1966 03 10 CC Minutes4092 MINUTES OF THE REGULAR COUNCIL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOUN March 10, 1966 The City Council of the City of Baytown, Texas met in regular session on Thursday, March 10, 1966 at 6:30 p.m., in the Council Room in the Baytown City Hall with the fol- lowing members in attendance: C. Huron Mayor City Manager City Attorney City Clerk Councilman Councilman Councilman The Mayor called the meeting to order, the Invocation was offered, afterwhich, he called for the minutes of the regular meeting of February 24th and special meeting of March 4th. Councilman Donnelly moved to dispense with reading of the minutes - they be approved as submitted in written form. Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Massey, Braswell and Donnelly. Mayor Cravey Nays: None Approve Audit Report - 1%4 -65 M. Cecil Bobbitt, CPA, appeared before the Council to answer any questions which may be submitted relative to the 1964 -65 Annual Audit which was presented to the Council�� at the January 13th meeting. The Council had no questions so Councilman Donnelly moved to approve the 1964 -65 Annual Audit as presented by Mr. Bobbitt. Councilman Massey seconded the motion. Mayor Cravey Nays: None Annexation Committee - Common Boundary Agreement - Tri -City Beach Area The Annexation Committee once again reviewed the results of a meeting held with residents of Tri -City Beach relative to the conflicting elements for plans to annex the 10 -foot strip along the county road by the City of Baytown and the desire to incorporate an area that is now within the extra territorial control of Baytown by residents of Tri -City Beach. At a recent meeting of the two groups, it was hoped that a satisfactory agreement was reached which would permit the continuation of the strip annexation by the City, yet permit the residents of Tri City Beach to incorporate the area controlled by Baytown; all subject to Council approval. After some discussion Councilman Braswell moved to authorize the administration to prepare fidd notes and an ordinance setting forth the agreement which will give the residents of Tri City Beach permission to come within the City's two mile territorial control with their incorpora- tion boundary conditioned upon them giving the City of Baytown permission to continue with the 10 -foot strip along Tri -City Beach Road without a common boundary. Councilman Donnelly seconded the motion. The vote follows: Ayes: Councilmen Massey, Braswell and Donnelly. Mayor Cravey Nays: None 4093 Map and Petition - Mont Belvieu Proposed Incorporation Mr. Gill of Mont Belvieu, a member of the incorporation committee., presented a map of the proposed limits together with a petition setting forth the mets and bounds of the proposed limits. Once again, he requested the Council to consider releasing a section of the finger. annexation of the Southern - Pacific Railroad right -of -way which divides the water District of Mont Belvieu; he suggested Cedar Bayou Stream. The Council felt that it should continue in its present direction. After the strip annexation is com- plete, it may be that the Council will choose to de -annex the area requrested and take another route. Since the strip annexation is a protective attempt on the part of the Council, it was agreet that it may be necessary to take another look at the area at a later date, but they were reluctant to make any major changes until the overall plans are completed. The Annexation Committee will hold a joint meeting with the Incorporation Committee of Mont Belvieu within the next week. *Details will then be worked out so that an ordinance may be drafted giving approval to the proposed incorporation. Consider Proposal for CATV Service The Council heard a request from Joe Zorn, local attorney, representing the South- west CATV, Inc., to delay consideration of the proposals for CATV services for Baytown at this meeting to give his clients an opportunity to present their proposal. Proposals were sought by the Administration for presentation at the February 24th meeting and only two were submitted. Later the management of the Southwest CATV Company had contacted City Manager Lanham and asked for an opportunity to be heard but the other two proposals had been received and exposed to the public through means of a public hearing and the local press. The Council was of the opinion that a deviation from the general practice of setting limits iQ receipt of proposals to hear someone who had neglected to meet the deadline, would be unfair to those who from time to time complied with the require- ment; especially when the contents of the first proposals have been made public as in this case. After a lengthy discussion, Councilman Donnelly moved to not accept additim- al proposals at this time until the Council has completed its study and either accepted or rejected those proposals which were submitted within the deadline. Councilman Massey seconded the motion. The vote follows: Ayes: Councilmen Massey, Braswell and Donnelly. Mayor Cr.avey Nays: None Mr. Rufus Honeycutt, who was absent from the February 24 meeting due to a death, presented a more detailed resume of the Baytown Community Antenna Company's proposal setting forth a monthly rental fee of $4.95, 24 -hour weather reports, FM music, with a 12 -year franchise provision. Other relating questions were forthcoming from the Council, afterwhich Councilman Donnelly proposed deferring further action upon the proposals at this meeting since three members of the Council were absent. Council will review the proposals and take formal action upon the one thought to be most advantageous at a special meeting, Friday, March 18th. Mr. Gary of Radio Station KWBA questioned the need of awarding such a franchise since Houston has three major networks which service the City of Baytown. He urged the Council to give the matter more study, since in his opinion, it would not be of any special benefit to the City of Baytown, nor to its citizens as a whole. M -B -CO M-B 16 $4,164.25 It was the recommendation of the Administration that the low bid of Boehck Equip- ment be accepted. The Smith Municipal Supplier's machine did not meet specifications. Councilman Donnelly moved to accept the recommendation of the Administration and award the bid to Boehck Equipment Company for the Mark -Rite 9,000 at the bid price, $3.694.00. Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Massy, Braswell and Donnelly. Mayor Cravey Nays: None Advertise Bids - City Hall and Community Center Building The Council reviewed the plans for the City Hall and Community Center Building as Mr. Lammers explained some of the recent changes which have been made. Also, the basement plans have not received final approval by Civil Defense authorities, however, If the plans as set forth were essentially what the Council wanted, he asked for permission to advertise for bids to be received on Tuesday,.April 19th. Councilman Braswell moved to instruct the Architect to release plans and specifications to the bidders on March 21st for construction bids on the-City Hall and Community Center building, said bids to be received on Tuesday, April 19th. Councilman Massey-seconded the motion. The vote follows: Ayes: Councilmen Massey, Braswell and Donnelly. Mayor Cravey Nays: None 4095 W. S. Milner - City Install Culvert Across Ditch Adiacent to Subdivisoin Messrs. Busch and Milner, asked the Council to install a culvert or bridge across the Harris County Flood Control Ditch which is adjacent to his subdivision to connect with Mocking Bird Lane in the Eva Maud Subdivision. The subdivision plans have been approved by the Baytown Planning Commission without requiring the connection, but the subdivider proposed the connection since it would provide additional circulation from traffic to connect with Kilgore Road. Estimates on the cost of installing the pipe and paving the roadway were compiled based on 60" pipe for a total of $5,285.00 17 or on 72" pipe, for a total of $6,352.00. These estimates included pavement, backfill, excavation, inlets andother incidentals required to complete the job in good order. After some discussion, the Council proposed to purchase the pipe, provide inlets and other incidentals if the developer will do the backfill and pave the connecting roadway. The developer agreed to this proposal, afterwhich, Councilman Donnelly moved to approve the purchase of the pipe, its installation in place and other necessary incidentals in preparation for the backfill and topping of the roadway by the subdivider, W. S. Milner. Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Massey, Braswell and Donnelly. Mayor Cravey Nays: None Approve Water Service Lines - Wilburn and Brown - West Side of Highway 146 The Council discussed the need of a water service connection to service the homes of Wilburn and Brown abutting upon Highway 146. These properties are now serviced by a one -inch line that dead -ends resulting in rusty water problems and low pressure. The Council discussed the cost of constructing a segment of the proposed 12 -inch water line which is in the long range plan for Highway 146 or replacing the section of one inch line that was removed to connect at Cedar Bayou and Bob Smith Road, with a 2 -inch line for a distance of approximately six hundred (600•) feet. After tome further discussion, Councilman Donnelly moved to authorize the installation of the two (2 ") inch water service line. Councilman Massey seconded the motion. The vote follows: Ayes: Councilmen Massey, Braswell and Donnelly. Mayor Cravey Nays: None Ordinance - Fire Protection Harris County Councilman Donnelly moved to adopt an ordinance authorizing an agreement with Harris County to provide fire protection equipment and services for a designated unincorporated area of Harris County for a period of one year. Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Massey, Braswell and Donnelly. Mayor Cravey Nays: None The caption of the ordinance follows: ORDINANCE NO. 784 AN ORDINANCE AUTHORIZING AGREEMENT WITH HARRIS COUNTY, TEXAS, PROVIDING FOR THE FURNISHING OF FIRE PROTECTION SERVICES AND EQUIPMENT TO AN UNINCORPORATED AREA OF HARRIS COUNTY; STATING CERTAIN OF THE PRINCIPAL TERMS OF THE AGREEMENT; APPROVING FORM AND SUBSTANCE OF AGREE- MENT AND AUTHORIZING ITS EXECUTION ON BEHALF OF THE CITY, AND DECLARING AN EMERGENCY. Ordinance - First Reading - Annexation - Southern Pacific Railroad Tracks Councilman Massey moved to adopt an ordinance, on first reading, providing for the annexation of a 10 -foot strip along the Southern Pacific Railroad consisting of 2.424 acres of land. Councilman Donnelly seconded the motion. The vote follows: 4096 Ayes: Councilmen Massey, Mayor Cravey Nays: None 3.)0. !G Braswell and Donnelly. The caption of the ordinance follows: ORDINANCE NO. 785 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 2.424 ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN. TEXAS. Ordinance - Second Reading Amending Telephone Franchise Councilman Donnelly moved to adopt an ordinance, on second reading, amending the telephone agreement between the City and General Telephone Company to provide extended area service in lieu of strictly local service. Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Massey, Mayor Cravey Nays: None Braswell and Donnelly. The caption of the ordinance follows: ORDINANCE NO. 780 AN ORDINANCE AMENDING TELEPHONE FRANCHISE AGREEMENT BETWEEN CITY OF GOOSE CREEK, TEXAS, NOW BAYTOWN, TEXAS, AND SOUTHWESTERN ASSOCIATED TELEPHONE COMPANY, NOW GENERAL TELEPHONE COMPANY OF THE SOUTHWEST, APPROVED APRIL 1, 1946; AUTHORIZING EXTENDED AREA SERVICE IN LIEU OF STRICTLY LOCAL SERVICE; PROVIDING FOR DELEGATION OF AUTHORITY, RATE REGULATION, AND ANNUAL PAYMENT FOR THE RIGHT TO USE CERTAIN FACILITES; REPEAL OF CONFLICTING ORDINANCES AND FOR PARTIAL INVALIDITY. Transfer - Resolution Councilman Donnelly moved to adopt a resolution authorizing the City Manager to transfer $1,755.00 from the Council Contingency Fund to purchase an adding Machine for the Purchasing Agent and purchase paint and signs for street intersections and roadway. The caption of the resolution follows: RESOLUTION 101 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CITY MANAGER TO TRANSFER ONE THOUSAND SEVEN HUNDRED AND FIFTY -FIVE ($1,755.00) DOLLARS FROM THE COUNCIL CONTINGENCY FUND TO BUDGET CLASSIFICATIONS 105 -10 -2 AND 200 -2 -13. The Administration was requested to have the sugar loaves, at Robert E. Lee High School, anchored as the trial period has proven this channelization of traffic to be working most favorably. Committee Reports Councilman Donnelly gave a brief and FBI Agent Hetherington relative to hundred interested citizens of Baytown organization of a citizens committee f by Mayor Cravey recently will meet and the new organization. 4097 report on the successful meeting with Judge Guarino obscene literature and pornography. The Committee appointed develop goals and a constitution and bylaws for Councilman Braswell gave a report on a meeting held on February 23rd in Houston with Attorney Wiley Caldwell and Nat Turner for the purpose of exploring the advantages. costs 1 and legal requirements to form a water pollutim control district for the streams that flow through the city limits. namely Cedar Bayou and Goose Creek. The Committee learned that a district can be set up on two basis, either would be sufficient: A. To regulate and enforce compliance with permits that are issued by others for the disposal of effluent into a stream within the district. or B. To authorize the design and construction of sewer and water treating facilities within the district. It was learned that it is not necessary for the limits of a district to encompass the entire watershed of a stream; the field notes for the boundaries may be taken from a map or maps; areas inside and outside of city limits should be handled separately; minimum cost of creating a district will be $25,000 legal fees plus $4.000 engineering expense; minimum expenses would be about $20.000 per year; the directors for.such a district should be elected, and the proposal to create the district must have the endorsement of the State Senator. Councilman Braswell was of the opinion that such a district would be a vehicle to be used in the prevention of water pollution and he asked the Council to give it some study so that a definite decision may be made by the Council at some subsequent meeting. Councilman Braswell pointed out the urgent need of replacing several joints of drainage pipe which have fallen off and left a large gaping hole in the yard of a home owner in Country Club Subdivision. The City Manager reported that the City Engineer is presently making a study of five (5) other such places in the subdivision. An estimate of cost to replace and repair the sections will be compiled and presented to the City Council at a later meeting. The City Manager will set up a breakfast meeting with V. V. Ramsey and Turner Collie, Consulting Engineers for the week of March 13th if possible. We to the nature of the needs to be discussed, it was suggested that the meetings be held separately. City Manager's Report Mr. Lanham reported on some of the activities of the Park Committee; its suggestion to use some of the State Highway Department's rights -of -way for playgrounds and temporary park sites. In connection with this suggestion. Mr. Lanham had contacted officials of the Highway Department regarding the use of the right -of -way of the proposed Loop 201 between Schilling and Glen Arbor Subdivision. The State Highway Department has given permission provided (1) the City will move any playground equipment placed on the property when requested to do so; and (2) Provided there is no opposition from abutting property owners on the use of the right -of -way property for this purpose; and (3) provided the City will maintain the grounds in an acceptable manner; and (4) provided the City will relieve the Highway Department of any responsibility for accidents that may occur on the grounds. It is the recommendation of the Parks Committee that the City provide $1.500.00 for development of the park facilities. It further recommended that the Administration work with the Glen Arbor Civic Association in its purchasing of playground equipment and the placing of the equipment on the playground site. The Council favored and approved the recommendations of the Park Committee and authorized and approved the agreement with the State Highway Department for the use of the right -of -way as a temporary parksite. M Mr. Lanham has received a request from R. H. Pruett, a member of the Port Commission, for the City of Baytown to be the local sponsor for deepening of the Goose Creek Stream a project which has been under study for several years. There will be no expense involved but the City would be responsible for negotiating with utility companies to relocate pies and lines. He was instructed to set up a meeting with a representative of the U. S. Army Corps of Engineers to discuss the project. The Council will be notified of the time and date. Approve Placing Litter Boxes - Chamber of Commerce $- Councilman Braswell moved to approve the installation of litter boxes, by the 9 ' Baytown Chamber of Commerce, on existing poles and standards, such installation to be (_! regulated by the City Administration to avoid traffic hazards, seconded the motion. The vote follows: Ayes: Councilmen Massey, Braswell and Donnelly. Mayor Cravey Nays: None Adjournment Councilman Braswell moved for the meeting to adjourn. Councilman Donnelly seconded the motion.
