1966 01 11 CC Minutes, Special9059 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN January 11, 1966 The City Council of the City of Baytown, Texas, met in special session on Tuesday, January 11, 1966 at 9:30 p.m. in the Council Room of the Baytown City Hall with the following members in attendance: C. Al. Massey Councilman. ' Don M. Hullum Councilman A. M. Braswell Councilman _ J. C. Huron Councilman Raymond T. Donnelly Councilman Seaborn Cravey Mayor Fritz Lanham City Manager Edna Oliver City Clerk Absent: Robert Barnes Councilman George Chandler City Attorney The Mayor called the meeting to order for the purpose of reviewing the waste discharge application of Marbon Chemical Division; Borg - Warner Corporation. Discussion and Council Action Mr. Byron Kistler, plant engineer for Marbon Chemical, submitted copies of an application for a regular permit to discharge up to an average of 91,500 gallons per day of industrial waste water, consisting of process steam condensate and treated sewage effluent, from the plant to be discharged into a drainage ditch near the plant site, thence into the west fork of Goose Creek, thence into Goose Creek in the San Jacinto River Basin. Heretofore this waste water had been discharged through the Humble Company's system, but, because of the new Pollution Control Board and new regulations, an application had been filed in September, 1965, for a permit to dis- charge the waste material in this manner. The hearing on the application will be held in Austin on January 20, 1966. . In reviewing the application, Mr. Kistler informed the Council that the discharge of effluent from the septic tank at the plant would be effect for only one year be- cause the special provisions require that within on a year of the date of issuance of the permit, the Company shall take such step as are necessary to insure that the waste water is disposed of in some manner other than the ditch - the permit stipulates a flow measuring device and readily accessible sampling point shall be provided by the Company. Jack Walker, Sid 0. Brady, Gene ,Aiuller and Dean King, members of the newly organized Baytown Air and Water Pollution Committee, were present and each agreed that the waste water being discharged by Marbon into the ditch was well within regulations. qtr. Brady stated that it was, in effect, distilled water. Mr. Walker, Chairman of the Board, stated that he felt that the Pollution Board had no basis upon which to protest the application of Marbon Chemical Company, but there are problems coming from areas other than Marbon. The Committee would continue its study of these violations and come back with recommendations to resolve a portion of the pollution. Gene Muller moved to recommend that no protest be made against approving the permit of Marbon. Both Councilmen [Massey and Donnelly expressed some reservations about not protesting the permit because of the State Pollution Control Board. After some further discussion, Councilman Braswell moved for the City of Baytown not to protest the application of Marbon Chemical Company to permit discharge into a drainage ditch near the plant. Councilman Hassey seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Huron and Donnelly. Mayor Cravey Nays: None 4055 Mayor Cravey informed the Council that he has written to the State Pollution Board and asked that the City of Baytown be notified of any application for permits in Harris County; Chambers County could be included also. Councilman Braswell proposed a study be made of creating a Water Pollution & Con- trol District for the Goose Creek watershed. It is possible that Cedar Bayou Stream and the Ship Channel may be included in the district.. Such a District can be established by special act of Legislature and have the degrees of control as large as possible. It was agreed that the Council will pursue the recommendation; the City Attorney will ybe asked to make a study of the proposal and a full investigation will be made rela- tive the requirements far creating such a district. Adiournment There being no further order of business, the motion was made and seconded that the meeting adjourn. The ayes were unanimous and the Mayor declared the meeting adjourned.
