1964 05 05 CC Minutes, Special2016 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN May 5, 1964 The City Council of the City of Baytown, Texas met in special session on Tuesday, May 5, 1964 at 6 :30 p.m. in the Council Room of the Baytown City Hall with the following members in attendance: J. Robert Barnes David C. Clark Kenneth E. Badgett Seaborn Cravey M. E. Lively J. C. Huron Counc ilman Councilman Councilman Councilman Councilman Councilman C. L. Liggett Mayor Fritz Lanham , City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order and the following business was transacted: Decision - Hire Architect Community Center At the April 23 meeting of the City Council, C. J. Bailey, Jr., Chairman of the Community Center Committee, met with the council, gave a brief report on the work being done by the subcommittees and urged the council to retain the services of an architect as soon as possible as the group needs the professional advice and guidance of an architect in its research studies. The Council instructed the City Manager to contact the three architects, Dan Perkins, James A. Davis and Lowell Lammers, and invite them to meet with the council for an interview. Members of the Community Center Committee and the three architects met with the council to discuss the many ramifications required to properly develop an intelligent outline of the order to be pursued in tho presentation of a bond issue to the voters of Baytown. During the preliminary discussion it was definitely established that services of an architect were urgently needed for counseling prior to the architectural development and the fees would be the same regardless of the planning stage at which an architect is hired. Councilman Clark then moved to retain the services of an architect for the proposed community center. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Clark, Badgett, Cravey, Lively and Huron Mayor Liggett Nays: None During each interview, the architect in question gave a brief resume of his family, educational and occupational background. He then gave a brief oral listing of architectural construction in and around Baytown in which he was either partially or totally responsible by contract. Items discussed were: 1) Using the services of the City's Planner, Bernard Johnson, in conjunction with the architect; 2) the city's obligation to the architect, fee wise, should the bond issue fail to pass; 3) Architect fees; submitting a model written contract for council perusal prior to execution of a contract; and 4) submitting a written list of buildings designed and supervised by architect. A committee composed of Councilmen Clark, Badgett and Lively with Mr. Ash of the Bernard Johnson Engineering Company, was appointed to obtain information about the qualifications and type of work each architect has done for other clients. This committee will make a report on its study at the May 14th meeting and it is hoped that the council will be able to make a decision on the architect at the conclusion of the report. Execute Lease Agreement - City of Baytown- Cerebral Palsy Board Mayor Liggett executed copies of a lease agreement between the City of Baytown and the Baytown Cerebral Palsy Board. Term of the lease to be 50 years with option provisions. 2017 Resolution - Policy Manufacturing Industries In and Near Baytown Councilman Badgett moved to adopt a resolution of the city council which established and declared that manufacturing industries near the corporate limits of Baytown do not use municipal services to the same extent as private citizens and should be annexed proportionately to their use. Councilman Barnes seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Lively and Huron Mayor Liggett Nays: Councilman Cravey The caption of the resolution follows: RESOLUTION NO. 42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN FINDING, ESTABLISHING AND DECLARING THAT MANUFACTURING INDUSTRIES NEAR THE CORPORATE LIMITS OF THE CITY OF BAYTOWN DO NOT USE BAYTOWN'S MUNICIPAL SERVICES TO THE SAME EXTENT, IF ANY, AS DO PRIVATE CITIZENS, AND, CONSEQUENTLY, SUCH MANUFACTURING INDUSTRIES SHOULD BE ANNEXED PROPORTIONATELY TO THEIR USE AND - ENJOYMENT OF SUCH MUNICIPAL SERVICES; PROVIDING THAT THE CITY COUNCIL IS NOT SURRENDERING ANY OF ITS POLICE POWERS BY ADOPTING THIS RESOLUTION; PROVIDING FOR THE DISTRIBUTION AND PUBLICATION OF THIS RESOLUTION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Accept Alternate Bid -•Use�of Shell -.Street Construction City Manager Lanham informed the council that he had been asked about the possibility of using shell as a base construction alternate on the street construction proposals to be received by the city at its next regular meeting. The City Council had restricted the use of shell last October and since that date nothing but limestone has been used for a base material and this was the type base materials regpested.in the specifications. Councilman Lively moved to permit the use of shell as base material in street maintenance and construction projects. Councilman Barnes seconded the motion. The vote follows: Ayes: Councilmen Barnes, Clark, Badgett, Cravey, Lively and Huron Mayor Liggett Nays: None Miscelleanous The City Council authorized the expenditure of,a major emergency repair job on the North Main Street Water Well. The Council called a second hearing to be held Thursday, May 14th on the application of Mrs. Margaret Travers for an On Premise Beer License at 1301 Lee Drive after she presented her letter marked by the Postal Department and delivered to her son living on a rural route. Ad_i ournment Councilman Cravey moved for the meeting to adjourn. Councilman Badgett seconded the motion. The ayes were unanimous and the Mayor declared the meeting adjourned. Edna Oliver, City Clerk
