Donnelly Councilman Councilman Councilman Councilman Councilman Councilman Seaborn Cravey Mayor Fritz Lanham City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order, the Invocation was offered, afterwhich he called for the minutes of the special meetings of March 21, 18th, 31st and April 5th; the regular meeting of March 24th. With two minor corrections in the March 24th minutes, and one in the April 5th minutes, Councilman Braswell moved to dispense with reading of the minutes - they be approved ascorrected. Councilman Donnelly seconded the motion. The vote follows: Ayes: Councilmen Massey, Braswell, Hullum, Fanestiel and Donnelly. Mayor Cravey Nays: None Abstained: Councilman Ball Bids - Gasoline Contract for One Year Gasoline bids were tabulated from the following firms: Humble Oil G Ref. Co. (Dino) Regular .1575 Premium .1675 Humble Oil G Refining Company had the lowest bid and it was the recommendation of the Administration that the contract be awarded the Humble Company on the basis of the low bid. Councilman Donnelly moved to accept the recommendation to award the gasoline contract to Humble Oil G Refining Company for the ensuing year. Council- man Massey seconded the motion. The vote follows: Ayes: Councilmen Ball, Massey, Hullum, Braswell, Fanestiel and Donnelly. Councilman Hullum seconded the motion. The vote follows: Ayes: Councilmen Ball,. Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None Special Meeting Police Chief and City Manager The City -Council will hold a special meeting with the City Manager and Chief of Police on Tuesday, May 3rd at 5:00 o'.clock p.m., to review some of the policies of the Police.Department. Ordinance - Agreement for Installation Traffic Signal - Spur 330 and Bavwav Drive .The Council discussed the contents of an agreement with the State Highway De- partment for the installation of a three -dial, fixed -time, interconnected and coordinated traffic signal at the intersection of Spur 330 and Bayway Drive. The agreement provided that the City will operate and maintain the traffic light after its installation;' will pay all power costs; will obtain written approval before making changes in the design of operation; will return any and all parts should the signal be removed; and, will be responsible for the police enforcement required for securing obedience to the highway traffic signals. Such an agreement required the passage of an ordinance to be transmitted to the State of Texas for appropriate action. Presently this inter- section is a bottleneck in traffic movement during peak periods of the day. Council- man Massey suggested that the Administration negotiate with the State for installation of an actuary traffic signal rather than the proposed three -dial, fixed time traffic signal. He was instructed to inform the State Highway District Engineer that the Council was in agreement with all provisions of the instrument but preferred the origi- nal traffic signal installation to be an actuary type rather than the type set for t in the instrument. The Council.deferred action upon the proposed ordinance until the City Manager has submitted the Council's request to the State Highway District Engineer. Final Reading - Ten Foot Strip SP Railroad Councilman Donnelly moved to adopt, for final reading, Ordinance No. 785 -A which provides for the annexation of a 10 -foot strip along the right -of -way of the Southern Pacific Railroad. Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel, and Donnelly. Ordinance - Hearing Second Additional Annexation FM Road 1942 Councilman Donnelly moved to adopt an ordinance calling for a public hearing for the 12th day of May, 1966 at 6:30 p.m., in the Council Chamber of the City Hall on the proposed annexation of additional territory to State FM Road 1942. Councilman Massey seconded .the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Fanestiel and Donnelly. Ordinance - Hearing Annexation Riaht -of -Way Bohemian Hall Road Councilman Donnelly moved to adopt an ordinance calling for a public hearing for the 12th day of May, 1966 at 6:30 p.m., on the proposed annexation of additional territory along the right -of -way line of the Bohemian Hall Road. Mayor Cravey Nays.: None Abstained: Councilman Ball The caption of .the ordinance follows: ORDINANCE NO. 793 AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF SUCH PUBLIC HEARING AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Discuss - Comprehensive Plan Prepared Bernard Johnson Engineers City Manager Lanham asked the Council for its feelings relative to the Comprehen- sive Plan prepared by Bernard Johnson Engineers of Houston. The Company, which had been retained by a previous Council, had completed its study and submitted its final report several weeks ago. Some of the recommendations of the comprehensive plan are in the process of being implemented and others are now under study but no formal action has been taken by the Council relative to the plan. Mr. Lanham found in checking with other cities, that some City Councils have adopted the comprehensive as a general guide, while others have adopted the plan with certain exceptions. A majority of the Council gave expression of favoring the adoption of the Comprehensive Plan as a guide only, so that maximum use may be had of the detailed plan but no formal action was . taken at this time as the new council members had not made a study of the plan and were not familiar with its projected proposals. The Council will take formal action upon the Plan at the next regular meeting. Councilman Braswell expressed some concern regarding the downtown business area and the laxity of the group which is presently making a study of the district in relation to the Comprehensive plan. In his opinion, the Council will soon be faced with the traffic and parking ills and suggested getting some expression from the group upon .which way they wanthe Council to proceed in relation to the traffic pattern for the downtown area. 4124 Repairs of Storm Sewer in Country Club Oaks Jack Morton, Director of Public Works, submitted an estimate of $8,000.00 as cost for making necessary repairs to storm sewers in ,Country Club Oaks where head walls have given. away, erosion is prevalent where the storm sewers empty into Goose Creek Stream and the pipe has separated and washed away ,completely. If city forces are used in the repair project, he recommended the three major repairs be made in this year's budget. Should the Council choose to go out for bids. it would be more economical for