1962 01 16 CC Minutes, SpecialMINUTES OF THE SPECIAL MEETING OF THE CITY COUNIL OF THE CITY OF BAYTOWN January 16, 1962 The City Council of the City of Baytown, Texas, met in special session on Tuesday, Janury 16, 1962, at 7 :00 o'clock p.m. in the Council Room of the Baytown City Hall with the following members in attendance: Seaborn Cravey W. L. Ward C. A. Hansen Velma J. Ansley Roy H. Hughes James M. Bryan Al Clayton J. B. LeFevre George Chaddler Edna Oliver Councilman Councilman Councilman Councilman Councilman Councilman Mayor City Manager City Attorney City Clerk', The Mayor called the meeting to order, the Invocation was offered by Reverend W. S. Graham, afterwhich, the following business was transacted: Discussion - Procedure - Thoroughfares - Resolution Adopted Mayor Clayton opened the meeting by asking for questions from those in the audience relative to the proposed bond issue. Most of the questions directed to the Council were not•in opposition•but for clarification of the issues, especially the thoroughfares designated for improvement, the routes,.the cost to the tax payers tax -wise and by increased valuation; credit, if any, for existing.curb and gutter and other pertinent facts relating to the Council's policy for the improvements If the bond issue is approved. Mayor Clayton read a resolution which designated certain streets and thorough- fares in a state of disrepair within the city which have need of permanent Improve- ment and proposed to'permanently improve said streets from funds derived from the approved bond issue without the required 51%- property owner signatures. The eight (8) streets named in the resolution which were classified as public thoroughfares follows: 1. James Street, from Alexand Drive to Lobit Street and Lobit Street from James to Decker Drive. 2. Commerce Street from Gulf to Forrest. 3. Lynchburg Road and Harbor Drive 9. Fayle Street from Commerce to Narcille. 5. Pruett Street from best Main to West Sterling, 6. Gulf Street from Whiting to Highway 146. 7. North Pruett Street from Homan to Lloyd Lane. 8. Briarwood Drive from present Western terminus to South Main. Messrs. H. N. Love and Jack G. Hester, residents of Pruett, Addition, Section 2, suggested that some change be made in the wording of the James Street thorough- fare. A revision was made by designating the improvement from the intersection of James and Alexander Drive to the intersection of Lobit and Decker Drive following the most feasible route. With this correction, Councilman Ward moved to adopt the resolution as amended. Councilman Hughes seconded the motion. The vote follows: Ayes: Councilmen Cravey, Ward, Hansen, Ansley, Hughes, Bryan Mayor Clayton Nays: None 1707 6' �9 1708 RESOLUTION A UNANIMOUS RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN DESIGNATING CERTAIN STREETS AND THOROUGHFARES; FINDING THAT SUCH STREETS ARE IN NEED OF PERMANENT IMP®OVEMENT; RESOLVING THAT SUCH STREETS MILL BE CONSTRUCTED AND IMPROVED FROM THE PROCEEDS OF THE NETT BOND ISSUE; FINDING THAT.THERE ARE MANY RESIDENTIAL STREETS 1WHICH ARE IN NEED OF PERMANENT IMPROVEMENT; DEtERMINING.THAT RESI- DENTIAL STREETS SHALL BE IMPROVED, AT THE DISCRETION OF THE CITY COUNCIL, FROM THE PROCEEDS FO THE NEXT BOND ISSUE ON THE BASIS OF PETITIONS PROPERLY PRESENTED TO THE CITY COUNCIL; AUTHORIZING AND DIRECTING THE MAYOR AND CITY. CLERK TO EXECUTE THIS RESOLUTION AND THE CITY ADMINISTRATION PROPERTY PUBLICIZE SAME. WHEREAS, the City Of-;Baytown has relatively few through streets, particularly thoroughfares connecting the East part of the City with the West part of the City; and WHEREAS, the existing thoroughfares are in a state of disrepair _pnd need to be permanently imprrved; and ' WHEREAS, the City Council of the City of Baytown has gone on record that it shall improve certain thoroughfates from the proceeds of the next Bond Issue; and SEAS, the City Council of the City of Baytown has also.determined that' a number of residential streets are in a state 'of disrepair and the City Council shall improve same for the proceeds of the next Bond Issue; NOW,-THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown, upon the.'recom- mendattoo of the Baytown Advisory Board, the City Administration and of.its own volition,hbreby designates the following streets within the City of.Bagtown as public Thoroughfares: 1. From the intersection of James and Alexander Drive to the intersection of Lobit and Decker Drive following the most feasible route. ' 2, Commerce Street from Gulf to Forrest. 3. Lynchburg Road and Harbor Drive 4. Fayle street from'Commerce to Narcille 3, Pruett Street from Nest Main to West Sterling 6. Gulf Street from Whiting to Highway 146 7, North Pruett Street from Homan to Lloyd Lane 8. Briarwood Drive from present Western terminus.to South Main. BE IT FURTHER RESOLVED by the City Council of the City of Baytown that such streets need to be permanently - improv6d and it hereby goes on record that it shall permanently improve thaeforementioned streets from the proceeds of the next Bond Issue. Section 2: That the City Council of the City of Baytown is cognizant of the fact that many residential streets are in dire need of permanent improvement and that it shall improve same as petitions of the abutting property'owdert are properly*presented . to it. That`such determination shall be predicated on.the general welfare of the community as well as the need -and convenl6nee of the local property owners, at