1963 11 14 CC Minutes1963 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN November 14, 1%3 The City Council of the City of Baytown, Texas met in regular session on Thursday, November 14, 1963 at 6 :30 p.m. in the Council Room of the Baytown City Hall with the following members in attendance :. T. E. Cook Councilman Kenneth E. Badgett Councilman Velma J. Ansley Councilman M. E. Lively Councilman J. C. Huron Councilman Seaborn Cravey Mayor Pro Tem Fritz Lanham City Manager Edna Oliver City Clerk Absent: C. L. Liggett Mayor George Chandler City Attorney Mayor Pro Tem Cravey called the meeting to order, the Invocation was offered, after which the City Clerk was instructed to read the minutes of the October 24th meeting. Councilman Ansley moved to dispense with reading of the minutes; they be approved as submitted in written form. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Cook, Badgett, Ansley, Lively and Huron Mayor Pro Tem Cravey Nays: None Plans - Two Regulation Type Base Ball Fields Dr. Bob Warford, President of the Baytown Optimist Club, presented plans for a ball park for Baybwn; plans call for a Sophmore and Junior Field, shows - lighting, grand stands and the possibility of using it as a foot ball field during off season for base ball. The plans require acreage 440 feet in depth and 665 feet in width and would provide the two regulation size base ball fields. Councilman Ansley moved to accept the plans and expressed sincere thanks to the Optimist Club for presenting the plans. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilman Cook, Badgett, Ansley, Lively and Huron Mayor Pro Tem Cravey Nays: None Mayor Pro Tem Cravey referred the plans to the Parks and Recreation Committee for study. This committee will meet with representatives of the Optimist Club and attempt to formulate plans for a workable solution to the ball park proposal before the next ball season. Bids - Feeding of Prisoners in City Jail Bids on the feeding of prisoners were opened and tabulated as follows: Holly Inn Resturant, T. A. Bairrington Total price per meal $0.55 Victory Cafe, Frank Hruby Total price per meal $0.45 Bush Hotel, H. 0. Bush Total price per meal $0.35 1 Councilman Huron moved to accept the low bid of H. 0. Bush, Bush Hotel. Council- man Lively seconded the motion. The vote follows: Ayes: Councilmen Cook, Badgett, Ansley, Lively and Huron Mayor Pro Tem Cravey Nays: None 1964 Bids - Tires and Tubes Only one bid was received on the invitation for tires and tube requirements for the City of Baytown for a period of one year. This bid was submitted by B. F. Goodrich Company and upon recommendation by City Manager Lanham was returned unopened to the bider. Bids - Regular and Premium Gasoline Bids for furnishing and delivering all of the City of Baytown's regular and premium gasoline for a.period of one year were opened and tabulated as follows: Gulf Oil Corporation Regular Gasoline, Premium Gasoline, Texaco Inc. Regular Gasoline, Premium Gasoline, Good Gulf No Nox Fire Chief Sky Chief Su -Preme 17.75 unit price 19.25 unit price $.1125 -gal plus applicable taxes $.1425 -gal plus applicable taxes 1% 10 days Humble Oil & Refining Company Regular Gasoline, Enco .1060 plus .05 state tax Premium Gasoline, Enco Extra .1270 plus .05 state tax Councilman Cook moved to accept the low bid of Humble Oil & Refining Company for furnishing and delivering all of the City of Baytown's regular and premium gasoline for a period of one year. Councilman Huron seconded the motion. The vote follows: Ayes: Councilmen Cook, Badgett, Ansley, Lively and Huron Mayor Pro Tem Cravey Nays: None City Manager Lanham will make a study of.what equipment can and cannot operate on regular gasoline and bring recommendations for council perusal. This action was taken after it was suggested the council study the feasibility of using regular gasoline only in City owned vehicles. Bids - Chlorine Bids for furnishing and delivering liquid chlorine to the City of Baytown were opened and tabulated as follows: Dixie Chemical Company, Houston, Texas $9.50 per cwt - delivery one day Sanitary Chemical Lab., Inc., Beaumont, Tex $0.9% per lb.