MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
October 24, 1961
The City Council of the City of Baytown, Texas met in regular session on
Tuesday, October, 24, 1961, at 7 :00 p.m. in the Council Room of the Baytown City
Hall with the following members in attendance:

The Mayor called the meeting to order, the Invocation was offered by David
Funderburk, afterwhich, the City Clerk was instructed to read the minutes of the
previous meeting. The motion was made to dispense with the reading of the minutes;
the following corrections were made: "Appointment Zoning Committee: Raymond Tick -
ner ". - "Study Alleviate Flooding Durain Road: After some discussion, the Council
agreed to hold the flood gate installation in abeyance until the City Engineer has
completed his study on drainage of the area south of Missouri and east of Spur 201.
After he submits his recommendation, the Council will review the entire construction
project, including installation of flood gates, and action will then be taken on
the entire construction proposal." "Drainage - Cedar Street and Vicinity - The
City Manager to proceed with construction plans; bids to be solicited after plans
are completed." With these corrections, Councilman Ansley moved to approve the
minutes-as amended. Councilman Ward seconded the motion. The vote follows:

Chlorine Bids
Only one bid -was received -for furnishing and delivering liquid chlorine to
the City of Baytown for a 12 month period. This bid was received from Diamond Alka-
li Company for the unit price of Nine and One -Half %0.095 r pound. Counc-
ilman Ansley moved to accept the bid of Diamond Alkali and the contract be awarded
for the 12 ensuing months. Councilman Cravey seconded the motion. The vote follows:

Councilman Ward moved to accept the bids as presented; the City Clerk be
instructed to record receipt of same in the regular minutes but further action be
tabled. The bids will be referred to the City Manager and Director of Public Works
for study. In the meantime, the Council will review a demonstration of all avail-
able machines. Councilman Cravey seconded the motion. The vote follows:

After some discussion, Councilman Hansen moved to accept the
botham Motor Company and authorized the purchase of Three (3) 1962
Sedans at a net cost of $3.578.38. Councilman Cravey seconded the
follows:

Mayor Clayton presented a Proclamation of Christmas Seal Season by enumerating
the many benefits such as brings us reminder that a great joy of the holy season is
giving to others; (2) this is the 50th anniversary of our Houston - Harris County TB
Association, past contributions have helped to save thousands of people from the
disease; (3) TB remains stubbornly entrenched and no family is safe from it; (4)
to press a new attack on TB the association is asking that each of our families
join the Christmas Seal team and officially proclaiming the period from November
11th, through December, 1961 as Christmas Seal Season in the City of Baytown and
urged every family and firm to contribute generously to the Christmas Seal appeal
of the TB association to help step up its program of education, case detection,
community health work and research-to safefuard the health of all. Councilman
Ward moved to approve the Proclamation as read. Councilman Ansley seconded the
motion. The vote follows:

Discussion - Terms Fire Ptotection - O:itside City Limits - Harris and Chambers Counties
Mr. George Chandler, City Attorney, gave a report on his contact with Eugene
Jensen, County Attorney of Chambers County, relative to Council instruction to
negotiate for remuneration on calls made by the Baytown Fire Department in Chambers
County and, secondly, an agreement relieving the officials of Baytown from any lia-
bility for damages in cases where wrecks, involving fire trucks, occur when answer-
ing fire calls. -Attorney Jensen was not receptive to the proposal for Chambers
County to pay money for services rendered by the Baytown Fire Department but an
agreement will be executed relieving the city officials of responsibility if an
accident occurs when answering a call. Fire Chief Lintelman reported that he had
met with the County Judge and members of the Chambers County Commissioners Court
and explained a portion of the law as interpreted by our City Attorney. The Court
expressed willingness to execute any agreement to absolve Baytown officials should
a wreck occur but no money for remuneration was available at the present-time as the
1961 -62 fiscal year budget has been compiled and approved. The Court agreed, how-
ever, to review the financial structure a little later in the year and it is possi-
ble that an agreement may be executed on remuneration for fire services rendered
by the City of Baytown in Chambers County. At the request of Mr. Chandler, a
figure of $500 to $600 for Chambers County and $1,500.00 for Harris County was sub-
mitted as a basis of equity and reasonable cost for the out -of -town fire services.
The money is to be paid to the City of Baytown and used. °to defrRy a portion of the
expense of sustaining the equipment of the Fire Department. The City Attorney was
Instructed to continue negotiations with both governmental agencies for execution
of the release agreement and remuneration for fire services rendered by the City
of Baytown in both Harris and Chambers Counties.

