MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
October 24, 1963
The City Council of the City of Baytown, Texas met in regular session on
Thursday, October 24, 1963 at 6 :30 p. m., in the Council Room of the Baytown City
Hall with the following members in attendance:

The Mayor called the meeting to order, the Invocation was offered, afterwhich
the City Clerk was instructed to read the minutes of the October 10th meeting. One
correction was made, namely: Hearing of Benefits - New Jergy Street - "The Council
agreed that it could do nothing relative to the $3.00 per front foot assessment. . .
as amended. Councilmen Ansley seconded the motion. The vote follows:

Receive Bids - Painting James Street Water Tower
Only one bid was received for cleaning and painting the elevated water tower
on East James Street. The bid was received from Water Tank Service Comapny of Houston
at the bid price of $8,987.00. It was the recommendation of the City Manager LeFevre
that the bid be rejected since it was in excess of the amount budgeted for this
project. He will restudy specifications - if it is possible to eliminate the statutory
bond requirement, this will be done to allow competitive bidding. Councilman Lively
moved to reject the bid of Water Tank Service Company; the CityManager be instructed
to restudy specifications and readvertise for bids. Councilman Ansley seconded-the
motion. The vote follows:

Due to the 3 -4 month delay in the delivery of Police Package Type cars, both
dealer and city take a risk in interim. City Manager LeFevre recommended that the
police cars be accepted on an outright purchase basis without trade -ins, When the
new cars arrive, he proposed to advertise the used cars,for sale or if some other
department of the city needs one of the cars he will make recommendation not to sell
a particular unit and assign it to the department where needed. The Council wanted
to know the make of car each bidder was proposing to sell to the city but this was
omitted from the specifications. Councilman Lively moved to table all bids and
permit the City Manager to obtain more information on the make of the automobiles
prior to awarding of bids, Councilman Badgett seconded the motion. The vote follows:

A representative from Clyde Jones Motor Company was present and informed the
Council that his company's proposal was based upon the Dodge 330. In order to expe-
dite the awarding of the contract, Councilman Ansley suggested that Chief Forshe'
contact representatives of Higginbotham Motor Company and Buck Turner Chevrolet Co.
by telephone, and ask the make of car. After some time he reported that Higginbotham
Motor Company based their proposal upon Police Patrol Special - Plymount -
Buck Turner upon Chevrolet Biscayne. Councilman Lively moved to award the contract
for the purchase of the five (5) police cars to the low bidder, Higginbotham Motor
Company on the basis of the Alternate Bid, outright purchase without trade -ins,
Councilman Huron seconded the motion. The vote follows:

7 , Counsilman Ansley moved to accept the low bid of Higginbotham Motor Company
for the purchase of the Plymouth Station Wagon with trade -in, bid price $ 2,038.41.
Councilman Badgett seconded the motion. The vote follows:

Discussion - Converting City Owned Property off Barkaloo Road —Ball Park
Dr. Bob Warford and Mr. Ralph Garrett, President and member respectively of
the Baytown Optimist Club, met with the council to discuss the possibility of con-
verting the city -owned property abutting Barkaloo Road into two ball parks,
a sophomore and junior teen age size. They and others have gone over the grounds
and would be happy to accept them for the purposes stated. Mr. V. V. Ramsey,
County Commissioner, has been contacted and has agreed to clear the land and haul
fill soil for the leveling of the property; a local engineer has donated his time
to drawing plans for the ball fields should the council see fit to permit the land
to be used for this purpose. On August 8th, the Council had voted to permit the Bay-
town Rifle Club to use the tract as a rifle range for an indefinite period. Their
concern at this meeting was if the construction of the two ball fields would inter-
fere with the Rifle Club's activities. It was the opinion of the Optimist Club
representatives that both clubs could use the grounds without interference, but
the council in general disagreed. Since the construction of the proposed b. -11 parks
will be on a cooperativ basis, the city's cost will be minor. The Optimist Club was
proposing a lease of 10 -years or more duration and the council presently has $3,000
budgeted in the 1963 -69 budget for baseball activities. After some discussion,
Councilman Ansley moved to instruct the City Attorney to draw up a lease agreement
to form a cooperative effort between the ball clubs, with the Optimist Club acting
as coordinator, for the construction of a ball field on the Barkaloo Road tract
provided a mutual agreement can be arranged between the Baytown Rifle Club and the
Optimist Club. Councilman Badgett seconded the motion. It was pointed out
that the Baytown Rifle Club is presently using a range of 200 yards on the back
side of the 9.9 acre tract and the Rifle Club will have priority if negotiations fail.
Councilman Cook then moved to table the motion. Councilman Cravey seconded the motion.

Request - City Participation Utility and Extensions
Mr. A. J. Busch, Jr. local engineer, presented a plat of Lakewood Oaks
Subdivision which had been presented and accepted by the Baytown Planning Commission.
However, the developer was requesting the City to construct two sanitary sewer
manholes on the city's existing 12 -inch rain and also extend the two -inch water
main to the developer's property line, on the basis of the Resolution No. 7 adopted
by the City Council January 29, 1963 which provides for the City's assistance
under certain restriction measures. Then estimated cost to the city for the con-
struction of the manholes and water line extension was $880.00. Councilman Cravey
moved to grant the request of the subdivider and the City Manager be authorized
to proceed with the installation of items requested. Councilman Badgett seconded
the motion. The vote follows:

