1960 08 11 CC Minutes14.98 KWTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN August 11, 1960 The City Council of the City of Baytown.. Texas met in regular session on Thursday, August 32.. 1960 at 7:00 o'clock P.M. in the Council Room of the Baytown City Hall with the following membbrs in attendance: Seaborn Cravey Councilman K. E. L. ukrd Councilman George Chandler City Attorney The Mayor called the meeting to order, the Invocation was offered by Mr. H. M. Campbell, afterwhich, the City Clerk was instructed to read the minutes of the regular meeting of July 28th 1960. Councilman Badgett moved to dispense with the reading of the minutes and they be approved. Councilman Cravey seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Cravey Nays: None It Badgett " Ansley " Hughes " Lusk Mayor Pruett Bids - Modification Fire Station Building No. 3 City Manger LeFevre reported that no bids were received on the invi- tation for modification and remodeling of Fire Station No. 3. 'The City Engineer explained that the specifications were such that larger construction contractors were not attracted and s=11 contractors had difficulty in mak- ing bond as required in the plans and specifications or the general contract. Bill Dalpes, local contractor, had previously submitted a modification cost estimate of $79000.00 but the Charter required any expenditure of more than 82,000.00 shall be let to the lowest and best bid after there has been an opportunity for competitive bidding. It was the recommendation of the Mayor that Mr. Dalpes be retained at a fixed fee and a Committee be appointed to supervise the construction. The electrical and plumbing installations will not be submitted to competitive bidding but city personnel will be used as an alternate. Councilman Badgett moved to accept the recommendation of the Mayor; Mr. Bill Apes be retained at a fixed fee for the modification and remodeling of Fire Station No. 3. Councilman Cravey seconded the motion. The roll call vote was as follows: Roll Call; Ayes: Councilman Cravey Nays: None " Badtett " Ansley " Hughes " Lusk Mayor Pruett City Manger LeFevre, Fire Chief Lintelman, City Attorney Chandler and Mayor Pruett were appointed as a Committee to act in a supervisory capacity during the duration of the construction, 1499 Recommendation - Libras Bond Election to be held September 20th Max Mosesman, a member of the Advisory Board of the Library Department, submitted the recommendation of the Board for a Library Bond Election to be held on Tuesday, September 20th. His recommendation also included the stipulation that the Library Bond Issue be the only one on the ballot. The Board has plans to sue the student body to publicize the ramifications of the proposed 050,000 issue. By so doing, it was thought that the parent's of abhool=age children will see the need of providing more modern facilities, larger seating space for those using the library and increasing the volume capacity, Since the Council was of the opinion that the present street improvement program should not be extended at this time, by asking for an additional Street Improvement Bond Issue, Councilman Lusk moved to accept the recommendation of the Library Advisory Board and sit the date of Tuesday, September 20th for the proposed 4350,000 Library Bond Issue only. Councilman Ansley seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Cravey Nays: None " Badgett " Ansley " Hughes " Lusk Mayor Pruett Amendment Fire Zone No. 2 - Alexander Drive (Highway 1/6) ....� The City Manager introduced and read an ordinance extending the No. 2 Fire Zone of the City of Baytown to include property abattinj upon Alexander Drive, from the south property line of "Bennie Gray Addition to the south property line of Bob Smith Road. The ordinance includei.-property on either of Highway 1/+.6 for a depth of 100 feet and such action was taken after the Council received a petition, signed by property owners along the Highway, asking for such protection. Councilman Badgett roved to adopt the ordinance as read. Councilman Ansley seconded the motion. Trai'fic Ordinance - Adopted The City Manager introduced and read an ordinance known as the Traffic Code, of the City of Baytown. The ordinance regulated traffic on public streets, designated certain powers to the Police Department of the City of Baytown, stipulated the driving regulations, speed zones, one -way streets, traffic and pedestrian signals and miscellaneous driving rules. Councilman Hughes roved to adopt the ordinance as read. Councilman Cravey seconded the motion. Opening Green Street - Report Councilman Lusk reported that the committee, appointed to study the' request of the Lamar PTE to open Green Street, needed more time to complete its investigation as no official meeting of the committee has been held due to the fact that some of its members have been away on vacation. Ordinance - Accepting Improvement South Main Street Councilman Lusk moved to adopt an ordinance receiging and accepting the work of construction of South Main, from East Republic Street to Alexander Drive, by Brown & Root, Inc., Contractors and authorized the issuance of Special Assessment Certificates to the contractor. Councilman Badgett seconded the motion. Extension - S0118ry Sever Sexyloe Line Approved The Council approved an expenditure of $479.65 for the extension of a sanitary sewer service line on Hafer Street.. east across the railway track to sei+vice the four (4) homes presently facing the Hafer Street extension. The total distance will be 750 feet. This approved estimate lists material and boring costs only; labor and equipment costs will be listed as an additional expenditure. Mr. Grantham, Director of Public Works, will also reset an existing water meter by extending a water line' across the stre6t and setting the meter on the property of Mr. Gore, the party being serviced by the meter. 