1966 01 13 CC Minutes4056 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN January 13, 1966 The City Council of the City of Baytown, Texas, met in regular session on Thurs- day, January 13, 1966 at 6:30 p.m., in the Council Room of the Baytown City Hall with the following members in attendance: Robert Barnes Councilman C. Donnelly Councilman Seaborn Cravey Mayor Fritz Lanham City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order, the Invocation was offered, afterwhidi he called for the minutes of the regular meeting of December 9th and the special meet- ings of December 28th and 30th. Councilman Huron moved to dispense with reading of the minutes; they be approved as submitted in written form. Councilman Braswell seconded the motion. Mayor Cravey Nays: None Presentation to City of Baytown - Plague - Organization of Arab Students - Baytown Chapter The President, Vice President and Treasurer of the Lee College Chapter of the Organization of Arab Students presented the Mayor and City Council with a plaque showing their appreciation and acceptance in Baytown. Councilmen Donnelly moved to instruct the City Attorney to prepare a resolution expressing the Council's appreciation, their pleasure at having the students as a part of the community life of Baytown, setting forth their good- neighbor policy while in Baytown and extending an invitation to other Arab students to join those presently residing in Baytown. Mayor Cravey Nays: None Consider Bids - Police Uniforms Only one bid was received on the bid proposal for furnishing uniforms for the Baytown Police Department. Finance Director Le Fevre stated that, upon investigating, he learned that prospective bidders had not received a copy of the bid proposal; it had been advertised in the local paper according to the Charter but bid forms were not mailed out. The Administration felt that competitive bids would be received if the present bid was not made public and the Administration would be permitted to re- advertise for bids. Councilman Huron moved to instruct the Administration to readvertise for bids on the Police Uniforms. Councilman Massey seconded the motion. Councilman Huron moved to accept the recommenda- tion of the Administration and award the contract for the three dump bodies to Motor Truck Equipment Company in the, amount of $2,220..00 - this being the low bid of the three proposal presented. Councilman Massey seconded the motion. The vote follows: Ayes: Councilmen Barnes, Massey, Braswell, Hullum, Huron and Donnelly. Mayor Cravey Nays: None Consider - Waterworks Supplies and Materials Bids Bids were received from the following firms on the proposal to furnish waterworks supplies and materials for one year. Municipal Pipe b Supply Company - Houston, Texas Utility Supply Company - Houston, Texas United States Pipe G Foundary Go., Dallas, Texas Based on the estimated materials projection, the low bid was Utility Supply Company, $77,930.00; Municipal Supply, $82,987.64 less 2% and U. S. Pipe and Foundary, on pipe only - F.O. B., foundary with freight allowed at 12,34 per net ton only. Any difference in freight and the cost of unloading is to be borne by the City. After some discussion, Councilman Braswell moved to accept the low bid of Utility Supply Company to furnish waterworks supplies and materials to the City of Baytown for one year beginning the date of awarding the contract. Councilman Huron seconded the motion. The vote follows: Ayes: Councilmen Barnes, Massey, Braswell, Hullum, Huron and. Donnelly. Mayor Cravey Nays: None Presentation - Petitions Oak Addition - Street Improvements Rev. R.. L. Finney, Executive Director of the Greater Baytown Civic league, sub- mitted petitions for the improvement of all the streets in Oak Addition. Each of the petitions carried the signatures of 65% of the property owners, excepting for the improvement of Oak Street which is classified as a main collector street and carries heavy traffic to and from school. Rev. Finney explained that the business firms are located on this street and some of the property owners do not make their home in Baytown. This makes it rather difficult to secure the names of the property owners as they are not interested in the development of the streets nor would they sign a petition, should a copy be forwarded to them for their signatures. He offered the following suggestions for the Council's consideration and possible favorable action: 1. Suggested the lowering of the percentage rate necessary on petitions to Improve streets and install curb and gutters. The present rate is 65 %; they suggested 51 %. 2. The petitions now in the hands of the Council, regarding the street improvements be approved and work started at the earliest practicable date. 3. That an investigation be made of the traffic flow across Oak Street, and 4 -way stop signs be installed at Oak and Johnson Streets to remove the hazard presently existing because of lack of traffic regulations. 