1964 10 08 CC Minutes2067 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS October 8, 1964 The City Council of the City of Baytown, Texas met in regular session on Thursday, October 8, 1964 at 6:30 p.m. in the Council Room of the Baytown City Hall with the following members in attendance: J. Robert Barnes Councilman David C. Clark Councilman Kenneth E. Badgett Councilman M. E. Lively Councilman J. C. Huron Councilman C. L. Liggett,.M. D. Mayor Fritz Lanham City Manager George Chandler City Attorney Edna Oliver City Clerk Absent: Seaborn Cravey Councilman The Mayor called the meeting b order, the Invocation was offered, afterwhich the City Clerk was instructed to read the minutes of the September 23rd meeting. Councilman Badgett moved to dispense with reading of the minutes; they be approved as submitted in written form. Councilman Barnes seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Lively and Huron Mayor Liggett Nays: None G. Cain - Propose Adoption of Ordinance Protect Public Railroad Crossings Mr. Garth Cain, engineer for the Missouri- Pacific Railroad Company, petiitioned the council to adopt an ordinance requiring each Railroad Company operating within the city limits of Baytown to man each engine with a full crew, that is an engineer, a fireman, a conductor and two brakemen; such an ordinance would be essentially the same as the State Full Crew Law now in effect. The council agreed to take the request under advise- ment. In the meantime, the City Attorney will furnish each councilmember with a brief of the State Law requiring a full crew on all locomotives. Mr. Cain will be notified if the council decides to resume discussion of this matter at the conclusion of its study. If this is decided, representatives of the railroad companies operating within the City of Baytown will be asked to be present at the council meeting also. Tow Service Abandoned Vehicles At the September 24 th meeting, the City Manager was instructed to ask for bids, on a per unit basis, for towing charges for abandoned cars as ordered by the Police Department in accordance with Ordinance No. 726 of the City of Baytown. Only one bid was received within the specified time, this being Jimmy Barcelo of Higginbotham Motor Company and was $10.00 per unit. Councilman Huron moved to accept the bid of Jimmy Barcelo for the towing service at $10.00 per unit. Councilman Barnes seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Lively and Huron Mayor Liggett Nays: Councilman Badgett The terms of the bid proposal stipulated a one -year contract, but according to the requirements of a new "Wrecker Ordinance ", adopted by the City Council August 27, 1964 and being Ordinance No. 728 of the City of Baytown, only persons and businesses operting ' within the city limits of Baytown shall be lidensed. Mr. Barcelocperates a garage at Four Corners which is outside the city limits of Baytown. This will require the adminis- tration to readvertise for towing bids on or before January 1, 1965. 2068 Clyde Jones - Discuss Proposed Changes in Wrecker Ordinance Clyde Jones, representing wrecker operators within the City of Baytown, presented proposed changes to the wrecker ordinance adopted by the City Council on August 27, 1964. The proposed changes are as follows: Section 4: License Fee First New License should be $500.00 - the renewal annual license fee to be $25.00. Section 6: Wants city council to rule on "new" wrecker license - similar to franchise grants. Section 7: Semi - Annual inspection of brakes, lights, and mechanical condition of wreckers shall be subject to inspection of Police Department or Traffic Committee. (a) Supplemental Wreckers: 1. Owner must go before City Council for approval 2. Operator cannot run one small and one large wrecker 3. Inspection etc shall be same as on No. 1. Section 8: Regulations Governing Auto Wrecker Operation (a) After the word fire extinguisher, the word "pry -bar" shall be entered. (b) Wrecker drivers shall help with directing traffic until adequate police arrive. (c) Scratch both bottom lines of section "C ". (d) If individual owner of vehicle does not specify a specific wrecker to haul his car, the present wreckers shall "draw" for the job. All wreckers shall stay at their licensed places of business during normal working hours. Section 5: Liability Insurance: (a) For injury to any one person - $50.000.00 For injury to two or more persons or death, etc. - $100,000.00 For injury to or destruction of property etc - $ 20,000.00 The proposed revisions were discussed at length, afterwhich, further action on the proposed changes was deferred to allow the City Council and the Council's Traffic Committee to make a study of them in respect to both public and private interest. Mr. Jones will be notified of the Council's decision after the study has been com- pleted. Replacing Incandescent Street Lamps with Mercury Vapor Lights - West Pearce & West Defee Councilman Lively moved to accept the recommendation of the City Manager and approved the replacement of eleven (11) incandescent street lamps on West Pearce and West Defee between Commerce and Pruett with mercury vapor lights. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Barnes. Clark, Badgett, Lively and Huron Mayor Liggett Nays: None Council Record - Mosquito Control Program Councilman Huron moved to endorse a county wide mosquito control program and to urge the county officials to take appropriate action to control mosquitoes in Harris County. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Lively and Huron Mayor Liggett Nays: None Earnest Deposit - 30 acres Land - John M. Kilgore Councilman Clark moved to approve the contract with John M. Kilgore for an earnest deposit of $1.000.00 covering the purchase of approximately 30 acres of land 2069 that faces 795 feet on Market Street and approximately 1000 feet on West Main Street. Councilman Lively seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Lively and Huron Mayor Liggett Nays: None Approved Proposal Turner C Collins - Engineer Services Elevated Storage Tank Baker Road Councilman Lively moved to approve the proposal of Turner & Collins, Consulting Engineers of Houston for engineering services in connection with the replacement of foundations for the elevated storage tank on Baker Road. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Lively and Huron Mayor Liggett Nays: None Miscellaneous The Ordinance Committee will have a draft of a proposed ordinance controlling the trash haulers using the sanitary land fill at the next regular meeting. These will be passed out to the Council for its perusal and adoption at a later meeting. City Manager Lanham will contact State Officials for a report on the Council's Resolution urging the construction of a levee in the Brownwood- Lakewood area. The City Manager, Director of Public Works and City Council will continue its study of streets and thoroughfares to be included in the 1969 -65 major improvement program.
