1963 05 08 CC Minutes1899 MINUTES OF THE REGULAR MEETIPG OF THE CITY COUNCIL OF THE CITY OF BAYTOWN May 8, 1963 The City Council of the City of Baytown. Texas met in regular session on Wednesday. May 8, 1%3 at 5:30 p.m. in the Council Room of the Baytown City Hall with the following members in attendance: Seaborn Cravey Councilman W. L Ward Councilman Kenneth E. Badgett Councilman Velma J. Ansley Councilman J. M. Bryan Councilman T. E. Cook Councilman C. L. Liggett, M. D. Mayor J. B. LeFevre City Manager George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order. the Invocation was offered, after- which, the City Clerk was instructed to read the minutes of the April 25. meeting. Councilman Ansley moved to dispense with reading of the minutes, they be approved as submitted in written form. Councilman Huron seconded the motion. The vote follows: Ayes: Councilmen Cravey, Badgett. Ward. Ansley. Bryan and Huron Mayor Liggett Nays: None Resolution - Canvassing Election Returns - April 27 The returns of the special Municipal election held April-27th were can- vassed by the City Council, afterwhich, the City Manager-introduced and read a resolution declaring the results of the election and finding that the election was duly and properly held in accordance with the laws of the State of Texas. Councilman Ansley moved to adopt the resolution as read. Council- man Huron seconded the motion. The vote follows: Ayes: Councilmen Cravey, Badgett, Ward, Ansley, Bryan and Huron Mayor Liggett Nays: None The caption of the Resolution follows: RESOLUTION NO. 23 -4 -63 A RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 27TH DAY OF APRIL, 1963, FOR THE PURPOSE OF ELECTING TWO COUNCILMEN FROM THE RESPECTIVE DISTRICTS NOS. 2 AND 6; DECLARING THE RESULTS OF SAID ELECTION; FINDING THAT NOTICE OF SAID ELECTION WAS DULY AND PROPERLY GIVEN AND THAT SAID ELECTION WAS DULY AND PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. Administered Oath of Office - Two Councilmen. Cook and Lively Corporation Court Judge B. L. Ward administered the Oath of Office to Councilmen Cook and Lively as councilmen from Districts 2 and 6, respectively for the two ensuing years. Congratulations were extended to the new City officials. Outgoing Councilmen Ward and Bryan expressed their appreciation to the Council. City employees and citizens of Baytown for the cooperation and courtesies extended to,them during their tenure of service on the City Council, afterwhich and Appreciation Plaque and personal gifts were presented to each of the Councilman and his wife. 1900 Beautification Committee - Report Councilman Ansley. Chairman of the Beautification Committee, introduced James A. Davis. local architect, who presented drawings of the proposed Church and Service League directories which will be erected at the City limits to the South, North and West in due time. The cost of combined installation will be approximately $2,500 for each location. The Council agreed to take the proposed sketch under advisement; local churches will be contacted for an expression on the proposal to have each church purchase its own metal plaque. CFinal Approval Section N Lakewood Subdivision 1 The Council received a request for final approval of Lakewood Subdivision. Section N. The preliminary approval was given by the former Council on December 13. 1962 and at that time it was noted that the development did not meet the specifications of the city's subdivision ordinance in relation to the installation of curb and gutters; the existing terrain preventing such improvement. City Manager LeFevre reported that the development had been inspected by a representative from the engineering. water G sewer and fire departments and all installations had been made in accordance with the pre- liminary plat plans. It was his recommendation that this section of the develop- ment be given final approval. After some discussion, Councilman Ansley moved to grant final approval to Lakewood Subdivision, Section N. as recommended by the City Manager. Councilman Cravey seconded the motion. The vote follows: Ayes: Councilmen Cravey, Ansley, Badgett and Lively Mayor Liggett Nays: Councilmen Cook and Huron Ordinance - Quit Claim Water District No. 58 - Lone Star Water Company On recommendation of City Attorney Chandler and Baytown's Fiscal Agent Ernest.L. Brown, Jr., Councilman Cravey moved to accept a cash settlement of $37,055.62 from the Lone Star Water System (representing operating expenses due Harris County Water Control and Improvement District No. 58 accrued prior to the City of Baytown's annexation and abolishment of said District No. 58 on November 29, 1962, and paid as operating expenses of the North Houston Water System) to adopt an ordinance setting forth the acceptance and settlement of the existing controversy and authorizing the execution of a quit claim deed to such water properties. Councilman Badgett seconded the motion. The vote follows: Ayes: Councilmen Cravey. Cook, Badgett, Ansley, Lively, and Huron Mayor Liggett Nays: None The caption of the ordinance follows: ORDINANCE NO. 682 AN ORDINANCE RECITING THE CONTROVERSY BETWEEN THE CITY OF BAYTOWN AND HARRIS COUNTY EASTEX OAKS WATER AND SEWER DISTRICT OVER OWNER- SHIP OF WATER PROPERTIES FORMERLY OWNED BY HARRIS COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT NO. 58, FUNDS ON DEPOSIT IN THE NAME OF SUCH DISTRICT, AND MANAGEMENT FEES ATTRIBUTABLE TO SUCH WATER PROPERTIES. FINDING THAT SUCH WATER SYSTEM IS NOT PORTION OF THE CITY OF BAYTOWN'S WATER WORKS SYSTEM OR NECESSARY FOR OPERATION OF THE CITY'S SYSTEM. ACCEPTING AN OFFER OF COMPROMISE AND SETTLE- MENT OF SUCH CONTROVERSY, AND AUTHORIZING DISCLAIMER OF THE CITY'S INTEREST TO SUCH CONTROVERTED WATER SYSTEM IN PENDING LAWSUIT AND QUITCLAIM DEED TO SUCH WATER PROPERTIES. Handbook - Civil Service Rules Raymond T. Donnelly. Director of the Civil Service Commission, presented each Councilman with a copy of a handbook which contains the Rules of the Firemen's and Policemen:.s Civil Service System of Baytown as adopted by Ordinance of the City of Baytown pertaining to the system. He asked that the handbook be studied by each of the Councilmen and formal action be taken later. 1901 Miscelleanous The City Manager requested the Council.to be prepared to make the appointment of the 1%3 Board of Equalization at its next regular meeting as the Charter requires the appointment to be made prior to June 1. The City Manager reported that the Gulf Hill Parksite for colored resi- dents of Baytown is presently being leveled and the ball diamond prepared for the 1963 season. The City Manager for bids on the construction of a fence around the swimming pool site located in Ponderosa Subdivision. Bids for the painting of the Water tower on East James street will not be sought until later in the year as the peak water -use period is during the summer months. The City Manager will continue negotiations for the use of the abandoned Baytown Elementary School building as a recreational center for both young and older citizens of Baytown. Mayor Liggett gave public recognition to Mrs. Edna Oliver. City Clerk. for being named Secretary -of- the -year by the San Jacinto Chapter of NSA. Adiournment Councilman Ansley moved for the meeting to adjourn. Councilman Badgett seconded the motion. The ayes were unanimous and the Mayor declared the meeting adjourned. City Clerk /na
