MINUTES OF A SPECIAL MEETING
OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
September 27, 1965
The City Council of the City of Baytown, Texas met in special session on Monday,
September 27, 1965 in the Baytown City Hall with the following members in attendance:

The meeting was called to order by the Mayor 8 r the purpose of discussing the
bank depository bids which were received on September 16th and discussed at length
at the September 23rd meeting.
Councilman Barnes suggested asking the banks for cash alternates under Item V
on each of their binds. This approach was favored by a majority of the Council but
Councilmen Donnelly and Braswell opposed it. They favored the Council members review-
ing the proposals and placing their own evaluations on each item to determine which of
the banks submitted the best bid. Councilman Braswell stated that he felt it was the
Council's responsibility to evaluate the bids and in his opinion was unethical to go
back to the banks and request new bids. Councilman Donnelly expressed some doubt as to
the legality of asking the banks for such evaluation. After a lenghty discussion,
on motion by Councilman Barnes, seconded by Councilman Massey, the following was
moved; To go back to the banks and request that they restate their bids covering Item V
in the bid form. The City expects to receive the usual banking services listed as
follows:
Free counting, sorting and rolling of coins
Free charges for overdrafts on city accounts
No paying agency fees
No service charges of any kind on city accounts or city funds
Free cashier's checks
Free bank money orders
Free traveler's checks
Free safety deposit boxes
Free night depository
Free certified checks
Free deposit books
Free vault service
Free checks
Handling of sight drafts at no charge to the city
Any'bther considerations" shall be stated in such a manner that the city may accept
the services or the bank's statement of the equivalent in cash with such cash being de-
signed for items included in the budget, with the services to be performed at the city's
discretion, or cash to be paid in equal quarterly payments with the first payment being
paid on the first day of the depository contract. It is to be expressly understood
that the cash payment be a specific amount of money. These cash considerations are
to be totaled. It is expressly understood that the banks will be responsible for the
legality of their bids and that it further be understood that if a bank submits an
illegal bid that voids the bid, this shall be reason to void the contract and award
it to the next highest legal bidder. This clarifying statement supersedes Item V
in the original bids. This clarification of bids must be delivered to the City Clerk
in a sealed envelope not later than 6:30 p.m., Wednesday, September 29, 1965. The
vote follows:

Councilman's Donnelly's Motion
Councilman Donnelly moved that the council evaluate the bids but it died for
lack of a second.
Adiournment
The motion was made for the meeting to adjourn. The ayes were unanimous and
the Mayor declared the meeting adjourned.
