Ordinance No. 14,701ORDINANCE NO. 14,701 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, REPEALING, IN PART, ORDINANCE NO. 14,659, REGARDING THE PURCHASE OF THREE (3) CHEVROLET TAHOES FROM LAKE COUNTRY CHEVROLET THROUGH THE INTER LOCAL PURCHASING SYSTEM (TIPS); AUTHORIZING THE PAYMENT OF ONE HUNDRED FIFTY-TWO THOUSAND ONE HUNDRED EIGHTY-EIGHT AND NO/100 DOLLARS ($152,188.00) TO FREEDOM CHEVROLET, THROUGH A COOPERATIVE PURCHASING AGREEMENT WITH TARRANT COUNTY, FOR THE PURCHASE OF THREE (3) CHEVROLET TAHOES FOR THE FIRE DEPARTMENT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ********************************************************************************* WHEREAS, on January 28, 2021, the City Council authorized, through Ordinance No. 14,659, the purchase of three (3) Chevrolet Tahoes from Lake Country Chevrolet through The Interlocal Purchasing System (TIPS); and WHEREAS, Lake County Chevrolet has been unsuccessful in obtaining the three (3) Chevrolet Tahoe's for the Fire Department; and WHEREAS, the City is able to purchase the three (3) Chevrolet Tahoe's for the Fire Department through its Interlocal Agreement for cooperative purchasing with Tarrant County; and WHEREAS, pursuant to such agreement, the City may make purchases based upon the bids received by Tarrant County; and WI IEREAS, Tarrant County has taken bids for the three (3) Chevrolet Tahoe's for the Fire Department; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby repeals only that portion of Ordinance No. 14,659, that authorizes the purchase of three (3) Chevrolet Tahoes from Lake Country Chevrolet through The Interlocal Purchasing System (TIPS). Section 2: That the City Council of the City of Baytown, Texas, hereby authorizes the payment of ONE HUNDRED FIFTY-TWO THOUSAND ONE HUNDRED EIGHTY-EIGHT AND NO/100 DOLLARS ($152,188.00) to Freedom Chevrolet, through a cooperative purchasing agreement with Tarrant County, for the purchase of three (3) Chevrolet Tahoes for the Fire Department. Section 3: That pursuant to the provisions of Texas Local Government Code Annotated §252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less, provided that the original contract price specified in Section 1 may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25° o) without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
