1963 11 26 CC Minutes1968 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN November 26, 1963 The City Council of the City of Baytown, Texas, met in regular session on Tuesday, November 26, 1963 at 6:30 p. m. in the Council Room of the Baytown City Hall with the following members in attendance: Seaborn Cravey Councilman T. E. Cook Councilman Kenneth E. Badgett Councilman Velma J. Ansley Councilman M. E. Lively Councilman J. C. Huron Councilman C. L. Liggett Mayor Fritz Lanham City Manager George Chandler City Attorney Edna Oliver City Clerk Mayor Liggett called the meeting to order, the Invocation was offered, afterwhich the City Clerk was instructed to read the minutes of the November 14th meeting. Councilman Cook moved to dispense with the reading; the minutes be approved as submitted in written form, Councilman Ansley seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron Mayor Liggett Nays: None Award Contract - Water 6 Sewer Department Materials and Supplies Copies of the bid tabulation of Water 6 Sewer Department Materials and supplies received at the last council meeting were presented to the council by City Manager Laham. The tabulation revealed that Utility Supply Company of Houston was low on all items excepte repair clamps and brass fittings however, a provision in the original bid stipulated the 5% would be added to the price of all items purchased from them if Utility Supply waS not awarded the entire bid; It was his recommendation that the contract be awaubd to Utility Supply. Councilman Cravey moved to accept the recommenda- tion of the city manager and award the contract to Utility Supply Company for the ensuing year. Councilman Lively seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron Mayor Liggett Nays: None Water Alain Extension - Ferry Rd- Highway 146, Massey- Tompkins, N. Main 6 Harold Lane A. J. Busch, Jr., local engineer, to a portion of the newly annexed areas of Ferry Road at the end of the existin Highway 146 with a 6 -inch, cross to nor ,'Hassey- Tompkins Road with 8 -inch, weste Street, down North. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron Mayor Liggett Nays: None Renewed Discussion Authorization Release Prisoners - City Jail Councilman Huron asked that his proposal of last council meeting on limiting ^" the number of persons authorized to realese prisoners from the.city jail be brought up for discussion again as he was of the opinion that enough time had lapsed to per- mit the other council members to give some thought to the original proposal. He moved that the published list of names authorizing the release of.prim ners from the city Jail be abolished and the-releasing of prisoners be accomplished according to the laws and Statutes set forth by the State of Texas. Councilman Badgett seconded the motion. Mayor Liggett asked for an enumeration of these laws; Councilman Huron stated the law sets forth that the Corporation Court Judge has the authority to release prisoners and to appoint anyone in his absence to fulfill these duties. It was the opinion of some members of the council that this was the present practice and if the Corporation Judge's services are now satisfactory the council should not interfere; should he be violating the fundamental right of equal justice for all, he should be replaced. City Attorney Chandler answered questions directed to him relative to having names removed from the published list, close observation to eliminate abuses of this privilege, etc. Chief of Police Forshe' answered questions relative to serving of warrants and other factors such as property and cash bonds. After a lengthy discussion, Mayor Liggett asked for a vote on the motion of Councilman Huron. The vote follows: Ayes: Councilmen Huron and Badgett Nays: Councilmen Cravey, Cook, Lively and Ansley Mayor Liggett Repealing Resolution No. 7 - Assisting Developers In conjunction with the Subdivision Committee's activities, Councilman Cook introduced and read a resolution repealing Resolution No. 7, passed by the City Council on January 24, 1963 permitting the City Council to aid and assist developers in the development of their subdivisions. Councilman Ansley seconded the motion. Some discussion was made afterwhich the vote was called by Mayor Liggett. The vote follows: Ayes: Councilmen Cook, Badgett and Lively (Not voting: Councilman Cravey Nays: Councilman Huron and Mayor Liggett The caption of the resolution follows: RESOLUTION NO. 33 A RESOLUTION•OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, REPEALING RESOLUTION NUMBER 7 -1 -63, PASSED BY THE CITY COUNCIL ON THE 24TH DAY OF JANUARY, 1963, SUCH RESOLUTION BEING REFERRED TO AS "THE CITY OF BAYTOWN'S RESOLUTION ASSISTING DEVELOPERS IN THIS AREA." Appointment Members - Human Relations Committee Councilman Lively moved to accept the recommendation of Mayor Liggett to change the name of the Bi- Racial Committee to the Human Relations Committee and approved the appointment of Rev. Charles Teykyl, Mrs. R. L. Martin, R. L. Summers, H. Frank Goss, Steele McDonald, Tom Heflin, J. C. Baldwin, T. H. Roycbr, Don Evens, Wanda Brown, Mrs. Frank Nelson, Andrew Contreras, Clint Carrell, P. F. Korbach, Mrs. Eillen Runnels Jaeger, Rev. David Williams and Bob Forshe to serve on the committee.. The committee will hold its organization meeting and name its officers. