY COUNCIL BELIEVES, AFTER DUE STUDY AND CONSIDERATION, THAT AN OFTEN -USED AND HEAVILY - TRAVELED RAILROAD 'THROUGH THE CENTER OF BAYTOM WOULD BE UN- REASONABLE AND UNNECESSARY; RESPECTFULLY REQUESTING SUCH RAIL- ROAD TO SELECT ALTERNATE ROUTES WITH THE ADVICE AND CONSULTATION OF CITY OFFICIALS; PROVIDIN G FOR THE EXECUTION OF THIS RESOLUTION AND THE DELIVERY OF SAME TO THE OFFICIALS OF SAID RAILROAD COMPANY AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Copies of the Resolutirn will be certified and mailed to officials of the Missouri Pacific Railroad, Federal District Judge Joe Ingraham, the Interstate Commerce Com- mission and any other party interested in the proposed routing. Councilman Donnelly then moved to instruct the City Attorney to brief this question without delay to determine what jurisdiction the City may or may not have; if it is found feasible, that a petition be filed with Federal District Court asking that the City be heard on the question. Councilman Fanestiel seconded the motion. After some discussion for clarification of the reason for the motion the vote was called. Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None 9153 Water Service - 'Texas Highway Department Sour 201 City Manager Lanham reported that the City had received a letter from Mr. W. E. Carmichael, District Engineer of the Texas Highway Department, requesting permission to obtain water from a city fire hydrant located at Spur 201 and Missouri Street for use in washing the Baytown Tunnel. Presently they are obtaing water from the City,at the Lee Drive, Nazro Street intersection' but ne cu Ls o rmitted. to take water from a hydrant_except _ in- ca"- ot__asire. He recommended that the Highway Department be asked to continue getting the water pt the aforementioned locatim, or should the Highway Department be willing to pay for a water tap, this may be made at some point nearer the tunnel. Councilman Braswell proposed making a tap and setting a meter nearer the tunnel and after some discussion he moved to instruct the City Administration to find a suitable place, make a water tap, set a meter and provide water service for the State Highway Department in the same manner as any other customer with the Highway Department paying the required tapping fee. Councilman Donnelly seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel and Donnelly. Aiayor Cravey Nays: None. Civil Defense Plan - Presentation - Fletcher Hickerson Mr.. Fletcher Hickerson, Civil Defense Director of Baytown, Submitted a detailed plan for Baytown with several annexes. Thse plans are filed not only with Federal but state agencies as well and plans are so drawn as to meet the basic concept which was prepared in 1963 and is now being updated by the annexes. He concluded his report with the request for approval of the plans by the City Council. Councilman Donnelly moved to adopt the Civil Defense Plan and annexes as presented by Mr. Hickerson. Councilman Fanestiel seconded the motion. The vote follows: Ayes: Councilmen Massey, Braswell, Hullum, Fanestiel and Donnelly. Mayor Cravey Nays: None The Council was unanimous in its praise of the work that was being done by Mr. Nickerson and his co- laborers . Councilman Braswell pointed out that if fall- out shelters were deductible from the Income Tax more would be constructed and urged Mr. Nickerson and his panel to give this some study at one of the Civil Defense Council meetings. Amended Pawn Brokers' Ordinance Adopted Councilman Donnelly moved to adopt an ordinace amending the city's Pawnbroker Ordinance to provide for the registration of all property acquired and the posting of the notice of sales at public auction in three public places in Harris County, one of which places shall be the Baytown City Hall; such provisions to aid the Police Officers of the City to apprehend persons guilty of unlawful traffic in merchandise handled by Pawnbrokers. Councilman Massey seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None The caption of the ordinance follows: ORDINANCE NO. 801 AN ORDINANCE DEFINING THE TERM "PAWNBROKER "! PROVIDING FOR THE REGULATION AND OPERATION OF PAWNBROKER; PROVIDING FOR SUPERVISION AND CONTROL BY THE POLICE DEPARTMENT; REQUIRING A SURETY BOND; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED ($200.00) DOLLARS AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. 4154 Report Modifications To West Main Treatment Plant Plans - Ivan Langford Ivan Langford of Turner, Collie & Braden, Inc. Consulting Engimers, reviewed possible deductions and deletions from the West Main Sewer Treatment Contract approved at the June 15th meeting. The plans have been carefully reviewed and eight items which he submitted for council consideration, two of which carried his recommenda- tion for deletion, namely: (1) install owner furnished 12" C.I. pipe @ $1,380.00; and (2) Delete two -one ton chlorine containers @$400.00 each, $800.00 making the adjusted contract amount $365,415.00. Other possible deletions were reviewed, such as, (1) grating and supports for walkway on splitter box $ 396.00 (2) retaining wall, slab, steps and handrail adjacent to east side of existing plant office building 650.00 (3) foam spray system, including reworking of existing foam spray ststem 2,520.00 (4) Portable waterline from.sludge pump to west main street 300.00 (5) Asphalt surfacing and cement - stabilized shell base (Use 6- inch-of compressed shell for raods) 3,000.00 (6) Yoldy steel pipe for air supply main and sludge return line (use carbon steel) $3,800.00 Of these items, the council only approved the deletion of Nos. 3 and 5 to make a total of $5,520.00 plus the $2,180.00 totaling $7,700.00 to be deleted from the basic contract price of $365,595.00. After some discussion Councilman Braswell moved to instruct the engineers to issue a change order reflecting a reduction of $7,700.00 in the basic contract by the deletion of the four-(4) approved items outlined above. Councilman Massey seconded the motion. The vote follows: Ayes: Councilmen