1964 08 27 CC MinutesZU04 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN August 27, 1964 The City Council of the City of Baytown, Texas met in regular session on Thurs- day, August 27, 1964 at 6:30 p.m. in the Council Room of the Baytown City Hall with the following members in attendance: * J. Mayor Fritz Lanham City Manager Edna Oliver City Clerk Absent: George Chandler City Attorney The Mayor called the meeting to order, the Invocation was offered, afterwhich the City Clerk was instructed to read the minutes of the April 13th meeting. Councilman Badgett moved to dispense with reading of the minutes; they be approved as submitted in written form. Councilman Lively seconded the motion. The vote follows: Ayes: Councilmen Clark, Badgett, Lively and Huron Mayor Liggett Nays: None Letter - General Telephone Company Direct Dial Service into Houston Exchange City Manager Lanham submitted copies of a letter from E. 0. Cambern, District Manager of the General Telephone Company for the Baytown area. relative to the inquiry of Councilman Barnes for direct dial service into the Houston Exchange. Studies are being made to determine the cost for such service and he asked to be placed on the agenda for the September 24 meeting. The City Manager was instructed to have the City Attorney prepare a historical brief. in his own words, relative to the franchise, and what the City Council can do to expedite this service. This brief is to be prepared in sufficient time to permit the council to make a study of its contents prior to the meeting. Approve Plans - Employees Service Awards Committee Councilman Huron moved to approve the plans of the Employees Service Awards Committee to hold the dinner at Rod. Reel and Gun Club building on Saturday. September 19 at 6:00 o'clock p.m.; dinner to be buffet style with the City Manager presenting the tenure service awards to city employees. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Clark. Badgett, Lively and Huron Mayor Liggett Nays: None Ordinance - Removal and Impounding of Motor Vehicles Councilman Lively moved to adopt an ordinance directing the removal and impounding of motor vehicles when found in public places and an officer has reasonable grounds to believe that it is abandoned, stolen, left unattended upon any bridge, viaduct or in any manner obstructing traffic. Councilman Huron seconded the motion. The vote follows: Ayes: Councilmen Clark, Badgett. Discussion - Ordinance Parkina Violations The Council discussed the draft of an ordinance regulating the parking of motor vehicles in front of a residence or residences over several days period; permitting the Chief of Police to have such vehicles impounded after a sworn complaint has been filed with the Corporation Court. The discussion revolved around the definition of "habitually ", exceptions necessary in residential areas where parking meters are located, Wo is liable for wrecker fees when no violation is found, etc. It was decided to take no further action on the ordinance until it can be discussed with the City Attorney. Ordinance - Establishina Speed Limits Construction 330 Councilman Barnes moved to adopt an ordinance establishing speed limits during the construction of Spur 330. Councilman Huron seconded the motion. The vote follows: Ayes: Councilmen Clark, Barnes, Badgett, Cravey, Lively and Huron Mayor Liggett Nays: None The caption of the ordinance follows: ORDINANCE NO. 727 AN ORDINANCE ESTABLISHING SPEED LIMITS DURING CONSTRUCTION OF A PORTION OF SPUR 330 WITHIN THE CITY LIMITS OF BAYTOWN, TEXAS, AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. Resolution - Reauestina a State Park Mouth of Cedar Bayou Stream Councilman Badgett moved to adopt a resolution requesting the Texas Legislature to assist the City of Baytown in its efforts to establish a park on a tract of land near the mouth of Cedar Bayou Stream. Councilman Clark seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Cravey, Lively and Huron Mayor Liggett Nays: None The caption of the resolution follows: RESOLUTION NO. 56 -A A UNANIMOUS RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN RE- QUESTING THE HARRIS COUNTY DELEGATION TO THE TEXAS LEGISLATURE TO DO EVERYTHING IN ITS POWER TO GET THE TEXAS PARKS AND WILDLIFE DEPARTMENT TO EXTABLISH A TRACT OF LAND NEAR THE MOUTH OF THE CEDAR BAYOU STREAM AS A STATE PARK; AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE THIS RESOLUTION AND DIRECTING THE CITY MANAGER TO MAIL A COPY TO THE CHAIRMAN OF THE TEXAS PARKS AND WILDLIFE DEPARTMENT. 2056 Discussion - Water Service Residents Grace Oil Lease Director of Public Works Morton gave the council a brief history of water service for eight or nine families who live on Grace Oil Compnay's property on Evergreen Road. Grace Oil Company is billed by the.City and pays for the water consummed each month by the 8 -9 residences plus its own use. The water service to the residences is by a 2 -inch waterline across Gulf Company's property. When drilling contractors move into the area they pay for setting a meter and are permitted to tie into the 2 -inch line but when they fill their tanks the residences have no water. Heretofore there has been a gentlemen's agreement between the two oil companies - the drilling contractors set up f reservoirs for their use and fill same during certain hours of the night. Recently there has been violations due to the conduct of persons operating workover rigs within the area. It was recommended