1961 09 14 CC Minutes1652 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN September 14, 1961 The City Council of the City of Baytown, Texas met in regular session on Thursda y, September 14, 1961, at 7 :00 o'clock p.m. in the Council Room of the Baytown City Hall with the folowing members in attendance: Seaborn Cravey Councilman W. L. Ward Councilman , C. A. Hansen Councilman Roy H. Hughes Councilman James M. Bryan Councilman Al Clayton Mayor J. B. LeFevre City Manager *George Chandler City Attorney Absent: Velma J. Ansley Councilman **Edna Oliver City Clerk "Minutes recorded by Mrs. Oliver's Secretary in her absence. The Mayor called the meeting to order, the Invocation was offered by Council- man Bryan, afterwhich the City Clerk's Secretary was instructed to read the minutes of the August 24th Regular Meeting, the Budget Review Meeting of September 5th and the Special Meeting of September 13th. The following corrections were made: September 5th - Budget Review Meeting: Discontinue Donation of Water - Churches and Other Non - Profit Organizations - "Neither of the two (2) High Schools in Baytown will be charged during their three months summer recreational program. The purpose of doing this is to provide a way for the City to absorb a part of the expense of the recreational program." September 13th - Special Meeting: Emergency Repairs - Water Tower and Disposal Plants - "The usual procedure of securing City contracts is by competitive bidding; this would require a delay of Fourteen (14) days or more." Offer Assistance.- Stricken Areas Within City and Brownwood. Lakewood: "After some discussion, Councilman Ward moved to instruct Mayor Clayton and /or City Manager LeFevre to contact County Commissioner Ramsey, members of the No. 8 Water District Board, Civil Defense Director Feinberg and others to offer assistance in the elimination of spoilage or any other services the City may render in the Brownwood, Lakewood area. Also, to personally contact residents within the city who had serious damage (especially on Kilgore Road, Mayo, Mississippi, Missouri Streets and Jones Road), find out their specific problems as to disposing of spoilage and removing debris and offer assistance." With these corrections, Councilman Bryan moved to approve the minutes as amended. Councilman Hughes seconded the motion. The vote follows: Ayes: Councilmen Cravey, Ward, Hansen, Hughes, Bryan Mayor Clayton Nays: None Ordinance - Assessing Fee - Sanitary Sewer Service The City Manager introduced and read an ordinance assessing a fee for sani- tary sewer service C providing a method of charging and collecting such fee. After a lengthy discussion as to the problem of equitable administrative methods involving,billing, charges per unit basis, proper classification as to volume of usage and collection for such service, Councilman Hansen moved to adopt the ordinance as presented. Councilman Hughes seconded the motion. The vote follows: Ayes: Councilmen Cravey, Ward, Hansen, Hughes, Bryan Mayor Clayton Nays; None The caption of the ordinance follows: 60Z 1653 ORDINANCE NO. 632 AN ORDINANCE ASSESSING A FEE FOR SANITARY SEWER SERVICE AND PROVIDING A METHOD OF CHARGING AND COLLECTING SUCH FEE; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE AND PROVIDING FOR THE EFFECTIVE DATE THREOF. Mayor Clayton appointed Councilmen Ward and Hansen as a committee to work with City Manager LeFevre in making a thorough study and to recommend amendments to the ordinance in order to make it more equitable. Ordinance - Adopting Budget - Fiscal Year 1961 -62 Councilman Ward moved to adopt an ordinance adopting a budget for the ensuing fiscal year, beginning October 1, 1961, in accordance with the Charter of the City of Baytown. Councilman Cravey seconded the motion. The vote follows: Ayes: Councilmen Cravey, Ward, Hansen, Hughes, Bryan Mayor Clayton Nays: None The caption of the ordinance follows: ORDINANCE NO. 633 AN ORDINANCE ADOPTING A BUDGET FOR THE ENSUING FISCAL YEAR, BEGIN- NING OCTOBER 1, 1961, AND ENDING SEPTEMBER 30, 1962, IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY OF BAYTOWN; AND PROVID- ING FOR THE PUBLICATION OF THIS ORDINANCE. *Mr. Chandler excused from meeting. Tax Rate Ordinance - 1962 Councilman Hughes moved to adopt an ordinance fixing the rate of tax levy for the City of Baytown for the fiscal year ending September 30, 1962. Council- man Cravey seconded the motion. The vote follows: Ayes: Councilmen Cravey, Ward, Hansen, Hughes, Bryan Mayor Clayton' Nays: None The caption of the ordinance follows: ORDINANCE NO. 639 AN ORDINANCE FIXING THE RATE AND TAX LEVY FOR THE