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron Mayor Liggett Nays: None 1970 Resolution - Transfer Funds - Calculator Councilman Lively moved to adopt a resolution authorizing the city manager to transfer $155.00 to budget account 105 -10 -3 to cover the additional cost of a calculator for the tax department. Councilman Cook seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron Mayor Liggett Nays: None The caption of the resolution follows: RESOLUTION NO. 31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS AUTHORIZING THE CITY MANAGER TO TRANSFER ONE HUNDRED FIFTY -FIVE DOLLARS ($155.00) FROM THE CONTINGENCY FUND ACCOUNT 101 TO BUDGET ACCOUNT 105 -10 -2 Ordinance - Accepting Construction - Curb G Gutter New Jersey Street Councilman Badgett moved to adopt an ordinance accepting the construction of curb and gutter on New Jersey Street from the north right of way line of Missouri Street to the south right of way line of Kentucky Street and directing the payment at $10,165.65 to Brown G Root, Inc., the Contractor. Councilman Ansley seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron Mayor Liggett Nays: None The caption of the ordinance follows: ORDINANCE NO. 712 AN ORDINANCE RECEIVING AND ACCEPTING THE WORK OF THE REMOVAL OF EXISTING AND CONSTRUCTION OF CONCRETE CURB AND GUTTER ON NEW JERSEY STREET FROM THE NORTH RIGHT OF WAY LINE OF MISS- OURI STREET TO THE SOUTH RIGHT OF WAY LINE OF KENTUCKY STREET IN THE CITY OF BAYTOWN; AUTHORIZING AND DIRECTING THAT THE SUM OF TEN THOUSAND ONE HUNDRED SIXTY -FIVE AND 65/100 DOLLARS ($10,165.65) BE PAID TO THE CONTRACTOR PERFORMING SAID WORK AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. Suggestion - Annex Fisher and Dow Reefs - Prevent Dredging Councilman Lively referred to a recent article in the Houston Chronicle relative to sport- minded citizens of Baytown. Recent action by the Game C Fish Commission will evidently destroy all oyster reefs in the Baytown area and ruin ideal fishing spots for these sportminded people. A possible solution to the condition, if legal, should be in the form of annexation of Fisher. Dow and other reefs in the Baytown vicin- ity. It is probable other cities might be interested in doing likewise as a means of protection. This was submitted for council consideration. The council was impressed by the proposal and the City Attorney was instructed to check the legality of such annexation since the State owns all navigatle streams. Resolution - Purchase Government Bonds - Reserve Bond Account Councilman Cravey moved to adopt a resolution authorizing investment of the city's bond reserve account with the First City National Bank of Houston by purchase of $32.125.00 government bonds. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron and Mayor Liggett. Nays: None 1971 The caption of the resolution follows: RESOLUTION NO. 32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN TEXAS, AUTHORIZING INVESTMENT OF THE CITY'S BOND RESERVE ACCOUNT WITH THE FIRST CITY NATIONAL BANK OF HOUSTON, TEXAS, BY PURCHASE OF UNITED STATES GOVERMENT BONDS. Report Sanitary Landfill - Burning of Trash City Manager Lanham submitted a written report on the recent study made of burning trash at the sanitary landfill abutting Cedar Bayou Stream. His investigation revealed materias being burned are brush, tree limbs and building materials - no garbage and outhomobile tires: 2) Materials burned dumped on east side and burning is done some 2100 feet from the residences on Ferry road; 3) with present usage., the landfill shoud supply needs for approximately 12- years; 9) burning is done only in the late afternoon and 5) consideration given to burning at other locations on city property but cost not feasible. Citv's Manager Report City forces will do the base work on the improvement of New Jersey Street. Lime- stone material will be used for the base; this will be laid according to the specifications as set forth by the State Highway Department. City Manager Lanham will go to Austin to confer with Mr. George Hawley, State Fire Insurance Commissioner, relative to new key rate for the former No. 8 and No. 58 water districts since the completion of the water main extension on Garth and Baker Roads. Miscellaneous City Manager Lanham was asked to check into the possible installation of street lights on Lee Drive from West Main to Market Street. The Traffic Committee has plans to present its recommendation on the appointment of certain individuals from service and civic groups to the Citizens Traffic Advisory Council of Baytown; possibly at the next regular meeting. Mayor Liggett excused from meeting. City Engineer - Jack A. Morton Councilman Lively moved to approve the recommendation of City Manager Lanham to hire Jack A. Morton of Waco as the Director of Public Works and City Engineer in Baytown effective as of December 2, 1963. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Cook, Badgett, Ansley, Lively-and Huron Mayor Pro Tom Cravey Nays: None Adjournment Councilman Badgett moved for the meeting to adjourn.
