MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
July 11, 1963
The City Council of the City *of Baytown, Texas met in regular session
on Thursday, July 11, 1963 at 6:30 p.m. in the Council Room of the Baytown
City Hall with the following members in attendance:

The Mayor called the meeting to order, the Invocation was offered,.
afterwhich the City Clerk was instructed to read the minutes of the June
27th meeting. Councilman Cook moved to dispense with reading of the minutes;
they be approved as submitted in written form. Councilman Badgett seconded
the motion. The vote follows:

Bids - Pavina of East Favle, North First and East James Streets
Bids were opened and tabulated for the paving of East Fayle Street,
from Danubina to Alexander Drive, North First Street, from East Texas to
East James, and East James from North Fifth to Alexander Drive. The
tabulation follows:

The bids were referred to the City Engineer and company representatives
for verification as to unit prices. At the completion of the study the
bids were returned with a recommendation to accept the low bid of
W. Mischer Company at a total cost of $59.752.50 for improvement of the
three streets, as set forth in bid specifications. Councilman Cravey moved
to accept the recommendation and award the contract to the low bidder,
W. Mischer Company. Councilman Ansley seconded the motion. The vote follows:

Ordinance - Licensine and Other Controls - Pest Control Operators
The Council discussed the draft of a proposed ordinance requiring- the
licensing of pest control operators within the City of Baytown; setting forth
precautionary measures such as a Pest Control commission, bond,-etc. In
the discussion, it was agreed that Section 6 -a and Section 19 of the draft
should be deleted. Councilman Cravey moved to delete Section 6 -a and
Section 19 and adopt the ordinance as amended. Councilman Cook seconded
the motion. The vote follows:

Councilman Lively moved to set the annual license fee for operators
at $10.00 plus an additional annual fee of $2.00 for each service vehicle
used in the operation of the business. Councilman Ansley seconded the
motion. The vote follows:

OPERATORS AS HEREIN DEFINED; CREATING A PEST CONTROL COM-

Live Stock Control Ordinance
The Council discussed the draft of a proposed ordinance to regulate
the keeping of certain animals within - City limits of the City of Baytown,
with the exclusion of household pets living in the confines of owners'
residence, nor the keeping of dogs. At the conclusion of the discussion,
Councilman Cravey moved to adopt the ordinance as presented. Councilman
Badgett seconded the motion. The vote follows:

ORDINANCE NO. 690
AN ORDINANCE FOR THE PROMOTION OF,PUBLIC HEALTH AND GENERAL
WELFARE BY PROHIBITING THE OWNING, MAINTAINING, USING, KEEP-
ING OR HAVING IN POSSISSION CERTAIN ANIMALS WITHIN THE CITY
LIMITS OF THE CITY OF BAYTOWN EXCEPT UNDER CERTAIN CONDITIONS;
DEFINING CERTAIN TERMS; REPEALING ORDINANCES INCONSISTENT
HEREWITH; CONTAINING A SAVINGS CLAUSE; PROVIDING A PENALTY
AND THE EFFECTIVE DATE THEREOF.
Fruit and Produce Control Ordinance
The Council discussed the contents of an ordinance proposed to
regulate and control the operation of fruit and produce stands within the
City of Baytown. Some thought the $30.00 permit fee requirement was excessive.
Councilman Cravey moved that Section 4 of the ordinance be amended to
read "A permit fee of $10.00 shall accompany every application submitted."

Since the vote was a tie, it was agreed that further study must be
given to the proposed ordinance in order for it to be acceptable to a
majority of the Council. Following discussion, Councilman Badgett proposed
to withdraw his second to the aforementioned motion to amend the permit
fee, a second vote was taken on the permit fee amendment proposal and
the vote follows:

Councilman Lively moved to adopt the ordinance regulating fruit
and vegetable stands as set forth in the original draft. Councilman Badgett

