1960 11 10 CC Minutes1530 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN November 10, 1960 The City Council of the City of Baytown, Texas met in regular session on Thursday, November 10, 1960, at 7:00 o'clock PM in the Council Room of the Baytown City Hall with the following members in attendance: Seaborn Cravey Councilman W. L. Ward Councilman R. E. Badgett Councilman Velma J. Ansley Councilman Roy H. Hughes Councilman Lacy Iusk Councilman R. H. Pruett Mayor J. B. LeFevre City Manager Edna Oliver City Clerk Absent: George Chandler City Attorney The Mayor called the meeting to order, the Invocation was offered by Council- man Badgett, afterwhich, the City Clerk was asked to read the minutes of the regu- lar meeting of October 27th. Councilman Badgett moved to dispense with the read- ing of the minutes and they be approved as submitted. Councilman Hughes seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Cravey Nays: None " Ward " Badgett " Ansley " Hughes " Lusk Mayor Pruett Second Council Meeting - November, 1960 Since the next regular meeting of the Council is scheduled for November 24th, Thanksgiving Dap, it was agreed to defer the meeting until December 8th, however, the City Manager was instructed to call a meeting on the 22nd or 23rd of November, should any pressing item be presented which will require Council action. Water and Sewer Service Connections - Service Nome Construction off Cedar 9avou Road Dan Seven) local contractor, representing E. L. Green and other property owners whose property abuts upon Busch Road, a non- dedicated street off Cedar Bayou Road, explained that's 6 inch sanitary sewer service line will be installed at the property owners' expense, as proposed by the Council at the September 8th nesting. This line will extend to the City's existing sanitary sewer line on the north side of Cedar Bayou Road. He asked for permission to tap-in to the City!s main line upon payment of one sewer tap for the sanitary sewer connection. Also, each prop- erty owner is extending his own one -inch water line to the City's main line off Cedar Bayou and the Council was asked to approve thase connections. Councilman Ansley moved to approve the extension and requested connections to the City's water and sewer mains, upon payment of one 6 -inch sanitary sewer tapping fee of Thirty Five ($35.00).Dollars and payment of a water tapping fee for each and every one -inch water line extension made to the City's line on Cedar Bayou Road. The individual water tapping fee is necessary as a water mater will be set oa Cedar Bayou Road for each tap made. Councilman Hughes seconded the motion. T. E. Dossey,•Jr. - Annual Audit Reports - Payment of Contract Fee Mr. T. E. Dossey, Jr., C.P.A. of Houston, presented copies of the annual audit report and special report of the Water and Sewer System and gave a brief resume of his findings. He stated that the records of the City were in excellent condition, however, during the past fiscal year the City has dug deep into its reserves and funds for capital outlay have been reduced to $100.00. The Bond Funds are practically depleted. At the completion of his report he presented his state- ment for payment of services rendered as per contract agreement. Councilman Lusk moved to accept the annual audit report and Water and Sewer System special report as submitted by Pk. Dossey; the City Manager be further instructed to pay Mr. Dossey his fee of $900.00 as per contract agreement. Councilman Badgett seconded the motion. After closer reviewing all bids, Councilman Lusk moved to accept the bid of Ernie Dittman Motors; the Five (5) units to be purchased at a total bid price of $82475.00, Councilman Cravey seconded the motion. Councilman Ansley seconded the motion. If terms, owner will extend upon a down payment of not less than $5,000 in cash. ra Owner will furnish general warranty deed, tax certificates showing all advalorem taxes paid, and a guaranteed title to the City. 2. KEYSTONE REALTY COMPANY 42 acres situated on Kilgore Road, just north of Cedar Crest Cemetery and the Cedar Bayou Methodist Church - fronting approximately 2200 feet on the Bayou Offer the property for purchase by the following two methods: (1) A lease Purchase Agreement with the City of Baytown, whereby the City Will pay $15,000 per year, in advance, f6r the first three annual pay - ments, and 06,600.00 plus accrued interest at the rate of 6% at the end of the next year on the total price of $51,600 from the date of the original agreement. or, (2) To sell this property to the City of Baytown for $51,600 on a note and deed of trust for $15,000 down and the balance in three years with 6% interest on the unpaid balance. Owners agreed to furnish, at their expense, a survey by a registered surveyor, a Guaranteed Title Policy and Tax Certificates from all taxing agencies - approximately 30 -days for deliver of deed. The bid presented by Mr. Bond was ruled out as the Council felt the hauling distance would prove to be cost prohibitive. The second bid was favored as it was formerly a brick yard site and pits of from 6 -9 feet in depth are already dug, it is just outside the City limits, fronting 2200 feet on Cedar Bayou stream and the tract is of sufficient size to be used as a disposal site for the next 15 to 20 years and other attractive features to serve necessary functions of a sanitary land fill garbage disposal site. The purchase terms were discussed, with Councilman Lusk proposing to pay cash for the property upon delivery of the deed and guaran- teed title. The City to pay $15,000 of the purchase price from its present budget, the remaining $36,600 to be borrowed from peoples State Bank, the City's depository, interest free as per Depository Contract dated May 1, 1959. Other members of the Council favored the proposal of Councilman Lusk, whereupon, Councilman Ward moved to approve the bid of Keystone Realty Company as a land -fill garbage dis- posal site and authorized the purchase of the 42 acre tract from Mr. Charles laird of Paris, Tennessee at a cash price of $51,600; full payment to be made upon delivery of the deed instrument, guaranteed title policy, tax certificates and stamps. Councilman Hughes seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Cravey Nays: None " Ward " Badgett " Ansley Hughes " Lusk Mayor Pruett ra Copies - Advisory Board and Annexation Ordinances Submitted For Study The City Manager presented copies of an ordinance which creates an Advisory Board for the City of Baytown, provides terms, fills vacancies, etc. He asked that the Council make a study of the proposed ordinance before the next regular meeting. It was also decided to defer final passage of the two ordinances annex- ing portions of the Humble Company until the next regular meeting in order to give the City Engineer more time to complete his field notes on annexation of additional industrial plants as per action taken by the Council on August 25th and September 8th, respectively. 1534 City Manager - Negotiate Parking Metera Downtown Parking - Southern Pacific Property The City Manager was given permission to solicit quotations for approximate- ly 35 parking meters which will be installed at the newly approved parking lots abutting upon Sommeroe and owned by the Southern Pacific Railroad Company, At the October 13th meting, the Council approved the improvement of this site for parking purposes, however, to date no contract has been received from the Company. Work is being held up until this matter has been completed. When the proper in- struments have been executed, the City crews will proceed with haste, in an effort to provide more parking space for holiday shoppers. Bids - Library Site Rejected - Readvertise Mayor Pruett asked the Council for its decision on the recent library site study, what was their decision regarding the bide now being held? Should the Council reject all bids or approve any one site? Councilman Ansley stated that she was told that the bids which were submitted were not in line with mar- ket values and proposed to reject all bide and readvertise. Councilman Cravey suggested that the City negotiate for a Library site rather than advertise a second time. Councilmen Ward objected to having Real Estate representatives tell the Council what to do as Charter requirements were mot when bids were sought and received by competition. Mrs. Mattis Howard, a somber of the Library Advisory Board, urged the Council to locate the library site within the business area and suggested that any new bids received should be referred to the Library Advi- sory Board for study as no mention was made of a second selection when the first recommended site was presented. Councilman Hughes and Badgett asked that the four (4) remaining sites be reviewed closely by the Council, and if possible, a selection made from them, Councilman Ward expressed an opinion that the Council and Board should exhaust every possibility before the bide are rejected and sug- gested that the Library Advisory Board again review the bids. A negative response was received for each suggestion submitted resulting in a motion by Councilman Cravey to reject all Library Site bids and readvertise, bids to be received December 8th, 1960. Councilman Ansley seconded the motion. October expense accounts were received from Mayor Pruett, Councilman Hughes, Ansley and Cravey. City Manager laFevre was instructed to notify officials of the Missouri - Pacific Railroad Company, by registered mail, that street crossings within the City limits mist be repaired or the Council will require that the Company place a watchmen at each and every crossing as set forth in Ordinance No. 100 of the City of Baytown.
