1965 12 28 CC Minutes, Special9099 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN December 28, 1%5 The City Council of the City of Baytown, Texas, met in special session on Tues- day, December 28, 1965 at 5:00 p.m., in the Council Room of the Baytown City Hall W th the following members in attendance: Robert Barnes Councilman C. M. Massey Councilman Don M. Hullum Councilman A. M. Braswell Councilman J. C. Huron Councilman Raymond T. Donnelly Councilman Seaborn Cravey Mayor Fritz Lanham City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order, the Invocation was offered, afterwhich, he called for the first order of business as set forth on the agenda. Conduct Hearing - Annexation of School Property - Garth Road Mayor Cravey opened the hearing upon the proposed annexation of school property lying to the north of the present city limits. He called upon City Manager Lanham to review the limits of the proposed annexation, its purpose, and the benefits de- rived from the joint efforts of the County, School District and City of Baytown to properly develop the roadway and provide drainage after the annexation has been consummated. The many facets were explained to those attending the meeting, after - which, Mayor Cravey asked if any person or persons in the audience had a question or objection to present. No one offered further comment, so Councilman Braswell moved to close the public hearing on the annexation of the aforementioned school pro- perty. Councilman Barnes seconded the motion. The vote follows: Ayes: Councilmen Barnes, Massey, Hullum, Braswell, Huron and Donnelly. Mayor Cravey Nays: None Delegation - Improvement of Alabama Street A delegation of home owners abutting upon Alabama Street appeared to petition the Council to consider improving Alabama Street. W. J. Reineke was spokesman for the group and urged the Council to make necessary repairs to the street by using maintenance funds. He explained that the residents had formerly tried home -owner participation but many of the occupants of the homes are retired and have a fixed income and do not feel that they are financially able to accept further expenditures at this time. Too, many have since moved away and the property is now vacant or serv- ing as rent property. The sister streets, Utah and Florida, have been repaired but Alabama Street has had no major repairs done to the streets since its construction in 1992. Cnuncilman Barnes suggested getting a definitive estimate of what needs to be done to the street, the cost., etc - then an appraisal of what the estimated re- pairs will do to the street - will it be a 1st, 2nd or 3rd class street. This would give the property owners some assurance that the Council will take a careful look at the problem and make a report back to them after a reasonable time has lapsed to make the necessary estimates and appraisal. He also requested an estimate of cost on providing storm sewer drainage for the street, in conjunction with the base and curb work. Councilman Braswell suggested circulating a property -owner participation petition and using bond money for its improvement. At the conclusion of the discussion, it was agreed that the Administration will be instructed to prepare estimates of cost on the proposed improvements. The Council will then be in a position to decide if funds are available for the project and a definite approach will be instituted to resolve the problem. 4050 Consider Providing Water and Sewer Service - Station at Bowie Drive 6 Highway 146 The Council discussed a recent request for water and sewer service lines to a building being constructed at the corner of Bowie Drive and Highway 146 (Alexander Drive). There are water and sewer trunk lines in the area but, to service the present and proposed construction, additional lines will have to be extended to service each build- ing. According to the City's ordinances, in respect.tq water and sewer extensions, the City may extend a service line one hundred feet at its expense and the property owner bear the remaining expense to complete the service extension. The Council reviewed the tentative long range plans for water and sewer installations, as prepared by Turner C Collie, Consulting Engineers, compared these plans in relation to the present request and offered several proposals in relation to installation of water mains of sufficient size to provide fire protection. The property owner has requested a 2 -inch water service extension. Should the City decide upon a larger line, it would bear the additional cost of a larger line. After discussing the many facets of the request, Councilman Donnelly moved to tie -in the 2 -inch water line at the south east corner of the property line, the city pay the cost of the first 100 -feet extension; the city bear the cost of extending the sewer line 100 -feet from the west side of Alexander Drive, under the highway to the east side of Alexander Drive, con- struct a manhole at this point and permit the property owner to continue the service line extension from this point to service his property. Councilman Huron seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Huron and Donnelly. Mayor Cravey Nays: None Councilman Barnes excused from meeting prior to completion of discussion. Huron - Restore Areas Tornuo Natural Gas Line Installation Councilman Huron instructed the City Manager to keep a close check and see that the easements, roads and rights -of -way being torn -up by the installation of.the Natural Gas mains, are properly restored before the contractor leaves this area.' Joint Election - School and City Councilman Donnelly, reporting