that the meter be moved from its present location on Gulf Oil property, and reset at the city's main on- Highway 146. The companies can then work out a peaceable settlement between themselves on water service to the residences and to service the reservoirs of workover rigs. After a lengthy discussion. Councilman Clark moved to reset the meter on city property at Highway 146. Councilman Barnes seconded the motion. The vote follows: Ayes: Councilmen Barnes. Clark, Badgett, Cravey and Huron Mayor Liggett Nays: None Abstained: Councilman Lively Extend Contract - Concession Stand Additional Two Years City Manager Lanham submitted a request from Leon Higgenbotham, present Lessee of the Roseland Park Concession Stand, for extension of his present contract for a two -year period. He has incurred considerable expense for this one season and would like an opportunity to offset his expenses and make a fair return on his investment if possible. Councilman Lively moved to approve the request; the 2 -year extension be granted Mr. Higgenbotham. Councilman Cravey seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Cravey, Lively and Huron Mayor Liggett Nays: None Request Constable Paul Anderson - Place Antenna on Water Tower Near 83 Fire Station The Council received a request from Constable Paul Anderson to place a radio antenna on the water tower located on South Main Street near Fire Station a3. Also, to place a base station in the brick building behind the meter repair office. City Manger Lanham recommended that the request be granted. Councilman Badgett moved to accept the recommendation of the City Manager and the request of Constable Paul Anderson be granted. Councilman Lively seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Cravey, Lively and Huron Mayor Liggett Nays: None Transfer Resolution - Water Well Councilman Clark moved to adopt a resolution transferring $1,320.00 from the Water Fund Contingency to pay for repairs on water wells at Carlton and Cleveland. Councilman Lively seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Cravey, Lively and Huron Mayor Liggett Nays: None The caption of the resolution follows: RESOLUTION NO. 57 -A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN. TEXAS, AUTHORIZING THE CITY MANAGER TO TRANSFER ONE THOUSAND THREE HUNDRED AND TWENTY ($1,320.00) DOLLARS FROM WATER FUND CLASSIFICATION 1005 CONTINGENCY TO BUDGET CLASSIFICATION 1001 -4 -7. 2057 Appoint - Members to Planning Commission Councilman Barnes moved to re- appoint W. D. Hinson, George L. Walmsley, M. D., and Mrs. Nancy Mundinger to the Board of the Baytown Planning Commission for the two ensuing years. Councilman Lively seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Lively and Huron Mayor Liggett Nays: None Set Date - Budget Hearing Councilman Barnes moved to set the date of September 10th for the Public Hearing upon the proposed 1964 -65 budget for the City, of Baytown. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Cravey, Lively and Huron Mayor Liggett Nays: None Ordinance - Amendment Regulating Operation of Auto Wreckers Councilman Barnes moved to adopt an ordinance amending the city's present wrecker ordinance to provide that no wrecker driver shall remove any wrecked or dis- abled vehicle outside the city limits unless otherwise directed by the legal title holder of the vehicle. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Cravey, Lively and Huron Mayor Liggett Nays: None The caption of the ordinance follows: ORDINANCE NO. 728 AN ORDINANCE REQUIRING A LICENSE FOR THE BUSINESS OF OPERATING AUTO WRECKERS; PROVIDING A LICENSE FEE; REGULATING THE OPERATION OF AUTO WRECKERS; PROVIDING THAT UNLESS OTHERWISE DIRECTED BY THE LEGAL TITLE HOLDER OF A VEHICLE OR HIS AUTHORIZED REPRESENTATIVE, NO WRECKER DRIVER SHALL REMOVE ANY WRECKED OR DISABLED VEHICLE OUT- SIDE THE CITY LIMITS OF THE CITY OF BAYTOWN; REPEALIING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED ($200.00) DOLLARS AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. City Manager's Report City Manager Lanham reviewed the street construction projects now in progress in the city and answered questions relative to the expected completion of each project. Chemicals are being distributed at the Fire Stations in an effort to control the mosquitoes since the outbreak of encephalitis in Houston and adjacent areas. The city forces are also spraying twice weekly. If it is found that the program should be accelerated, the City Manager is prepared to do so. The City Manager was instructed to get cost estimates for the completion of the project of closing the ditch abutting the Travis Elementary School. A portion of the ditch has been closed but the project needs to be carried further. The Council will review the street program of Baytown for the ensuing year. It is hoped that caflicts in the policies of property owner participation may be brought to a minimum so that some residential streets may be improved during the 1964 -65 fiscal year as well as thoroughfares. Hire - New Chief of Police - Blair Mann Councilman Huron moved to accept the recommendation of City Manager Lanham to hire Blair Mann as the new Chief of Police, date of employment to become effective September 1, 1964. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark. Badgett, Cravey, Lively and Huron Mayor Liggett Nays: None 2058 Adiournment Councilman Badgett moved for the meeting to adjourn. Councilman Huron seconded the motion.
