1963 08 08 CC Minutes1925 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS August 8, 1963 The City Council of the City of Baytown, Texas met in regular session on Thursday, August 8, 1963 at 6 :30 p.m. in the Council Room of the Baytown City Hall with the following members in attendance: Seaborn Cravey Councilman T. E. Cook Councilman Kenneth E. Badgett Councilman Velma J. Ansley Councilman M. E. Lively Councilman J. C. Huron Councilman C. L. Liggett, M. D. Mayor J. B. LeFevre City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order, the Invocation was offered, after - which the City Clerk was instructed to read the minutes of the July 25th meeting. Councilman Badgett moved to dispense with reading of the minutes;-they be approved as aibmitted in written form, with minor spelling corrections. Councilman Ansley seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron Mayor Liggett Nays: None Proposed Improvements to Carnegie Street Councilman Badgett moved to authorize the City Manager to Fr oceed with the proposed improvement of Carnegie Street from the Southern Pacific Railroad tracks north to Market Street; the School District to bear the cost of in- stalling curb and gutter on its abutting property, the City to widen the existing street to 48 feet, stabilize shoulders make recaurs wgere becessart '.to:the base of street and top with two courses of inverted penetration or hot mix asphalt. Councilman Ansley seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron Mayor Liggett Nays: None Discussion - Water Line Extension Baytown Jr. High and Robert E. Lee High School The City Manager asked the Council to study a request for waterline extension to Baytown Junior High and Robert E. Lee High Schools. This request had been presented at some previous date due to inadequate fire protection. Two proposals have been submitted to Mr. Gentry, Superintendent of the Schools. First (1), City to extend the water main from the existing 6 -inch main to the school's property line, the school will proceed from this paint to complete the looping, install the fire hydrants and return to place of beginning or two (2) the project be completed on a 50 -50 cost basis with an estimated total cost of $9,442.50 for Robert E. Lee High School and $5,855.00 to Baytown Junior High School. His recommedation was the latter plan. The project be let to a reputable contractor and the City and school share equally in the cost. After some further discussion, C ouncilman Cook moved to declare the intention of the Council to include the cost of its pro rata share of the water fine extension to the schools in the 1963 -64 budget. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron Mayor Liggett Nays: None Ordinances - Calling Hearing Improvements North First._ East Favle and East James City Manager LeFevre' introduced and read ordinances determining that certain steps have been taken in relation to the matter of permanently improving North First Street, from the north property line of East Texas Avenue to the South properly line of East James Street, _East Fayle street from the east property line of State Highway 146 to the west property line,of Danubina Street and East James Street from the east property line of North Fifth to the West property line of State Highway 146 and ordering that a hearing be held and given to all owning properties abutting upon said streets to be improved on August 22; 1963 in the Council Room of the Baytown City Hall, said notice to be; mailed as soon as practicable. Councilman Ansley moved to adopt the ordinances as read. Councilman Huron seconded the motion. Studv Proposed Amendments - Pest Control Ordinance The Council will study proposed amendments to the recently enacted Pest Control Ordinance of the City of Baytown. Official action on the amendments will be taken by the Council after sufficient time has passed to allow a thorough study of the proposed changes. Receive Bids - Curb and Gutter New Jersey Street The bid tabulations for the installation of curb and gutter on New Jersey Street from Missouri to Kentucy follows: Gul` Bitulithic Co. Brown & Root, Inc. Skrla Inc. $11,890.00 ) $10,880.00 $11,550.00 Maxwell Construction Co. $12,970.00 The bids were referred:to Clyde Pond and other City Personnel for verifi- cation of bid price quotations. These prices were verified and upon recommenda- tion of the City Manager, Councilman Ansley moved to award the contract for the curb and gutter installation on New Jersey Street to the Low bidder, Brown & Root, Inc. Councilman Cook seconded the motion. The vote follows: Ayes. Councilmen Cravey, Cook, Badgett, Ans =ley, Lively, and Huron Mayor Liggett Nays: None Traffic Committee - Traffic Light Changes - Baytown Junior High School Councilman Cravey, Chairman of the Traffic Committee, presented a drawing with