CITY OF BAYTOWN, TEXAS, FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1962, UPON ALL TAXABLE PROPERTY IN SAID CITY OF BAYTOWN, TEXAS, IN ACCORDANCE WM THE LAWS OF THE STATE OF TEXAS AND THE CHARTER PROVISIONS AND ORDINANCES OF SAID CITY; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. Ordinance - Including Library Employees - Participate - Municipal Retirement System Councilman Ward moved to adopt an ordinance providing that all employees of all departments, including the City Manager, of the City of Baytown shall here- after participate in the Municipal Retirement System, Councilman Hughes seconded the motion. The vote follows: Ayes: Councilmen Cravey, Ward, Hansen, Hughes, Bryan Mayor Clayton Nays: None The caption of the ordinance follows: ORDINANCE NO. 635 AN ORDINANCE PROVIDING THAT ALL EMPLOYEES OF ALL DEPARTMENST, INCLUD- ING THE CITY MANAGER, OF THE CITY OF BAYTOWN SHALL HEREBY AND HERE- AFTER PARTICIAPTE IN THE MUNICIPAL RETIREMENT SYSTEM; REPEALING ORDI- NANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE AND PROVID- ING FOR THE EFFECTIVE DATE THEREOF. T�0C 1659 Reauest - Allow Wood Shinales on Roofs in Bavtown Councilman Ward stated he had been contacted by some of the residents of Baytown whose roofs had been damaged by Hurricane Carla. It was their contention that wood shingled roofs had endured the wind, whereas, roofs constructed of other materials had been damaged. They inquired if anything could be done to amend the Building Code Ordinance whereby they would be allowed to replace their roofs with wood shingles. Councilman Ward contacted Councilman Hansen and they called on Fahy Godfrey, Baytown's Manager of Insurance, for information as to how this would affect Baytown's fire insurance key rate. City Manager LeFevre at this point explained that this was to be part of his report, as Mr. Godfrey had come by his office and had asked for sufficient time to investigate, as there are revi- sions being made by the State Insurance Commission regarding this problem and it would take him two weeks to compile the information. The Council further dis- cussed past efforts made in behalf of citizens making the same request and such efforts had proved futile. Mayor Clayton re- activated the Insurance Committee to work with Mr. Godfrey-to secure the information and present their recommendations to the Council. Request - Mr, Caldwell - Repair Welfare League Building - City Crews Mr. Charles Caldwell, Executive Secretary of the Community Chest was intro- duced and presented a request to the Council for assistance in repairing the roof on the building which accomodates the Welfare League as the roof is leaking badly. He stated that they have been trying to secure another building and turn this one back to the City but, as yet, they have been unable to locate one. Because of the general condition of the building, Mr. Caldwell stated that the Community Chest did not want to spend too much on repair and requested that the Council grant permission for City maintenance crews to assist in repairing the roof and leveling the building and the Community Chest would pay for the materials. Council- man Ward moved that the City Manager be granted permission to use city crews in repairing the building as a temporary expedient. .Councilman Cravey seconed the motion. The vote follows: Ayes: Councilmen Cravey, Ward, Hansen, Hughes, Bryan Mayor Clayton Nays: None Advisory Board Members - Re- Appointments The three (3) members of the Baytown Advisory Board whose term of office expired as of September 1, 1961 were to be contacted to see if they would be willing to accept a re- appointment to the Baytown Advisory Board for a two (2) year term. E. C. Kimmons declined re- appointment, Harry F. Massey accepted re- appointment for the two (2) year term and Kenneth Dismang has not yet been con- tacted. Councilman Bryan was asked to recommend a new member to succeed E. C. Kimmons. Resolution City Manager LeFevre complimented Department Heads and employees in general for the wonderful cooperation he received during the Hurricane, Carla, Mayor Clayton added his appreciation, The Council unanimously agreed that the City Attorney be instructed to prepare a resolution commending all city employees and all organizations for donating their services during Hurricane Carla. City Manager LeFevre stated he would mail copies of the resolution to Council members and they could telephone their approval. The resolution will be published before the next Council meeting, Adjournment Councilman Hughes moved that the meeting be adjourned, Councilman Cravey seconded the motion.