Request Close Hemphill Street - November 5th Through November 11th
The City Manager presented a request from managers of Sears Roebuck C Company
and Weingartens for permission to close Hemphill Street. from West Gulf to West
Texas, from November 5th through November 11th. The two business firms are plann-
ing Special Sales Days' during this period and kiddie rides will be provided to
entertain the children while the parents shop. If the Council approves the request,
these rides will be erected on the closed ktreet. Since these are the only two
business firms abutting the one block of Hemphill Street, and both firms plan to
jointly sponsor the entertainment, Councilman Cravey moved to approve-the request;
permission granted to close the one block of Hemphill street, from West Gulf to
West Texas, from November 5th through November 11th. Councilman Ansley seconded
the motion. The vote follows:

Discussion - All Day Parking - Non - Metered Streets
The Council discussed some of the problems created by all day parking on non -
metered streets after the City Manager reported that he has received several com-
plaints about such parking from residents living near the downtown area. The com-
plaints are many and varied; some are made by elderly persons who are required to
carry groceries several blocks because of the congested parking, some have drive-
ways blocked, some have friends who wish to visit but can find no parking space,
etc. The Council considered the feasibility of removing the meters on the city's
parking lot, between Commerce and Main, and allowing all day parking without charge,
possibly installing meters or erecting No Parking signs in certain areas but no
decision was definitely reached as it was generally agreed that all day parking can-
not be restricted within the entire area; this is a common inconvenience of living
In the scope of a downtown business district.
Representation - Texas Municipal League Annual Meeting - San Antonio
The Council gave permission to City Manager LeFevre, City Attorney Chandler
and Chief A6countant David Funderburk to attend the annual meeting'of the Texas
Municipal League which convenes at San Antonio from October 29th through 31st.
Park Site Study Committee
Following the suggestion of Councilmen Ansley and Hansen, members of the Park
Committee,'a six -man Park Site Study Committee was appointed by members of the Coun-
cil. The Study Committee will investigate park sites in each of the city's districts
as set forth in the Charter of the City of Baytown. Those named to assist the Park
Committee are as follows:
Ben Cove, 1400 Barrymore Drive - District 1.
Mrs. Bobby Sutphin, 1906 Mississippi, District 2.
Charles Fuller, 903 North Circle Drive - District 3
John Martin, '1501 Strickland Street, District 4
Dr. Bob L. Warford, 102 Chandler, District 5.
Mrs. Zenobia Booth, 703 Rosewood, District 6.
Zoning Commission - Members
To complete the Zoning Committee roster, Councilman Ward submitted the name
of Billy B. Ashby, 1805 Florida Street and Councilman Cravey submitted the name of
Tony Campos, 1518 West Humble; both nominations were approved, but the roster will
not be complete until Councilman Hansen has hubmitted the name of his committee
appointee.
Copies - Water & Sewer Bond Improvement Fund - Financial Report
The City Manager presented the Council with a copy of the Waterworks and

Sanitary Sewer Bond Financial report for the period ending October 29, 1961. On
the Sanitary Sewer Improvements twelve (12) projects were listed at a total esti-
mated cost of $976,000.00 however, to date $598,629.02 has been expended. In the
Mater System eight (8) projects were listed at a total estimated cost of $529,000.00
of this amount only $339,039.78 has been expended. The total alloted fund is
$1,000,000.00 with a cash balance of $66,997.22 as of 10/29/61. The projected
expenditures include three (3) sanitary sewer jobs, the installation of a 12" water
main and the installation of an 8" water main at a total estimated construction
cost of $58,299.99 leaving an estimated free balance of $8,202.23 at the completion
of the abovementioned projected improvements.
Sucested Chances - Monthly Activity Report
Councilman Hansen suggested that the following changes be made in the monthly
activity report prepared by the City Manager.
1. Give a summary of personnel changes, such as, number of new employees,
number separated from employment, or any major change.
2. Indicate maintenance of automobiles; how much being expended for mainte-
nance on the entire fleet and average cost per car.
3. Street Maintenance - give total yardage of materials used, how much used
to surface streets, how much used for patchwork purposes, number of employ-
ees used in this type work and how much money spent per month.
Solicit Bids - Paint West Main Disnosal Plant
At the suggestion of Councilman Ward, the City Manager was instructed to soli-
cit bids from two or more interested parties for painting the West Main Disposal
Plant.
Copies - New 1961 -62 City Budget and Written Equalization Report
The City Manager presented each Councilmember with a copy of the new 1961 -62
City Budget and a copy of a written report of the xtivities of the 1961 Tax
Equalization Board.
Accepted Trophy - Greater Baytown Development Council
The Council accepted a trophy received by Mayor Clayton at the Greater Baytown
Appreciation Dinner, Monday, October 23rd. This award was made inrecognition of
the City's assistance and cooperation during and following Hurricane Carla.
Adiournment
Councilman Ansley moved that the meeting be adjourned. Councilman Ward seconded
the motion. The ayes were unanimous and the Mayor declared the meeting adjourned.