proposed recommended changes for the traffic signalization and channeliza- tion at Market, Wisconsin and Nevada Streets near Baytown Junior High School. The Council expressed its appreciation to the committee, whereupon Councilman Livdy moved to authorize the expenditure for proper installation of the recommend- ed changes in the traffic channelization and signalization at this intersection. Councilman Ansley seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron Mayor Liggett Nays: None The Traffic Committee is soon to give some study to cutting of limbs and shrubbery when they obscure an intersection or a Stop Sign. Presently there exists many such dangerous intersections and a concerted effort is to begin for the elimination of such hazards at the conclusion of the study. The City Manager will assist the Traffic Committee by assigning the responsibility of the cutting and disposition of tree limbs, shrubbery, etc. to a specific department. Committee Reports Councilman Ansley and Cook presented proposed amendments to the Street Resolution adopted in February, 1963. The Council will study the proposed changes and action will be taken after the study is completed. Awards will be made at the next regular Council meeting to the persons making the greatest contribution during the Clean -Up Campaign. The City Attorney will prepare a written brief on what can be done to enforce the health regulations of the City of Baytown in areas of the City which are not presently connected to the sewer system; a supplemental report will be prepared by the Health and Engineering Departments relating to the availability of sewer lines, water supply etc. With these reports will be a map designating the areas in question. - Fowl Ordinance The City Manager introduced and read and ordinance regulating and prescribing the conditions under which fowls may be kept within. the City of Baytown.- Councilman Badgett moved to adopt the ordinance as read. Councilman Cravey seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron Mayor Liggett Nays: None The caption of the ordinance follows: ORDINANCE NO. 696 AN ORDINANCE FOR THE PROMOTION OF PUBLIC HEALTH AND GENERAL WELFARE BY REGULATING AND PRESCRIBING THE CONDITIONS UNDER WHICH FOWLS MAY BE KEPT :WITHIN THE CITY OF BAYTOWN; DEFINING CERTAIN TERMS; PROHIBITING FOWLS FROM RUNNING AT LARGE; REQUIRING THAT SUCH FOWLS BE KEPT IN A PROPER ENCLOSURE OR PEN; PRESCRIBING THAT SUCH FOWLS BE KEPT UNDER SANITARY CONDITIONS; PRESCRIBING THAT FEED AND STORAGE BINS FOR SUCH FOWLS SHALL BE KEPT IN A SANITARY MANNER REPEALING ORDINANCES INCONSISTENT HERE- WITH, CONTAINING A SAVINGS CLAUSE; PROVIDING A PENALTY AND THE.EFFECTIVE DATE THEREOF. Management Survey Preliminary Contract 1 The Council discussed the management Survey Preliminary Contract which would be comprised of a full management survey covering all organizational and operational features of the City's functions at a cost of $10,000 with an additional $2,000 for possible assistance desired by the Council in the progress of the program. This would include engineering in a general but not for specific projects. Since it was pointed out that the survey would extend over a period of 3 to 4 months, Councilman Ansley moved to start the project on a independent basis. Councilman Badgett seconded the motion. The motion was discussed at length since the Council had no assurance that the survey would go :under the 701 program; should it go under the plan the City would save in an excess of $6,000 but would require a delay of possibly 90 days or longer. After the discussion the following vote was taken: Ayes: Councilmen Ansley and Badgett Mayor Liggett Nays: Councilmen Cravey, Cook, Lively and Huron Councilman Cravey then moved to contact Griffenhagen- Kroger, Inc. of Los Angeles and inform them that the City Council of Baytown has selected their firm to conduct a management survey for long -range City development; the Council has selected a firm to do a master plan and they are to contact this firm to apply for a grant under the 701 program. Councilman Cook seconded the motion. The vote follows: Ayes: Councilmen Cravey Cook, Badgett, Ansley, Livel:, and Huron Mayor Liggett Nays: None .,(� I1�4 Petition - Improvement Pin Oak Drive The Council acknowledged and accepted a petition from A. A. Aikey for the permanent improvement of Pin Oak Drive, a major.connecting street for residents of Lakewood Subdivision between Bayway Drive and North Burnett Drive, Rolling Wood, etc. The petition had the signatures of 150 interested residents of the area. The portion of the street requiring improvement extended approximately one -half mile with no residents on either side of the street. Since the Council had not studied the problem prior to its presentation no definite committment was made at this time. The City Manager