ORDINANCE NO. 691
AN ORDINANCE REGULATING FRUIT AND VEGETABLE STANDS; REQUIRING
PERMIT, BOND,AND HEALTH CARD THEREFOR; REQUIRING CERTAIN
SANITARY STANDARDS TO BE MET BY SUCH FRUIT AND VEGETABLE STANDS;
PROHIBITING SUCH STANDS TO BE OPERATED ON PUBLIC PROPERTY;,
REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A
SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED
($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE
DATE THEREOF.
Ordinance - Creatina Planning Commission
The adoption of an ordinance creating a Planning Commission for the
City of Baytown was deferred to a later meeting.
Approved - Extension of Water Mains - Garth and Baker Roads
The City Council authorized City Manager LeFevre to proceed with plans
for the extension of water mains to eventually perfect the looping of the
water systems of the City of Baytown. A recent study has been made by
three local registered engineers and at the completion of their investigation,
a recommendation, in writing, had been mailed to each Councilman urging
the extension of an 8 -inch main out Garth.Road to Baker Road, east along
Country Club Oaks to tie -in to an existing 10 -inch. Since this routing
fits into the overall program of the City, City Engineer recommended its
adoption. The Council was in agreement with the overall plan and the
City Engineer was instructed to proceed with plans for such installation.
Transfer Obsolete Radio Equipment - Harris County
City Manager LeFevre informed the Council that the City presently has
some radio equipment which was purchased with matching federal funds about
12 or 19 years ago. It is not in use presently as it requires low -band
frequency and the municipalities are now required to operate on high -band
frequency, by FCC. He has recently received a request for the equipment
to be assigned to the Harris County Disaster & Relief Organization and
operated on the Harris County radio frequency.. Since the City has no.need
for the equipment, he suggested also that the equipment could be sold at
public auction but one -half of the funds must be returned to the federal
government as its pro -rata share of the original cost. After some further
discussion, it was suggested that the City advertise the equipment for sale.

If the bid quotations are found to be too low, the Council will then decide if it
wants to assign the equipment to the Harris County Disaster and Relief organization
for use in East Harris County proper.
Accept Civil Defense Plan Manual
Councilman Ansley moved to accept the Civil Defense Plan for the City of Baytown
as prepared by J. F. Hickerson, Director of Civil Defense, and submitted for Council
perusal at the May 23rd meeting. Councilman Cravey seconded the motion. The vote
follows:

Citv Manager"s Report
City Manager LeFevre reported the estimated cost of the water main extension now
under construction under the new 330 loop and along Baker Road at $9,638.00.
City Manager LeFevre reported work will begin within the next week on the Trifon
Ditch project; this project has been pending since 1962. The City crews will provide
equipment and man -power for the installation and the City will share in one -half the
cost of the pipe as per agreement.
A progress report on the park projects. Ponderosa- Craigmont and Gulf Hill, was
given with a promise for City crews to return to street maintenance as soon as the
preliminary park work is completed.
City Attorney Chandler, Fire Marshal Bounds and Fire Chief Lintleman were ap-
pointed to work with the Committee designated to promote a clean -up program for
Baytown. This consists of the removal of unsightly and dilapidated buildings, needless
underbrush, etc.
A meeting will be held with members of the Texas Highway Department for a dis-
cussion on problems of left turns on Alexander Drive. Should left turn arrow signal
installation be approved, it is almost mandatory that a portion of Alexander Drive
be widened to permit 4 -lane traffic.
Humble- Company's Private Streets - Truck Route
City Attorney Chandler informed the Council that he had talked with an Humble
Company Attorney relative to using Finley, Baytown Avenue and San Jacinto Streets as
a designated truck route. The Attorney had asked if the City would participate in
the maintenance of said streets. Mr. Chandler assured him the City would not claim
title to the above streets and in his opinion would not participate in maintenance
of same; the City's concern was to combine the heavy transport turck route in that
section of town into one designated route. Councilman Badgett moved to record that
the City will not claim title to Finley, Baytown Avenue and San Jacinto Streets
which are located within the metes and bounds of property owned by Humble Oil G Ref-
ining Company of Baytown, Texas. Councilman Cravey seconded the motion. The vote
follows:

Park Committee Report
Councilman Ansley submitted a written report on the results of the Park Committee
meeting July 10th. Some discussion was given to the recommendation to close the wading
pool at Roseland Park until it can be tied into the main pool's filtering system,
however, no definite action was taken on the recommendation at this meeting. The
Council did approve. the expenditure of securing stationery and stamps used in polling
the Churches and Civic Groups relative to participation cost in the construction of a
directory near Baytown -La Porte Tunnel.
Councilman Cook - Denton and Arlington
Councilman Ansley moved to authorize Councilman Cook to go to Denton and Arling-
ton to check City Planning, Subdivision Ordinances and Street Paving Ordinances by
property owner participation basis. Councilman Badgett seconded the motion. The vote
follows:
