MINUTES OF THE SPECIAL
MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
April 14, 1965
The City Council of the City of Baytown, Texas met in special session on Wednes-
day, April 14. 1965 at 6:30 p.m. in the Council Room of the Baytown City Hall with
the following members in attendance:

The meeting was called to order by Mayor Liggett, the Invocation was offered
afterwhich the following business was transacted:

City Manager Lanham recommended that the low bid of Bayshore Constructors, Inc.
be accepted as it will tie -on to asbestos - cement pipe at Baker Road and again at
Massey- Tompkins Road and North Main. Councilman Badgett moved to accept the low
bid of Bayshore Constructors, Inc for A. C. proposal of $10,856.75. Councilman
Lively seconded the motion. The vote follows:

Resolution - Canvassing Election Returns and Declaring Results of Election
The City Council canvassed the returns of the General Municipal Election held
April 6. 1965 by verifying the election totals of the eleven precincts and the
absentee machine at city hall as submitted by the election judges. The City Manager
then introduced and read a resolution declaring the results of the election, fining
that notice was duly held and the returns made by the proper officials in accordance
with the laws of the State of Texas. Councilman Lively moved to adopt the resolution
as read. Councilman Badgett seconded the motion. The vote follows:

Interview Architects - Construction of City Hall - Proposals
The Council agreed upon a ten (10) minute time limit to hear the proposals of
the two architects and five (5) engineering firms seeking contracts with the City of
Baytown for the implementation of the City's Capital Improvement Program. The archi-
tects were to confine their proposal to the construction of the City Hall but the
engineering firms, all phases of the issue. The first architect to be heard was
James A. Davis, 401 West Defee Street. He introduced members of his staff who are
professionally trained in architecture, all five are college graduates, three are regis-
tered Architects, and all have experience in the field beyond the college level; also,
submitted brochures of the Lee College Vocational Techinical building and the Robert E.
Lee High School Science Building showing the firm's ability and experience in planning
and coordinating one building in a mass with others, coordinating utilities, drives,
planting, site development, and other phases of construction. Regarding fees, he stated
his fees would be based upon the minimum fee schedule of the American Institute of
Architects. In October, 1964, the schedule for the standard minimum fee for construc-
tion of a city hall was 7% of project construction cost; of this fee, three and one -half
(.%%) percent will be paid to sub - engineers.
Lowell Lammers, the second architect, submitted a brochure requesting that his
firm be retained by Contractural Agreement for the design and construction development
of the entire Community Center Site. The complete architectural services would include
financial and site analysiss; operational and building programming; building planning and
design; and construction management.. In certain areas of the work, specialized pro-
fessionals will be retained. Generally these include Electrical, Mechanical, Structural
and Site Engineers. Landscape Architects, Acoustical and Interior Design.Consultants are
retained on a contingent fee basis. The firm would advertise for and secure bids and
proposals from reputable and financially reliable contractors who have the ability to
post bid and completion bonds. Relative to compensation, the City and the firm of
Lowell Lammers presently have an Agreement for the construction of a Community Center
which calls for the basic architectural services.to be performed at 6% of the construc-
tion cost for work let on a lump sum single contract; the fee will be the same for the
construction of the City Hall. After hearing both presentations, a secret vote was
taken and Lowell Lammers was.selected as the firm to act as architects in the construc-
tion of the city hall.
Interview Enaineerina Firms
Bernard Johnson Engineers, Inc.. was the first to present an engineering proposal
to provide engineering services for the proper completion of the proposed Bond Program.
An experience record was submitted with a listing of references should the City Adminis-
tration desire to investigate further. It is the policy of the firm to use local
qualified firms in its conduct of work; have had experience in public approved programming;
have in -house and on -board every discipline of engineering and planning service;
management oriented service, including control by job path techniques as well as financial
aid guidance. The lastest Manual of Professional Practice for Engineering Service will
serve as a guide for the fees, however, the firm proposed to give the City cash credit
for any fees due the firm by virtue of the work performed heretofore; total possible
fee credits amount to $16,600. Also. it was suggested that separate fees be negotiated
for the different portions of the work in order for the city to take maximum advantage
of complexity and duplication of facility factors.
A. J. Busch, Jr., owner of the Busch Engineering Company, submitted his proposal
to enter into contract with the City of Baytown to provide engineering services for
the completion of the proposed improvements. He presented a brochure with a proposal
for the proposed appraisal of the city's water and sanitary sewer system at a total
fee not b exceed $2,000; should the City undertake a pressure analysis, he recommended
the City negotiate with the firm of "Pit -O -Meter and Associates of New, York" as they
were specialists in the field. The engineering fee proposed is the minimum recommended
fee as set forth in Schedule of Charges in the "Manual of Professional Practice, General
Engineering Practice ". Inspections, however, will be an added cost, on a per diem basis.

Interview Engineerina Firms - continued
W. D. Broyles, for Pace Engineers, Inc., submitted a proposal to provide engineer-
ing, drafting and surveying services for the work being contemplated as the first
phase of the bond program recently adopted by the voters of the City of Baytown.
The staff of Pace Engineers compreises forty persons who are well experienced in their
fields and take pride in providing quality engineering services. In his presentation,
Mr. Broyles stated that the firm would like to be considered for all of the engineering,
however, it would accept and carry out the eigineering on any one or more phases of the
whole program. He presented a Fee Basis I and Fee Basis II Schedule. Under Basis I, the7
services covered art as listed in the TSPE Manual on Design Type Projects, Services
and expenses not included by this basic design fee are included in Fee Basis II which
Is a per diem or hourly charge.
Mr. Collie, for the firm of Turner & Collie Consulting Engineers, Inc., reviewed
a proposal to provide engineering on Phase No. 1 of the Bond Program. He stated
that the Firm was comprised of engineers who are specialists in the field of Municipal
engineering. He presented a brochure listing the principals of the firm, the civil
engineers, structural, sanitary and mechanical engineers with other key personnel
such as planners, draftsmen, inspectors, etc. Also, a listing of the present activities
of the firm, the name and type of project, location and estimated cost. The firm
would accept any part of the engineering the council.should designate to it. The fee
is the minimum recommended fee as set forth in Schedule of Charges in the Manual of
Professional Practice, General Engineering Practice..
William C. Walsh, of the firm of Walsh & McLaren, Angleton, Texas, submitted
his proposal $r professional engineering services in connection with the Bond Program.
He stated that his fees would be based on the latest Manual of Profession Practice
for General Engineering Service as published by the Texas Society of Professional
Engineers, Austin. If his firm is selected they will open and maintain an office in
Baytown for the duration of the project. If the pressure study is made on the exist-
ing and proposed water exensions this fee will be deductible in full from their fee
when the Capital Improvements Program is carried out. He listed work which had been
done by the firm, should the council want to make inquiries. At the conclusion of the
Interviews, the Council decided to postpone the selection of an engineering firm until
a later meeting.
File Cabinet - Mayor Cravev
The council approved the purchase of a filing cabinet for Mayor Cravey. He pro-
posed to return the cabinet to the city at the conclusion of his tenure of service
with the city.
Adiournment
Councilman Badgett moved for the meeting to adjourn. Councilman Lively seconded
the motion. The ayes were unanimous and the Mayor declared the meeting adjourned.
