1962 10 11 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN October 110 1962 The City Council of the City of Baytown, Texas met in regular session on Thursday, October 11, 1962 at 5:30 p.m. in the Council Room of the Baytown City Hall with the following members in attendance: Seaborn Cravey C. LeFevre Edna Oliver Absent: Al Clayton George Chandler Councilman Councilman Councilman Councilman Councilman Mayor Pro Tem City Manager City Clerk Mayor City Attorney The Mayor Pro Tem called the meeting to order, the Invocation was offered, afterwhich, the City Clerk was instructed to read the minutes of the September 27 meeting. Councilman Ansley moved to dispense with reading of the minutes; they be approved as submitted in written form. Councilman Cravey seconded the motion. The vote follows: Ayes: Councilmen Cravey, Ansley, Bryan and Huron (Hansen not yet Mayor Pro Tem Ward Arrived) Nays: None Bids - Pickup Truck - Police Department Bids on a 1/2 ton pickup truck for the police department were opened and tabulated as follows: Buck Turner Chevrolet 1962 pickup truck Less trade -in 1949 GMC $19566.02 Thad Felton 1963 pickup truck Less trade -in 1949 GMC $1,643.90 Boyd Mullen 1963 pickup truck Less trade -in 1949 GMC $1,668.47 Councilman Hansen moved to accept the low bid of Buck Turner for the 1962 Chevrolet Pickup truck, less trade -in at $1,566.02. Councilman Cravey seconded the motion. The vote follows: Ayes: Councilmen Cravey, Hansen, Ansley, Bryan and Huron Mayor Pro Tem Ward Nays: None Approve Installation Street Lights - West Main to Cedar Bayou Road City Manager LeFevre presented a proposal for the installation of 52 mercury vapor street lights extending from West Main to Cedar Bayou Road at an estimated cost of $29340.00. Instead of the metal standard poles, it was his recommendation that wooden poles be used with the 20,000 lumen lights on suspension brackets. Lights will be installed at each intersection and within the middle block but not spaced as a conflict may arise. If the Council approves this type installation, the city will derive a savings of $4,000 plus over the original cost estimate. Mr. LeFevre also asked for approval to have a mercury vapor light installed at each of the two churches facing North Main Street past the Cedar Bayou Road intersection. After some discussion, Councilman Ansley moved to accept the recommendation of the City Manager; he be instructed to order the installation of mercury vapor lights from West Main northerly to Cedar Bayou Road, with the inclusion of the two churches. Councilman Huron seconded the motion. The vote follows: 1819 Ayes: Councilmen Cravey, Ansley, Bryan and Huron Mayor Pro Tem Ward Nays: None The City Manager will confer with engineers of the Houston Lighting and Power Company in the recommended installation. Ordinance - Street Name Change The City Manager introduced and read an ordinance amending an ordinance changing the names of certain streets, including in Ordinance 656, to bear the same names originally designated, such as, Rosille and Lacy Drives. Councilman Ansley moved to 7 adopt the ordinance as read. Councilman Bryan seconded the motion. The vote follows: Ayes: Councilmen Cravey, Mayor Pro Tem Ward Nays: Councilman Hansen Ansley, Bryan and Huron The caption of the ordinance follows: ORDINANCE NO. 659 AN ORDINANCE AMENDING AN ORDINANCE, TO -WIT: "AN ORDINANCE CHANGING THE NAMES OF CERTAIN STREETS WITHIN THE CITY OF BA BAYTOWN, TEXAS, IN ORDER TO PROVIDE FOR GREATER STREET NAME UNIFORMITY: AND PROVIDING FOR THE EFFECTIVE DATE THEREOF ", BEING ORDINANCE NO. 656,PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 23RD DAY OF AUGUST, 1962, BY AMENDING SECTIONS ONE (1) AND TWO (2) THEREOF, AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. Adoption Proposed Changes - Civil Service Rules Exception 2 Sections Raymond Donnelly, Director of the Baytown Civil Service Commission, presented proposed changes to the civil service rules; reviewed each section and gave full explanation on the reasons why such change is proposed. Thirteen proposed changes were presented, one of which was entirely new and required periodic physical examination of all classified employees at intervals not exceeding three years. The proposed change in Section 43 changed the present personal investigation by the Director of Civil Service to provide that personal investigation shall be made by the Police Department. The Council questioned this proposed change and agreed to defer any change in the - .present reading and investigate the possibility of securing outside assistance in the investigation rather than using a member of the Police Department. In section 44, it was proposed that applicants for positions in the classified service need not reside within the city at time of application. Since this is an administrative problem, the City Manager was