MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS
September 9. 1965
The City Council of the City of Baytown met in regular session on Thursday,
September 9, 1%5 at 6 :30 p.m. in the Council. Room of the Baytown City Hall with
the following members in attendance:

The, Mayor called the meeting b order, the Invocation was offered, after -
which the minutes of the special meeting of August 25th, the regular meeting of
August 26th and the special meeting of September 2nd were called for reading,
Councilman Massey moved to dispense with reading and they be approved with the
following corrections in the regular meeting: Bank Depository- Receive bids
on September 16, 1965 at 5:00 p.m. Adams Street Ditch - The County will do
the same thing on the Adams Street Ditch, etc. Councilman Huron seconded the
motion. The vote follows:
Ayes: Councilmen, Massey, Hullum, Braswell, Huron and Donnelly.

Welcome Demo 1 ays
Mayor Cravey welcomed three members of the Demolays who were visiting
the Council meeting prior to a meeting of September 16th in which they will
be acting "City Dads."
Public Hearing - Protesting Application - On- Premise Beer License, 1107 Riggs
Street
Mayor Cravey opened the public hearing to determine whether or not the
application of Mrs. Inez Daniels for an on- premise beer license at 1107 Riggs
Street should be approved. Ordinance No. 738 states if there are as many as
five people within 300 feet of the location object to the issuance of an on-
premise beer license it is automatically denied by the City. Councilman Hullum
moved to recommend to the Harris County Judge and the Texas Liquor Control Board
that the application of Mr$. Daniels be denied. Councilman Huron seconded the
motion. The vote follows:

Drainage of Allen Field Property on Baker Road - Mr. Wilcox
Mr. Johnny Busch, Consulting Engineer, in behalf of Allen Field, a developer,
presented a request to the City Council for the City's participation in the cost
of lowereing a siphon on a canal owned by the San Jacinto River Authority. A resi-
dental and multi - family apartment development is being planned for the property,
which will not drain sufficiently without the lowering of the siphon or by in-
creasing the capacity of the existing ditch.
Mr. Bushc stated that if the siphon is lowered it would eliminate the need
of a portion of drainage ditch that has been proposed by the City under its Com-
prehensive Plan. Councilman Huron stated that he would like an opinion.for Bernard
Johnson Engineers, Inc. since they have studied the area and are preparing the
City's Comprehensive Plan.

Mayor Cravey pointed out that there are a lot of severe drainage problems of
people who have had them for years. He feels that these people should be helped
rather than provide new drainage for a new development.
The Council asked Mr. Busch to provide cost estimates on the project. An
opinion from Bernard Johnson Engineers will be obtained and a decision will be
made at a later meeting.
Equalization Board Report - R. H. Pruett
The Council heard a report from R. H. Pruett, Chairman of the 1965 Equali-
zation Board, relating to its meetings and hearings conducted for the tax year of
1965. The contents of the report included the general hearings with citizens.
At the end of the report Councilman Huron moved to accept the findings of the
Equalization Board. Councilman Braswell seconded the motion. The vote follows:
Ayes: Councilmen Massey, Hullum, Braswell, Huron and Donnelly.

Amendment - Fire Zone Ordinance
Councilman Donnelly moved to adopt an ordinance which amends the original
Fire Zone Ordinance No. 446, Section 3. The new ordinance will extend fire
zone number two, 150 feet on each side of West Main from Lee Drive to fire zone
on Market Street.
Councilman Braswell voted against the motion to amend the ordinance, ques-
tioning whether it would be fair on the part of the individual who had purchased
property prior to the passage of the ordinance with the intention of patting up
a certain type building and before he can get a permit, the specifications are
changed.
Councilman Donnelly seconded the motion. The vote follows:
Ayes: Councilmen Massey, Hullum, Huron and Donnelly.