presented an estimate of cost in the amount of $4,662.00, previously made by the City Engineer; this estimate included repairing of base and 2 courses of inverted penetration. Councilman Ansley moved to accept the petition as presented by Mr. Aikey for the.improvement of that portion of Pin Oak Deive; a study to be made of the project at a later date. Councilman Huron seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Ansley, Lively and Huron Mayor Liggett Nays: None Selection Firm faster Plan The Council again considered the firms for the preparation of a master plan for long -range City development. In the discussion, Councilman Lively stated that he had found that a master plan has been submitted to the City of Baytown by the former Planning Commission. The plan may not be complete but it projects city growth into 1975 and is being followed to some extent and before selection of any firm for a master plan for the City of Baytown, he recommended that the Council look over the plan that now exists. Councilman Ansley felt that the Council should select a firm to bring the program up to date and Councilman Cravey stated that much of the work was unfinished at the time the former Planning Commission was disbanded. Councilman Cook moved for the Council to authorize the firm of Bernard Johnson, Engineers, Inc., to prepare and application for a comprehensive City Plan under the 701 program, including City management study by the firm of 6riffenhagen- kroeger, and that Baytown enter into a contract for these services upon approval of the 701 application. Councilman Cravey seconded the motion. The vote follows: Ayes: Councilmen Cravey, Cook, Badgett, Huron Nays: Councilmen Lively, Ansley and Mayor Liggett Councilman Ansley then stated that she felt that any contract that the city enters into of this magnitude should be by unanimous decision and she would like to concede to the majority. Discussion - Mayor's Report in Newspaper Councilman Cravey defended his position as Councilman from District No. 1 In reply to a recent letter addressed to the people by Mayor C. L. Liggett and published in The Baytown Sun. The letter spoke of internal problems of the City government and how they apply to the progress of the City. Councilman Cravey stated that he was speakingonly for himself. He accused the Mayor of improper conduct and suggested that he re -read the charter of the City. He admitted that a controversy presently existed on the Council and it was his belief that this had been created, since many erroneous statements have been made publicly by Mayor Liggett; one member has presumed to speak for all the council without consulting the other members. It was his opinion that a good leader in Citf-government is one who is able to sense the desires of his consti- tuents and assert these to the Council and encourage them; the only hope this Council has of being successful is for the Mayor to re -read the charter, to examine his activities, to examine the duties and responsibilities prescribed for him in the charter and to live within those limitations. v . City Manaaer's Report The City Manager presented a memorandum re- stating his desires re- garding his future employment with the City of Baytown. He felt that a statement was in order to clarify his approach to the problem as to whether he continue as City Manager or step down and devote full time to the office of Director of Finance. There is a definite need for a full -time Director of Finance in the City; he presently is operating in a dual role of City Manager - Director of Finance but the City's operations have grown to such an extent until it leaves him little time to assist in the finance department. The other department heads in the department are presently carrying such a work load until it is impossible for them to do more than minimum requirements of cost'studies, statistical reports, purchasing analysis and other data that is beneficial to the operation of the City. The condition will be more accute with the retirement of Mr. Barber on October 1, 1963. He intended to explain the situation to the Council in detail at the time of the budget studies, and request that a salary be specified for a full time Director of Finance. If this had materialized and the salary was sufficient to meet his requirements, he proposed to ask the Council to start looking for a suitable replacement for him as City Manager and when one is located, to permit him to step down into the finance director's position on a full -time basis. Councilman Cook moved for the Council to affirm its intentions to not accept the request of City Manager J. B. LeFevre to step down from City Manager until the end of this budget year or the finding of a suitable replacement for him as City Manager, whichever may be the latter. Councilman Ansley seconded the motion.