Bowie Subdivision Extension
City Manager LeFevre submitted a drawing of the propmed extension of Bowie
subdivision. This plat has been presented to the Planning Commission but approval
was delayed due to plans of the city to extend Narcille Drive through property
which is being developed. The drawing showed the propsed alignment of Narcille
Drive into French Place. Preliminary approval was granted the entire Bowie Subdivision
in April, 1962, for construction purposes over to the east line of the McFarland
property-and a major portion of the property has been developed. The Planning
Commission withheld its approval of the final extension pending the alignment of
Narcille Drive into French Place or another proposed street by F. A. Richardson.
The former Baytown Advisory Board had proposed certain thoroughfares for Baytown,
Narcille Drive being included as one and the City Council had adopted the master
plan for streets and thoroughfares in July, 1961. At that time this entire area

was undeveloped. The cost for the land now was set as $3,300 per lot and two lots
would be affected by the extension. Councilman Ansley moved to defer action on
the possible purchase of developed property for the extension of Narcille Drive
until the Compehensive Planners have completed its survey, Councilman Lively seconded
the motion. The vote follows:

Request - Certain,Items Development of Bowie Subdivision Extension
A. J. Busch, Jr., local engineer, presented the following request under Resolution
No. 7 for the city's participation in certain itmes of construction of Bowie Sub-
division extension. The items are:
1. The developer be allowed to use 6 -inch cement asbestos pipe as an alternate
to the 6 -inch cast iron pipe required by the City's Subdivision Ordinance.
2. The City install the culvert pipe and pave the approaches to the two
streets that intersect Ward Road.
3. That the city construct the proposed sanitary sewer manhole on Ward
Road and extend the sewer line to the developer's property line
4. That the city regrade the ditch on Ward Road or construct storm sewer
to improve the drainage for the entire area.

Councilman Cook asked to go on record as in no shapes form or fashion agreeing
with the Resolution of January 24, 1963 nor does he agree with further use of
cement asbestos pipe so he finds himself completely opposed to the ideas that were
being-presented. Maurice Reed, engineer, prepared an estimate of cost to the
city on the participation and the total sum was $2,474.00; $1,500 for culvert pipe
and paving two approaches, $200 for manhole and sewer line extension and $774,00
for difference in cost of a 6" vs 2" water main along Ward Road. Councilman Ansley
moved for the city to pay the difference in the cost of 2" vs 6" water main extension
along Ward Road, the difference being $774.00. Councilman Huron seconded the motion.

Councilman Huron moved to authorize the City Manager to install culvert pipe
and pave the approaches into Bowie Subdivision, provided, the subdivider bears the
cost of the culvert pipes to be installed. Councilman Ansley seconded the motion.

City Attorney Chandler suggested that the Subdivision Division Committee
should review the city's subdivision ordinance and make some amendments inasmuch
as the present ordinance sets forth a 5 -mile ,jurisdiction by the city and the recent
law permits 2- miles. We are presently in violation of this Statute and other
amendments need to be made to eliminate conflicts. Too, it was suggested that the
Subdivision Committee review Resolution No. 7 passed by the City Council on
January 24, 1963; some changs may be recommended as a result of the study.
Draft - Circus Operation in City of Baytown
A Committee composed of City Attorney Chandler, Councilman Lively, Dr. David L.
Norton and Gary Garner was appointed to review a draft of an ordinance regulating
the operations of certain shows, performances and exhibits whthin the City of Bay-
town.
Ordinance Amending Traffic Code of Baytown
Councilman Ansley moved to adopt an ordinance amending the Traffic Code of
the City of Baytown to permit 40 miles per hour speed zones on a certain portion
of Tri -City Beach Road and a 55 mile zone -on that portion of Tri -City Beach Road
from Evergreen Road to Cedar Bayou Lake Drive, a distance of 1.6 miles. Councilman
Badgett seconded the motion. The vote follows:

Annexation Committee
Mayor Pro Tem Cravey appointed Councilmen Lively, Badgett & Cook as an Annexation
committee to work with City Attorney Chandler in the settlement of the Highway 73
and Highway 90 controversy with the City of Houston. Some of the factors are not
legal, but a fact situation and the City Attorney requested the appointment of such
a committee which will act in the capacity of• a consultant as the need arises.
City Manager's Report
The Subdivision Committee was requested to review the Subdivision Ordinance
and include an amendment to require the construction of sidewalks; this amendment
was proposed by the new Baytown Planning Commission.
City Manager LeFevre and Neill Seeley gave a brief report on the advantages
of the city going to a Local Government radio frequency. Mr.. Seeley answered
questions relative to the technical operations, feasibility of a taller tower,
and other problems pertinent to the general operations of the Police,Fire and
Water Radio Systems.

City Manager's Report - Continued
City Manager LeFevre reported that he had received a letter today from Mr.
Ellisor of Wyatt Hedrick, Consulting Engineers of Houston stating that he had
met with a contracting engineer of Chicago Bridge G Iron Company and submitted
a method of taking care of the tank foundation of Water Dist. 958 elevated tower.
They are preparing a detailed drawing and specifications to be forwarded to Chicago
Bridge G Iron for a firm quotation. Wyatt Hedrick should have the naswer on or
before November 1st and after the review has been completed by their personnel,
rrecommendations will be forwarded to the City of Baytown for solution to the existing
leaning elevated water tower. It is possible the City may take some formal action
if no answer is received by the November 19th meeting.
Persons desiring water service lines on Fisher Hill will. be. invited to meet
with the City Council at its regular meeting November 19th.
The City Manager was instructed to order a car load of limestone to be used
in street maintenance and repair projects.

Councilman Ansley moved for the meeting to adjourn. Councilman Bodgett seconded
the motion. The ayes were unanimous and Mayor Pro Tem Cravey declared the meeting
adjourned.