asked to bring a written policy defining "reasonable distance" from the city limits which will be used as a guide in the administration of this section. After reviewing the entire list, it was agreed to defer any action on the periodic physical examination requirement at this time; Councilman Ansley moved to adopt the proposed changes, as presented excepting Section 43, Police Investigation of applicants and the new section, Physical Examination. Councilman Huron seconded the motion. The vote follows: Ayes: Councilmen Cravey, Hansen, Ansley, Bryan and Huron Mayor Pro Tem Ward Nays: None Councilman Huron, City Manager LeFevre and one member of the Civil Service Commission were appointed as a Committee to draw up specifications for the Periodic Physical Examination proposal and bring its recommendations to the Council after the study has been completed. Present Copies Proposed Reclassification Ordinance - Fire 8 Police 1820 Service Classification ordinance by defining terms, interpreting the class specifications and providing for the allocation of positions to the various classes. The council will make a study of the ordinance during the two ensuing weeks and final disposi- tion made by the Council at the October 25th meeting. Houston Natural Gas Representatives - Discuss Gas Rate Structure Mayor Pro Tem Ward introduced and read a letter of inquiry relative to a comparison between Houston's winter gas rate and Baytown's winter gas rate and showing a difference of $5.12 for the 30,600 cubit feet of gas consumed. He stated that a conference had been held with H. F. Massey, District Manager of the Houston Natural Gas Corporation, and was assured that the rates of Baytown were lower than those of Houston. Since there may be a possibility of discrepancy, City Manager LeFevre and City Attorney Chandler were instructed to go to the main office cf the Gas Company and secure an official comparison of the existing summer and winter rates in the City of Baytown and City of Houston; also, secure from the company, copies of ordinances from, all of the other areas served relative to rate structure. If is found that a discrepancy exists, to our disadvantage, Mr. LeFevre was further instructed to invite representatives from the company to attend the October 25 meeting for the purpose of interrogation, specifically Jackson Hinds. Resolution - Opposing Trial de Novo Amendment Councilman Cravey moved to instruct the City Attorney to prepare a resolution setting forth the Council's opposition to the Trial de Nova amendment which is listed as No. 14 and will be voted upon at the Nov. 6 general election. Councilman Hansen seconded the motion. The vote follows: Raw Ayes: Councilmen Cravey, Hansen, Ansley, Bryan and Huron Mayor Pro Tem Ward Nays: None Policy- Accumulated Sick Pay - Termination and Rehiring The City Manager was instructed to have an amendment to Section 1 of Ordinance Nz. 595 prepared which will clarify the position and establish a policy of accumulated sick benefits for employees who have been rehired by the City and were paid accumulated sick benefits at the time of employment severance. Garbage Collection Ordinance - Discussion The proposed amendments to the cit's garbage collection ordinance were reviewed section by section. All of the amendments were approved with the exception of those included in Section 14, relative to charge of dumping on grounds by outside residents, commercial haulers, etc. It was suggested that the ordinance be approved with the exception of this section; it can later be presented for addition to the provisions of the ordinance after a concrete charge schedule has been adopted by the council. After some further discussion, Councilman Cravey moved to adopt the ordinance, as amended, with the exclusion of Section 14 which will be acted upon at a later date. Councilman Ansley seconded the motion. The vote follows: Ayes: Councilman Cravey, Hansen, Ansley, Bryan and Huron Mayor Pro Tem Ward Nays: None A Committee composed of Councilman J. C. Huron, City Manager LeFevre and A. J. Busch, Jr. was appointed to make a study of the rate schedule contained in the deleted Section 14 and prepare an addendum for council perusal, after a workable schedule has been drafted. Thta caption of the ordinance follows: 1821 ORDINANCE NO. 660 AN ORDINANCE REGULATING THE COLLECTION OF GARBAGE AND REFUSE WITHIN THE CITY OF BAYTOWN: PROVIDING THE SIZE OF CONTAINERS; ESTABLISHING A FEE FOR THE RESIDENTAL COLLECTION AND PROVIDING A METHOD OF BILLING AND COL- LECTING SUCH FEE; PROVIDING FOR MAXIMUM PENALTY OF $200.00 FOR VIOLATION AND FOR EFFECTIVE DATE LgEREOF AND REPEALING ALL PRIOR ORDINANCES AND AMENDMENTS RELATING THERETO. Adjournment Councilman Cravey moved for the meeting to adjourn. Councilman Ansley seconded the motion. The ayes ere unanimous and the Mayor Pro Tem delcared the meeting adjourned.