- Minimum shipment of cylinders at a time 10 or more Diamond Alkali Company, Houston, Texas $0.095 per.pound Terms; Net 30 days Councilman Lively moved to accept the bid of Diamond Alkali Company for the furnishing and delivering liquid chlorine to the City of Baytown for one year. Councilman Cook seconded.the motion. The vote follows: Ayes: Councilmen Cook, Badgett, Ansley, Livel and Huron Mayor Pro Tem Cravey Nays: None Bids - Diesel Fuel and Kerosene Bids for furnishing and delivering all of the City of Baytown's diesel fuel and kerosene for a period of one year were opened and tabulated as follows: 1965 Texaco Inc. Diesel Fuel, 445 Diesel Chief Kerosene, Crystalite Gulf Oil Corporation Diesel Fuel, Gulf No. 2 Kerosene, Gulf Humble Oil & Refining Company Diesel Fuel, Kerosene $.123 -gal ex. tax $.123 -gal ex tax 30 days net 10.80 gallon 11.79 gallon $.1075 gallon $.1175 gallon Councilman Ansley moved to award the Diesel fuel and Kerosene contract to Humble Oil & Refining Company as low bidder. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Cook, Badgett, Ansley, Lively and Huron Mayor Pro Tem Cravey Nays: None Bids - Water and Sewer Department Supplies Bids for furnishing the City's requirements for water and sewer department materials and supplies were opened. Those bidding are listed as follows; Mabry Foundry C Machine Company, Houston, Texas Lone Star Steel Company, Dallas, Texas Brooks Products of Texas, Inc. Houston, Texas Municipal Pipe & Fabricating Company, Houston, Texas Utility Supply Company, Houston,.Texas U. S. Pipe & Foundry Company, Houston, Texas The bids were referred to Messrs. LeFevre and Funderburk who exposed the bids to interested representatives. However, Councilman Ansley moved to table further action on the bids until the next regular meeting of the Council. In the meantime the tabulation will be completed and copies made available for j all interested parties. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Cook, Badgett, Ansley, Lively and Huron Mayor Pro Tem Cravey Nays: None Waterline Extension.- Fisher Road The Council reviewed the request for a 2 -inch Water line extension up Fisher Hill Road. Mr. Sowell, a homeowner whose property abutts the road. informed the council that Messrs. 0. E. and W. T. Fisher had agreed to formally dedicate an easement for this extension on the north side of the road provided the city will bear the entire cost of such construction. After a length discussion, Councilman Cook moved to approve the installation of a 2 -inch waterline on the north side of Fisher Road, such installation to extend to the property line pro- vided a dedicated easement can be secured from 0. E. & W. T. Fisher. It is to be further understood that each home owner along the road is to tie -on to the 2 -inch main; will be required to pay a water tap and will be serviced from an individual meter, with one exception - Mr. Sowell will not be required to pay a water'tap:as he,-has paid this fee to the Cedar Bayou Water District prior to its annexation by the City of Baytown. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Cook, Badgett, Ansley, Lively and Huron Mayor Pro Tem Cravey Nays: None Approve Teen Age Traffic Violation Program Upon recommendation by the Corporation Court Committee. Councilman Huron �I 1966 moved to approve the proposal of the Robert E. Lee High School D. 0. Society to sponsor and participate in a Teen Age traffic violation program with Officer Russell Liles as co- sponsor. Councilman Lively seconded the motion. The vote follows: Ayes: Councilmen Badgett, Ansley, Lively and Huron Mayor Pro Tem Cravey Nays: None Abstain: Councilman Cook Resolution - Execute Agreement - Missouri Pacific Railroad Councilman Ansley moved to adopt a Resolution authorizing and directing the Mayor of Baytown to execute a written agreement between the City and the Missouri Pacific Railroad Company for permission to install, maintain and use one 10 -inch cast iron water main on the premises of the railroad company. Councilman Huron seconded the motion. The vote follows: Ayes: Councilmen Cook, Badgett, Ansley, Lively and Huron Mayor Pro Tem Cravey Nays: None The caption of the Resolution follows: RESOLUTION NO. 30 411 -63) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AUTHORIZING AND DIRECTING THE MAYOR OF BAYTOWN TO EXECUTE, FOR AND IN THE NAME OF THE CITY, ONE CERTAIN WRITTEN AGREEMENT DATED SEPTEMBER 30, 