4. A twenty mile (20 -mile) per hour School Zone sign be placed at or near Carver Elementary School and Carver High School. 4059 Minutes Baytown City Council January 13, 1966 5. Cross Walk markings be placed at appropriate places near schools. 6. A Patrol Officer be assigned to the above named schools to direct the flow of traffic during the beginning and closing hours of school each day. After discussing the several items suggested, Councilman Donnelly moved to accept the petitions as presented; instruct the Administration to have the names checked to verify ownership, and study the suggestion of lowering the percentage rate from 65% to a possible 51% requirement for petitioning the improvement of streets by property -. owner participation. Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Barnes, Massey, Hullum, Braswell, Huron and Donnelly. Mayor Cravey Nays: None Items 3, 4, 5, and 6 were referred to the Traffic Committee for study and further recommendation. Councilman Huron, a member of the Traffic Committee, invited Rev. Linney or a member of his committee to attend the next meeting of the traffic committee which will be held on Wednesday, January 26th - 4:00 p.m., at the police station. Hearing - Annexation of Land within ROw - Tri -City Beach Road and Interstate 10 Hwy. Mayor Cravey opened the public hearing upon the proposed annexation of land within the rights -of -way of the Tri -City Beach Road and Interstate 10 Highway. He asked if anyone in the audience wanted to be heard relative to such annexation. Mrs. Lensing asked for clarification on the width of the annexed area, this was explained by Mayor Cravey. Therebeing no further questions presented or objections offered, Councilman Barnes moved to close the public hearing upon the proposed annexation. Coun- cilman Huron seconded the motion. Mayor Cravey Nays: None Ordinance - First Reading Annexation School Property The City Manager introduced and read an ordinance, on its first reading, for the annexation of the Sterling High School site. Councilman Donnelly moved to adopt the ordinance as presented for first reading. Councilman Barnes seconded the motion. The vote follows: Ayes: Councilmen Barnes, Massey, Hullum, Braswell, Huron and Donnelly. Mayor Cravey Nays: None The caption of the ordinance follows: ORDINANCE NO. 768m AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 122.97 ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AN ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS. Presentation - 1964 -65 Annual Audit Report M. Cecil Babbitt, CPA, presented copies of the report of examination of the books and records of the City of Baytown for the fiscal year ended September 30, 1965. He stated that the examination was made in accordance with the recommendation of the National Committee on Municipal Accounting where applicable, and included such tests and procedures considered necessary under the circumiLances. He concluded his report by stating that he would be happy to meet with and discuss the budget, if they had any questions after completing their study. Councilman Huron moved to accept the annual audit report for the fiscal year ended September 30, 1965, as presented by Mr. Babbitt. Councilman Braswell seconded the motion. Consider Plans - Loop 201 Between West Main & Decker Drive City Manager Lanhj Rf8jR ?ted copies of a letter which he had received from Mr. Hebner, Supervising �ngineer with the State Highway Department, stating that the Highway Commission has authorized $1,600,000 for construction of grading and storm sewers on Loop 201 from West Main to Decker Drive. The Highway Department is ready to start drawing plans, however, they need an answer from the City Council re- garding the possible relocating of the Missouri- Pacific Railroad near the Civic Center site at Market Street, and using a joint track with Southern - Pacific Railroad. The local agents of both railroad companies have expressed a willingness to cooperate with the City in this consolidation. However, at the last meeting, they indicated that the company officials were not willing to bear the cost of the relocation -which was estimated at between $80,000 - $95,000. Too, the companies would have to get I.C.C. approval before removal construction could be finalized; this would cause further delay and it is possible, removal would be denied. In view of the fact that the High- way Department is ready to proceed with its plans for construction of grades and storm sewers and, the City has good access to the Civic Center under the original plans and, there is an expenditure of between $80,000 - $95,000 that someone would have to pay other than the railroad companies, Mr. Lanham concluded his report with a