1961 05 10 CC Minutes, Special1592 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN May 10, 1961 The City Council of the City of Baytown, Texas met.in special session on Wednesday, May 10, 1961, at 7:00 o'clock p.m. in the Council Room of the Baytown City Hall with the following members in attendance: Seaborn Cravey Councilman W. L. Ward Councilman K. E. Badgett Councilman Velma J. Ansley Councilman Roy H. Hughes Councilman C. A. Hansen Councilman James M. Bryan Councilman R. H. Pruett Mayor Al Clayton Mayor J. B. LeFevre City Manager George Chandler City Attorney Edna Oliver City Clerk and special guest, Bob Eckhardt, State Representative. Absent: Lacy Lusk Councilman The Mayor called the meeting to order, the In#ocation was offered, afterwhich, the City Clerk was instructed to read the minutes of the April 27th meeting. Council- man Badgett moved to dispense with the reading of the minutes and they be approved. Councilman Ward seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Cravey Nays: None Ward Badgett Ansley " Hughes Mayor Pruett Resolution - Canvassing Election Returns - April 29th Election The returns of the April 29th election were canvassed and totals verified by the City Council, afterwhich, the City Manager introducted and read the following resolution: A RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 29TH DAY OF APRIL, 1961, FOR THE PURPOSE OF ELECTING A MAYOR FROM THE CITY AT LARGE, AND THREE COUNCILMEN FROM THE RESPECTIVE DIS- TRICTS NOS. 2. 3 AND 6; DECLARING THE RESULTS OF SAID ELEC- TION; FINDING THAT NOTICE OF SAID ELECTION WAS DULY AND PRO- PERLY GIVEN AND THAT SAID ELECTION WAS DULY AND PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN AC- CORDANCE WITH THE LAWS OF THE STATE OF TEXAS. WHEREAS, pursuant to Section 96, Article IX of the Charter of the City of Baytown, the City Council of said City, at a special meeting held on this the 10th day of May, 1961, proceeded as required by law to canvas the returns of the Special Municipal Election held in the City of Baytown on the 29th day of April, 1961, for the purpose of electing a Mayor from the City at large, and three Councilmen from the respective Districts Nos. 2, 3 and 6, said Election having been held under and pursuant to the provisions of the Charter of said City and an Ordinance passed on the 12th day of April, 1961, calling said Election; and, WHEREAS, said Election having been duly and regularly had and held as called In said ordinance and according to law and the returns thereof having been duly made and the Election Judges having certified the results of said Election as here- inafter set out and the City Council having duly and regularly canvassed the re- turns of said Election and finding that the total votes cast at said Election were as follows, to -wit: U C' I 1593 For Councilman From District No. 3 C. A. (Chris) Hansen, Jr. 2,209 Votes Kenneth E. Badgett 1,967 Votes For Councilman From District No. 6 James Monroe (Jim) Bryan 2,296 Votes Fred C. Canant, Jr. 1,323 Votes AND WHEREAS, the City Council of the City of Baytown finds the election returns as set out above to be accurate and correct aid no election protest or contest having been filed with said Council or instituted in connection with said election; NOW, THEREFORE, r BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That Al Clayton received a majority of the votes cast at said election for the office of Mayor from the City at large and, accordingly, the said Al Clayton is hereby declared elected to the office of Mayor of the City of Baytown. Section 2: That Walter L. (Dub) Ward received a majority of the votes cast at said election for the office of Councilman from District No. 2, and, accordingly, the said Walter L. (Dub) Ward is hereby declared elected to the office of Council- man from District No. 2 of the City of Baytown. Section 3: That C. A. (Chris) Hansen, Jr. received a majority of the votes cast at said election for the office of Councilman from District No. 3 and, accord- ingly, the said C. A. (Chris) Hansen is hereby declared elected to the office of Councilman from District No. 3 of the City of Baytown. Section 9: That James Monroe (Jim) Bryan received a majority of the votes cast at said election for the office of Councilman from District No. 6, and, accord- ingly, the said James Monroe (Jim) Bryan is hereby declared elected to the office of Councilman from District No. 6 of the City of Baytown. Section 5: That the City Council of the City of Baytown further finds that the notice of said election was duly and properly given as required by law and as provided in the Ordinance calling said election and that said election was duly and regularly held and the returns thereof duly and regularly made by the proper officials of said election and in all things according to law. The roll call vote was as follows: Roll Call: Ayes: Councilman Cravey Nays: None it Ward to Badgett of Ansley it Hughes Mayor Pruett Resoluti6n - Recognizing and Thanking Honorable Lacy Lusk - City Councilman The following resolution was introduced and-read: A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF BAYTOWN FORMALLY RECOGNIZING AND THANKING THE HONORABLE LACY LUSK, CITY COUNCILMAN, FOR HIS EIGHT YEARS OF DEVOTED SERVICE AS COUNCILMAN AND MAYOR PRO TEMPORE OF THE CITY OF BAYTOWN; RECITING A FEW OF THE ACCOMPLISH - MENTS WHICH HE WAS INSTRUMENTAL IN BRINGING ABOUT DURING HIS TERMS OF OFFICE; RESOLVING THAT THE SAID HONORABLE LACY LUSK HENCEFORTH SHALL BE`COUNCILMAN EMERITUS" OF THE CITY OF BAYTOWN, AND SHALL ALWAYS BE ENTITLED TO A SEAT AT ALL MEETINGS OF THE CITY COUNCIL OF THE CITY OF BAYTOWN. WHEREAS, the Honorable Lacy Lusk faithfully and conscientiously served as Councilman, District No. 6, for the City of Baytown, from April 7, 1953 to April 29, 1961; and, WHEREAS, be•_is now completing his fourth year as Mayor Pro Tempore of the City of Baytown; and, WHEREAS, during his terms of office there were enumerable accomplishments and projects which were completed, the following being only a few of,the many accomp- lishments made while he was