1964 09 10 CC Minutes2059 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF B.iAYTOWN September 10, 1%4 The City Council of the City of Baytown, Texas met in regular session on Thurs- day, September 10, 1964 at 6:30 p.m. in the Council Room of the Baytown City Hall with the following members in attendance: J. R. Barnes David C. Clark Kenneth E. Badgett Seaborn Cravey M. E. Lively J. C. Huron Fritz Lanham George Chandler Edna Oliver Absent: C. L. Liggett, M. D. Councilman Councilman Councilman Councilman Councilman Mayor Pro Tem City Manager City Attorney City Clerk Mayor Mayor Pro Tem Huron called the meeting to order, the Invocation was offered, after - which, the City Clerk was instructed to read the minutes of the August 27th meeting. Councilman Badgett moved to dispense with reading of the minutes; they be approved as submitted in written form. Councilman Lively seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Cravey and Lively Mayor Pro Tem Huron Nays: None Budget Hearing - Ordinance Adopting Budget Fiscal Year 1964 -65 The public hearing upon the proposed 1%4 -65 fiscal year budget was opened by Mayor Pro Tem Huron. City Manager Lanham gave a brief breakdown of each department and its total appropriation as compared-with the 1963 -64 budget appropriation. Those in the audience were then given an opportunity to be heard if they had questions. Mr. Charles Danelly made an appeal to the council for the reinstatement of the city's full contribution supporting the Little League Ball program in Baytown - during the budget review the council had reduced the city's contribution from $1,500 to $750 for the 1964 -65 fiscal year. The hearing was then declared closed by the Mayor Pro Tem and the City Manager was instructed to read an ordinance adopting the budget for the ensuing fiscal year, 1964 -65, in accordance with the Charter of the City of Baytown. Councilman Barnes moved to adopt the ordinance setting forth the budget estimate of revenues and expenses of conducting affairs for the City of Baytown for the ensuing fiscal year beginning October 1, 1%4 and ending September 30, 1965. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Cravey and Lively Mayor Pro Tem Huron Nays: None The caption of the ordinance follows: ORDINANCE NO. 729 AN ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR, BEGINNING OCTOBER 1, 1964, AND ENDING SEPTEMBER 30, 1%5, IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY OF BAYTOWN; AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE. 2060 Ordinance - Fixing Tax Rate, 1964 -65 Councilman Badgett moved to adopt an ordinance fixing the rate and tax levy for the fiscal ending September 30, 1965. Councilman Lively.seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Cravey and Lively Mayor Pro Tem Huron Nays: None The caption of the ordinance follows: ORDINANCE NO. 730 AN ORDINANCE FIXING THE RATE AND TAX LEVY FOR THE CITY OF BAYTOWN, TEXAS, FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1%5, UPON ALL TAXABLE PROPERTY IN SAID BAYTOWN, TEXAS, IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS AND THE CHARTER PROVISIONS AND ORDINANCES OF SAID CITY; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. Transfer Resolution - Purchase Radio Eguipment Councilman Clark moved to adopt a resolution transferring $800.00 from one budget classification to another classification, within the general fund budget, to purchase portable radios which will be used in the Fire, Police and Building Inspection Depart- ments of-the City. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Cravey, and Lively Mayor Pro Tem Huron Nays: None The caption of the resolution follows: RESOLUTION NO. 58 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, A[TrHORIZING THE CITY MANAGER TO TRANSFER, WITHIN THE GENERAL FUND BUDGET, CERTAIN FUNDS FROM ONE CLASSIFICATION TO ANOTHER CLASSIFICATION FOR PURCHASE OF RADIO EQUIPMENT. Approval - Adding Portion of McKinney Road to Contract No. 2 Street Improvement Contract Councilman Badgett moved to accept the recommendation of City Manger Lanham to add the improvement of a portion of McKinney Road, abutting the Cedar Bayou School and situated between the two sections of Cedar Bayou Road, to Phase II Street improvement Contract. Councilman Barnes seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Cravey and Lively Mayor Pro Tem Huron Nays: None Extension Storm Sewer Robin Road At the last meeting Councilman Clark had requested that an estimate of cost be prepared for the extension of storm sewer in the ditch along Robin Road abutting the Travis Elementary School. City Manager Lanham submitted an estimate of $3,546.40 as cost for a 211 foot extension which will close the entire ditch abutting the Travis School property on Robin Road. The closing of the entire ditch would eliminate