1960 06 23 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN June 23, 1960 The City Council of the City of Baytown, Texas met in regular session on Thursday,. June 23, 1960, at 7:00 o'clock P.M., in the Council Room of the Baytown City Hall with the following members in attendance: Seaborn Cravey W. L. Ward K. E. Badgett Velma J. Ansley Roy H.. Hughes R. H. Pruett J. B. LeFevre George Chandler Edna Oliver Absent: Lacy Lusk Councilman Councilman Councilman Councilman Councilman Mayor City Manager City Attorney City Clerk Councilman The Mayor called the meeting to order, the Invocation was offered by Reverend R. M. Cheek, afterwhich, the City Clerk was instructed to read the minutes of the regular and special meetings, June 9th and 22nd, respectively, Councilman Ward moved to dispense with the reading of the minutes of the two meetings and they be approved. Councilman Badgett seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Cravey Nays: None " Ward " Badgett " Ansley " Hughes Mayor Pruett Preliminary Amroval - Sections 1 and 2 - Ridgewood Subdivision W. D. Broyles, local consulting engineer, presented a plat of Sections One and Two, Ridgewood Subdivision and asked for preliminary construction appro- val of same. The proposed subdivision development lies north of Creekwood Sub- division, off Garth Road, just outside the present City limits. It was the opinion of the engineering firm that the developer will ask for this section to be taken into the City limits in the near future. The development will be serviced from water and sewer facilities of the City, the tie -in being made north of Glen Arbor Subdivision, the developer proposing to extend the water and sewer mains to connect with City facilities now on Garth Road. The plans pro- vide for 6-inch mains, however, the developer agreed to install 8 -inch mains, the City bearing the difference in cost for the material change order only. It was also agreed that an additional fire hydrant will be provided and installed for proper fire protection. After some further discussion, Councilman Ward moved to grant preliminary approval to Sections One and Two, Ridgewood Subdivi- sion as per the agreed amendments. Councilman Cravey seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Cravey Nays: None if Ward it Badgett " Ansley " Hughes Mayor Pruett Negligent Collision Ordinance - Adopted The Council discussed the ramifications of the proposed Negligent Colli- sion Ordinance, afterwhich, Councilman Ansley moved to adopt the ordinance which will hold any driver guilty of Negligent Collision when he wilfully collides with or causes damage to any other vehicle or property within the City and when convicted shall be subject to a fine. Councilman Cravey seconded the motion. The roll call vote was as follows: 1455 Roll Call: Ayes: Councilman Cravey Nays: None it Ward " Badgett " Ansley " Hughes Mayor Pruett The caption of the ordinance follows: ORDINANCE NO. 597 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTCWN, PROVIDING THAT IF ANY DRIVER OR OPERATOR OF A VEHICLE SHALL WILFULLY OR WITH NEGLIGENCE COLLIDE WITH OR CAUSE DAMAGE TO ANY OTHER VEHICLE OR TO PROPERTY WHATSOEVER HE SHALL BE GUILTY OF NEGLIGENT COLLISION; DE- FINING "WILFULLY OR WITH NEGLIGENCE" BY ADOPTING THE DEFINITION CON- TAINED IN THE PENAL CODE OF THIS STATE IN THE TITLE AND CHAPTER "NEG- LIGENT HOMICIDE "; DEFININZ "VEHICLE "; PROVIDING THAT PROOF OF NO IN- TENT TO COLLIDE SHALL NOT BE A DEFENSE; REPEALING ORDINANCES IN CON- FLICT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED ($200.00) DOLLARS; AND PROVIDING FOR THE PUB- LICATION AND EFFECTIVE DATE HEREOF. Skip Letter - Non - Signers Paving Assessments - Wright Blvd. Councilman Ward moved to approve the City of Baytown underwriting the amount of $4,729.71 for Twenty (20) parcels of land abutting upon East Wright Blvd. from Danubina Street to Bayou Drive, now under construction to be improved by Brown & Root, Inc., whose owners have not secured the contractor in payment of the assessments against the respective properties. Councilman Badgett seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Cravey Nays: None " Ward " Badgett " Ansley " Hughes Mayor Pruett Skip Letter - Non - Signers - Carnegie Street Paving Councilman Ward moved to approve the City of Baytown underwriting the amount of $385.00 for