The City Council of the -City of Baytown, Texas, met in regular session on Thursday, March 10, 1960, at 7:00 o'clock P.M. in the Council Room of the Baytown City Hall with the following members in attendance: P. LeFevre City Manager _..George Chandler City Attorney Edna Oliver City Clerk The Mayor called the meeting to order, the Invocation was offered, after - which, the City Clerk was instructed to read the minutes of the regular meeting of February 25, 1960. Councilman Ward requested that the minutes be corrected as follows: '.'Request Topping West Main - Plans for the repair of Lee Drive from its intersection with West Main, south to State highway 146, will be done if the City is successful in its effort to obtain assistance from Harris County Commissioner V.V. Ramsey ". With this correction, Councilman Mears moved to dispense with the reading-of the minutes and they be approved. Councilman Reeves seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman nears Nays: None " Ward " Badgett " Reeves " Clayton " Lusk Mayor Pruett Ordinance - EstablishinL a Library Department Representatives of the Public Library P1anhing;:Committee petitioned the Council for passage of an Ordinance establishing a library department for the City of Baytown and creating an Advisory Board of Trustees to assist in carry- ing out the various functions and duties of such a department. The group will serve without pay and it will be its duty to study regulations, methods of finan- cing and size and site of such a library. After some further discussion, the City Manager introduced and read an ordinance establishing such a department and creating such a board. Councilman Clayton moved to adopt the ordinance as read. Councilman Mears seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: None Ward Badgett Reeves Clayton Lusk Mayor Pruett Open Bids - Police Cars The bids on the advertisement for a new 4 -door sedan for the Police Depart- ment were opened and tabulated as follows: Ernie Dittman Motor Company Dodge less 1958 Chevrolet $1,947.85 Thad Felton Ford Agency Ford less 1958 Chevrolet 52,034.64 Buck Turner Chevrolet Chevrolet Less 1958 Chevrolet $1,937.86 The Council compared the low bide of Dittman Motors and Buck Turner. The maintenance costs of each automobile were compared and when it was learned that the up -keep of the Dodge is much lower than the Chevrolet, Councilman Clayton moved to accept the bid of Ernie Dittman Motor Company and the Dodge be purchased at a price of $1,947.85. The City Manager was instructed to utilize the fund balance in Budget Account 2C1 -Z.4 and the remaining cost to be taken from the Emergency Fund. Councilman Reeves seconded the motion. H. F. Massey, District Manager of the Houston Natural Gas Corporation, presented an .ordinance, for Council approval and adoption, setting forth rates for all gas used by Residential and Small Commercial customers in the City of Baytown for the billing months of November through April inclusive, which was identified as Winter Rates and an amended or lowered rate for the same type customers, during the months of May through October, inclusive, identified as Summer Rates. The ordinance provided, however, that the Summer Rates may be discontinued or ad- justed not to exceed the Winter Rate Schedule within thirty (30) days after the Utility gives the City Council written notice of its intention to discon- tinue or adjust such rates. The City Manager was instructed to read the ordi- nance, afterwhich, Councilman Ward moved to adopt the ordinance as read. Council- man Badgett seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Mears Nays: Ilona " Ward Badgett Reeves Clayton Lusk Mayor Pruett 1452 The caption of the ordinance follows: ORDINANCE NO. 586 AN ORDINANCE REGULATING THE RATES OF THE HOUSTON NATURAL GAS CORPORATION IN THE CITY OF BAYTOWN34 TEXAS; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. Jim Bond - Ramifications of Performance Bond Mr. Jim Bond, local insurance salesman, explained the detailed protection assured the 'Owner" or City under the terms of the Performance Bonds required and submitted as an intricate.part of each and every contract let by the City of Blown. The Bond gives assurance that the projects will be completed in accordance with the Plans and Specifications set forth in the original bid at the price submitted and accepted by the Council, prior to the letting of the contract. Should the contractor default in his contract, the Performance Bond guarantees the completion of the project at the expense of the Bonding Company underwriting the Bond. Too, the Bond protects the City from any defective construction for a period of one (1) year as the General Contractor is held re- sponsible for such construction - one year from date of completion of project. Councilman.Badgett seconded the motion. Councilman Lusk moved to open and acknowledge receipt of bids but no further action be taken until the City Manager has made a complete tabula- tion and study of each bid. F. Noxell by the Federal Government as a building site for additional Housing Unite for white. Councilman Ward seconded the,motion. Underwrite - Forrest Street - Gulf Bitulithic Cospany Councilman Clayton moved to approve the City underwriting the amount of $643.21 for five (5) parcels of land abutting upon Forrest Streets now under contract to be improved by Gulf Bitulithic Company, whose owners have not secured the contractor in payment of the assessments against the respective properties, Councilman 14sars seconded the motion. The roll call vote was as follows: Roll Call; Ayes: Councilman Mears Nave: None " Ward " Badgett " Reeves " Clayton " Lusk Mayor Pruett Pay Civil Service Director - Expenses City Manager LeFevre reported that he had conferred with Mr. Grover Edge Civil Service Director, and as a result of his findings, it was his recommends tion that the payment of 5100.00 per month be continued to cover expenses in- curred in the routine maintenance of the office. Report - Landfill Garbage Disposal Study Councilman Clayton, Chairman of a Committee appointed to study the poss- ibility of sanitary landfill as a system of garbage disposal for Baytown, rec- onmnded an experimental landfill disposal system as an educational project. Since the institution of such a system will of necessity require costly equip- ment, he proposed that the City use a dragline and bulldozer it now owns. The two pieces of machinery are being presently used on other projects, but when available, Mr. Clayton proposed to use them at the present dump grounds. The dragline will be used to dig a trench and the bulldozer will fill the trench and cover. A schedule can be set up which will be of little expense and the system can be instituted on a trial basis. It may be found that such a program will be moat profitable as it may not require the trucks and man- power now being used in the Garbage Department: Since it has been estimated that the initial cost of instituting such a program will be between $45,000, and $50,000, this method can be given a trial, if the Council approves, and the results will determine if it will be of benefit to the community. He also proposed that an investigation be made of the possible purchase of surplus army equipmnt. The Council accepted the recommendation of Councilmen Clayton and it was agreed that this program will be instituted on a trial basis, when- ever the machinery is available. Investigate - Killing Dogs - Dump Ground Councilman Clayton requested the City Manager to investigate a complaint of dogs being shot at the dump grounds off Rarkaloo Road. If it is found that dogs are being shot, and not gassed, as authorized, it was his further recom- mendation that the employee in violation be discharged immediately. Report - Paint Locomotive Councilmen Ward reported that he has received a cost estimate of $450.CO for sandblasting the S.P. Locomotive at Roseland Park, however, it was the re- commendation of railroad personnel that the engine be cleaned with an air -com- pressor and then painted. He further reported that the paint had been donated, at no cost to the City, and he now must contact members of the Key Club to complete the project, if and when the weather permits such work to be done.