1501 Donation Paving Assessment - Parkway Drive - Opportunity School Mayor Pruett submitted a copy of a letter sent to Mr. Don L. Teter, Treasurer of the Baytown Opportunity School, 1201 Parkway Drive, confirming the donation of a $475.00 paving assessment to the Opportunity School by Brown & Root, Inc., contractors of the Parkway Drive project. The council expressed its appreciation by commending the company for its liberal dona- tion and the execution of release covering the paving assessment levied again the school :property. Ordinance - Abandoning Street Near Humble Refinery City Manger LeFevre introduced and read an ordinance discontinuing, abandoning for public use and closing a portion of Baytown Avenue, abutting upon the fence line of the Baytown Humble Refinery and authorizing the Mayor and City Clerk to execute and attest a conveyance of said interest to abutting property owners. Councilman Cravey moved to adopt the ordinance as read. Councilman Ausley seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Cravey Nays: None " Ansley It Hughes " Badgett " Lusk Mayor Pruett The caption of the ordinance follows: ORDINANCE N0. 6o9 AN ORDINANCE DISCONTINUING, ABANDONING FOR PUBLIC USE AND CLOSING A DESCRIBED PORTION OF BAYTOW' AVENUE (SOMETIMES REFIIaW TO AS TEXAS AVENUE EXTENSION) IN THE CITY OF BAYTOWN AND ABANDONING AND QUITCLAIMIING ALL INTEREST OF THE CITY OF BAYTOWN AND THE PUBLIC IN AND TO THE DAID STREET AND AUTHORIZING THE I&YOR TO EXECUTE AND THE CITY CLERK TO ATTEST A. CONVEYANCE OF SAID INTEREST TO ABUTTING OWNERS. Miscellaneous-_ The Council set the date of Monday, August 22nd as the starting date for the review of the proposed 1960 -61 budgev.with the City Manager and Department Heads. The meeting will be held in the Council Chamber of the City Hall, the starting times, 6 o'clock P.M. City Imager LeFevre reported that plans and specifications are now being prepared by the City Engineer for the improvement of Lee Drive, from West Main to Highway 11+6., and for the covering of the Harris County Flood Control Ditch in Plumaood Addition. These estimates will be presented to V. V. Ramsey, County Commissioner, as he has informed Mayor Pruett that Harris County Commissioners' Court is ready to participate in the construction of the projects as soon as the plans and specifications are ready. It was thought that a cash settlement may be forthcoming. The city may then do the work or ask for bids from reputable contractors. The City Mang presented a memorandum of work which is now on the summer agenda, for the improvement of drainage in Hill Terrace Addition. The recommendation included the installation of 150 feet of 36" storm sewer along Davis Road to Beaumont Street Ditch, and regrade the Beaumont Street Ditch. This will eliminate the restricted drainage and deepen the existing flat ditch to prevent flooded conditions during heavy rains. The Council discussed including an appropriation for the Little League and Teen Age Ball clubs in the 1960 -61 proposed budget. Also, Councilman Badgett suggested placing the Chamber of Conmm ce real and personal property on the tax rolls, when he learned that the organization was not being taxed. The Councilmen's July expense statements were submitted and reviewed, after - which, the City Manager was instructed to reimburse each member for July expenses incurred as listed on statement. 1502 Tax Assessor - Collector C. C. Redd informed the Council that City Attorney Chandler has not completed his study on the legality of including San Jacinto Memorial Hospital, a chartered non - profit institution, on the 1%0 tax rolls of the City of Baytown. The City Manager was instructed to have the traffic light presently opera- ting on Ise Drive at Carver rechecked for operation efficiency. Report - Legislative Committee on Annexation Mayor Pruett submitted a lengthy report on the meeting held in Austin on August 8th, of the Legislative Committee on Annexation. This meeting was held by the Municipal League and annexation and all of its ramifications was discussed at length. It was his opinion that a definite change in annexa- tion procedure will be forthcoming as it is the opinion of one and all that the present law is being abused. There is a possibility that all territory presently under first reading will be abandoned under the proposed revisions of the law. For his portion of the conference, Mayor Pruett suggested that cities be restricted on future annexations by allowing a city to annex only a percent of its present base land area in any one calendar year. The group seemed to approve his suggestion and it was thought that further discussions may be had on the proposal. Mayor Pruett concluded his report by urging the Council to review its present first reading ordinances as it is possible that the Council may want to officially annex some of the territory now under first reading, before legislative action prevents such annexation. Adjournment Councilman Cravey moved for the meeting to adjourn. Councilman Lusk seconded the motion. The ayes were unani+R+us and the Mayor declared the meeting adjourned.