three (3) parcels of land abutting upon Carnegie Street, from Lindberg Street south to the Missouri Pacific right -of -way, whose.owners have not secured the contractor, Brown & Root, Inc., in payment of the assess- ments against the respective properties. Councilman Cravey seconded the motion. Seventh and Parkway Drive Councilman Ward moved to adopt an ordinance amending Section Three (3) of an ordinance adopted by the City Council on December 10, 1959, such amendment to correct certain irregularities, informalities and discrepancies in the descrip- tions of certain of said abutting properties and the listing of names. Council- man Ansley seconded the motion. The roll call vote was as follows: 1486 Roll Call: Ayes: Councilman Cravey Nays: None " Ward " Badgett " Ansley " Hughes Mayor Pruett The caption of the ordinance follows: ORDINANCE NO. 601 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, COR- RECTING AND AMENDING AN ORDINANCE ENACTED BY IT ON DECEMBER 10, 1999, BY AMENDING SECTION 3 THEREOF; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Ordinance - Receiving and Accepting Work of Construction - Fourth. Seventh, Parkway- The City Attorney introduced and read an ordinance receiving and accepting the work of construction, by Brown & Root, Inc., of permanent improvement of South Fourth, South Seventh and Parkway Drive. 'Councilman Badgett asked that the approval and adoption of the ordinance be delayed until the contractor has com- pleted certain clean -up items, however, Councilman Ward raised an objection. City Engineer Busch assured the Council that he will not give the necessary approval for final payment of the contract until all unfinished items are in place. After some further discussion, Councilman Ward moved to adopt the ordinance accepting the construction of South Fourth, South Seventh and Parkway Drive. Councilman Ansley seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Cravey Nays: None " Ward " Badgett " Ansley " Hughes Mayor Pruett The caption of the ordinance follows: ORDINANCE N0. 602 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, RECEIVING AND ACCEPTING THE WORK OF CONSTRUCTION OF PERMANENT IMPROVEMENT WITH THE FOLLOWING DEFINED PORTIONS OF FOURTH STREET - FROM SEVENTH STREET TO BRIARWOOD STREET; SEVENTH STREET FROM ALEX- ANDER DRIVE TO FOURTH STREET AND PARKWAY DRIVE - FROM SOUTH FOURTH TO GLENN STREET, IN THE CITY OF BAYTOWN; AUTHORIZING AND DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL ASSESSMENT CERTIFICATES TO BROWN & ROOT, INC., THE CONTRACTOR PERFORMING SAID WORK; APPROVING THE FORM OF SUCH SPECIAL ASSESSMENT CERTIFICATES; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Committee Report - Playground Site Oak Addition The Council heard a report from City Attorney Chandler, spokesman for a committee appointed to secure a playground site for children living in Oak Addition. The only available site belongs to the School District, however, they have granted permission for the property to be used as a playground. It must first be cleaned off and possibly tables placed around for those who may want to eat watermelon on the grounds. Mr. Grantham, Director of Public Works, was instructedto use his man -power and equipment in cleaning the playground site. Appointment - Corporation Court Committee Mayor Pruett appointed Councilman Hughes, Badgett and Ansley as members of the Corporation Court Committee. Reject Bids - Property - Maryland Street - Readvertise The Council rejected the one (1) bid received on the sale of the City owned lot abutting Maryland Street. The City Manager was instructed to re- advertise and to solicit aid from the Baytown Realtors in the promotion of the sale. Miscellaneous After receiving several complaints, City Manager LeFevre and Public Works Director Grantham were instructed to check the out£all storm sever lines, especially in the Danubina -Adams Street area, and see if steel gates or grills can be placed on the stub -outs to prevent children from playing in the inlets. City Manager I.eFevre was instructed to solicit a cost estimate for mat- erials required to properly enclose the City's dirt stock pile lying off Ise Drive. The Council agreed upon a rate of Ten (10) Cents per mile as a basis for compiling their monthly expense statement. Adjournment Councilman Cravey moved for the meeting to adjourn.
