1960 04 28 CC MinutesMnMTE8 OF THE REGULAR MEETING OF THE CITY COUNCIL- OF THE CITY OF BAYTOWN April 28, 1960 The City Council of the City of Baytown, Texas, mat in regular session on Thursday, April 28, 1960, at 7:00 o'clock P.M., in the Council Room of the Baytown City Hall with the following members in attendance: W. Mears Councilman The Mayor called the meeting to order, the Imrooation was man Badgett, afterwhich, the Mayor instructed the City Clerk to of the regular meeting of April. 13th. Councilman Reeves moved the reading of the minutes and they be approved as presented, seconded the motion. The roll call vote was as follows: Roll Call: Ayes : Councilman Ward Nays: None 0 Badgett " Reeves Clayton " Lusk Mayor Pruett Underwrite Non - Signers Assessments - West Murrill Street offered by Council- read the minutes to dispense with Councilman Badgett Councilman Ward moved to approve the City of Baytown underwriting the amount of $529.44 for four (4) parcels of land abutting upon West Murrill., from Md ting to Lobit, now under contract to be improved by Gulf Bitulithic Cow, whose owners have not secured the contractor in payment of the assessments against the respective properties. Councilman Reeves seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman It Ward Nays: None Badgett Reeves Clayton Lusk Mayor Pruett Reject Bids - Virginia Street Storm Sewer - City Do Job The City Manager gave a report on the study he and the City Engineer had made of the Virginia Street Storm Sewer bids received at the April 13th meeting. It was his opinion that all bids should be rejected and the City use its own equipment and manpower in the improvement project without tying up the crew. Councilman Ward asked if the City crew will be able to get on the project immedi- ately and was informed that it will be two or three weeks before the work can commence. Councilman Cl8 ton asked about the contract specifications in rela- tion to quick -sand and was informed that this would be counted as Extra Work and the City would be required to pay additional by one of three methods shown in the General Conditions of the Contract, Section 18. After sons further dis- cussion, Councilman Lusk moved to reject all bids received at the April 13th meeting; the City Manager, City Engineer and Director of Public Works be author- ised and instructed to proceed at the earliest date possible with the construc- tion of the storm sewer project of Virginia, Georgia, New Jersey and Kentucky '7 ltd? Street by using City owned machinery and personnel. Councilman Ward seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Ward Nays: None " Badgett " Reeves " Clayton " Lusk Mayor Pruett Ordinance - Amending Meat Inspection Ordinance City Manager Wevre introduced and read an ordinance amending the present City Meat Inspection Ordinance by adding Section 4, State Approved Establishments, emaeptions. Councilman Ward moved to adopt the ordinance as read. Counoilman Badgett seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Ward Nays: None " Badgett " Reeves " Clayton " Lusk Mayor Pruett The caption of the ordinance follows: ORDINANCE NO. 590 AN ORDINANCE AMENDING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, "ADOPTING THE TEXAS STATE REGULATIONS FOR MEAT AND POULTRY INSPECTION WITHIN THE CITY OF BAYTOWN; PROVIDING THAT ALL MEAT AND POULTRY SOLD WITHIN THE CITY OF BAYTOWN MUST FIRST BE IN- SPECTED AND APPROVED BY EITHER FEDERAL OR STATE INSPECTIONS; PROVID- ING FOR ABATTOIR PERMITS; PROVIDING FOR FACILITIES FOR INSPECTION; REGULATING THE TRANSPORTATION OF MEAT AND POULTRY; EXCEPTING FEDERAL AND STATE ESTABLIMOM; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; INCLUDING A FINE OF NOT LESS THAN TEN (410.00) DOLLARS NOR MORE THAN TWO HUNDRED 0200.00) DOLLARS; REPEALING ORDINANCES INCONSISTENT HEREWITH; AND CONTAINING A 'SAVINGS CLAUSE, "BEING ORDI- NANCE NO. 571 PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 28TH DAY OF JANUARY, 1960, BY AMENDING SECTION FOUR (4) THEREOF BY ADDING START; APPROVED ESTABLISMENTS THERETO, AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. Approve Financial. Assistance - Teen Age Base Ball Teams - Optimist Club Mr. George Lerch, President Elect of the Optimist Club, sponsors of Then Age Base Ball Program in Baytown, informed the Council that the Club will be forced