the entire project to be considered, funds to be taken from Capital Street & Drainage Budgeted allocation. Councilman Fanestiel moved to instruct the City Engineer to prepare plans and specifications and advertise for bids on the repair of :the five (5) storm sewer projects. Councilman Donnelly seconded the motion. The vote follows: .. Ayes: Councilmen Ball, Massey, Hullum, Braswell, Fanestiel and Donnelly. Nays: Mayor Cravey Ordinance - Prohibiting Dumping of Dirt or Mud - Public Streets The Council discussed the draft of an ordinance making it unlawful for persons operating any motor vehicle upon the public streets to leave, deposit, drop or other- wise place dirt, mud, sand, gravel, concrete or other building and construction materials on city's streets and rights -of -way. It was suggested that possibly the City's litter ordinance would cover the violation and it could be used as a means of enforcement. It was suggested, also, that an amendment be made to the Litter Ordinance to include the specific items of material included in the draft; copies of the ordinance be furnished the Buidling Permit personnel for distribution to contractors, etc. The assistance of the Police Department in watching for violators will be solicited, also. The City Manager recommended, however, that any violation of this type should be covered under a sepazate ordinance as this is not generally thought of as littering. Councilman Fanestiel then moved to adopt the proposed ordinance with an amendment to include all debris as well as building mateiials, dirt, mud, etc. Councilman Donnelly seconded the motion. Mayor Cravey NaSs : Councilman Braswell The caption of the ordinance follows: ORDINANCE NO. 794 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN MAKING IT UNLAWFUL TO OPERATE ANY VEHICLE UPON THE PUBLIC STREETS AND RIGHTS - OF -WAY OF THE CITY OF BAYTOWN IN SUCH A MANNER AS TO LEAVE, DEPOSIT, LITTER, DROP OR OTHERWISE PLACE DIRT, MUD, SAND, GRAVEL. SHELL, CLAY, BRICK, LUMBER, CONCRETE, DEBRIS OR OTHER BUILDING AND CONSTRUCTION MATERIALS ON SAID CITY'S STREETS AND RIGHTS -OF -WAY; PROVIDING A SAVINGS CLAUSE; REPEALING ORDINANCES INCONSISTENT HEREWITH; PROVID- ING FOR A MAXIMUM PENALTY OF TWO HUNDRED ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. Select Mayor Pro Tem Councilmen Donnelly and Braswell were,each nominated to the position of Mayor Pro Tem. When the vote was called Councilman Donnelly received three (3) votes and Council- man Braswell. four (4) votes. Councilman Braswell was then declared the Mayor Pro Tem. Committee Reports Councilman Donnelly speaking in behalf of the City - School Parks Committee reported that a meeting will be held with a landscape architect on Frid.ay, April 29th at 9 :30 a.m. relative to the estimate of cost for developing a plan from three sites selected by the Committee, namely: Travis Elementary, Horace Mann- Anson*Jones or James Bowie Elementary. Councilman Donnelly proposed that the City sponsor a contest for the.development of the Civic Center Site, based on the architect's layout of the building. Plans may be submitted by the garden clubs or any other club or organization which may be interested and proper recognition will be given the winner by the City Council. 4125 The Council favored the proposal, whereupon, Councilman Donnelly moved to instruct the Parks & Recreation committee to draft a set of rules, set of plans, details relative to prize and other,facets in connection with,the proposed contest. Councilman Ball seconded the motion. The vote follows: Ayes: Councilmen Ball, Massey, Hullum, Braswell, Fanestiel and Donnelly. Mayor Cravey Nays: None Councilman Braswell and City Manager Lanham will confer with representatives of the U. S. Steel Company relative to the impact their future plans may have upon the growth of the City. If possible, this will be prepared in written form and forwarded to the Department of Health, Education and Wolfare in support of the last application for funds to install lateral lines in the development of the sanitary sewer system of Baytown. A special meeting will be held with parties interested in the development of a Water Pollution Control District. City Manager Lanham will contact Mr. Caldwell of Houston and set up the meeting after learning his schedule. Barnes Sign Committee - Patrick Ball Utilities Committee - Councilmen Hullum Ball and Donnelly Mayor Cravey will prepare a written summation of various ordinances of the City from time to time. These will be published in the daily newspaper as an educational feature to keep Baytonians informed of the laws and ordinances of the City of Baytown. City Manager's Report Mr. Lanham reviewed the need for maps to be made for use in the Tax Department as well as other departments of the City. Recently he has received a proposal from Guy Holman, Instructor in Engineering Drawing at Lee College, on a per sheet basis of $11.50 per page, with an estimate of 445 sheets. This will be done on a part -time basis with the assistance of another teacher at Lee College and his estimated time for completion on this basis was eighteen monde. It was the opinion of the City ,Manger that the per page basis was more economical than the former per hour or per day proposals which projected the cost to a $20,000 figure. Too, money is now in the budget for this expenditure, should the Council approve the per sheet proposal. The Council suggested using the school maps or Sanborn maps which are available at a lower cost. The sheet map drawings would be made on linen, would be reproducible and would be the property of the City. The Council was in agreement as to the need for adequate maps, but formal action upon the proposal was deferred until the next regular meeting in order for the City Manager to get the school administration's reaction to a joint effort proposal; also, maps available from the Sanborn Map Company. 4126 Cooper McEachern - Traffic Engineering Proposal The Council took no action upon the proposal of Cooper McEachern, Traffic En- gineering Consultant, for furnishing a traffic engineering and traffic planning consulting service for the City. His proposal was based on spending two days per month in Baytown for a monthly fee of Three Hundred ($300) Dollars, which includes all expenses of travel and other incidentals incurred in the normal course of duties. Adiournment Councilman Donnelly moved for the meeting to adjourn. Councilman Braswell. seconded the motion. The ayes were unanimous and the Mayor declared the meeting adjourned.
