MINUTES OF THE REGULAR MEETING OF
THE CITY COUNCIL OF THE CITY OF BAYTOWN
September 25, 1963
The City Council of the City of Baytown, Texas met in regular session on
Thursday. September 25, 1963 at 6:30 p.m, in the Council Room of the Baytown
City Hall with the following members in attendance:

The Mayor called the matting to order, the Invocation was offered, afterwhich
the City Clerk was instructed to read the minutes of the September 12th and 16th
meetings. With one minor correction, Councilman Ansley moved to dispense with
reading of the minutes; they be approved as submitted in written form. Council-
man Lively seconded the motion. The vote follows:
Ayes: Councilman Cook, Badgett, Ansley, Livety and Huron
Mayor Liggett .

Ordinance - Setting Date Hearing of Benefits - East James Street
Due to an error in the date of publication for hearing of Benefits on East
James Street, held August 22, 1963, City Manager LeFevre introduced and read
an ordinance determining that certain steps have heretofore.been taken in
relation to permanent improvement of East James Street, from North Fifth Street
to Highway 146 (Alexander Drive) and ordered ahearing to be held on Thursday,
October 10th, 1963. Councilman Badgett moved to adopt the ordinance as read.
Councilman Ansley seconded the motion. The vote follows:

ORDINANCE NO. 706
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
DETERMINING THAT CERTAIN STEPS HAVE HERETOFORE BEEN TAKEN IN
RELATION TO THE MATTER OF PERMANENTLY IMPROVING EAST JAMES STREET
FROM THE EAST PROPERTY LINE OF NORTH FIFTH STREET TO THE WEST
PROPERTY' LINE OF STATE HIGHWAY 146(ALEXANDER DRIVE), IN THE CITY
OF BAYTOWN, TEXAS, WITHIN THE. LIMITS HEREIN REFERRED TO, AND
RATIFYING AND CONFIRMING SUCH ACTION; SETTING OUR A COPY OF THE
ENGINEER'S ESTIMATES OF THE COSTS OF SUCH PROPOSED IMPROVEMENTS;
MAKING APPROPRIATION OF FUNDS FOR PAYMENT OF THE SHARE OF THE
COST OF SUCH IMPROVEMENTS TO BE BORNE BY THE CITY OF BAYTOWN, TEXAS;
ORDERING THAT A HEARING BE HELD AND GIVEN TO ALL OWNING OR CLAIMING
RELATED MATTERS; SETTING AND FIXING THE TIME AND PLACE OF SUCH HEARING

Traffic Problems - Public Schools
A joint meeting of City Council and School Board members will be held on
Monday, October 14th to discuss traffic problems at schools within the Baytown
area. The meeting was arranged by Councilman Cook after he received a request
for part -time patrolling of the Travis,Elementary School. Since this isa
mutual problem, the council did not feel that the city should bear the entire
expense of providing such services. It is hoped that a workable solution may
be drafted as a result of the joint meeting. Members of the Traffic Committee
will also be invited to attend the meeting and take part in the discussion.
MISCELLANEAOUS
The City Manager was instructed to proceed with leveling and draining the
4 -acre city owned tract of land lying off North Main Street. This will be used
as a base ball practice field after the work has been concluded. By this broad
designation, no one group may monopolize the.field, it will.be.used by both
Little League and Teen -age groups.
The City Manager and Department Heads will make a study of the costs of
extending garbage collection to the Wooster area proper. It was suggested that
the service could be extended during this budget year by the purchase of an
additional truck and less than a 3 -man crew. Mr. LeFevre will report his findings
at the completion of the study and the council will take action on providing or
denying such service during this fiscal year.
R. M. Johnston - Suit Filed Corporation Court
The Council heard a complaint from R. M. Johnston..2001 Wright Blvd.-relative
to the mis- handling of a case filed in Corporation Court. The original charge
was filed against a neighbor, by Mr. Johnston. for harboring avicious dog
after the animal had attack and bitten his son and the son of a second neighbor.
He stated that the charged was filed on the 10th of February, 1963; the person
filed upon was seized with a serious heart attack and the case was re -set.
Recently he inquired of the Corporation Judge on the disposition of the charge
and was told that it has been dismissed; later he was told that the case was
reset for November 15th. He contended that the case was not reset until he
started his investigation and wanted to know why it happened in this manner.
His opinion was an open case of malfeasance in the handling of the case.
The council questioned both City Attorney Chandler and Corporation Court-Judge
Ward; Councilman Cook asked the council's authority and limitations in this and
similar cases and the City Attorney recommended that in this particular case
the trial should be held and the council should see that justice is done.
Henceforth the Police Department will supervise the duties of the dog catchers
and it is hoped that this will improve the efficiency of the Humane officers.
Copy - Ordinance Amending Civil Service Regulations
The council received copies of an ordinance amending the Class Specifications
for positions in the Civil Service Classified Service - Police to include the
classification of Policewoman. A study will be made of the proposed ordinance
and definite disposition will be made at the next regular meeting.
Fence Expenditure Approved
The Council approved an expenditure of $119.04 for the installation of a
fence from the Firemen's Recreation Hall to the office of the Public Works.
This area faces Lee Drive and is being used by the department to house forms used
in laying sidewalks, concrete curb and gutters. etc.

Grant Delay - Pest Control Ordinance Amendments
Councilman Ansley moved to grant a 30 -day delay in the passage of proposed
amendments to the Pest Control Ordinance as per the request of Exterminating
Operators presently doing business inthe City of Baytown. Councilman Lively
seconded the motion. The vote follows:
Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron

Expressed Thanks - Humble Company - Bicycle Racks - Library
The Council instructed Mr. LeFevre to write a letter of thanks to officials
of the Humble Oil G Refining Company for the donation of bicycle racks to be
located at Sterling Municipal Library.
Report Meeting - Councilman Lively
Councilman Lively gave a brief report on items discussed at the September 16th
meeting held in Houston and attended by representatives from unicipalities
located within Harris County. An Agenda Committee has been appointed and it is
possible that the City of Baytown may be interested in some participation. This
will be decided upon after the council has time to study the agenda items.
Expanding Traffic Committee - Include Sub - committee
Police Chief Forshe' gave a report on the possibility of appointing a
twelve- fifteen -man subcommittee, from interested citizens, to act in an
advisory capacity to the Councils Traffic Committee. Its primary purpose
would be to seek out traffic problems which do not ordinarily appear on the
working committee; results of the study would be transferred to the subcommittee
for conveyance to the original source. It is hoped that such a program would
keep traffic problems at a minimum and build up better public relations.
Appropriation Ordinance - Unappropriated Surplus Water Fund
City Manager LeFevre introduced and read an ordinance appropriating $49,700.00
from the Unappropriated Surplus Water Fund to Budget account 1002 -10 -9 for
construction of water line connecting the old City of Baytown water system with former
Water Districts No. B and No. 50. Councilman Badgett moved to adopt the
ordinance as read. Councilman Cravey seconded the motion. The vote follows:

FROM UNAPPROPRIATED SURPLUS WATER FUND OF 1962 -63 BUDGET TO ACCOUNT
1002 -10 -9.
Adjournment
Councilman Ansley moved for the meeting to adjourn. Councilman Lively seconded
the motion. The ayes were unanimous and the Mayor declared the meeting adjourned.