1963, BETWEEN SAID CITY AND MISSOURI PACIFIC RAILROAD COMPANY, SAID AGREE- MENT BEING ATTACHED HERETO AND MADE A PART HEREOF FOR ALL INTENTS AND PURPOSES, AND INSTRUCTING THE CITY CLERK TO DELIVER A CERTIFIED COPY OF THIS RESOLUTION TO THE MISSOURI PACIFIC RAILROAD COMPANY'S LEGAL DEPARTMENT. New Jersey Street - Hot Mix Topping At the October 10th meeting, when the Hearing was being held on the improve- ments to New Jersey Street, the City Manager was instructed to review the property adjustment according to Resolution 14 adopted by the City Council on the 14th of February, 1%3. Upon investigation it was found that this provision is appli- cable only to Class "B" - Residential Thoroughfares-.where the property owner is assessed his prorata share of curb and gutter and street improvements. New Jersey Street improvements are being done under the Class "P provisions, the property owner is assessed only for the cost of curb and gutter. The Council expressed its regret but agreed there was no way whereby it could reduce the per foot assessment of the three property owners who have New Jersey as a side street. City Manager Lanham pointed out that the curb and gutter on New Jersey Street is being installed by contract. the base work to be done by city forces but council has not yet granted authority to surface it. He recommended that he be permitted to add this to the James Street contract at an estimated cost of $3,115.00. Councilman Ansley moved to extend the James Street contract to include the hot -mix surfacing of New Jersey Street at an estimated cost of $3,115.00. Councilman Huron seconded the motion. The vote follows: Ayes: Councilmen Cook, Badgett, Amsky, Lively and Huron Mayor Pro Tem Cravey Nays: None Miscellaneous City Manager Lanham gave copies of the October activities report to each of the City Council. The report included the Public Works projects now under construction and the percentage of completion as per project. IL'lfl Councilman Cook asked the City Manager to contact Mr. George Hawley, Fire Insurance Commissioner, Austin and inquire if the installation of the 10 -inch water mains on Garth and Baker Roads will meet all the requirements for the reduction of Fire Insurance rates to residents of former water Districts 8 and 58. It was his understanding that the Fire Insurance Commissioner required an 8 -inch main to connect former City of Baytown water mains with the mains of the two former pater Districts. The present installation far exceeds the re- quirement, however, there is a small section of the City's 6 -inch main which has not been replaced with a 84ch main. City Manager Lanham reported that plans for the water main extensions on Massey- Tompkins Road and afjacent areas will be ready for distribution at the next regular meeting of the City Council. The Master Plan for Baytown has been approved and a contract document will be submitted for council perusal at the next regular meeting. City Manager Lanham was instructed to Inform complainants, by letter, that an intensive sutdy is being made to solve the unpleasant practice of burning tree limbs, brush and trimmings at the landfill disposal site off Ferry Road. Regular Council Meetina - November 26th Due to a conflict with Thanksgiving, Councilman Cook moved to set the date of Tuesday, November 26, 6 :30 p.m. as the date of the next regular meeting of the Council. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilman Cook, Badgett, Ansley, Lively and Huron Mayor Pro Tem Cravey Nays: None Action - Authorization Release Prisoners Deferred Councilman Huron asked for Council action on his Resolution of November 6th requesting that the number of people authorized to release prisoners placed in the city jail be reduced to the City Manager, Chief of Police and Corporation Court Judge. Sore felt that this was a Judicial matter and should be the decision of the Court as the City Council is Legislative in function and these should be kept separate. Councilman Huron disagreed with this interpretation since he felt the Council is a policy making body and this problem is a matter of policy. The motion died for want of a second and it was agreed to defer further action on the matter until a later date. Adiournment Councilman Cook moved for the meeting to adjourn.