for the Committee appointed to study the feasibility of holding joint City - School elections, informed the Council of the results of a recent meeting of the Committee. It is evident that ,joint elections can be held, however, there are some details which must be worked out before an election can be conducted. The time element favors holding a joint election for the run -off as the city's charter provides for the calling of the primary election in January, 1966. According to the City Attorney, it would be most difficult to hold a joint election for the primary, however, ,fir. Donnelly asked for an expression from the Council. The Council favored the latter proposal, so Councilman.Donnelly moved to not hold a joint election on the primary, but the Mayor be instructed to appoint a Committee to work with the City Attorney and the School Attorney to work out the details of a contract in order for a joint election to be held for the run -off. Councilman Braswell seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullum, Braswell, Huron and Donnelly. Mayor Cravey Nays: None Mayor Cravey retained the members of the present Committee to work with the City Attorney and School representatives for the formulation of a contract which would be applicable to both City and School District. Proposal - Special Meeting Review Depository Contract - Relating to Services The Council set the date of Thursday, January 20th, to hold a special meeting with the City Manager, Director of Finance and President of Citizens National Bank Trust Company, if the Council chooses, to review the depository contract, to see what services are being furnished, to clarify what services the city wants to take advantage of and to notify the President of the Bank, in writing, of the final decision of the Council after the study has been made. 4051 Huron - Charge to the Council Councilman Huron presented his charge to the Council for the next two years. The charge included the following items, to -wit: (1) Adopt a uniform bid form or policy for receiving bank depository bids. (2) Continued effort on the City - School election program. (3) Continued effort on combining the City- School Tax collection agencies. (4) Decision from the Parks Committee on location of park area to provide recreational facilities such as baseball diamonds, tennis courts, etc. (5) Decision on whether or not the city can afford to abandon the Woodlawn and Cedar Bayou disposal plants, replace different location. Approve Purchase - Civic Center Site As a matter of clarification, Councilman Donnelly moved that the purchase of the 29 -acre Civic Center Site, which was consummated in November, 1965, be affirmed by the Council. Councilman Massey seconded the motion. The vote follows: Ayes: Councilmen Massey, Huron and Donnelly. Mayor Gravey Nays: Councilmeh Braswell and Helium. :Miscellaneous Councilman Braswell asked the City Manager to obtain a report from the Police Department on the number of accidents occuring during the past two years at the corner of 4th Street and East Gulf. Councilman Huron reported that the Traffic Committee is investigating this intersection presently, and a report will be forth- coming shortly. Councilman Braswell urged the Mayor to appoint a committee to actively support the construction of a bridge across Cedar Bayou. Such a bridge will be in great demand after the Steel Mill becomes a reality, production to begin in about two years. The Mayor asked to delay any appointments until the meeting is held with officials of United States Steel Company in Houston on January 6th. :Mayor Cravey urged the Council to report to the City Manager and City Attorney any rumors of substandard subdividing of property within or near the city limits of Baytown. The city's present Subdivision Ordinance provides for controls by the City Council within a 2 -mile radius of the city limits. Some property owners are planning the sale of acreage presently by metes and bounds and the Council expressed its intent to stop such violations, if at all possible. The City Manager was instructed to refuse the erection of signs upon the city easements or any area where the city has control of the property, City Manaaer's Report The City Manager was instructed to contact Tom Masterson, the City's Fiscal Agent, and request preparation of an ordinance authorizing the sale of the $3,015,000 all purpose bonds for presentation at the January 13th, 1966 meeting. The Council instructed the City Manager to request Turner & Collie Consulting Engineers, Inc., to prepare bid proposals which will provide for alternate materials of concrete, vitrified clay and epoxy -lined transite pipe of all sizes, when re- questing bids for water and sanitary sewer construction under the bond program. Texas State Guard - Purchase Dodge Weapon Carriers Councilman Donnelly moved to approve the application of the Texas State Guard to purchase two 1952 Weapon Carrier Trucks through the Texas Surplus Property Agency, said purchases to be paid for by the Texas State Guard. Councilman Huron seconded the motion. The vote follows: 4052 Ayes: Councilmen Massey, Hulltq Braswell, Huron and Donnelly. Mayor Cravey Nays: None Ordinance - Setting Date for Public Hearing Annexation - Toward Inter -State 10 -Tri Citv Beach Councilman Huron moved to adopt an ordinance setting the date of January 13th for a public hearing upon the proposed annexation of two miles of land extending east along Interstate Highway 10 and along the Tri -City Beach Road. Councilman Donnelly seconded the motion. The vote follows: Ayes: Councilmen Massey, Hullurn, Braswell, Huron aid Donnelly.