Council's discretion. Section 3: That said thoroughfares and residential str6ets shall be con- structed and improved on a property offer participation basis as heretofore set forth in policies adopted by this Council, such policies being expressl# set forth in the official minutes of the City of Baytown. Lf7 Section 4: That the Mayor and City Clerk are hereby authorized and directed to execute this Resolution and the City Administration is directed to properly publicize same. ATTEST: /s/ Edna Oliver Edna Oliver, City Clerk ' Policy - Street Improvements - Under Bond Issue City Manager LeFevre submitted a four (4) part policy on street improvements under the bond issue for Council perursal. A draft of such policy was requested at the January 11th meeting. The first part named the thoroughfares to be improved. Since the Council had revised the James Street route, the policy was changed to read: "James Street from Alexander Drive to the intersection of Lobit and Decker Drive by the.most feasible route." The Council will decide on the priority for the street paving of any residential street, after the necessary petitions have been presented. This decision will be based on the general welfare of the community, each,street to be reviewed on its own merits. Part Two (2) df the policy was amended to reed: "Thoroughfares shall be paved consistent with anticipated traffic load, rather than with reinforced con - crate: as set forth in the draft. Part Four (4) was amended to make allowance and giva credit for any usable curb and gutter. Some of those in the audience seemed to feet that the $8.00 per front foot for property owners on thoroughfares was in- equitable, however, the Mayor explained that property owners on residential type streets would be allowed five (5) years, six (6) payments, in which to pay the improvements and payments on thoroughfares will be carried over a period of nine (9) years, ten payments. Councilman Ward also pointed out that some study is being given to a policy, reportedly used in Houston, which allows residents, living on thoroughfares, to sign papers to the effect their property is residential and it is their intent to keep it that way. The property owner will then pay a residential rate of no more than $4.00 per front foot for the improvements. If, at a later date, the owner should decide that the property has lost its residential value and it will be more conducive to business and sells the property, he will pay the dif- ference in cost of residential and thoroughfare street improvements at this time. The City Attorney is presently making a study of this policy and will present his findings at a later date. After some further discussion, Councilman Hansen moved to adopt the Street Improvement as revised. Councilman Ward seconded the motion. The vote follows: Ayes: Councilmen Cravey, Ward, Hansen, Ansley, Hughes, Bryan Mayor Clayton Nuys: None The statement of Policy follows: POLICY - RELATIVE TO STREET IMPROVEMENTS - PARTICIPATION BASIS 1. That the City Council shall not order a secondary or undesignated street to be improved under a paving assessment program unless and until 51% of the property owners abutting such street shall petition Council for such improvement, however, the City Council will designate certain streets as thoroughfares in the bond issue; these will be paved by order of the City Council without a petition of signatures of abutting property owners. Such streets are as follows, all of which were recommended by the Advisory Board and approved by the City Council after careful consideration: James Street from Alexander Drive to the intersection of Lobit and Decker Drive by the most feasible route; Commerce Street from Gulf to Forest; Lynchburg Road and Harbor Drive; Fayie Street from Commerce to Narcille; Pruett Street from West Main to Sterling; 1709 Sul, 1710 r Gulf Street from Whiting to Highway 146; North Pruett Street from Homan to Lloyd Lane; Briarwood Drive from present western terminus to South Main. The Council will decide on the priority for paving streets which-are requested by receipt of abovementioned petitions, based on the.general welfare. 2. That the Council shall determine whether a roadway is a residential street or a thoroughfare and it shall not assess the abutting property owners thereon more than $4.00 per front foot for the improvement of resi- dential streets and no more than $8.00 per front foot for thoroughfares. Thoroughfares shall be paved in a manner consistent with antidipated traffic load. Residential streets shall be paved with a minimum of 7Y2" cement stabilized shell and topped with 1!�" hot mix asphalt. 3. The abutting property owners shall not be assessed the cost of constructing _any storm sewers that may be required for the improvement of such streets. . 4. That the abutting property owners shall receive a credit (which thall be de- ducted from his $4.00 per front foot or $8.00 per front.foot, as the case may be) for any curbs, gutters and base streets which were previously con -' structed according to the City's PlAns and Specifications and under the City's supervision; provided, that such curbs and gutters were constructed and built after consolidation of.Pelly, Goose Creek and Water District No. 7, and are in usable condition. • -The consideration that such abutting property owner shall receive as a credit shall depend on a cost estimate prepared by the City Engineer and approved by -the City Council.
