1960 03 24 CC Minutes1456 MINUTE OF THE REGMAR MEETING OF THE CITY COIINCIL OF THE CITY OF BAYTOWN March 244 1960 The City Council of the City of Baytown, Texas mat in regular session on Thursday, March 240 19609 at 6:80 P.M. in the Council Room of the Baytown City Hall, however, a quorum was not present until 7:00 ololook P.M. The attending members=were as follows: Absent: W. L. Wend *K. E. Badgett *A1 Clayton Lacy Lusk *R. H. Pruett J. B. LeFevre George Chandler Edna, Oliver P. H. Mears W. D. Reeves The Mayor called the meeting to order read the minutes of the regular meeting of to dispense with the reading of the minutes Badgett seconded the motion. Council and they be approved. call vote was as follows: instructed to Councilman Nays: None Bearing - Carnegie Street - Ordinance Closing Hear3x� • --- - -- - Ward moved Councilman The benefit hearing for the improvement of Carnegie Street was opened by Mayor Pruett, afterwhich, he called upon the City Attorney to preside. Mr Bob Beverly was called by the City Attorney and testified, in response to questions, that he had been a resident of Baytotan for the past fifteen years; the past seven of which he had been engaged in the real estate business. His connection was the selling and appraising of real estate, and was familiar with the real estate values in Baytown, in particular with the properties and values of such property abutting that portion of Carnegie Street covered under the improvement project proposal.. It was his opinion that all properties located thereon and involved in this paving program will be enhanced in value in amounts exceeding the costs of such improvements as shown by the Engineer's schedule contained in the published notice of hearing. The Manor then asked if any in the audience desired to be heard regarding the proposed improvements. Only one protest was offered, afterwhich, the City Manager introduced and read an ordinance closing the hearing given to the real and true owners of property abutting upon Carnegie Street; fixing charges and liens against said properties and providing for issuance of assessment certifi- cates and the manner of collection. Councilman Badgett moved to adopt the ordi- nance as read Councilman Lusk seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Ward Nays: None U tt Badge " Clayton " Lusk Mayor Pruett The caption of the ordinance follows: ORDINANCE 140. 588 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CLOSING THE HEARING GIVEN TO THE REAL AND TRUE OWNERS OF PROPERTY ABUTTING UPON CARNEGIE STREET IN THE CITY OF BAYTOWN, TEXAS, AS TO SPECIAL BENEFITS TO ACCRUE BY VIRTUE OF THE IMPROVEMENT THEREOF, AND AS TO THE ACCURACY, SUFFICIENCY, REGULARITY AND VALIDITY OF TEE PROCEEDINGS AND CONTRACT IN CONNECTION WITH SAID IMPROVEMENTS, AND THE ASSESSMENTS TO BE LEVIED COVERING THE COST THEREOF; OVERRULING AND DENYING ALL PROTESTS AND OB- JECTIONS OFFERED; FINDING AND DETERMINING SPECIAL BENEFITS TO EACH PAR- ` CEL OF PROPERTY AND THE OWNERS THEREOF IN EXCESS OF THE AMOUNT OF THE SPECIAL ASSESSMENT AGAINST SAME; FINDING THE REGULARITY OF ALL PROCEED- INGS AND THE PERFORMANCE OF ALL PREREQUISITES TO FIXING THE ASSESSMENT LIENS AND THE PERSONAL LIABILITY OF THE PROPERTY OWNERS; LEVYING ASSESS - MENTS, FIXING CHARGES AND LIENS AGAINST SAID PROPERTIES ABUTTING SAID STREET AND THE TRUE OWNERS THEREOF FOR PAYMENT OF PART OF THE COSTS OF THE IMPROVEMENTS; PROVIDING FOR THE ISSUANDE OF ASSIGNABLE ASSESSMENT CERTIFICATES AND THE MANNER OF THEIR COLLECTION; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Roper - Teen Age Baseball Program - Monetary Assistance Mr. Wilton Roper petitioned the Council for some monetary assistance in the promotion of the Baytown Teen Age Baseball Program during the summer months. The School Board has given permission for the 180 scheduled gams to be played on its grounds however, the promoters mast pay for the lights and up -keep of grounds during the period. This cost will require an additional $2,000 and Mr, Roper asked the Council for a donation to cover the entire cost. After soma discussion, the Council asked permission to defer any definite action until after the March 31st audit. The Council will then review the financial status of the City and a reply will be forthcoming. *Mayor Pruett and Councilmen Badgett excused from meting to attend Mayors' and Councilmen's Dinner - San Jacinto Inn. Adjournment Councilmen Clayton moved for the meeting to adjourn. Councilmen Wand seconded the motion. The ayes were unanimous and the meeting was declared adjourned. ATTEST`.