SEVERABILITY CLAUSE; AND PROVIDING FOR THE EFFECT-
IVE DATE THEREOF"', BEING ORDINANCE NO. 446, PASSED
BY THE CITY COUNCIL OF THE CITY OF BAYTOWN.ON THE
26TH DAY OF SEPMTEMBER, 1957, BY CHANGING SECTION
THREE (3) THEREOF TO INCLUDE NEW BOUNDARIES WHICH
SHALL BE DESIGNATED AND KNOWN AS THE FIRE LIMIT
AREA OR ZONE NO. TWO (2) OF THE CITY OF BAYTOWN;
REPEALING ORDINANCES IN CONFLICT THEREWITH; PROVID-
ING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECT-
IVE DATE THEREOF.
Agreement - Traffic Light - Highway 146 and Crosby -Cedar Bayou Road
Councilman Donnelly moved to adopt an ordinance accepting the maintenance,
operation, enforcement and control of the traffic signal located at the inter-
section of Highway 146 and Crosby -Cedar Bayou Road, from the State Highway Dept.
Councilman Braswell seconded the motion. The vote follows:
Ayes: Councilmen Massey, Hullu, Braswell, Huron and Donnelly.

MENT, BATED SEPTEMBER 9. 1965, BETWEEN THE STATE OF
TEXAS AND THE CITY OF BAYTOWN, FOR THE CONTINUED
EXISTENCE, USE, OPERATION AND MAINTENANCE OF HIGH-
WAY TRAFFIC SIGNAL AT THE LOCATION SHOWN ON EXHIBIT

ONE (1), ATTACHED HERETO AND MADE A PART HEREOF, IN
THE CITY OF BAYTOWN; REPEALING ORDINANCES INCONSIST-
ENT HERWITH; CONTAINING A SAVINGS CLAUSE; PROVIDING
FOR THE EXECUTION OF SAID AGREEMENT; AND DECLARING
AN EMERGENCY.
Budoet Hearino
The Council agreed to set September 23, 1965 as the date of the public
hearing on the 1%5 -66 budget. This is the night of the next regular Council
meeting.
Resolution - Transfer Funds
Councilman Braswell moved to adopt a resolution transferring $350.00 from
one account within the Fire Department to another account withinthe same depart-
ment for maintenance to buildings, and for $100.00 from one department within
the Police Department to another account within the same department for purchase
of dog food. Councilman Donnelly seconded the motion. The vote follows:

RESOLUTION NO. 91
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE CITY MANAGER TO TRANSFER APPROPRI-
ATED FUNDS FROM ONE ACCOUNT TO ANOTHER WITHIN THE SAME
DEPARTMENT.
Commercial Zone - Houston
City Manager Lanham and Councilman Huron will attend a public hearing
which will be held Monday, September 13, in Houston, by the Texas Railroad
Commission pertaining to the need for a Houston Commercial Zone.
Committee Reports
Councilman, Braswell gave a report on the recent meeting of the Goose Creek
Development Committee. Mr. Braswell reported a new program of the Texas Parks
and Wildlife Department where it is possible to get funds matching 50% of the
cost of a program. He stated that the State is making a survey of the recrea-
tional facilities throughout the state and are sending out forms to the ones
who have a project and want to be on the planning list. It is a Federal
program and is handled by the state. Councilman Huron moved to submit the
forms to the Texas Parks and Wildlife Department for future help in financing
the fresh water lake on Goose Creek Stream. Councilman Massey seconded the mo-
tion. The vote follows:

Councilman Massey reported on the Citizen's Committee meeting concerning
the fish kill and polution of channel waters and bays. The Committee wants to
know what the City's legal status it toward being able to bring a suit against
the State regulatory body that permits the disposition of polution into the
channel.
Councilman Huron stated that the Council as a governing body and a repre-
sentative of the people in the area that has been affected by the fish kill,
should do anything it could, legally, to try to eliminate the situation.
Councilman Donnelly reported that the Fire Arms Committee held a public
hearing on September 1, 1965. He stated that it was productive and that the
Committee would have a recommendation at the next regular Council meeting.