the existing hazard caused by children riding bicycles to shcool. Councilman Clark moved to approve the construction project; the city manager be instructed to advertise for bids on the closing of the ditch and a contract be awarded for the improvement pro- ject provided the school district will share in Jva of the cost of such project. Council- man Badgett seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Cravey, Badgett and Lively Mayor Pro Tem Huron Nays: None 2061 Ci_/ o -6 V The City Council - School Board Joint Committee will discuss decision of the council in eliminating the hazard at its next regular meeting. Final Payment - Skrla. Inc. - Phase No. 1 Street Improvement Proiect Councilman Lively moved to approve final payment of $12.470.36 to Skrla, Inc., for Phase I of the Street Improvement projects approved by the City Council May 14, 1964. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett. Cravey and Lively Mayor Pro Tem Huron Nays: None City Attorney Chandler submitted a written memorandum relative to upgrading services of the General Telephone Company of the Southwest together with a copy of the city's existing franchise with the Telephone Company and excerpts from the City Charter on the powers of the Council in granting, amending, renewing and extending franchises to all public utilities operating within the City of Baytown, He stated that the Charter provisions are very broad but there are certain conditions in the franchise which could be burdensome to the utility should the City choose to follow its terms explicity. Regulating rates under the Texas Law is rather hard but services may be regulated under the Charter extensively. The Council discussed the pros and cons of a State Legistative Committee and seeking support of the Texas Municipal League for the creation of such a Commission. No definite decisions were made by the Council at this meeting; representatives of the General Telephone Company are scheduled to appear before the Council at the September 24th meeting at which time direct dialing facilities will be discussed at length. Accept Report - Bernard Johnson Engineers. Inc. - Northside Sewage Collection & Treatment Bob Andrews of Bernard Engineers, Inc.. submitted copies of a letter received by the firm from B. N. Walton, Chief Engineer -Plans and Grants - Texas State Health Department, which acknowledged receipt of the report of the needs of the City of Baytown for additional sewage collection lines and treatment facilities on the north_ side of the city. From the information presented in the report, it was his opinion that a major portion of the items would be eligible.for a Federal grant under Public Law 660. The council discussed the feasibility of making application for matiching funds on Phase 1 C 2 of the proposed projects, appropriate timing for calling a bond election, etc. and decided to delay making application for matching funds until a later date. Councilman Barnes then moved to accept the report of Bernard Johnson Engineers, Inc., on Northside Sewage Collection and Treatment and authorized the City Manager to pay the firm for professional fees on this phase as per agreement. Councilman Clark seconded the motion. The vote follows: Ayes: Councilmen Barnes, Mayor Pro Tem Huron Nays: None City Manager's Report Clark, Badgett, Cravey and Lively City Manager Lanham gave a progressive report on the street work now under contract. The Planning Commission will be asked to study the need and investigate the possibility of providing ,a third through street from Highway 146 and adjacent areas to North Main westward to Decker Drive. The City Manager was instructed to solicit the aid of the Baytown Chamber of Commerc and its Recreation Committee in the development of a State Park at the mouth of Cedar Bayou Stream. 2062 City Manager's Report - Continued The Council was given a copy of the Baytown Civil Defense Standard operating plan for hurricane emergencies as compiled by J. Fletcher Hickerson, Civil Defense Director. Should the Council have suggestions, these will be passed on to Mr. Hickerson. The City Manager was instructed to solicit the aid of the Municipal League in endorsing a resolution permitting the use of treated wood shingles rather than the required asphalt shingles as set forth by the State Fire Insurance Commission. A recent survey within the City revealed approximately 22% of the buildings are roofed with wood shingels and when a maximum of 25% has been reached. the Fire Insurance Commission will levy a penalty against the city and fire insurance rate 8r Baytown will be increased. Builders prefer wood shingles, and it was hoped that properly treated wood shingles may be substituted for the required asphalt shingles if the proposal can get the proper support from all parties concerned.