recommendation that the Council proceed with the original plans proposed by the State Highway Department's Corps of Engineers. After discussing the many facets which have been used by the Council in trying to solve the problem of relocation, Councilman Donnelly moved to instruct the State Highway Department to proceed with its original plans for construction of the loop. Councilman Huron seconded the motion. The vote follows: Ayes: Councilmen Barnes, Massey, Hullum, Braswell, Huron and Donnelly. ,5iayor Cravey Nays: None Reappoint - Robert Beman - Civil Service Commissioner Upon recommendation of City Manager Lanham, Councilman Donnelly moved to approve the reappointment of Robert Beman, Jr., to the Baytown Civil Service Commission for a period of three years. Councilman Barnes seconded the motion. The vote follows: Ayes: Councilmen Barnes, Massey, Hullum, Braswell, Huron and Donnelly. Mayor Cravey Nays: None Masterson - Discussion Sale of Bonds Mr. Lanham gave a report on the increase of revenue in the water department for the first three months of this fiscal year. In the comparison of water pumped and water billed, there is still a difference of approximately 15% which, according to Turner & Collie, Consulting Engineers, is classified as a reasonable loss. Some of the reasons for the loss were credited to flushing fire hydrants, inaccurate water meters and leakage. During the 1964 -65 fiscal year, 639 stuck water meters were replaced; the three months of this fiscal year, 196 have been replaced and the city has plans for a systematic water meter change -out program which will change all the water meters within a 5 -year period. Other points of study are also being explored in the effort to increase revenue and reduce the percentage difference of water pumped and water billed, Air. Masterson expressed his concern over adding 200 to 300 connections each year and losing ground in increased revenue. It was suggested that meters at the wells may be inaccurate and a possible engineering study in this field was proposed. After some discussion relating to this proposal, it was agreed to defer seeking invitations from other engineering firms until.the Council has met with and discussed the problem with Turner G Collie, the engineering firm retained under the bond program for water and sewer improvements. It was suggested that a Committee composed of the auditor, a mem- ber of the engineering firm and Tom Masterson, study the many facets of the problem and submit recommendation for solution. Mr. Masterson reported that he would be.prepared, at the January 27th regular meeting, to present an ordinance calling for a bond sale on the 10th, 17th or 24th of February. He stated that the Council may want to sell 4061 more General Obligation Bonds than has been allocated for this year's sale. However, on Revenue Bonds, he recommended no more than $750,000 be sold at this time. He will keep the Council advised upon the correct approach to the sale of the bonds. Discuss - Estimate Improving Alabama Street Several estimates for improving Alabama Street were presented for discussion. The estimate to rebuild Alabama with cement stabilized shell base, construct curb and gutter was $49,261.76; alternate No. 1, Sand stabilized shell base, $43,168,36; Alternate II, San stabilized shell base - quantity 982 base failure only - $29,817.86; -j Alternate III, Rebuild with Sand Stabilized shell base with inverted penetration surfacing, $40,008.31; Alternate IV, Replacing sections of curb and gutter and with sand stabilized shell base; Alternate V, Replacing sections of curb G gutter and with cement stabilized shell base, $37,435.94, and Alternate VI, Using lime slurry, $29,627.11. In the study, it was determined that, no storm sewer will be necessary if the curb and gutter is replaced. Councilman Huron proposed supplying the residents with petitions for endorsement by the property owners for property owner - city participation in the construction of a first class street. City Engineer Morton reported that the surface is worn out on the street. However, in most cases the base material is good. Since the residents along Alabama Street were interested in a good street and were willing to try to get signatures of property onwers for participation cost construction, the City Manager was instructed to have an estimate prepared for the construction of a first class street, break down the total estimate into unit cost basis to property onwers, notify Mr. Reineke when the unit price has been determined and supply him with petitions setting out the unit cost to the property owner, for solicitation of signatures on the participation provision. Approval - Final Payment Skrla Construction Company - 1965 Street Improvements Councilman Donnelly moved to approve final payment of $16,082.74 to Skrla Construction Company