Massey, Hu1Lm, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None Fanestiel - Traffic Committee - Amending Speed Limit Regulations Spur 330 Councilman Fanestiel introduced a letter from the State Highway Department relative to a speed zone study which had been conducted along Spur 330 in Baytown for the purpose of determining reasonable and prudent speeds. The recommended speed was set forth in three different catagories of fifty, fifty -five and forty -five mph. The Traffic Committee, in making its study recommended only two speed zones along Spur 330, from a point 1637 feet northwest of Bayway Drive to a point 2429 feet northwest of Airhart Drive - fifty -five miles per hour and from a point 2429 feet northwest of Airhart Drive to a point 211 feet northeast of Airhart Drive - forty -five miles per hour. After some discussion, Councilman Donnelly moved to adopt the ordinance with the recommended speed zones as set forth by the Traffic Committee of the City of Baytown on Spur 330. Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None The caption of the ordinance follows: ORDINANCE NO. 802 AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF ARTICLE 6701D, VERNON'S TEXAS CIVIL STATUTES, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION, UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF BAY'TOWN, AS SET OUT IN THIS ORDINANCE; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PROVIDING A PENALTY AND THE EFFECTIVE DATE THBREOF. Some study will be given to the suggestion to install flashing traffic lights at Baker Road crossing, Midway -North plain intersection and Highway 146at Cedar Bayou Road crossing. 9155 Traffic Committee Report - Continued Other traffic discussions included the interconnected fixed time traffic light at Bayway Drive and Decker Drive, traffic signal light installations on a long -range program, double parking on Stimpson Street by Telephone Company requrested denied, permitted loading zone on East Wright to service Baytown Typewriter Exchange and investigation of possible removal of NO PARKING - TRUCK LOADING signs on South Ashbel street, between West Gulf and West Pearce. Committee Reports Councilman Donnelly reported that a complete CATV Franchise report will be forth- coming at the next regular meeting. Councilman Donnelly reported on the recent meeting with E. 0. Cambern, District Manager of the General Telephone Company. The Utility Committee and other administra- tive personnel will hold a joint meeting with representatives of the utility companies servicing Baytown to begin exploratory discussion on underground installations in new subdivisions. Councilman Donnelly expressed his opposition to the practice of visitors attending regular Committee meetings since, in his opinion, the primary purpose of committees is to work out details of any one given task or project for presentation to he City Council at an open regular or special meeting to which the public is invited. This action was taken as a result of two members of the Womens League of Voters attend- ing a regular meeting of the Parks Committee without invitation from members of the committee. Some comment was offered by the Council but no policy was adopted. Councilman Donnelly recommended issuing a citation to owners of property abutting Spur 201 toward the Baytowm Tunnel to appear at the office of the Baytown Corporation Court to explain why they are maintaing a trash dump within the City. Councilman Massey reported that the Committee appointed to study driveway openings recommended, due to the diverse nature of kinds of curbs and driveways throughout the entire city, to consider each request separately using the engineer's specifications as a guide post. Councilman Braswell reported that due to the lack of interest in the Goose Creek dredging project, he suspected the issue was dead but he would make ore other attempt to get a definite expression before the Corps of Engineers is notified of the decision. City Manager's Report The City Manager reported on the study of drainage in Brownwond Addition to relieve a pohding condition presently existing on Bayshore Drive near Crow Road intersection. At the June 9th meeting, Mr. Floyd, a resident of the area, suggested grades be run on Crow Road and at this meeting the City Engineer recommendation the installation of an 18 -inch culvert at the intersection of Bayshore Drive and Milner Street. Councilman Braswell moved to accept the recommendation of the City Enginer and approved the installation of an 18 -inch culvert at this point. Councilman Donnelly seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None Councilman Braswell requrested that the ditches be cleaned out in the area also. Mayor Cravey asked that the same -. type effort be made by the City Engineer to relieve the drainage situation which prevails on Bolster Street during heavy rains. Resolution - Authorizing Application for P.L. Grant 09 -117 Councilman Donnely moved to adopt a resolution authorizing filing for application with the Department of Housing and Urban Development, for a grant of $136,000.00 under P.C. 89 -117. Councilman Massey seconded the motion. The vote follows: 4156 Ayes: Councilmen Alassey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None The caption of the resolution follows: RESOLUTION NO. 111 A RESOLUTION OF THE CITY COUNCIL OF THE CIT OF BAYTONN AUTHORIZING FILING OF APPLICATION FOR P.L. 117 FUND IN THE AMOUNT OF $136,000.00. Ground breaking ceremony for City Hall and Civic Center construction will be held on Tuesday, July 5th at 4:00 o'clock p.m. A breakfast will be held on Monday, June ,27th at 6:30 a.m., for review of the appraisals of North Main Street. The breakfast meeting will be held at Holiday Inn. The City Manager and City Attorney were instructed to forgo any attempt to forclose on thirteen (13) delinquent tax suits where the persons involved are either elderly or handicapped in other ways to prevent payment of taxes to the City Adjournment Councilman Hullum moved for the meeting to adjourn.
