1959 10 08 CC Minutes1395 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN October 8, 1959 The City Council of the City of Baytown, Texas, met in regular session on Thursday, October 8, 1959, at 7:00 o'clock P.M., in the Council Room of the Baytown City Hall with the following members in attendance: Absent: W. Reeves Councilman Councilman Councilman Councilman Mayor Acting City Manager City Attorney City Clerk Councilman Councilman The Mayor called the meeting to order, the Invocation was offered by former Councilman, H. M. Campbell, afterwhich, the Mayor called for the minutes of the regular and special meetings of September 24th and 29th, respectively, to be read. Councilman Ward moved to dispense with the reading of the minutes and they be adopted as presented. Councilman Badgett seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Ward Nays: None " Badgett Clayton Lusk AN Mayor Pruett Re- Appointment L. W. Grossman - City Health Officer Councilman Clayton moved to approve and authorize the re- appointment of Lyman Weeks Crossman, M. D., to the position of City Health Officer for the two (2) ensuing years, re- appointment to be retroactive to October 5, 1959. Councilman Badgett seconded the motion. The roll call vote was as follows: Roll Call: Ayes: Councilman Ward Nays: None It Badgett to Clayton " Lusk Mayor Pruett Presentation - Copies Revised Plumbing Ordinance - Study Copies of a revised plumbing ordinance were presented to each Councilman with the suggestion that the ordinance be studied. It will be considered for adoption or rejection at the next regular meeting of the Council. Letter - Baytown Society for Crippled Children The Mayor presented a letter from the Executive Board of the Baytown Society for Crippled Children, thanking the Council for the lease on the City property on West Sterling near the San Jacinto Memorial Hospital. The Center is now open for its fall semester, the location has proven to be ideal and some beautification work will be done to the grounds as soon as possible. Councilman Lusk was appoint- ed as a comwittee of one to make a thorough check and determine the possibility of locating all the buildings, now leasing City property on Lee Drive, to this site in order to provide much needed space for the expansion of the Public Works De- partment. He will make a report on the findings at a later meeting. 110th Progress Report - Street Lighting Program Acting City Manager LeFevre presented copies of a progress report on the street lighting program in the City of Baytown. The report was made in writing by E. C. Kimmons, Jr., Division Manager of the Houston Lighting & Power Company. The report covered all authorized wood poles, overhead wire, street lighting jobs and the underground lights for Mlibydale- Richardson Place area, Pruett Addition, Britton Cravens Addition, Roseland Oaks, Fair Park Addition; the mercury vapor lights for the three business areas, the West Main Street project, Lamar Courts Wynnewood- Lawndale Area and Danubina Courts giving approximate dates for comple- tion of each job. Mr. Kimmons expressly stated that this report was given as estimated completion dates and not a guaranteed completion schedule. The Council asked that the Acting City Manager check with Mr. Kimnons on item seven (7) of the report for clarification , as no business area but Texas Avenue was mentioned and it should read Highway 146 and West Baytown business areas also. Donation - Piano and Chairs - Roseland Park Pavilion Mayor Pruett acknowledged receipt of a 650.CO donation from the Jaycees toward the purchase of chairs and a piano for the Roseland Park Pavilion. Report Study Storm Sewer - Daniel Street The City Engineer submitted an estimate of $2,500.CC for the installation of a storm sewer on the north side of Daniel Street, running parallel with the railroad track. The estimate covered an extension from a big ditch separating Lee Heights Subdivision and Oak Addition east to the intersection of Yupon Street. After some discussion, City Engineer Busch was instructed to prepare a revised estimate extending the storm sewer installation to Lee Drive. The Council will then compare costs and make final decision on the Storm Sewer installation. Advertise Bids - Street Paving The City Engineer reported that street paving bids for Live Oak, Carnegie, North Commerce, Forrest and East Wright Blvd. have been mailed to prospective bidders and will be received at the October 22nd meeting. Each bidder was being asked to submit an alternate bid with drainage