upon completion of Phase No. 2 of the 1965 Street Improvement Program. Councilman Huron seconded the motion, The vote follows: Ayes: Councilmen Barnes, Massey,Hullum, Braswell, Huron and Donnelly. Mayor Cravey Nays: None ;Jr. Lanham reported that $11,621 of the $110,000 budgeted for major street improvements during the 1965 -66 fiscal year, has been spent thus far on major improvements. Too, Jack 11orton, City Engineer, reported that work is progressing on the Brownwood Street profile project and he will soon be able to give his complete report to the Council. He will also investigate a breakage in the surface of MacArthur Street and a possible fault in the recent construction on Wooster Street. Representative - Missouri Pacific Railroad Company R. A. Gresman, a representative of Missouri- Pacific Railroad Company, appeared before the Council to protest the proposed merger of the Rock Island- Southern Pacific Railroads. He set forth several reasons for submitting his protest since, in his opinion, such a merger would not be in the public interest as shippers, both large and small, would be effected by these mergers, especially those customers presently. served by Missouri- Pacific RR Company. In his exhibit, he submitted a listing of itmes of importance in evaluating the proposed merger and at the conclusion of his protest, presented the ,Mayor with a copy of a resolution, for Council perusal and possible adoption, which supports the Missouri- Pacific's position in this matter. The Council discussed several relating items, but took no further action upon the protest nor the resolution. Committee Reports ri Councilman Donnelly requested the City Attorney to set up a meeting of the City - School Election Committee in order to formulate proper procedures for a joint election, should a run -off be necessary following the General Municipal and School Elections. Councilman Barnes reported on the recent meeting of the Utilities Committee with representatives of the General Telephone Company. The company is presently spending a sizable amount of capital improvement money in Baytown in order that service may be improved and extended area service may be available for Baytown customers. Too, more detailed progress reports will be given in the future. 4062 Committee Reports Continued Councilman Barnes reported that the Parks Committee is presently working with the School and School to present System on a project which, in his opinion, will be beneficial to both City if it materializes. The Committee is making an effort to have a firm proposal to the Council for its consideration within the next 30 -days. The Civic Center Building Committee has recently met with J. D. Giddings relative to cleaning and ridding the site of Junk and other rubbish left behind by former rental tenants. As a member of the BuiHing Committee, Councilman Barnes, suggested the creation of a Community Building Advisory Board which will assist in carrying out the functions and setting policies for operation of the Community building. He further suggested that the Mayor be designated to name members to the Board, no member to be on the City Council, an ordinance be drafted providing for its membership, setting out the terms of office, enumerating its powers, etc., which will be presented to the City Council for its ratification and adoption. It was agreed that such appointments would be forthcoming shortly. The Council expressed some dissatisfaction with the progress being made on the development of plans for. the Civic Center by the architect, and urged that further delay be cut to a minimum. Councilman Barnes asked the City Manager to provide the Council with literature relating to installation and operational costs of an incinerator for buring tree limbs, building materials and other waste matter collected by the trash pickup service furnished to residents by the City of Baytown. Councilman Braswell reported that the Humble Company' is presently installing a similar type incinerator and when it is ready for operation, he will notify the City Manager, City Council and other department heads so that they may see it in operation. Councilman Braswell submitted the name of W. A. ,McElhannon to serve on the pro- posed Building Code Committee. Councilman Braswell reported that he and Councilman Massey had met with A. J. Busch, Jr., Engineer, regarding the espanade on North Alain Street. It was thought at first that a Aecision had been reached, but it has become apparent that none thus far, is feasable. Presently it appears that more openings, than normally required, must be pro- vided because of the business houses to be served. The last time the committee met, Air. Busch was asked to contact Mr. Hebner, Traffic Engineer of the State Highway Department, relative to the proper method of designing an espanade. The