Councilman Huron gave a report of the Traffic Committee. He presented to the
Council, cost estimates of between $8000.00 and $9,000.00 dollars for revision of
the existing traffic control system at the intersection of Texas Avenue and North
Main Street. The Traffic Committee recommended to the Council not to install this
system.
The Traffic Committee recommends the City administration to contact Mr. V. V.
Ramsey to see if a dangerous hazard on North Main between Bob Smith Road and Cedar
Bayou Road can be eliminated. This stretch of road needs to be graded off.
The Traffic Committee has made a study of the hazard at Memorial Drive and
Fleetwood. The Committee will make a recommendation at a later date.
The City Administration will start the revision of the traffic control sys-
tem at Robert E. Lee High School. It is to be completed by the end of the week.
Mr. Huron stated that at a later date the Committee would make a recommendation
to the Council that there be no parking on North Main Street between East James
and Cedar Bayou Road.
Councilman Massey reported on the joining of Craigmont and Ponderosa Sub-
divisions to an outlet to Baker.Road. The residents of Craigmont feel that the
Highway Department is going to close one of the lanes for further straightening
and reroute the traffic down the new lane that is now being topped. Mr. Massey
stated he would like to have the estimates from the Engineering Department on
the two alternates as soon as possible, the alternates being 1) Going along
by the Southern edge of McElroy Park with a connecting street, and 2) the orig-
inally proposed 30 foot across the right -of -way at Dorris and Hemlock Streets.
Councilman Massey suggested also, that information be obtained from the High-
way Department in regard to their exact plan and what would be the traffic
pattern in the area for egress.
City Manager's Report
City Manager Lanham gave a status report on the Street Improvement Program.
The following projects have been completed:
Gentry Drive
Burnet Drive -.Storm Sewer
East Defee - Storm Sewer
Bayshore Drive - 75% of fill material is.stock -piled on site.
Central Heights Area - All curb work and pavement repairs have been completed in
preparation for resurfacing.
Mr. Lanham presented the Council with copies of a report on the work that
was accomplished during the summer by employees working under the Youth Employ-
ment Program. The following number of youths were used:
Parks Department - 4
Sanitation Department - 2
Street Department - 2
Sewer Department - 3
Engineering - 1 girl. 1 boy
Police Department - 1 girl, 1 boy
Mr. Lanham stated that he thought the program had been successful and he
would like to use at least seven of the youths during the winter months. Council-
man Huron moved to permit the City Manager to hire the youths during the winter
months. Councilman Donnelly seconded the motion. The vote follows:

Storm Sewer - Adams Street Ditch
„ Mr. Lanham presented the Council with cost estimates for material to con-
struct astorm sewer in Adams Street Ditch. An estimate of $36,321.40 was given
for a 60" storm sewer from Strickland to Narcille Street, and a supplement of
$14.280.00 from Narcille past Holly Hills Subdivision for a total of $50.601.40.
The possibility of property owner participation was discussed. Councilman
Braswell and Mayor Cravey mentioned that one property owner had expressed his
willingness to pay some of the cost. Councilman Huron stated that he would like
to look at providing covered ditches throughout this and other areas of the City.
He suggested that these be included in a bond issue so that all the drainage pro-
blems could be eliminated at one time. After a lengthy discussion the Council
decided to defer action until further study could be made.

Jack Morton, City Engineer, presented a sketch of the proposed traffic cir-
cle at Baytown Junior High School. Mr. Morton reported that the radius of the
circle would be 37! feet. The school sent over the largest bus they have and
the driver drove around the circle on the inside lane with ease. Mr. Morton
stated that a circle of this size with two lanes would take care of any type .
truck that would be traveling around it. Councilman Donnelly moved to accept
the recommendation of the Traffic Committee to construct this circle. Council-
man Massey seconded the motion. The vote follows:

It was suggested that the traffic light be left intact until the circle proved
to be the workable solution. -
There is to be a meeting of the Harris County Mayors' and Councilmens'
Association Thursday, September 16, 1965 at 7:30 p.m. at the Continental Houston
Motor Hotel.
The Texas Municipal League Conference will be held October 31st through
November 2nd in San Antonio, Texas.
Re- Use.Asphalt Topping and Subbase Material
Councilman Braswell questioned the possibility of taking the old asphalt
topping and subbase of fof streets that are being replaced, crushing , remixing
it and using it again on minor streets as a base material.
Jack Morton stated that it is the responsibility of the contractor to re-
move the material. He usually gives It away to haulers in town and all the
contractor has to do is load it on the truck. If the City designated a place
for the material to be dumped they would either have to pay the contractor to
haul it or use City trucks and forces. The cost of hauling, crushing and re-
mixing would cost the City almost as much as new material which is $3.00 per
yard. Councilmen Braswell said he would like to see the City use some of this
material for a base and top it with,esphalt.
Adiournment
Councilman Huron moved for the meeting to adjourn. Councilman Donnelly
seconded the motion. The ayes were unanimous and the Mayor declared the meet-
ing adjourned.