a member of the Council; Various parts of the City were looped together by water maids. Two new Fire Stations were completed and one Fire Station renovated. Three Elevated and two Ground Storage Tanks and three Water Wells were completed. All Sewer Disposal Plants wereSimproved and one new Disposal Plant was constructed and all of same were connected by Sanitary Sewer Interceptor Lines. Underground Storm Sewers were constructed in and to Minnesota, Louisiana, Kentucky, Virginia, New Jersey, Schilling and Danubina Streets and Martin and Jail Ditches. Land Fill Garbage Disposal System instituted. Many streets permanently improved. Police Administration Building completed. Pavilion at Roseland Park completed. Baytown - LaPorte Tunnel completed. Spur 201 Completed. Retirement System, Social Security and additional fringe benefits were provided for City employees and Civil Service for the Fire and Police- Departments; and, WHEREAS, the City Council-of the City of Baytown desires to formally express its appreciation to Councilman Lusk for his years of faithful civic participation in the government of the City of Baytown; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: UT 1J7a That the City of Baytown, by and through its duly elected City Council, hereby formally recognizes and thanks the Honorable Lacy Lusk for his years in public office in Baytown and hereby expressly makes and constitutes Lacy Lusk as "Councilman Emeritus" of the City of Baytown and resolves that Councilman Emeritus Lusk shall henceforth always have a seat at the Council table of the City Council of the City of Baytown. Badgett The following resolution was introduced and read: A UNANIMOUS RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN FORMALLY RECOGNIZING AND THANKING COUNCILMAN KENNETH E BADGETT FOR HIS SERVICES IN PUBLIC OFFICE AND PRESENTING HIM WITH AN OFFI- CIAL KEY TO THE CITY OF BAYTOWN. WHEREAS, the City Council of the City of Baytown desires to formally express its appreciation to Councilman Kenneth E. Badgett for his participation in the govern- ment of the City of Baytown, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: That the City of Baytown, by and through its duly elected City Council, hereby formally recognizes and thanks Councilman Kenneth E. Badgett for his services during his incumbency; and, RESOLVED FURTHER, that in recognition of his services, the City Council hereby gives its formal expression of appreciation to the said Councilman Kenneth E. Expression of Thanks - R. H. Pruett After the new Councilmembers were seated, Ex -Mayor Pruett expressed his thanks to all of the citizens of Baytown, those who served with him on the Council and the employees of the City of Baytown for giving such splendid cooperation during his tenure of office and concluded with the statement that if his administration has been successful it was because of the goodwill and cooperation of all. Gavel Presented - Reverend Cheek - Fromftisterial Alliance to Mayor Clayton Reverend R. M. Cheek, Pastor of the First Baptist Church, presented Mayor Clayton with a gavel -as a gift from the Ministerial Alliance of Baytown and wished him success in his administrational duties. Mayor Clayton accepted the gavel with sincere thanks and pledged his energies to serving the people of Baytown with sin- cerity and to the best of his ability. Gifts - Presented Ex -Mayor Pruett and Ex- Councilman Badgett Councilman Ward presented Ex -Mayor Pruett with a watch, pin and key to the City as tokens of appreciation for the many services rendered the City during his administration. Councilman Ansley presented Ex- Councilman Badgett with a key to the City and a watch as a token for the many services rendered during his two - year term. Councilman Ward - Named Mayor Pro Tem Mayor Clayton proposed, as his first order of business, that a Mayor Pro -Tem be named; Councilman Ansley moved to appoint Councilman W. L. Ward as Mayor Pro - Tem of the City of Baytown. Councilman Cravey* seconded the motion. Councilman Hughes seconded the motion. The vote was as followsi Ayes: Councilmen unanimous Nays: None Mayor Clayton Appointment of Committee - Study Signs Mayor Clayton named Councilmen Ansley and Hughes as a Committee to study and recommend new welcome signs which will be erected at City Limits replacing the ex- isting obsolete signs. The Committee was given permission to solicit the aid of some member of the Baytown Chamber of Commerce to assist in the study and recommenda- tion presentation. Equalization Board - Year 1961 City Manager LeFevre presented a letter from C. C. Redd, Baytown's Tax Assess- or- Collector, relative to the appointment of an Equalization Board for the year of 1961. The names of Harry Massey, Roy Elms and C. H. Miller were submitted by Mr. Redd and City Manager LeFevre approved the naming and recommended the acceptance. Councilman Ward moved to accept the recommendation of the City Manager and Harry Massey, Roy Elms and C. H. Miller be named as the Board of Eaualization for the year 1961. Councilman Ansley'seconded the motion. The vote was as follows: Ayes: Councilmen unanimous Nays: None Mayor Clayton Miscellaneous Mayor Clayton pledged the Council's full support of the various committees appointed by the former administration, and stated that no changes will be made in them as the Council is behind their efforts one hundred per cent. Councilman Hughes informed the Mayor and members of the Council that he was calling a joint meeting of the ways and Means Committee and Industrial Attraction Committee for Tuesday evening, 7 :00 o'clock p.m. in the Council Room of the City Hall, Ernest Brown, Jr. Baytown's Fiscal Agent, stated that members of the City Council were invited to meet with him at the Tower on Monday, May 15th at 12:00 o'clock noon. In conjunction with the luncheon, the group will discuss the problems of Municipal finances and possible future bond issues. The Council deferred preliminary approval of Section 5 - Eva Maude Subdivi- sion until Monday evening, May 15tb. This will give department heads time to check the plat drawing.
