1962 12 19 CC Minutes, SpecialW.M* MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS December 19, 1962 The City Council of the City of Baytown, Texas met in special session on Wednesday, December 19, 1962 at 5:30 p.m. in the Council Room of the Baytown City Hall with the following members in attendance: Seaborn Cravey W. L. Ward C. A. Hansen Velma J. Ansley J. M. Bryan J. C. Huron Al Clayton J. B. LeFevre Edna Oliver Absent: George Chandler Councilman Councilman Councilman Councilman Councilman Councilman Mayor City Manager City Clerk City Attorney The Mayor called the meeting to order and introduced Councilman J. M. Bryan, Chairman of the Annexation and Subdivision Committee. Bryan- Committee's Recommendation - Annexation Undeveloped Acreage Councilman Bryan gave a detailed report on the extensive study made by the Annexation and Subdivision Committee relative to undeveloped acreage lying southeast of the city limits of Baytown. It was the opinion of the Committee that an effort should be made to speed development of the acreage. A portion of the area could be developed as residential sites and other sections would be attractive to industry only, and such ann- exation would be to the best interest of Baytown. Robert Strickland, a local attorney representing Ashbel Smith Land Company, and one of the property owners to be effected if the annexation is approved, presented arguments against the annexation and filed a letter from Mr. Lester Settegast, Attorney at Law, requesting a hearing as provided in Article I, Section 9 of the Charter of the City of Baytown. Mr Sette- gast represents Bay & Bayou, inc., The Mound Company, and the Robert A. Welch Foundations. After a lengthy discussion, City Manager LeFevre introduced and read ordinances extending the city limits of the City of Baytown to include approxi- mately 2 square miles of undeveloped land southeast of the City. Councilman Ward moved to adopt the ordinances as read. Councilman Cravey seconded the motion. The vote follows: Ayes: Councilmen Cravey, Ward, Hansen, Ansley, Bryan and Huron Mayor Clayton Nays: None The caption of the ordinances follows: ORDINANCE NO. 428 -A AN ORDINANCE CONTAINING ORDINANCE NO. 428, INTRODUCED THE 27TH DAY OF JUNE, 1957, AND BEING: "AN ORDINANCE ENLARGING AND EXTENDING THE BOUDARY LIMITS OF TEH CITY OF BAYTOWN AND ANNEXING ADDITIONAL ADJACENT TERRITORY TO THE SAID CITY, ALL OF WHICH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE IN THE MANNER PROVEDED IN ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN ": PROVIDING FOR THE AMENDMENT OF SAID OR- DINANCE NO. 428 WITH RESPECT TO THE TERRITORY TO BE ANNEXED AND FOR THE FINAL PASSAGE OF SAID ORDINANCE IN AMENDED FORM PURSUANT TO SECTION 9, ARTICLE I, OF THE CHARTER OF THE CITY OF BAYTOWN. 1850 ORDINANCE NO. 500 -A AN ORDINANCE CONTAINING ORDINANCE NO. 500, INTRODUCED THE 10TH DAY OF JULY, 1958, AND BEING: "AN ORDINANCE ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS AND ANNEXING ADDITIONAL ADJA- CENT TERRITORY TO SAID CITY, ALL OF WHICH IS DES- CRIBED HEREIN; CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE IN THE MANNER PROVIDED IN ARTICLE I, SECTION 99 OF THE CHARTER OF THE CITY OF BAYTOWN "; PROVIDING FOR THE AMENDMENT OF SAID ORDINANCE NO. 500 WITH RESPECT TO THE TERRITORY TO BE ANNEXED AND FOR THE FINAL PASS- AGE OF SAID ORDINANCE IN AMENDED FORM PURSUANT TO ARTICLE "I, SECTION 99 OF THE CHARTER OF THE CITY OF BAYTOWN. Ordinance- Reannexing Additional Territory -Under First Reading The City Manager introduced and rear' an ordinance reannexing, under first reading all adjacent territory in- cluded in ordinances No. 428 and 500, respectively, and excluded from the amended Ordinances 428 -A and 500 -A. Councilman Ward moved to adopt the ordinance which re- annexed, under first reading, territory lying south, east and north of the City of Baytown. Councilman Cravey seconded the motion. The vote follows: Ayes: Councilmen Cravey, Ward, Hansen, Ansley and Huron Mayor Clayton Nays: None The caption of the ordinance follows: ORDINANCE NO. 666 AN ORDINANCE ENLARGING AND EXTENDING THE BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS AND ANNEXING ADDITIONAL ADJACENT TERRITORY TO SAID CITY, ALL OF WHICH IS DESCRIBED HEREIN; CONTAINING A SAVINGS CLAUSE, AND PROVIDING FOR THE PUBLICATION AND PASS- AGE OF THIS ORDINANCE IN THE MANNER PROVIDED IN ARTICLE I, SECTION 9, OF THE CHARTER OF THE CITY OF BAYTOWN. Execute Quit Claim Deed - Rice Street Councilman Cravey moved to authorize the Mayor and City Clerk to execute a quit claim instrument unto the Trustees for St Paul's Lutheran Church, on a 50 -foot strip of land out of the Schilling 210 acre tract which has been dedicated for the extension of Rece Street in Morrell, if and when, the property is developed. The city has no plans to extend Rice Street and the Church has bought land which includes the right -of -way. Council- man Ansley seconded the motion. The vote follows: Ayes: Councilmen Cravey, Ward, Hansen, Ansley, Bryan and Huron Mayor Clayton Nays: None Draft - Written Policy - Surrender of Land City Owns Councilman Hansen was appointed as a committee of one to draft a policy on the conditions under which the City Council will give away, release or donate property owned by the City. 1851 Resolution- Citizens State Bank, Houston, Payee. Bonds Water District No. 8 Councilman Ansley moved to adopt a resolution author- izing the signing of checks by officers of the City of Baytown on Citizens State Bank of Houston, depository and payee for bonds of Fresh Water District No. 8. which has been dissolved since annexation by the city of Baytown, November 29, 1962. Ayes: Councilmen Cravey, Hansen, Ansley Bryan and Huron Mayor Clayton Nays: None Adiournment: Councilman Ansley moved for the meeting to adjourn. Councilman Cravey seconded the motion.