on each of the paving projects. Flares - rissouri Street - Ditch Messrs. Grantham and Busch were instructed to check the ditch presently existing on Missouri Street as a result of storm sewer installation on the new South West Subdivision developed by Britton - Cravens. Councilman Clayton advised the Council th4t he had looked at the ditch and there was definitely an immediate danger existing. He asked that flares be placed in the area as a guard and her. Britton be contacted relative to the dedication of an easement in order for storm sewer tile to be installed in the ditch and same covered to eliminate any future hazard. Eva Maude Civic Association - Request Asphaltic Material - Street The Mayor recognized the presence of members of the Eva Maude Civic Associa- tion who presented a written request for the City to top -the streets within the addition with an asphaltic material similar to that being used on Alexander Drive by the State Highway Department. Since the streets in the addition are made of shell concrete, it was the belief of the Association that a wearing surface was needed in order to prevent severe deterioration and costly repairs or replacements in the future. Acting City Manager LeFevre, Mr. Busch and Mr. Grantham were in- structed to check the designated area and prepare an estimate of cost for the pro- posed improvement. Such estimate to be prepared for presentation at the next regu- lar meeting of the Council. Freliminary Approval Street - Construction - Cedar Bmu Park_Section• -One. The Council reviewed a plat of a proposed subdivision lying outside the City limits but within the five (5) mile radim controlled by the City's Subdivision Ordinance. The developers were seeking street construction approval only as no water and sewers were presently available. The Council discussed the feasibility of granting exceptions to its present subdivision ordinance and approving a proposed 1$97 development which did not meet the requirements of any one section. It was gene- rally agreed that the City could not furnish water and sewer facilities as such an extension would be cost prohibitive, however, the Council was divided in its de- cision to grant approval of the proposed street plan. After some further discus- sion, Councilman Clayton moved to grant preliminary approval to the street con- struction of Section One, Cedar Bayou Park, as submitted by the developers. Council- man Ward seconded the motion. The roll call vote was as follows: Noll Call: Ayes: Councilman Clayton Nays: Councilman Badgett " Ward " Lusk Mayor Pruett Classification Ordinance - Amendment - Police and Fire Departments Councilman Clayton moved to adopt an ordinance amending an ordinance class- ifying all positions in the classified service of the City of Baytown, so as to re- classify the positions of the police and fire departments of the City of Baytown. Councilman Clayton moved to adopt the ordinance as read. Councilman Ward seconded the motion. BEING ORDINANCE NO. 165, PASSED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN ON THE 3RD DAY OF NOVEMBER$ 1952, BY AMENDING APPENDIX I, SERVICE GROUP, POLICE - AND SERVICE GROUP, FIREMEN, SO AS TO RECLASSIFY THE POSITIONS OF THE POLICE AND FIRE DEPARTMENTS OF THE CITY OF BAYTOWN; CONTAINING A SAVINGS CLAUSE AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE OF THIS ORDINANCE. Check QMrations - East James Disposal Plant As a result of complaints received relative to the odors emerging from the East James Disposal Plant, Public Works Director Grantham was instructed to invest- igate the maintenance operation. Street haintenance - Knowlton and Fisher Hill The Council discussed the maintenance of Knowlton Street and a non- dedicated street on Fisher Hill. It was agreed that some maintenanceshould be done to the Fisher Rill Road in order to provide ingress and egress for the garbage trucks, however, nothing was to be done to Knowlton Road until property owners had ful- filled their portion of an agreement, dated February 12, 1959, to purchase water and sewer mains to service the area as far as practical. The City will use its equipment and man -power to install the water and sewer mains and then review the street maintenance request. 19.98 C. A. Patterson - Civil Service Commission - Succeed Harold Marc v Councilman Clayton moved to appoint Charles A. Patterson se; a member of the Baytown Civil Service Commission to succeed Harold L. Murphy, Sr., who has submitted his resignation, effective October 1, 1959, Councilman Lusk seconded the notion.