to discontinue its teen age ball program for 1960 if the Council rejects its request for financial aid, such request having been received by the Council at its March 24th meeting, He said that the club should know something definite prior to May lot as the balls, beta, uniforms, insurance premium and other necessary incidentals must be acquired prior to the official starting date in June. His plea included a proposal for the City of Baytown to sponsor the teen age teams and use members of the Optimist Club to administer the program. After much discussion, Councilman Ward moved to approve an appropriation of 43,000.00 as financial aid in the promotion of the teen age base ball program sponsored by the Optimist Club of Baytown; the City Manager be authorized to prepare a resolution appropriating the amount of $3,000.00 from the Council Contingent Fund to cover the additional gratuity. Councilman Lusk seconded the motion. Council- man Reeves seconded the motion. The roll call dote was as follows: Roll Call: Ayes: Councilman Ward Nays: None " Badgett " Reeves " Clayton " Lusk Mayor Pruett The caption of the ordinance follows: ORDINANCE NO. 591 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, RE- CEIVING AND ACCEPTING THE WORK OF CONSTRUCTION OF PERMANENT PAVING AND OTHER IMPROMOM WITHIN THE FOLLOWING DEFINED PORTIONS 'OF NORTH AND SOUTH MAIN STREET IN THE CITY OF BAYTOWN; AUTHORIZING AND DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL ASSESSMENT CERTIFI- CATES TO GULF BITULITHIC CONPANY, THE CONTRACTOR PERFORMING SAID WORK; APPROVING THE FORM OF SUCH SPECIAL ASSESSMENT CERTIFICZEES; AND PROVIDING FaR THE EFFECTIVE DATE HEREOF. Ordinance - Accepting Work Paving - North Commerce 'Street Councilman Reeves moved to adopt an ordinance receiving and accepting the work of construction of permanent paving and other improvements on North Commerce Street, from the north property line of Forrest Street to the south property line of Williams Street within the City of Baytown, and authorising the emecution of Special Assessment Certificates to Gulf Bitulithic Company, contractor. Council- man Badgett seconded the motion. Doss29 Jr., C.P.A. - City Auditor Councilman Reeves moved to accept the recommendation of the Audit Com- mittee; City Manager LeFevre tie instructed to write a letter of confirmation, to T. E. Dossey, Jr., C.P.A., Houston, Mexas, relative to an auditing contract for the fiscal year, 1959 -60. Councilman Badgett seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Ward Nays: None " Badgett " Reeves " Clayton " Lusk Mayor Pruett Storm Sewer Ditch - Oak Addition The City Manager presented an estimated figure in an amount of $4,435.50 fo 200' of 54" pipe, 250' of 48" pipe and 200' of 36" pipe to be installed in the drainage ditch, between Oak Addition and East Section of lea Heights Sub- _ division. He stated that this would not extend the entire length of the ditch, however, it would cover the area more seriously effected by soil erosion. Since it was the intent of the Council to have an estimate for the entire length of the ditch, City Engineer Busch asked for additonal time to complete the plans. He will prepare an estimate, to grade, beginning at the most northerly and of the drain ditch and proceeding south to West Main Street. In the overall esti- mate, be will include the installation of a lateral line down Daniels Street to Lee Drive, a project which has been discussed previously. This line will not be installed in conjunction with the major drainage ditch, but will be a sepa- rate project and laid at a later date. Miscellaneous The City Manager informed the Council that a work order, for the paving of South Main Street, had bean issued to the contractor, Brown & Root, Inc., with instruction to begin on the date of Monday, May 2nd. The City Attorney and City Manager were instructed to contact represen- tatives of Harris County Flood Control and get permission for residents, whose property abutts upon the Jail Ditch, south of East Republic, to beautify and care for the easement, even to the extent of erecting a fence upon the one -half section abutting their property. This would eliminate the unkept conditions now prevailing in the arsaaid prevent the easement being used as a race track also. Adjournment Councilman Reeves moved that the meeting adjourn.