Committee will delay its recommendations until this information is made available. Councilman Braswell asked the Council to take formal action upon the Goose Creek Fresh Water Lake project and proposed a joint meeting of the Council and Committee for overall discussion. The Committee feels that it has gone as far as it can upon com- pletion of the report and now needs direction from the Council. The Council commended the Committee upon its informative report, but the majority felt that plans for such a major improvement were premature at this time.. Councilman Braswell stated that, in his opinion, bond funds would be needed for the installation of the sewer facilities but matching funds would be available through the Texas Parks & Wildlife Commission for the remaining phases of the proposed construction. After some further discussion, it was agreed that a joint breakfast meeting will be held on Tuesday, January 18th, 7:00 a.m., at the Holiday Inn. Councilman Braswell suggested that the Council hold a joint meeting with members of the Baytown Chamber of Commerce relative to the need and possible location of a bridge across Cedar Bayou. Draft Ordinance - Regulatina Installation Signs Upon recommendation of Alayor Cravey, Councilman Donnelly moved to instruct the City Attorney to draft an ordinance prohibiting the installation of signs on public property, nor overhanging any street, nor overhanging any public property less than 7 B -10 feet; no removable or temporary advertising signs permitted upon public property and o.wners who are now in violation to be given a certain designated time to comply with the ordinance. Mayor Cravey Nays: None 4063 /_/3 -�1 Consider Granting Franchise - Community Antenna 'Television Service Mayor Cravey asked the Council to review the community antenna television proposals which were presented to the Council in March, 1965. The Committee, appointed to study the C.A.T.V. proposals, had recommended offering this type service to the citizens of Baytown in a report, December 9, 1965. Since the proposals presently in hand are over a year old, the City Manager was instructed to obtain a list of companies engaged in this type business in Texas. From this list, solicitations will be made for contract proposals which will include free connections for each school in the City. Policy Discharging City Employee not Under Civil Service The Council discussed but took no formal action upon the proposal of Councilman Hullum to direct the Administration to draw up some type formal policy for discharging city employees not under Civil Service. He suggested a possible Grievance Committee of three or more supervisors so that a discharged employees may have a designated channel for explaining his grievances, should he so desire. Presently, the City is using a personnel form which is signed by one or more persons but has no detailed explanation on the reasons for discharging the employee. Some interest was expressed but no definite steps were taken upon the proposal. City Manager's Report City Manager Lanham reported that he had a memorandum from the Fire Chief regarding wood shingles in the residential areas. The City has now reached its 25% maximum and it is possible that the City may be faced with a one -cent increase in the fire insurance key rate. Councilman Barnes moved to instruct the City Attorney to prepare an amendment to the Building Code, for presentatio„ at the next regular meeting, which forbids the use of wood shingles upon any residential construction within the city limits of Baytown. The administration was instructed to refuse to issue permits for wood shingles on residential construction in the iterim. Councilman Huron seconded the motion: Ayes: Councilmen Barnes, Massey, Hullum, Braswell, Huron and Donnelly. Mayor Cravey Nays: None The City Manager has received notification from the 'Texas State Library that approval has been given to the City's application for the $5,000 - Library Construction Act funds. The Council will hold a special meeting on Wednesday, January 19th at 6:30 p.m., to review the city's depository contract in relation to the services presently furnished to the city. Also, representatives from Turner G Collie Consulting Engineers will present a preliminary report to the Council upon their study of the water system of the City, The Council will hold a dinner meeting at the Tower on Monday, January 24th, 6:30 p.m. with the Baytown Planning Commission to review its proposals on Zoning regulations for the City of Baytown. Mr. Lanham reported that he and City Attorney Chandler had met with C. C. Crutch- field relative to codification of the ordinances of the City of Baytown. Mr. Crutch- field indicated that he will meet and be ready to make his presentation to the Council within the next few wekks, possibly the first meeting in February.
